Zambia Police to soon commence a crackdown on Sex workers

Sex workers or prostitutes who parade the streets at night to sell sex to desperate men will be handed jail terms or fines in a crackdown that shall commence soon. This is according to Inspector-General of Police Stella Libongani.

Ms Libongani described prostitution as a ‘public nuisance’ that will see the offenders get charged with either idling or disorderliness or both contrary to Chapter 87 of the Laws of Zambia.
The offence attracts a fine or a possible jail sentence depending on the circumstances and evidence produced.

“As you may be aware,” Ms Libongani said, “There is no offence known as prostitution under our laws rather the act itself is a ‘nuisance’ under the Public Order Act Chapter 87 of the Laws of Zambia.”

Ms Libongani said, “Those who will be caught will either be fined or taken to court. But for second and third offenders, they will be taken to court directly even if they have money to pay so that the court can mete out stiffer punishment.”

She was speaking at a press briefing in Lusaka yesterday where she spoke tough against prostitution, which she said is getting out of hand in the country, especially amidst HIV/AIDS whose numbers in Zambia are dropping, according to the Ministry of Health.

Ms Libongani also warned police officers that are fond of asking for ‘sexual favours’ from prostitutes to stop the habit because they will be charged with various offences alongside the prostitutes they coerce into sex in return for freedom after they arrest them.

She said police officers are supposed to behave in an exemplary manner during their course of duty. Ms Libongani was responding to reports that some police officers are fond of abusing sex workers in their custody.

But plans by the police to round up sex workers have received mixed feelings from some non-governmental organisations that look at the rights of women in Zambia. Women for Change executive director Emily Sikazwe said the intention by the police is welcome but that sex workers should be given alternative jobs before they are ‘stripped’ of their livelihoods.

Ms Sikazwe said yesterday that she believes sex workers are not even happy with the tough and often dangerous ‘job’ but only do it because they have no alternative or decent way of earning money and so they end up ‘selling’ their bodies to men they do not even love.

“It’s not all sex workers who enjoy being in that field of prostitution. In fact, most of them are driven into it due to lack of decent income- generating activities,” Ms Sikazwe said. “So the move by the police is welcome but we need to give them (sex workers) alternative jobs.”

The Non-Governmental Organisation Coordinating Council (NGOCC) said arresting sex workers will not solve the problem of prostitution. Chairperson Beatrice Grillo said as along as men have money to buy sex, the vice shall continue.

“So, the police cannot just say that they would round up the sex workers. If men were not going after these women, there will be no prostitution around the streets,” she said.

  1. Don’t arrest anyone! The prisons are already overcrowded, and you want to throw more people in there? That’s what will increase the spread of HIV, not prostitution. In fact, sex workers are often more likely to insist on the use of condoms than women who are married or in relationships. If you want to make sex work illegal, first create job opportunities for women and guarantee that the prisons you want to send them to will be safe. I cannot believe that the Inspector-General of the Police has only a mild reprimand for police officers who rape women in their custody…it shows where the police (and government’s) priorities are.

  2. Yes, arrest them, us married women twacula. Atleast without prostitution, you can punish your man by starving him the fruit…and he will come back begging for you after 2 days or so. Now they dont even beg cos with money, the can get it anywhere, punish them and return dignity to matrimonial/holy bed!

    So this will not apply to sex workers or prositutes who do not parade the steets at night or those that do sell sex to men who are not desperate.
    But why are the police so intent on misdirecting their enegies on an unwinnable war when dangerous armed robbers lurk out there? This is an example on concentrating on the easy questions with low marks at the expense of the the more difficult questions with higher marks. Who knows? protitutes just might serve as a safety valve. Socialogists out there, might there not be some co=relation between low levels of prostitution and high levels of paediphilia and incest?

These scare tactics seldom work it just becomes a game of cat and mouse…if you want to really get rid them or reduce their numbers in targeted streets…scare them of business by arresting the buyers then “name and shame” them and let them pay the hefty fines, some of these guys are respectable members of society with families…that would be more than just deterrent for them…if you are really serious use undercover female officers to really put them off.

    Hitchhikers in Zambia are called prostitute. It is or should be an abomination to call anyone a prostitute, the word is just WRONG and has no room in this modern society

    If men wants SEX and a woman consents to that, that does not make them a prostitute, I hope I am not contradicting myself here, I think the government if at all they think this vice exists which I doubt it does then they should construct brothels and charge 50% tax on any rendered services and then use this many to build roads, hospitals etc. Would I make a good politician? I like to think strategically probably because of my PHD soon, MBA, CIMA and ACCA

  15. Please can you tell those police officers to stop harassing truck drivers from rural areas in choma and kalomo. They only target those with canters. They had stopped when Malama ordered them to stop illegal road blocks. They are always there at KOZO lodge in the morning demanding for K100 000.00 per truck for no police offence. People voted for change but not this continued police corruption. Can someone give me Libongani’s email address or phone number. I also Kennedy Sakeni’s contact details. I am fed up of this nonsense.

  16. The Zambian government is breaking the law by arresting people who are alleged to be prostitutes. The law that the Inspector General is quoting cannot be used against a woman standing by the road side and attending to a motorist who stops and decides to pick her up. The motorist stops on his own volition. It is not a nuisence either. Roads are not private. It is not disorderliness, because the woman is not causing distress to anyone, but actually serving desperate men. Under human rights act, she has freedom of association and movement. Please lawyers, help these women pro bono. They are even better than street vendors. If we don’t want prostitution we must say so clearly by enacting good laws.

If prostitution is wrong then even the men who indulge should be equally punished. Indeed, there is more sex for favours going on even among lawyers, doctors, nurses, teachers, politicians, police officers etc. Millions of women are on the internet trying to date grand dads for a better life transposed to the west from the slums like Kabera! It has nothing to do with love, it is survival. Why should it only be an offence when the favour is pecuniary?

    Prostitution may be a moral wrong, but it is not a criminal act. It is not surprising that there are two types of persons who hate prostitutes.
    1. Women, who think that their husbands are using them. Well, too bad madam. He will be unfaithful even if there were no prostitutes in the world. It is not sex he wants, it is non-committal relationship he wants. You may be nagging and possessive and that is your problem.
    2. Men who fear being seduced by prostitutes. Tough. You can go to a monastery if you want, you will still think evil thoughts and as Psychologists say, you will think about s e x every 6 seconds for as long as you live.

As bad as prostitution is, give priority to murderers,thieves and rapists.With the advent off mass media,urbanisation and more liberal attitudes,this coarsening of morals was bound to happen.Zambians have become unglued from their traditional conservative values.Societal norms are giving way to what was once taboo.The fact that a zambian girl acted in a porn movie is a pointer of things to come and it’ll make prostitution seem tame in comparison.I would be gutted to see porn industry in my beloved zambia.

Get into Zanimuone, Intercontinantal,Pamodzi and the like, then you will see HIV transmission at its best.   45. I found about 3 or 4 cops on manning one speed camera come on bakapokola get serious. Within 3kms I find 4 officers or 6 again hiding in the bush to see vehicles overtaking on solid lines for descending or ascending traffic just after Chilanga. In the next 4 – 6 kms I found a Road block. Is that the best way cops can be and now some will be looking for women loitering not men but jus women? ?

  49. Who is a sex worker? I dumped one man because he was no longer spending on me, However he got me a job after I gave him sex. Now I have one rich married man who has given me a house and a car after I have given him sex. There are not many such men so the other girls cannot find them so they go to the streets and get numerous men who give them K40,000 for every screw. The ones in the street will be arrested but the ones in the office? I ask for sex workers to be left alone. Police should be arresting criminals.

  54. Leave our sisters alone. Prostitution is a social-economic problem. No woman wants to do it voluntarily. Put money in our pockets and prostitution will go away naturally. Besides the women in the streets are the tip of the iceberg. The full spectrum of prostitutes include: mistresses or second wives, escorts, club girls, hotel girls, hair dressers (yes!) and the visible street walkers. ZP has no capacity to arrest all these women. It is clearly a waste of resources. PF must just fulfil their election promises of giving money and jobs to the youth instead of being distracted by this prostitution issue.

  57. Zambia and sex!!! What is wrong with our country kanshi? Is it poverty? There are so many other issues we need to focus on. African countries are lagging behind in development and we the younger generation are in a hurry to see our country develop. Mr. Sata address important issues like infrastructure development, job creation for youth. development in manufacturing and industrial sector. These are the main issues not arresting prostitutes on the street.

This police patrol vehicle stopped abruptly and one sergent persued my car at the filling station and accused me of being on tthe phone whilst driving. I told him I just had my phone stolen and showwed him the police report.
