I assaulted no-one – James Banda

James Banda yesterday pleaded not guilty to a charge of assault occasioning actual bodily harm.

The son of former President Rupiah Banda is accused of assaulting banker Noel Nkoma.

Banda told the magistrates court he never assaulted former Finance Bank Zambia Limited director, Mr. Nkoma.

Appearing before chief resident magistrate Joshua Banda, a stone-faced and calm looking Banda denied having assaulted Mr. Nkoma, bringing to an end speculation that the complainant had withdrawn the case after an ‘unspecified’ out of court settlement.

When magistrate Banda read the charge to Banda also known as ‘Jimbo’ by colleagues, the former President’s son said, “I do understand the charge and I deny it”.

Banda, 51, a businessman, of house number 34, Mutende Road, Woodlands in Lusaka is alleged to have assaulted Mr. Nkoma on October 12.

He stands charged with assault ‘occasioning actual bodily harm’ contrary to section 248 of the Penal Code chapter 87 of the Laws of Zambia.
Banda is represented by Lusaka lawyer Lubinda Linyama.

Clad in a navy blue smart suit with elegant marching shoes, Jimbo was seen off and on with friends such as Mr. Edward Mumbi, an MMD cadre and Mr. Gregory Chifire a supporter of the MMD who runs a civil society group in Lusaka.

Magistrate Banda said after James took plea that trial dates have been mutually agreed by both parties and the accused will appear in court on November 28 for mention.

He extended James’ police bond to November 28 saying trial will commence on December 13.

And the prosecution said they will call five witnesses in the matter.

James is accused of having assaulted Mr. Nkoma on October 12 after a spat at the up-market five star Taj Pamodzi hotel in Lusaka. The court room was packed.

  2. This is least of this guys problems, he is likely to have much difficult court cases. He thought his Daddy owned Zambia and therefore he could play with anything in the country.

I think Rupiah Banda and his family are just being victimized by PF.How many assault cases are there on daily basis at the police and how many go to court like this? this is a bad precedent.when Sata leaves office should we expect to see his sons being hounded like this also.Leave the Bandas alone and focus on delivering election promises.

    • Your argument is typical. It is like the African countries complaining about ICC indictments when they are the ones who report. Now, if the assault victim does not report or take the matter further, does that mean even Noel should desist from seeking justice? Lets leave politics out of situations for once, Zedians.

  5. There is no victimization involved.If Mr Banda did nothing wrong he will be vindicated. Lets learn to live right and also differentiate between prosecution and persecution.Zambia should have a single set of laws for all Zambians.**==**==**==**==**==

    • Iwe ngwele is it Sata or Nkhoma who has sued James? Stop the nonsense, Sata has got nothing to do with this. If any of Sata’s children have committed a crime, take them to court period, why make a big fuss out of a straight forward issue? Ubupuba!

This man has alot to answer for, a precedent has to be set so people in power don,t steal from the country coffers or treat the govt as a cash cow. Next time James Banda comes up for mention remand him in custody, we don,t want another CHUNGU incident of bolting bail coming back to zambia when a new regime comes in power No No No take off his blue suit, let him use his marching shoes to march to jail, then he & his father will know the real meaning of kumunyokola njala, that njala will make him tell the law what was stolen,where and how

  8. They are all useless. I think this is persecution at its worst or is it its African way of dealing with enemies. And what makes these PF kaponyas think that they will be in power forever. Already huge by-elections on the way and PF will have to go to elections again. I am sure this time around Rupiah Banda will win because people have already seen that Sata is not presidential material. Infact Sata has already sensed that he will not “perform” with the smallest number of MPs in parliament since second republic. Also Sata will have the shortest term as presido for Zambia. Trust me!

  20. Some guy sued james. The guy just wants an out of court settlement seeing james is a big business man. Sata has nothing to do with it!!! Why do people hate sata so much. be strong 5 years is long. sata wont even recontest, you dont know the cobra. He’s smarter than most of you. Watch this space.   23. The POST has now declared its position on Sata. We will now get to know the truth. Sata will now feel the heat…and looking at the way things are going with his dubious appointments, Sata might just end up killing Mmembe. King Cobra against King Fred. I suspect that is why the Post website is closed down. Sata has probably instructed his intelligence to close down the Post website after Fred rowed with Sata for an hour on Friday.   24. It is prudent never to make any comments on the plight that James Banda is experiencing just because he happens to be Rupiah Bwezani Banda’s son. Note that KK has his own sons and daughters; Chiluba had his sons and daughters; Mwanawasa had his sons and daughters; just as President Sata has alsobeen blessed with sons and daughters. Each of these children have individual rights to live and exist like any of us. The case in which James Babda has been dragged to Courts of Law is now under the hands of competent authorities well-placed to adjudicate legal issues. Let’s stop shooting wild pre-emptive comentaries, but rather wait for the outcome of the Court procedings. We assume the PF Govt respects tenets of democracy and the rule of Law.
