PF now threatens to involve SADC, AU and UN over Rupiah Banda’s roots, after LAZ goes mute

The Patriotic Front has threatened to write to the Southern African Developing community SADC, the African Union AU and the United Nation UN on whether the ruling MMD should go ahead and field President Rupiah Banda as its presidential candidate.

PF Secretary General Winter Kabimba has said that the party wrote to the Law Association of Zambia (LAZ) to intervene in the matter of President Rupiah Banda’s parentage and his eligibility as candidate in the 2008 presidential elections as well as the forthcoming general elections but wonders why LAZ has been mute about the matter.

Mr. Kabimba said that in the absence of a response from LAZ, the party will take up the matter and write to SADC, AU, and UN before president Banda satisfies Zambians that he qualifies to stand as a candidate.

Speaking during a media briefing in Lusaka this morning Mr. Kabimba said that it was time the MMD started looking for an alternative Presidential candidate.

He stated that as a constitutional democracy, the eligibility of anyone to contest the presidential elections in Zambia is a fundamental question.

The PF secretary general said that the matter at hand was not political but was a legal issue of fundamental importance adding that no one should be allowed to evade the legal requirement in the constitution.

We have a president in Rupiah banda Who enjoys media abuse and propaganda. MMD’S TIME IS OVER. They tried to tell lies about Mr. Sata through that disgruntled journalist Chanda Chimba III but the more the tell lies about him the more we believe in him.     It is painful to agree with you but I think our PAWATO is not really ready. When I heard that they were holding a press briefing this morning I though we shall get the surprise list of candidates and alas, to just hear the same 1996 rubbish used against Kaunda in this age sure. A lot of people were really disappointed , I hope PF is reading the signs, they might just alienate people on the fence if they start focusing on non issues. RB is the same candidate they competed against in 2008. he is the same Zambia who has held various port folios and why now claim that he is not Zambia NOW.

    This is exactly what SATA orchestrated against KK. I think PF are towing a dangerous line

I thought we are a sovereign state, do we need to involve all these organisations to resolve this simple issue? What about our courts of law, are they inferior?   6. #6 you are right on the money. Truth be told, in 2008 they thought they could beat our President because he had no record to stand on. Now our president has delivered and the country is on the ascendancy and they clearly know they can’t beat us in the ring and they want to win the fight outside the ring.

    The fact is PF leadership know that they are getting buried this year and they cannot win this year’s election and to save face they want to either boycott or cause anarchy by involving the international community on a non issue.

    Of course their supporters believe PF will win but the leadership knows the truth and they know they are losing. JUST like the UPND-PF PACT. We told you it can’t work and the rest is history and so shall be this election. PF losing big . even to UPND

  7. When our super KK wanted to bounce back into State house in 1996, the MMD through the Late FTJ ( MHSRIP) used the same clause to bar him from contesting. The beauty with law is that you refer to the history. RB ‘afisa nji’ concerning his parentage? His father comes from Malawi period!!!!

  26. My understanding is that PF was hoping that there would be some defectors from MMD so they can adopt them in their list of candidates. Unfortunately on F.O.O.LS such Masebo and Mangani (double M) managed to do that. Honestly these folks are really stuck;

    They were calling for election date , not its parentage, next is ballot papers . I remember in 2008 when they impounded a truck in Livingstone on allegaations that it had brought in ballot papers and that the drivers of the named 2 trucks had letters for VJ.

    Given Lubinda magestically walking into Mulungushi and instructing ECZ to stop announcing results,,,,, the list is endless.

    In a nut shell, this is a sign of failure by Pa Fwaka party.

  28. On November 15, 2001, Mr Nsanda was quoted in the Times as having said Mr Sata told him that he was a Tanzanian whose name was Zondwa and that he was just using the name Chilufya as an alias.

    This was when Mr Sata approached Mr Nsanda shortly after he lost his bid for the MMD presidency, to organise 600 youths at the stations to cause a riot around Zambia after which the two would have run into Mbeya District in Tanzania where Mr Sata had promised to help Mr Nsanda to have his identity changed just like he had been using Chilufya as an alias name instead of Zondwa, which was his Tanzanian name.

  35. #25 I have salient points to share. Levy was not Zambian either actually his farther came from Malawi and worked for the Muzungu who worked for Rhodesia Railways. They settled in Chisamba first a railway siding and later kafulafuta another railway siding where his father retired and as you may know a lot of Ba Chawa or Malawi Moslems are settled with their Chief Chiwala they all asimilated as Lamba. Levy’s first wife was Malawian. Sata is simillarly from Tanzania. His first wife the Head Teacher was Malawian. He is a Mwachusa.Anything else you would like to know?

  37. Who ever will win we should learn to rispect the consititution. It was MMD who harrased Kaunda on the same issue, because Kaunda was in the opposition it held water. So even PF should not waste time but just concentrate on the campains otherwise persuing this issue will be chasing the wind. It will not work unless the Judiciary was not like we know in Zambia. Don’t waste you energy on this issue just go choose your candidates and campain or else!

  39. 71. The Commission has arrived at a decision regarding allegations of violation of
    Article 13 by examining closely the nature and content of the right to equality
    (Article 2). It cannot be denied that there are Zambian citizens born in Zambia
    but whose parents were not born in what has become known as the Republic of
    Zambia following independence in 1964. This is a particularly vexing matter as
    the movement of people in what had been the Central African Federation (now
    the States of Malawi, Zambia and Zimbabwe) was free and that by Zambia’s own
    admission, all such residents were, upon application, granted the citizenship of
    Zambia at independence. Rights which have been enjoyed for over 30 years
    cannot be lightly taken away.

PF have less than 50 days and voters need to know their policies in detail instead of them clinging to irrelavant issues such as parentage. This is the grand moment when Musa Mwenye should demonstrate the best of his legal profession to offer candid legal advice to the PF relating to citizenship of Zambia’s top profile personalities. If RB’s Zambian roots are to be verified thru the Courts, the PF lawyers will be referred to previous similar legal case in which the late Mr Mushota represented MMD to prove that KK was Malawian. It’s a puzzle that Kabimba as a lawyer opts to ignore a constitutional provision that all persons who resided in Northern Rhodesia by 23hrs 59mins 59secs on 23rd October 1964 automatically earned the Zambian Citizenship. This provision applied to KK said to be Malawian; to Chiluba said to be Congolese; to Levy Mwanawasa whose father is said to be a Yao of Malawi; to RB and Sata of Tanzanian roots.

PF must be serious on the elections, by fielding its team of parliamentary candidates. September 20th is only 49 DAYS away from today, yet PF have not published their team. May be PF’s realisation of losing the election has prompted them to opt for playing a spoiler’s game of sowing seeds of confusion. Young voters must vote wisely. The stakes are between HH and RB.

The chorus about FLY-OVER bridge and Cleaning UTH. Let us be real; just go back to your roots, the basis on which PF campaign policy has always been founded. “I am a MAN OF ACTION, I built the FLY-OVER bridge, I CLEANED UTH I am COBRA, I am SATA” and all the PF cadres should say “PABWATO, PABWATO X 3, MAN OF ACTION X 2, 90 DAYS X 2? and all should conlude by saying MONEY IN MY POCKET X 3? – Ends the song.

    I can assure you that this song can sell you manifesto a great deal as we know that what PF cadres know about PF manifesto is ‘man of action’, fly-over bridge, and the famous 90 day money in your pockets.

    What he is talking about does not need a lawyer to understand that he is misguided by anxiety and fear.

    RB’s Parents were Zambians, and that is what is on record. Now Wynter, or winter or summer, whatever he calls himself has the task with eveidence to prove, first of all before the Zambian courts of Law, and a verdict passed that RB’s Parents were not Zambia. Then after that he can bar RB from standing and if RB refuses, the seek help outside.

  77. Movement for Multiparty Democracy (MMD) member Nason Msoni has charged that revelations by former Ambassador Milton Phiri that President Banda is not qualified as Republican President should not be ignored.

    Mr Msoni says it is prudent for the MMD to seek for true and honest answers from President Banda who he says has several times admitted and stated that he was born in Zimbabwe.

    The MMD member has added that what appears to be more serious is the allegation that both his parents hail from outside this country.

    He says these allegations puts in danger the sovereignty and security of this country.

    Mr Msoni further says it is shocking that people who are not bonafide citizens of this country should cling to power and fight for the presidency of this country at all costs.

  78. Mmembe is the one who has pumped air into Sata over this nonsense. Anything that Mmembe says is gospel truth. He ranted at court that he would prove that RB’s parents were not Zambian, hence all this hot air now. Lets wait and see.

  79. Part II Citizenship

    Article 4 [Citizens of Zambia]
    (1) Every person who immediately before the commencement of this Constitution was a citizen of Zambia shall continue to be a citizen of Zambia after the commencement of this Constitution.
    (2) A person who was granted citizenship of Zambia before the commencement of this Constitution subject to the performance of any conditions following the happening of a future event, shall become a citizen upon the performance of such conditions.

    Article 5 [Children of Zambia]
    A person born in or outside Zambia after the commencement of this Constitution shall become a citizen of Zambia at the date of his birth if on that date at least one of his parents is a citizen of Zambia.

  82. Ooops. What happened to the homo issue? It seems like MMD is now on the defensive about their leaders citizenship (William and Rupiah Banda). Will there be deportations after the elections? Sounds like. On top of corruption cases, it seems someone will also be answering charges about fraudulently and lying under oath. Did the president commit Perjury? Not in the eyes of MMD cadres. What about in the eyes of the legal fraternity? Yes, yes yes!

    This leads me to ask, Why is it that worst dictators in the region are always from Malawi and Zimbabwe? Oh, cadres, please accept that this is very true. At least for once.

  89. Ba Kalos2121, (1) Regarding the 1996 election, the Supreme court of Zambia ruled that Dr Kaunda was qualified to stand. Unfortunately KK made the mistake of boycotting the elections. Read the verdict, that is why even Musa ‘LAZ’ Mwenye has “remained mute”. (2) You and your PF were calling for the election date to be announced more loudly than anybody else, up to a few days ago in fact. Assuming that the international community take up your case (i) they will refer you back to the Zambian judiciary, (ii) you will not have elections for the next five years and therefore RB would remain de facto President for another five years, (iii) All this would be agony for a party that has promised change. (iv) Would you wait to 2016 for more money in your pockets?

Especially that the Presidency bypassed Mr Sata and followed RB to his farm. That is the bitterness of the cobra. Banging on RBs parenatge as a campaign issues at this late hour is cheap politics.How on earth can this so called lawyer bring up this case which is a none starter and use it to advance his cheap political mileage?Lets get the facts right ,Kaunda was not disqualified and Chiluba whom the opposition took to court on a similar grounds won the case.This Wynter cannot win a case in court apart from the court of public opinion peddled by his propaganda news paper the post.
