Shikapwasha to foot Chanda Chimba legal bills, Government

Former information and broadcasting minister in the MMD government Lieutenant General Ronnie Shikapwasha and former permanent secretary in the same ministry Sam Phiri will settle the legal fees incurred by ZNBC from the Chanda Chimba stand up for Zambia documentary.

Government spokesperson Fackson Shamenda has disclosed this at a media briefing that SBN legal firm is demanding about 427 million Kwacha for having defended ZNBC in the law suits filed against it.

Mr. Shamenda says it is for this reason that on October 14, 2011 management at ZNBC wrote to the permanent secretary requesting for funds to foot the bill.This was against the background that the previous minister General Shikapwasha and his permanent secretary Dr. Phiri had promised that government would take full responsibility of the costs.

Mr. Shamenda noted that this prompted the new government to seek a legal opinion on the matter especially that the decision by General Shikapwasha was contrary to section 31 of the public finance Act number 15 of 2004 which also provides for a surcharge of officers who breach the financial regulation.

Mr. Shamenda said Attorney General Mumba Malila has since directed that General Shikapwasha and Dr. Phiri are surcharged for the legal cost which currently stand K 900 million and are most likely to go up.

The minister said that the PF government will not in any way spend tax payers’ money on any irresponsible decisions that could have been made against the will of the Zambian people.

This is in a matter in which the Michael chilufya Sata and Transparency International Zambia sued ZNBC for libel after it aired stand up for Zambia programme in which the producer Chanda Chimba constantly defamed all those that had different opinions about the then MMD government.

  2. At what moment did Shikapwasha tell the public that government ll settle Chanda Chimba’s bill, Was it when the documentaries were being aired or when ZNBC lost the court case? If it is when ZNBC lost the case, then legally the minister was seeking for solution to cushion ZNBC from the debt that was already incurred as a result of the court case, if the minister instructed ZNBC to air the documentaries with a promise that government ll settle the any legal costs fees incase of being sued, then this is a different issue, however, whatever the case, Malila should not waste people’s time by making them excited that the former PS and Miníster can take liability of a government debt. That is legally not plausable,whether what the Minister did is good or bad. Courts deal with laws.

  3. Zambia is in the mess of having been hijacked by a vindictive clique. Chanda Chimba did his best to expose the true nature of the Sata regime which has no clue as to how govts operate especially in matters that relate to princilples of continuity. Soon the next govt will strive to expose the axis of evil that connected PF-LAZ-TIZ-Catholic. Certainly money could have changed hands along this axis in a clandestine manner. Should it become necessary, the MMD can identify a credible Commercial Bank, open an Account and request well-wishers to donate. Many Zambians will respond positively to a very informative programme that millions of Zambians enjoyed to learn roots of the real truth.

  4. How can Shikapwasha pay this surcharge under your so called Section 31 of the public finance Act number 15 of 2004? He wasnt a civil servant nor the head of that department. He was a politician. Unless you intend to squeeze this poor Phiri chap. 

  5. Shikapwasha would have been better answerable for agreeing use of a defective air force plane by FAZ that led to the tragic demise of our footballers in 1993. He was ZAF commander then, maybe his sins are catching up with him after all albeit in a different way. Zambia Airways had offered a properly serviced commercial plane DC8 to ferry the boys to Gabon, but some-where along the lines, the boys were ushered unto a non-commercial plane across borders.

Let me get this straight, while Mr Mumba was busy giving a legal opinion which surprise surprise has to do with the President suing ZNBC over what is arguably political sponsored before he came to power, the President was busy making an embarrassing error in appointing a deputy director of ACC outside of the laws of Zambia. My question, couldnt both Mr Mumba and the President’s time be put to better use better still is any onein Zambia going to be a Telemachus and say ” in the name of Christ forbear”

  8. Fellow bloggers, due diligence is becoming an issue all over the world. Look at the Ukraine issue now where that Yulia lady has been clapped in irons for what she did “OFFICIALLY” as Prime Minister (and a bit before) in the name of national service. If Shikashiki did not follow the letter of the law in dealing with his portfolio he must definitely be personally liable. I see nothing wrong with that.

    It was just the other day when I was wondering to myself what had become of Shikapwasha. I’m sure he must be feeling like a fish out of water now. K 900 million is quite a huge sum for a retired Zambian politician. Well, there are lessons to be learnt for those in power: the winds of change blow very slowly but eventually the tables will have to turn and it will be time to account for the stewardship entrusted to them by the people.

  11. zambian politics suprise me, now the money will be paid to the same firm when it was pf that took znbc to court ok iliko bad i have understood, since znbc lost its case of chimba chanda fimo fimo now they have to pay sbn

    • I dont remember ZNBC losing this case unless they simply withdrew. Chanda Chimba was given an injunction against airing it. I lost track after that.

    • If you had the most basic legal knowledge you would know they wont pay a single ngwee. The court can not ask a third party to settle a bill. If ZBC is guilty, ZNBC pays…

  14. ZNBC will be complelled to pay by the court, if they have any quarrels with Shikapwasha and Phiri then they would have to sue the 2 as a separate case. This one is over and ZNBC are liable ,simple, only Sata and his ignorant lot can fail to undrstand that.

  15. SNB legal practioners are very clear who they want to bill, its ZNBC. If ZNBC dont want to pay, bailifs will collect their obsolete equipment.

Its not right to asking Shikapwasha and PS Phiri to pay because they were doing it on official duty.There is no such law that when out office then decision we made must follow us in the streets. Utter nonsense tomorrow someone will come up and say this is Contrary to Section A of the Civil Service Act number 9 which states that an person on official duty can not be tried in his individual capacity.  When shall PF start developing the country and stop persecuting MMD members. am beginning to miss the boring stories of RB opens this or that Factory or RB meets businessmen in Brazil ,China etc.All Sata and his henchmen are doing are attending swear in ceremonies and looking for the next MMD member to torture

I m even disappointed by this Mumba guy – remember the guy that failed to give legal advice to our constable at plot 1 regarding unlawful appoints? The bunch wakes up one morning to make laughable statements and the whole Kaponya cloud applauds? Shikapwasha was a minister (politician/Govt) – he can not be sued in his personal capacity while implementing govt/cabinet decisions

  31. Mumba Malila is wrong at law. The ZNBC is a suable entity in and of itself. The Minister of Information and Broadcasting, past, present or future is not liable for the programmes that ZNBC runs. If Shikapwasha did something wrong under the Finance Act, then he must be sued UNDER that Act. The case for libel is ZNBC’s alone. ZNBC bought the programmes from Chanda Chimba III, who is not an employee of ZNBC.

  35. Those saying that the govt is the one eligible to pay these legal fees are dormant minded. Surely this is MMD issue and not govt issue. Sata sued ZNBC who disclosed that MMD was the genesis of Stand Up for Zambia,and Shikapwasha was MMD govt’s spokesman and basically directed ZNBC while acting together with his PS to air that program. If you can’t get anything out of this,then just shut up and keep quiet.
