Consider appeal over Chiluba’s case-Attorney General told

The Law Association of Zambia has written to the Attorney General to consider an appeal in the Supreme Court in a matter regarding former President Fredrick Chiluba and others regarding the registration of the London Judgment.

In a press statement made available to ZANIS in Lusaka yesterday and signed by Law Association of Zambia (LAZ) President Stephen Lungu, the law body observed that it was mandated in section 4 of the laws of Zambia Act chapter 31 of the laws of Zambia to comment and provide guidance on legal matters that were of public interest.

Mr Lungu said LAZ through its research committee thoroughly looked at the matter and rendered an opinion on the same which has since been handed over to the Attorney General.

He said the Association’s opinion to the Attorney General was in the interest of the public for his office to consider lodging an appeal in the Supreme Court in order to finalise the matter adding that LAZ also advised Government to recommence the registration process under the common law which is applicable to Zambia.

He contended that the judgment of the High Court had far reaching implications therefore there was need for clarity in this area of the law.

Mr Lungu also stated that LAZ also encouraged the Attorney General to commence a fresh course of action under common law as an alternative.

He said the Zambian Government should take all necessary steps to ensure that this matter is handled with the courtesy it deserved saying the prosecution of the suspects in this matter had been costly not only to Government but to the Zambian people at large as tax payers money was spent to prosecute the accused.

  2. Ba LAZ, before that appeal is made and more money is wasted, atleast show the AG the grounds on which he should appeal. There is no provision in the Laws of Zambia to register the London Judgement, unless there was an andendum to that effect. Otherwise , you are just whistle blowing and adding to the useless noise.

This Lungu and his LAZ should be told to go to hell is he going to fund the appeal because Zambians say no to this kind of wasting money, let him probe his fellow Lawyers who were paid for doing nothing according to the AG’s report, has LAZ written to the DPP to find out why that female minister who had committed an crime like that of Hon. Mpombo has not yet been arrested? do not Zambians for fools you Lawyers already you have made a lot of money out of this Chiluba nonsence let the matter go to rest.

  4. i think the money wasted on Chiluba’s case is more than that has been spent prosecuting him and the crew….and now you are advising more money to be spent again???…it doesn’t make sense…..why didn’t you advise your fellow lawyers as the case was still in the courts?…..

When Nchito started with the Task Force- we were told it was Pro bono publico and I can only hope that LAZ do the real Pro Bono or for the good of the public as in other countries lawyers and solicitors do make an honest life! Lawyers in the United States are recommended under American Bar Association (ABA) ethical rules to contribute at least fifty hours of pro bono service per year. Some state bar associations, however, may recommend fewer hours. Even in the United Kingdom many UK law firms and law schools have celebrated an annual Pro Bono Week—which encourages lawyers to offer pro bono services and increases general awareness of pro bono service.

    VICE-President George Kunda has justified government’s intention to pay Lusaka lawyer Rodger Chongwe about US $6.7 million as compensation over a shooting incident that happened in Kabwe in August 1997.

    Addressing the media at his office yesterday, Vice-President Kunda said since Zambia was a signatory to the UN Convention on Human Rights, it was important that such rights be respected.

    “Dr Chongwe was shot by the police, and even the medical evidence is there that a bullet entered his body. Where it entered, the exit of the bullet, all these things, he was treated, he was taken to theatre; therefore he must be compensated.

  9. Any appeal will not amount to anything. You can’t oppose the ruling party on any issue even if you are right and expect to win.It’s a lost cause.Why bother? In my view, it would make more sense if LAZ itself pursued this case on our behalf as citizens. May be this would work. Personally, I have lost all confidence in our judiciary.

The govt is putting these judges in danger because of these mad people will start killing judges like in Mexico and they will start targeting high govt profiles so that the governing of the people becomes ungovernable. It is a known factor in many African countries where when the people’s trust in the judicial and the govt reaches its lowest point they use any means to justify that there is no law except for the poor and the rich and elite are above the law. Nigeria, south Africa are good examples.
    If the govt continues to interfer with the Judicial in 2010 – 2011 will be crucial and the elections will be bloody and division will be seen btween our people. No one at the moment trust the courts

  17. Good move by LAZ . At least it shows that there must be good grounds for an appeal. This FTJ case is very appropriate in giving LAZ an opportunity to demonstate their independence and i think they have done well.
    The MMD government is now under a different adminisration from the one that started this case and the current administration does not appear too keen to pursue the case. So it is timely that LAZ have used the provision in the law that allows them to offer some guidance on the matter. There are , indeed , far reaching implications from that high court judgement.

I know some of you are saying that LAZ could have acted early enough.You are wrong becoz if LAZ commented on the issue to give reasons why the case should be registered,they will have been sighted for CONTEMPT..remember mulongoti commented on mbombo’s case that ”you need me to bring you cigarretes in prison”?..That was contempt & mulongoti had to apologies.Same apllies to LAZ commenting on a case which is already before the courts..Anyway,I call Zambia a great country because everything occurs in unusual reactions from the normal.staright forward things seem to go the opposite.My advise gentlemen is just conctrate on self economic progress.make money 4 urselves and…

    I have read a lot of things on LT but I never read someone openly calling for the assasination of a former president and the ruling one. FTJ dont deserve to go thru the courts without an initial arrest! this is ridiculously insane! how do u drag someone to court if the police hasnt made an initial arrest? in order to appeal any case someone has to be booked and remaneded in prison just like mmembe, mpombo, chabwela, kalumba and his gang etc. why hasnt chiluba or his wife not been arrested and then sent to court? thats why im for a good hero carrying out a mission
