Constitutional immunity does not bar RB from being interrogated – Roger Chongwe

Headlines Constitutional immunity does not bar RB from being interrogated - Roger Chongwe

Dr Rodger Chongwe
Dr Rodger Chongwe

PROMINENT Lusaka lawyer, Rodger Chongwe has said the Constitutional immunity enjoyed by former President Rupiah Banda does not bar law enforcement agencies from interrogating him over alleged corruption and criminal activities.Reacting to observations expressed by Mr Banda’s lawyers Sakwiba Sikota of Central Chambers and Patrick Mvunga of Messrs Mvunga and Associates that their client still enjoyed his immunity, Dr Chongwe said investigative wings acted correctly to summon the former Head of State.

“The constitution is very clear, the President enjoys immunity from prosecution and not from being interviewed by the law enforcement agencies. The Constitution does not prevent law enforcement agencies to interrogate a former or even an incumbent Head of State,” Dr Chongwe said.

Dr.Chongwe said Mr Banda was also on the other hand obliged to refuse to appear before the team of investigators if he did not wish to do so as stated in the letter written by the ACC director general Rosewin Wandi.

“Ms Wandi clearly asked in her letter if he could come for interviews, and that in an event that Mr Banda was not willing to do so, he was obliged to state so. And Mr Banda indicated through his lawyers that he was not willing,” Dr Chongwe said.

“The ACC are within their competence on the decision they made and if the head of ACC wants to take it further, there are other avenues to explore such as requesting Parliament to lift his immunity for him to be interrogated. If the ACC have a good case nothing can be done but to lift Mr Banda’s immunity,” he said.

He said the current government was more lenient on Mr Banda unlike was the case with late former President Frederick Chiluba whose immunity was lifted through Parliament to pave way for his prosecution.

He said the current government was more lenient on Mr Banda unlike was the case with late former President Frederick Chiluba whose immunity was lifted through Parliament to pave way for his prosecution.

Mr Banda was requested by the ACC to appear before the panel of officers at 09:00 hours on Thursday.

Mr Banda’s lawyers accused the investigative wings of parading their client in what they termed as a media-trial.

In a letter to the ACC director Former Mr Banda’s lawyers stated that their client was not going to be tried in the media adding that he had already been convicted before going to court.

“We have read in the newspapers that the press are already aware of the steps you are taking and looking at the editorial deadlines the papers have, and the time when the letter was delivered to our client’s residence, it is clear that the press had the letter even before it was delivered to our client, ”

“Our client has seen that you wish to have conviction through the press before you even go to court. This is borne out by the fact that you saw it fit to leak your letter to all the State media and the press you consider favourable to the state. Our client is not prepared to subject himself to a media trial,” the letter read.

Ms Wandi warned that other legal avenues would be deployed to pursue Mr Banda once he failed to avail himself for questioning.

Meanwhile the Drug Enforcement Commission (DEC) head-offices was yesterday thronged by a heavy presence of Zambia Police officers formally awaiting Mr Banda to appear for interrogations following a summons on Monday this week.Mr Banda did not show up as he had already indicated that he would not
appear but the investigative wings followed the standard procedure as they had issued the summons which indicated that he was expected to appear yesterday morning.
Investigative wings spokesperson Namukola Kasumpa said in a separate interview that officers waited for Mr Banda in futility. She said that the nation would be informed of the next course of action following the failure by Mr Banda to appear before the team of investigators.

  1. Step-by-step. Soon the cookie will crumble; what we are not sure is who will be holding the dry end of it after dunking!

    • We are mourning, why you bring up this Chongwe and constitution. Mwebantu muli babi sana. What kind of editor is this?
This why people are begging for a national mourning, you can’t be entertaining people like this. Give us stories of what clergy and traditional leaders are commenting on the lost souls in that bus accident.

    • DRITY,STINKY,UGLY SATANIST.YOU WAIT TO DIVERT THE PIPO’S ATTENTION ON THE SON OF ZAMBIA LIKE RB FROM YOUR EVIL DEATH WHICH ARE GOING ON AROUND ZAMBIA.GOD ISTHE GOD OF JUSTICE

  2. DR CHONGWE EDUCATE WACHDOG. EDITORS OF WATCHDOG ARE SO ILLITERATE.
THEY ARE SO DESPERATE TO ATTACK GOVERNMENT EVEN ON FEASES AND URINE

    • @Cheelo
The problem with us Zambians is that we are too gullible and easily swayed by “headlines”. Chongwe has not said anything new or contrary to what Sakwiba or indeed the ZWD have said. RB has immunity that is a fact. The investigative wings can not persecute him without lifting that immunity – fact. The investigative wings can “ask” him to attend or assist with investigations just like they can with any citizen but the LAW does not compel anyone to attend and neither does it assume guilt in that refusal. The LAW is clear…Charge someone with an offence, “warn and caution” them, then interrogate them. To do this to RB they need to lift his immunity. LPM did so without trying to score media points by inviting FTJ to ACC…ACC should just put their case before Paliament – Period!

    • first of all, cheelo if not the ghost itself,,, tell Dr chongwe to educate you on ACC interogating kabimba and GBM with permission from Sata, what the law says. Asking him about the fight he had with kabimba about baroste issues which sent him in the dark away from sata.

    • there are laws which are descriptive and others are not. Zambian law is not, it is dependent of an authority, anybody competent is an authority, so long it their office

I thought it was a ACC that Mr Banda was supposed to appear before?I’m confused please help.

    • Mr Banda was a president of Zambia. He may be of use when wanting him or others when dealing with crimes. As a former head of state there could be many people who cashed cheque he never authorised. being questioned does noy mean being charged. let not our stry thoughts just waste a country that has potential. a lot national interest in how the money donated has been used are being asked. read world bank audid book for africa.

    • Now that will never happen in a “democratic” Zambia. Just imagine long, very long list of PF office bearers trying to be interrogated. Question for Mr. Sakeni: Are your colleagues from Ministry of Justice and Defense and your BOSS ready to be questioned?

  4. Problem with zambia’s laws – every Jim and Jack can interpret them as deemed fit – we have laws of pockets and bellies

  5. mr chongwe can u advise was your friend in order to tell wandi first to tell him of the ministers being investgated and was kabimba in order to appear with cadres and ask to be interviewed in the preses of the same?

  6. WHY NOT INTERROGATE SATA FOR THE US$27,000 HE WAS CAUGHT WITH IN SA AND MALAWI WHERE THEY BUNDLED HIM LIKE A BAG OF GBM MAIZE

  7. Rodger Chongwe, there’s no need to engage in foreplay if it won’t end up in bonking! Mr Chongwe Sir are you in the habit of advising your clients to undergo interrogation over unspecified charges! Rodger, if your PF paymasters have evidence about RB’s wrong doing, tell them to have his immunity removed and then sue him! Chongwe, you’re the maggots that have ruined this country with your treachery. Chiluba and Sata should have finished you and Kaunda off in Kabwe.

    • Chiluba couldn’t not have finished off these good men. God protected them! But you know which other good people Chiluba finished off or had a hand in finishing off….Nkumbula’s son, Penza, Wezi, Andrew Tembo, Capt Chiti, Capt Solo (after returning as vegetables from incarceration), Princess Nakatindi Wina; to name but only a few….For the list could be endless, by the way and Mung’omba!

  8. ewe Chongwe you educated fool you don’t have morals.why does ACC want to fast Track RB’s case leaving Wynter Kabimba’s? Sata has brought nothing to Zambia except Confusion, Corruption , Nepotism, Tribalism, unnecessary By elections,Shortage of mealie meal, killings and Road Accidents. PF new meaning is Poor Failures.

    • Are you saying ACC resources should be diverted to other streams to address some of the concerns you have highlighted? Let’s give credit where it’s due an upload what ACC is trying to attain here. I believe RB alleged crimes were committed before Kabimba. For simple sequence and logic, you deal with projects at hand before moving to new ones. If PF officials are not prosecuted during their current term, it will just tilt the balance of where you vote will go.

  9. He he he Chongwe excaped with as he lied to us with a gun shot that tore through his mouth.

The bloody lawyer was talking freely two minutes later giving BBC an interview. How?

I have stopped trusting lawyers, they accept to lie and cheat to get client aquitted when he is guilty. already they are argueing over nothing. where is LAZ??

  10. Chongwe’s advise sounds like that of a lay man in law. Does the constitution specify if the president can be interrogated for actions or decisions made while in office? NO then its a blank and you can say what you are saying. please use the law to advise not opinions and emotions. Besides no one will take your advise seriously considering your stance against RB in 2011.

  11. ACC summoned RB for interogations – they were right.
RB refused to appear before a discredited organisation – he was right.

So all were right – so end of story!!!!! No more useless surmons.

All is well that ends well.

  12. Rodger Chongwe is sick in the head, very dull lawyer. Actually this man has been enjoying the publicist he does not deserve. He practices law of the stomach

  13. Rodger Chongwe is a failed lawyer who I cannot hire for any case!! He is just tyring to get some food from Sata! When Sata is bussy raping the constitutuion day and night Rodger Chongwe is quiet! Can he tell the nation of what good is an invetigation that will not end up in prosecution? Why investigate someone you can prosecute???? Don’t waste our time an money!!!

  14. sakwiba sikota is so far the best lawyer in zambia i cant even question his interpretation of the law but mr chongwe, ur a desgrase thts wy even yo master cobra brashd u in front of yo childrens, wat has rb done to u kabimba is a criminal whom the ACC must west the time on but they are told not to intervie him befor geting clearance frm cobra.Kabimba is nt a justice minster but injustice minister.

  15. Mr Chongwe, laws are also moral and ethical codes of conduct – stop bullshitting! The legal grid-lock is obvious for all – they can’t have RB b’cos they won’t have the majority to lift his immunity, the opposition won’t impeach Sata b’cos they doubt achieving the majority needed – the interests of this country have never been your priority you so-called prominent citizens….By the way it took prior steps before Bill Clinton could be subjected to the Lewinsky Dance!

  16. For me even if Dr. Chongwe is right what will the police or whatever DEC do because he has refused to attend? And mwebantu….even if they find him with a case he can not be arrested so DEC should wait please and try praying for his immunity removal.

  17. HOW COME LAWYERS ARE NOW DIFFERING ON A STRAIGHT FORWARD PIECE OF LEGISLATION?

THIS IS THE REASON WHY I DID NOT WANT TO BE A LAWYER MYSELF.

    • Lawyers always differ depending on who they are representing. There is always two sides to a story and the Judge or jury have the role to decide whose right depending on the facts and evidence presented…

    • Mubukwanu there is no fundamental difference from the comments being made by the lawyers …Dr. Chongwe is in agreement with Saki on the fact that RB has the right to refuse being questioned , his opinion rather is that given the position , SAKI could still have allowed RB to be questioned that did not require the immunity to be lifted…furthermore he has indicated ways and means that the ACC can use to question RB in the evnt they put up a case in PARLIAMENT for Parliament to lift the immunity guess what its MCS who needs to take the case to Parliament like levy did on Chiluba ……does he have the ability to expound the case …well you are the right judge

  18. I am not a lawyer anyway but I am seeing some lawyers misdirecting and misrepresenting the people on this one! In the first place, why summon someone whom you know that no matter what the outcome of the interrogations/interview would be, you would not do anything to implement the outcome of such interrogations? It would make much sense to me if the interview was meant to get information from Mr. Banda in cases where he is required to testify as a witness but if it is on wrongs he (Mr. Banda) committed during his tenure of office as Republican President, I cannot see any logic in summoning him as he is still enjoying constitutional immunity from criminal and other charges. The best for me is to go by the way of parliament as others have advised.

    • My brother there is logic in interviewing RB because it is out of this interview that ACC will establish a prema facie case (if there is any) which will then be presented to the Public and Parliament for immunity to be lifted. Otherwise these caps will just go to parliament and read out unsubstantiated cases and RB immunity will be lifted like it happened with Chiluba. At that point RB will be treated anyhow.

  19. THE ZWD DOES NOT ATTEND EDUCATIVE PRESS MEETINGS. THEY WERE NOT THERE. BUT THEY WILL REPORT ‘ACCORDING TO STATE HOUSE SOURCES’.

LAST WEEK THEY QUOTED STATE HOUSE SOURCES AS SAYING THAT PRESIDENT SATA HAD BEEN FLOWN TO INDIA FOR MEDICAL TREATMENT FOR HIS CANCER AND HEART AILMENTS. WHILST CONDEMNING THE POST FOR ANNOUNCING THE ARRIVAL OF THE PRESIDENT PREMATURELY WHEN HE WAS STILL IN LONDON, THEY DID NOT SAY WHEN AND HOW THE PRESIDENT LEFT LUSAKA OR LONDON FOR INDIA! THEY ARE A SHAMELESS UNPROFESSIONAL GRADE 9 LOT.

    • @Kabimba
Objective and analysed blogging and utterances will gain you credibility among Zambians especially in your position as Minister of Justice and everything else (we must be lacking in manpower in this country). However coming to your point against ZWD. They are more credible source of information than the Post and they have every right to “point out” the blatant lies printed in the Post just as any media house can point out lies by the ZWD. However, your point of “ZWD not telling when Sata left Zambia, the UK or India” is rather shallow and at most irrelevant. The ZWD exposes the incompetences of the PF Govt and the lies of all Pro-PF media and they do a good job at it. Therefore PF cadres should either stay away from the site or objectively debate and offer alternative views

    • Please don’t tell me that this is our Minister posting this. I’mean, this can’t just be. First of all his language and later on the points he is raising are just too shallow for a Lawyer of his sort. Needless to say, that the point of discussion here is on RB investigation and immunity. No, this can’t be Wynter Kabimba.

    • Iwe the so-called Kabimba! Please learn to debate issues as they come and stop waffling. The issue at hand is on Rodger Chongwe’s article above and not what you are dreaming about!

  20. Rodger Chongwe is supposed to be a seasoned Lawyer and with that you would expect him to comment with integrity and due regard to the principles of law such as “presumed innocent until proven guilty”. But if you read the following extract from the article attributed to him, you wonder just how these guys think
“He said the current government was more lenient on Mr Banda unlike was the case with late former President Frederick Chiluba whose immunity was lifted through Parliament to pave way for his prosecution”
LPM had the basis to lift FTJ’s immunity and Paliament did. If this Govt has the same let them do it. It should not be “an expectation” that every new Govt should be prosecuting the head of the former, unless there is compelling evidence to do so.

  21. The plan is not prosecute RB… We will turn him into ‘the state witness or state property’ because he knew and still know everything MMD did. This way, he will for ever be quite ..and then we will put him into a witness protection programme. May be Mukobeko prision is ideal for our valuble state-witness. Prison wanders will protect him 100%.

  22. This is where we have problems with Zambian lawyers. Dr Chongwe who would have thought is competent on such matters is parrting academic law that at this stage is inconsequential. If its true that RB can be questioned by ACC at this stage, but at the same time has the liberty to decline being questioned as has done, then its an academic exercise of law. The substative issue is his removal of immunity that will not easly happen. Chongwe also claim sitting president Sata can be question by ACC. Chongwe is in a dreamland. Sata has to issue permision for an investigation on himself. This is where we rate some Zambian lawyers to be one of the dullest in the world. This may explain why Sata fired Dr Chongwe.

    • The issue here is to destroy Rupiah’s credibility before he leaves for Kenya at the head of the US NDI election observer mission. The fact that a government can connive to compromise the credibility of its own citizen who they are supposed to protect and support is the highest form of treason against its own citizen. A self confident government of patriots would in fact help him with additional competent Zambian staff to ensure he has a successfull mission to Kenya. Even if they have a case against him they should have waited until he has returned from Kenya. The plot to discredit RB is a signal that this government does not deserve any loyalty from any Zambian. We have to stop this PULL HIM DOWN sysndrome.

    • Please Zambians, don’t ask for removal of immunity before you are convinced that RB has a case to answer in our Courts. Its not difficult to remove immunity in parliament because our MPs are highly compromised. How come we have Mutembo Nchito as DPP when parliament knew very well that the guy had issues around him. Let ACC do their job and establish if there is a case or not

  23. @ Concerned Citizen!

IMPLEMENTATION MAY REQUIRE SPECIAL TOOLS LIKE RODGER IS SAYING. BASED ON THE OUTCOME OF THE INTERROGATION, THE ACC THRU THE PRESIDENT MAY ASK PARLIAMENT TO REMOVE FIMOFIMO BEFORE PROCEEDING.

REMEMBER CHILUBA HAD MOURNED THAT HE HAD NOT BEEN GIVEN A CHANCE TO EXCULPATE HIMSELF FROM ACC INVESTIGATIONS BEFORE THE FIMOFIMO WAS REMOVED. THERE WAS SOMEWHAT SOME RUSH IN CHILUBA’S CASE. SATA IS SURELY FAIR, HE IS GIVING EVERYONE A CHANCE WHICH PLUNDERERS HAVE MISTAKEN FOR A WEAKNESS ON HIS PART..

    • Ok, now this is Wynter Kabimba and I agree with you totally. ********** I think people are being emotional here. However, Hon. you are partly to blame for this public outcry in favour of RB because of your drama at ACC and the general selective prosecutions. You need to correct the situation to restore public confidence in ACC.

  24. There is nothing wrong with what Dr. Chongwe has said and also note that there is nothing wrong Sakwiba has done in refusing to allow RB from being questioned. As per Chongwes observation RB could have chosen to attend or to refuse …..so there no contradiction read the comment of Chongwe please…to add on Chongwe is infact saying even our current President can be questioned , he has a right to agree or refuse ….please learn to read and understand.

  25. Rodger Chongwe is a relative of Clive Chirwa (Zambia Railway Dorector) all are from Eastern Province, the place of white collar crimes!

I have respected friends from Eastern Province but i know that this place where Rodger chongwe hails from is a crook’s paradise.

Rodger Chongwe is a crook lawyer who can not even defend his own recommendations regarding Barotseland. What type of a lawyer is this useless Rodger chongwe who is a State Counsel but does not even know what he is doing?

He is an agent of lucifer like Sata who is a satanist, that is why the former President Frederick Chiluba fired him over his nonsensical support for what PF leaders satanists believe in!

Rodger Chongwe will never much the respect that Rupiah Banda commands unlike him who is a cheat.

  26. ANYONE, WHETHER YOU ARE IMMUNE DEFICIENCY OR IMMUNE SUFFICIENCY CAN DECLINE POLICE SUMMONS.

DEAR COUNTRY MEN AND WOMEN, REASONABLE AND UNREASONABLE PF AND OPPOSITION BLOGGERS, SUPPOSING RB HAD BEEN CITED AS A WITNESS IN SOME TRAFFIC ACCIDENT OR A BUGLARY AT HIS HOME! WOULDN’T THE POLICE OR WHOEVER CALL HIM TO GIVE EVIDENCE?

    I NEED YOUR GUIDANCE PLEASE.

    • @Kabimba
      The point you should understand is that there is no LAW that compels anyone to answer questions by the ACC or any investigative wing, if you are not arrested and cautioned especially if this can lead to self incrimination. But to answer your cunning question;
Yes, they would. If the offences were against RB it will be in his interests to help the Police with their investigations. If he was a witness of any offence or, in his capacity as former head of state, he can OFFER his account of what he knows or saw. Immunity does not play a part in those matters. However, it is a totally different issue when it comes to allegations of crimes committed, by him, while he was head of state. there is a safe guard in the LAW and one can see why it was prudent to make such a safe guard.

    • good point. or like that time when a lot of money was said to have been misplaced or stolen from his bedroom. he still feared to report the whole thing. instead he sent someone else! this immunity thing is really confusing Bwezani!

  27. I ve said it before and will say it again that IT IS VERY DIFFICULT TO CONVICT A FOR A FORMER HEAD OF STATE. Less stop academic exercises meant to hoodwink people. This exercise is only meant to enrich one local cartel. We lost alot of money in Chilubaz case and most of the assets confiscated from him were later returned to him. ANY PERSON INNOCENT IN THIS PRESENT GOVT SHUD BE THE FIRST TO CAST A STONE ON RB! Winning a case requires evidence beyond reasonable doubt which Im sure Madam Wandi doesnt have and wants RB to supply

  28. Why was Dr Chongwe quiet when the president said Mr Kabimba cannot be questioned without permission from the head of state? In any case, what does the term prosecution mean? From what I have researched, prosecution can also be synonimous to what the ACC where trying to do. Further, I think he is contradicting himself when he says RB has the right to refuse to go to ACC. The question is, what gives RB this right not to go to ACC if Dr. chongwe is saying RB’s immunity doesnt matter? Isnt the Doctor contradicting himself?

  29. Nostradamus and the DON you should listen to the words of advise before you start yapping!Roger Chongwe is a professional lawyer who knows what he is talking about. You guys dont even know a thing about law.Dont just comment without looking at the issue corned critically.Ignorance is dangerous. You wil end up insulting your own parents and cursing yourselves.Grow up and be careful in what you say!!

  30. @ NGOMWA

THE PRESIDENT’S ADMONITION TO ACC OR THE POLICE DID NOT APPLY TO ME ONLY. BUT TO ALL STAFF WHO REPORT DIRECTLY TO THE PRESIDENT. IT WAS FOR ADMINISTRATIVE PURPOSES ONLY. I REPEAT IT WAS FOR OFFICE ADMINISTRATIVE PURPOSES ONLY, FOR A BOSS, ANY BOSS TO KEEP TRACK OF STAFF MOVEMENT IN AND OUT OF THEIR OFFICES ON OFFICIAL ASSIGNMENTS SUCH AS THE ACC’S. YES, I DECLINED TO ATTEND THOSE INTERVIEWS AT FIRST BUT I AM GOING THERE ANYTIME WITHOUT ANY HULLABALOO. NEXT QUESTION?

    • You have asked for more questions, here you are; How does your being summoned by ACC become your official assignment? Was’nt your issue in public domain? Is it also for administrative issues that a tribunal has’nt been appointed for you the way RB did over Siliya or the way HE Mr Sata did over the judges?

  31. SATA, STOP THAT WHICH LPM FAILED TO ACHIEVE. JUST GIVE US THE CONSTITUTION WE WANT N FROM THERE WE’LL STRENGTHEN LAWS TO REDUCE BUKABWALALA. THESE CHAPS THAT U CALL AIDES CAN MAKE U STEAL WITHOUT REALISING. POWER IS SWEAT N CAN MAKE U BLIND ESPEC IALLY WHEN U DONT HAVE CLEAR GUIDES. LOOK AT YO KABIMBA. HE’S ABLE SHUT UP ACC. THAT’S WHAT POWER CAN DO IF NOT CAGED. I DONT BLAME THEM BUT THE LAWS.

  32. @ NGOMWA

COMRADE YOUR OTHER QUESTION: “WHAT GIVES RB THIS RIGHT NOT TO GO TO ACC IF DR. CHONGWE IS SAYING RB’S IMMUNITY DOESN’T MATTER? ISN’T THE DOCTOR CONTRADICTING HIMSELF?”. NO. ANYONE INCLUDING YOURSELF IS BORN WITH THE RIGHT TO SAY NO TO POLICE SUMMONS. SO RODGER IS RIGHT. RB CAN IF HE SO WISHES TO TURN DOWN POLICE INVITATIONS TO ATTEND INTERVIEWS LIKE HE HAS DONE AND LIKE I DID.

    • Whether you are really Mr Kabimba or not, I like one thing in your debate so far, and this is soberness. This is how it should be owayz as opposed to vulgar language that is unfortinately common for some pipo. However, I still stand by view that ACC jumped the gun by summoning RB. They knew very well that he has the right to refuse to attend to their summons and at the time he cannot be prosecuted. What were they trying to achieve? If for you as Mr be interviewed, ACC has to ask for permission from the president for so called administrative reasons, even ACC has to ask permission from Zambians through parliament for them to interrogate MR RB or MR Sata. You and me cannot support ACC if they were to call MR Sata for interrogations for any allegation even if commited before becomin president

  33. @ NGOMWA

YOU ARE TALKING ABOUT OTHER CHANNELS NOW. IF YOU MAY RECALL CHILUBA AT ONE TIME LAMENTED THAT HE HAD NOT BEEN GIVEN ENOUGH TIME TO EXPLAIN HIMSELF TO THE INVESTIGATING AGENCIES BEFORE HIS IMMUNITY WAS LIFTED. LEVY WAS IN NURRY. NO WONDER HIS CASES ARE STILL ONGOING.THIS ADMINISTRATION IS SPOT ON. STEP BY STEP. IN KISWAHILI WE SAY POLE POLE.

MY CORRUPTION ISSUE IS VERY MUCH IN PUBLIC DOMAIN. WHAT THE PRESIDENT MERELY SAID, AS OVERALL GUARDIAN OF THE ZAMBIAN PEOPLE, IS THAT HE NEEDED TO BE KEPT INFORMED ABOUT ISSUES AROUND HIS OFFICE..IN CASE SWD COULD REPORT THAT I WAS JUST WANDERING ABOUT IN TOWN INSTEAD OF BEING IN MY DESK.
PLEASE MY ISSUE IS NO MORE. I WILL BE AT ACC AT THEIR EARLIEST INCONVENIENCE.

LEVY WAS IN HURRY. NO WONDER HIS CASES ARE STILL ONGOING.THIS ADMINISTRATION IS SPOT ON. STEP BY STEP. IN KISWAHILI WE SAY “POLE POLE”.

MY CORRUPTION ISSUE IS VERY MUCH IN PUBLIC DOMAIN. WHAT THE PRESIDENT MERELY SAID, AS OVERALL GUARDIAN OF THE ZAMBIAN PEOPLE, IS THAT HE NEEDED TO BE KEPT INFORMED ABOUT ISSUES AROUND HIS OFFICE..IN CASE ZWD COULD REPORT THAT I WAS JUST WANDERING ABOUT IN TOWN INSTEAD OF BEING AT MY DESK.
PLEASE MY ISSUE IS NO MORE. I WILL BE AT ACC, AT THEIR EARLIEST INCONVENIENCE.

  35. There’s a danger of harassment of a former head of state. To me he looks like he’s gained some international credibility globe trotting on how he “gave up power willingly”. President Carter has appointed him delegation leader for Carter foundation observer mission in the soon to come Kenyan election. Obviously the suspicion here is; Is this an attempt by PF to smear the man to an extent that his reputation will remain in eternal tatters? So that no international body identifies with him? The aim may be like ” Look Mr Carter, this man you are en trusting such responsibilities has skeletons in his closets.” ” We won’t prosecute him,we just showing you the tip in the iceberg…”. ” Anyway its up to you Mr Carter, don’t say we didn’t tell you”. So the only way out is to lift RB…

  36. @ NGOMWA

“ACC JUMPED THE GUN BY SUMMONING RB?” THERE YOU AGAIN! INVESTIGATING OFFICERS DO NOT NEED ANYONE’S PERMISION DURING THE COURSE OF THEIR DUTIES. IMAGINE, IF IT WAS A CAR DRIVEN BY RB OR HIS CHAUFFEUR WHO WAS INVOLVED IN THIS WEEK’S HORIBLE ROAD ACCIDENT. WERE THE POLICE GOING TO ASK FOR PERMISSION TO INTERVIEW RB AS A WITNESS JUST BECAUSE HE IS ON IMMUNITY? NO. I THINK WE ARE MISUSING THE WORD ‘PERMISSION’ AS REGARDS THE PRES REMARK. I REPEAT, WHAT THE PRES IMPLIED WAS FOR ACC TO SIMPLY CC THE PRES WHENEVER HIS IMMEDIATE SUBORDINATES WERE URGENTLY SUMMONED TO ATTEND TO OTHER ISSUES, JUST FOR HIS RECORDS ONLY. THE PRES WAS NOT IN ANY WAY GOING TO SAY NO. HE MIGHT HAVE ASKED WHY BUT NOT TO STOP THEM? YOU SEE THE OPPOSITION SEEM TO USE THE IGNORANCE OF THE MASSES, LIKE U AND ME.

  37. @ ngomwa

MAN, I ADMIRE SATA FOR WHAT HE STANDS FOR AND FOR WHAT HE HAS BEEN ABLE TO ACCOMPLISH IN A CLIMATE WHERE HIS PEERS INCLUDING RB HAD RESIGNED THEMSELVES TO RURAL PEASANT LIFE. SATA IS THE ONLY PRESINDENTIAL CANDIDATE BESIDES ANDERSON AND HH WHO OWNED UP MARKET HOUSES AND HAS ALSO BEEN WORKING FROM UP MARKET OFFICES. HE IS SURELY MY KIDS’ ROLE MODEL OF A HARD WORKER! I COULD, HOWEVER, CHANGE MY SUPPORT TO HH WHEN HE SHARES HIS WISDOM OF HOW HE HAS MANAGED TO ACCUMULATE SO MUCH WEALTH IN SUCH A SHORT TIME. ANDERSON HAD WORKED FOR IT. I WILL EVEN QUARANTEE HIM ONE MP FROM MY CHIEFDOM OTHERWISE I WILL ALWAYS REGARD HH AS JUST ANOTHER ‘PLUNDERER’ IN WAITING-CHILUBA’S LIEUTENANT.

  38. Your attack on HH seem to show how much hate you have for him. Isn’t HH learned enough to acquire the wealth he has? He is apparently a hard worker who uses his brains to invest in the ‘little’ that he has. Don’t be such a hater.

  39. @Kabimba-I think yo comment about ZWD is out of order if I ve to use parliamentary language. Their report on H.E Sata’s whereabouts was accurate unlike the post who chose to lie to the nation. Secondly,Madam Wandi has no sufficient evidence against RB. If the people who ve accused RB gave enough ammunition to ACC to go at RB, why not start their trial? As for Dr Chongwe,Im sure he wants to realign himself after the Barotse fracus. On a better closing note u’ve kept yoself in the whole debate and I hop u ve not insulted in case of my oversight. That is sensible debate. I wish u were the one at Ministry of Justice unlike he demagogue we ve there! When u show up 2moro,Kabimba update us on yo case and when u are appearing before ACC. Its long overdue!

  40. Who doesn’t know Roger Chongwe? Frustrated white bearded old man, who wanted RB to influence Goverment to pay him for that shooting in Kabwe. When that didn’t happen, he has hated RB ever since. RB, Dr Jacob Mwanza and Chongwe were together at School and the two used to beat him in class face down. He has a grudge from long time ago. Don’t listen to him. He is frustrated and bitter man.

  41. @MOVEMENT FOR MULTI-DOCTORS

ARE SURE THE PRESIDENT WAS FLOWN TO INDIA AS REPORTED BY ZWD?
“IF THE PEOPLE WHO VE ACCUSED RB GAVE ENOUGH AMMUNITION…”, RB HAS NOT BEEN CHARGED UNLIKE THE DRIVER OF THE LAND CRUISER IN THE ACCIDENT..
PEOPLE HAVE ALREADY COME OVER WITH DIFFERING STORIES AROUND RB’S CRAFTINESS. THAT IS WHY THE ACC SIMPLY WANT TO STRAIGHTEN UP ISSUES WITH HIM!

SO WHY CANT RB COOPERATE LIKE THE CRUISER DRIVER? WHAT IS THE BIG DEAL HERE?

OUR LAWS ARE CLEAR. EVEN THE PRESIDENT CAN BE CALLED UPON TO GIVE EVIDENCE, ANY TIME, LIKE MANDELA DID.

ONE OF RB’S SONS HAS RUN AWAY. WHY IS HE HIDING IN THE LAW IF THERE IS JUST SMOKE WITHOUT FIRE? WHAT IS THE BIG DEAL HERE? BA DOC

  42. @maz

PLEASE LET HIM COME OUT IN THE OPEN AND TELL US!

BILL GATES AND WARREN BUFFET, BOTH ARE NOT DEGREE ORDERS. BOTH ARE BILLIONAIRES. BUT THEY ALL CAN TELL THEIR STORIES OPENLY ON HOW THEY ACQUIRED THEIR WEALTH!

PLEASE TELL HH TO COME FORWARD…..I PROMISE, I WILL GIVE HIM ONE MP, COME 2016…

  43. @maz
