Sata takes Dr Joshua Kanganja to task for giving illegal contracts to Brigadier Generals and Colonels

PRESIDENT Sata has directed that contracts of 13 brigadier generals and about 15 colonels in the defence forces be terminated with immediate effect because they are occupying offices illegally.

“All these people should leave offices now, but pay them up to December because they are in their offices illegally. I don’t have the power to give a contract; I only have the power to give a contract within the law. The Defence Act does not permit me; the Pension Act does not allow me. How do you, Secretary to the Cabinet, go and prepare a statutory instrument and give to somebody to sign? You are cheating the people in uniform,” he said.

The President was speaking at State House yesterday when he swore in permanent secretary in the Ministry of Chiefs Affairs Coillard Chibbonta and 10 provincial commissioners of police.

The commissioners of police include Solomon Jere (Central), Mary Tembo (Copperbelt), Joyce Kasosa (Luapula), Grace Chipalila (Eastern), Charity Masambo-Katanga (Lusaka), Mary Chikwanda (Northern), Eugene Sibote (North Western), Antoneil Mutentwa (Western), Brenda Muntemba (Southern) and Standwell Lungu (Muchinga).

“Why allow 13 brigadier generals and 16 colonels occupying offices illegally? You are giving them the money which should have gone to police to strengthen the establishment of the police. If you look at these policemen, some of them do not even have badges of ranks.

“If you want them to retire at 60 or 65, amend the law, the law will protect them, not you. They are not supposed to survive on who is in office, let the law protect them,” he said.

“On 13th May, my brother wrote an illegal letter giving contracts to 13 brigadier generals and about 14 or 15 colonels and issued a statutory instrument number 38. The laws of Zambia are not amended by statutory instrument. If you want to amend the Defence Act, Cap 106, you go to Parliament. If you want to amend the Pensions Act you go to Parliament, but unfortunately I want to address Dr [Joshua] Kanganja and your colleagues: be brave, say no, don’t just say yes when I say anything because you drafted this statutory instrument for Rupiah Banda, my predecessor, when you knew very well that it was illegal. You never amend any law by statutory instrument.

“We have had lots of extravagance in this country, and we have to change. The people who deserve money, we don’t give them the money because some of these police officers, since they left training school, they have never received their annual uniforms because in the police, every year you are supposed to receive a kit. I don’t think you even parade your kit because you have nothing to parade. I saw Muntemba wearing her shoes, that’s not a pair of police shoes she was wearing,” he said.

President Sata vowed to follow the commissioners’ work closely. “I will follow you because the job you are going to do is the job I know very well. I was properly trained than some of you people, and I won’t tell you I am coming, you will just see me arriving,” he said.

Mr Sata said he is disappointed that after 47 years of independence, the police establishment has not been filled. “We have a shortage of 12,000 men and women. That is why I have decided to promote all of you to commissioner level because the authority of the police is on your shoulders,” he said.

Mr Sata urged the commissioners to take criticism and do their job.

And addressing the Commissioner of Police at State House, Mr Sata directed him to keep the surrounding of the premises clean. “Are you not ashamed that every time I am driving, I stop because of a dry stick, and you are there as my Commissioner of Police. And if you look behind this building, it is very dirty. Look at the surrounding of this place.

“And yesterday, that programme finished at about lunch time and the tents are still there, and you are still here. Where is the security? You claim you are Commissioner of Police at State House, those tents they are still there,” he said.

And Mr Sata has directed Mr Chibbonta to visit all chiefdoms and establish the living conditions of traditional leaders. “If I can remember very well, a long time ago when I was minister of Local Government, the allowance I gave them that is what they are still having as if there has been no government,” he said.

And Inspector General of Police Martin Malama commended President Sata for appointing more women as commissioners of police. “It’s a great relief as a police service to see that out of the 10 provinces, we have six commissioners appointed who are ladies. This is groundbreaking for us because these ladies are very capable,” he said.

They were just chewing all resources that comes their way to furnish their farms and build houses. They were Generals when they were 45years but in our era we are still Majors at 49 !     • You write like a civilian. You know very well that there is a proper way to terminate someone in the army. Why make such announcements in public? Moreover the president is talking about the Army’s budget going to the police. Look at things beyond your nose.

  7. I am in support of our president’s decision to retire the army generals who are on contract ,it only right that they are retired to pave way for the junior officers to be promote as they have tirelessly served the nation.

  14. @ Contract General sums it all up, for all those of us who are not in the army and have never for a second done a chilailai, we should just shut up. The president isn’t foolish to handle this matter in the manner he did, and yes people have to disgraced in public no etiqutte should be shown… The commissioner at state house i’m sure makes alot of money, he has to do his Job, Dr Joshua also makes alot of money, he needs to be put to task, because it’s a trickle down effect if the people at the top are pushed they will push the people below them. I rather like the American system where there are senate committees on foreign affairs and defence and intelligence, for example, which scrutinise what is going on without jeopardising the security of the state.We tend to treat these institutions as sacrosanct hence the abuse that goes on there. Every Auditor General Report has talked about financial abuse in our foreign service, cadres are appointed to diplomatic posts, the Chungu saga showed mafia activities in the intelligence, now unlawful contracts in the defence force! This is a wake up call.

  16. Maybe there was no money to pay them their termination dues. The police commissioners will also need to be paid higher salaries. I can see BOZ printing more money (quantitative easing) this year and inflation going back up. The public expenditure is going up while the income is level or even going down. The copper prices are falling now, so no windfall tax. Please pray that there is wisdom and not emotion, intelligence and not populism and common sense and not socialism in the running of our country.

  17. I wonder what the motivation was for the whole of Dr. Kanganja to illegally award the contracts to army personnel. This could not have been a slip up – he can not say he did not know “procedures” relating to government contracts. The president must call him in for questioning (i am sure he has done so already) and take appropriate action.

  18. But I like the name and shame approach. That is what we need for Zambians to get off their butts and work. There should be an official medium through which Zambians can report misdeeds of named individuals. We need to name and shame police officers at road blocks asking for bribes, customs officers saying, ‘nanga ise mwatiletelako cani?’ when you arrive at KKIA. We need to shame lazy Passport officers who take 18 months to process a passport.

SOME OF THE TRIBES ARE NOT REPRESENTED IN THAT GROUP. ANOTHER MINISTRY WHICH REQUIRES RE-APPOINTMENTS IS MINISTRY OF AGRICULTURE WHICH HAS A LOT OF SENIOR POSITIONS OCCUPIED BY PEOPLE FROM EASTERN PROVINCE, AT DISTRICT AND PROVINCIAL LEVELS. KAUNDA USED TO BE VERY FAIR IN APPOINTING BECAUSE HE BELIEVED IN ONE ZAMBIA ONE NATION AND ALL PROVINCES AND WERE WELL REPRESENTED IN THE GOVERNMENT AND CIVIL SERVICE.

  21. Is it by no coincidence that there is no single Tonga or Lozi commissioner appointed and that all the 13 brigadier generals and 15 colonels fired are all Tonga and Lozi? This is fire Sata is playing with, such tribally bigoted moves only serve to injure the fabric of One Zambia One Nation which has bound us together as one nation since independence. You cannot terminate contracts for so many senior men in uniform at a time when you are busy trying to spark a war with Malawi. How could he also appoint a commissioner for Muchinga even before parliamant approves the creation of this new province? The illegality that characterizes this lunatic’s pronouncements is frightening.

The PF administration mean well when they say they want to cut government spending by reducing number of ministries, what is worrying is again the creation of ministries like chiefs, again the president is saying the chiefs are still getting the allowances at the old rate he left as governor.What this means is he wants the allowances revisited.This is more like saving with your right hand and again eating with your left…

  25. I am wondering why out of the 10 Police Commissioners non is from North Western Province one would have thiough Lemmy Kajoba was going to be one of those being promoted. On the retirement of Generals and Colonels I was of the view that these were being retained due to their expertise. I remember during the 1980s through to early 2000’s alot of men and women died due to Aids/HIV related complications and this had deprived the services of teh much needed manpower.I think Sats is contradicting himself on the age, he brings some dead would in his govt and proposes to increase the retirement age to 65. Has the creation Muchinga as 10th Province been endorsed by parliament and where is Standwell Phiri going to operate from as PCO since the Provincial Capital has not been deicded. More action

  26. The army and cops are never in good books. In the books of the army, cops are undertrained and sissys. Sata as a cop knows this, and is just trying to get at soldiers under the pretext of unlawful appointments. We all know that Zambian cops are far from professional. They are the most crafty and corrupt. As often as not, they offer no service but pretend to work. Spare the brigadiers and colonels – they are assets even in peace time when they need to retrain fellow officers and other ranks instead of directing them to construct roads. Better heads roll in the police -from the training school to traffic officers and from the road blocks to senior officers – because this is the citadel of corruption in the country.

  31. Let us give Sata a bit of time and not rush to criticise every decision he makes. I’m sure he means well. Those commissioners are not from just one or two tribes. Infact I think all the major tribes are in there. I don’t want to focus on tribe because it is the easiest criticism to make. But I just feel that he has left out some of the current police chiefs who have been doing very well. I mean Brenda Muntemba has just been a spokesperson, but there are others like the lady who went to the copperbelt to replace Malama – I think she was the police chief for eastern province…I mean how does Sata justify appointing Brenda against that lady?!! So there is a little bit of favouritism, it might not be tribalism, but I think those who refuse to have sex with bosses don’t see promotion…

  33. I have raised this issue before, HE President Sata is a free spirited person and he expresses himself as he so wishes, that is his nature or his true character. Since he is now the president, all we should look for in his speaches are progressive things and things to be corrected. I am not sure if he is in order to appoint the 10th Commissioner of police before the province is ratified by parli? Can anyone shade more light on this matter.   38. These generals were put there to rig elections. Since they were on contract, they new that they had a lot to lose if a new govt comes in e.g loss of job. Therefore to protect there jobs they had to ensure the govt does not change

  41. With all this firing, wouldn’t it be correct to assume that more jobs have been lost than created in the last 30 days of the new administartion? Multiply that number (the fired) by 6 (average household) you could easily be talking about close to a thousand souls now staring at poverty in the face! Disgruntled ex-service men have been a thorn in the flesh in some parts of the world. The administartion needs to trade cautiously on some of this firing.

  43. Yes Zambians asimilate what you have heard from the president if there is any difference with a capitao, head master or camp commander. The president has many ways to put in motion what he has said. The manner and style he’s no clue. Interestinly, when castigating Dr. Kanganja he admits that no one should just say yes or no to what ever he says. Mr Sata is an interesting president that puts one in an awkward position to describe him as a serious person or a clown even in between does not fit him.

Looking at the number of complaints coming along, feelings of most people so far that Sata is tribalist and that his appointments have been tribalistic, is what is going to make PF lose elections in 2016. RB made history of being the shortest-serving president in the history of Zambia. Sata is breaking the record of receiving the highest number of accusations of tribalism in less than a month of being in office. Sure way to go at the next elections. Sata must know that he can’t run away from balancing and being fair in appointments in govt. That is what brought RB down. If you make appointments on merit, it is okay, but Bembas are not the only educated tribe. Otherwise PF will be a one-term party and so far that is what is coming up, or else there will be tribal war in 2016…

  48. Mr President, I hear that Dr Kanganja, does not check when these people retired, some of his workers are paid to change the retirement age in their file, so that, they can keep on working. This is the fact. Check with your people in the registry, how they operate. May be Dr. you are too tired to operate efficiently, retire and leave room to the people who can do the job properly.

  49. #60 – That is the reality of life. Sometimes these things it depends which side of the coin you are. If you are not Tonga, HH is tribalistic. If you are not Bemba, Sata is tribalistic. If you are not Ngoni or Easterner, RB was tribalistic or if he wasn’t tribalistic then he must have been some other terrible thing like being corrupt. To the mother, a clearly ugly baby is the most beautiful thing on earth. But what is most important is to be realistic and not ignore the voices of those complaining. The same way non-Easterners complained about RB being corrupt, is the same way non-Bembas are now loudly complaining about Sata being tribal. RB lost the election, and so Sata must watch his bay. It’s the hard fact of life. There is something Sata can do about it to change perceptions.

That special wing was receiving special favours from the president evidenced by the envied way they dressed and the army detested that……….the best way to handle these men and women in uniform is to treat them equally…….And handle them nicely because they have feelings and because they feel they hold the real power.

I used to say the same things to hardcore supporters of RB, and they used to accuse me of being a PF kaponya. Now, it is the PF guys who are in denial. But you know what? – Time is the best judge.   61. Is the Commissioner of Police at State House responsible for cleaning the surrounding ? He should be in charge of security and they should have someone responsible for facilities to handle the cleaning…Ba President a lot of times you say things that don’t even make sense. Muleisebanya !

  63. This Kanganja man, i dont seem to appreciate the value, if any, that he has added to the civil service. His is like a ceremonial position.
    He has failed to refine the Civil Service.
    I am not seeing any difference between him and LESLIE MBULA except maybe the level of education!!!

  65. #31 Gokigo Milazhe 61. You are spot on with tribal observation. What peplexes some people is difficulties in facing realities of things. Without doubt Sata ranks to be the most tribal president Zambia has ever had. Why deny this had fact and bury your head pretending its not true. Zambians are intelligent enough not to be insulted that way.That is wrong created by himself and his part to be decampaigned wiyh in 2016. Zambians know ONE ZAMBIA ONE NATION means and say tribalism is wrong. Boot licker comments are based on principle knowing that MMD is a well structured party with a clear manifesto and pilicies in place some of which are now in PF govt. Its the wrong leadership that needs to be done away with. That is gonna be addressed with young leadership with new thinking for the party.

  66. The presido means well. For the sake of efficiency and making things move he is in order to go for the top man. In the armed services the commander will always push his 2ic them it descends to the lower ranks. I think the civil service should embrace performance based reward system which is part of performance management system. Its been tried in singapore new zealand to mention a few.

  67. Mutentwa and Muntemba are TONGA’s, Sibote is LOZI, Jere, Tembo, Lungu and Chikwanda are from the EAST, Masambo-Katanga is LAMBA while only Chipalila and Kasosa are from the NORTH. Therefore, if there is need to complain only LUAPULA, N/WESTERN, CENTRAL and LUSAKA provinces should. So whats so special about Tongas and Lozi’s when these others are not complaining?

  68. # 77 President Sata, kindly spare Dr. Joshua Kanganja for his experience in public service #81 This Kanganja man, i dont seem to appreciate the value, if any, that he has added to the civil service. His is like a ceremonial position PRESIDENT SATA: How do you, Secretary to the Cabinet, go and prepare a statutory instrument and give to somebody to sign? You are cheating the people in uniform.

    My comment: Dr Kanyanga just like Likolo Ndalamei needs to go. He was proper CARDER ont a civil servant.
