Constitutional immunity does not bar RB from being interrogated – Roger Chongwe

PROMINENT Lusaka lawyer, Rodger Chongwe has said the Constitutional immunity enjoyed by former President Rupiah Banda does not bar law enforcement agencies from interrogating him over alleged corruption and criminal activities.Reacting to observations expressed by Mr Banda’s lawyers Sakwiba Sikota of Central Chambers and Patrick Mvunga of Messrs Mvunga and Associates that their client still enjoyed his immunity, Dr Chongwe said investigative wings acted correctly to summon the former Head of State.

“The constitution is very clear, the President enjoys immunity from prosecution and not from being interviewed by the law enforcement agencies. The Constitution does not prevent law enforcement agencies to interrogate a former or even an incumbent Head of State,” Dr Chongwe said.

Dr.Chongwe said Mr Banda was also on the other hand obliged to refuse to appear before the team of investigators if he did not wish to do so as stated in the letter written by the ACC director general Rosewin Wandi.

“Ms Wandi clearly asked in her letter if he could come for interviews,and that in an event that Mr Banda was not willing to do so, he was obliged to state so. And Mr Banda indicated through his lawyers that he was not willing,” Dr Chongwe said.

“The ACC are within their competence on the decision they made and if the head of ACC wants to take it further, there are other avenues to explore such as requesting Parliament to lift his immunity for him to be interrogated. If the ACC have a good case nothing can be done but to lift Mr Banda’s immunity,” he said.

He said the current government was more lenient on Mr Banda unlike was the case with late former President Frederick Chiluba whose immunity was lifted through Parliament to pave way for his prosecution.

Mr Banda was requested by the ACC to appear before the panel of officers at 09:00 hours on Thursday.

Mr Banda’s lawyers accused the investigative wings of parading their client in what they termed as a media-trial.

In a letter to the ACC director Former Mr Banda’s lawyers stated that their client was not going to be tried in the media adding that he had already been convicted before going to court.

“We have read in the newspapers that the press are already aware of the steps you are taking and looking at the editorial deadlines the papers have, and the time when the letter was delivered to our client’s residence, it is clear that the press had the letter even before it was delivered to our client, ”

“Our client has seen that you wish to have conviction through the press before you even go to court. This is borne out by the fact that you saw it fit to leak your letter to all the State media and the press you consider favourable to the state. Our client is not prepared to subject himself to a media trial,” the letter read.

Ms Wandi warned that other legal avenues would be deployed to pursue Mr Banda once he failed to avail himself for questioning.

Meanwhile the Drug Enforcement Commission (DEC) head-offices was yesterday thronged by a heavy presence of Zambia Police officers formally awaiting Mr Banda to appear for interrogations following a summons on Monday this week.Mr Banda did not show up as he had already indicated that he would not
appear but the investigative wings followed the standard procedure as they had issued the summons which indicated that he was expected to appear yesterday morning.
Investigative wings spokesperson Namukola Kasumpa said in a separate interview that officers waited for Mr Banda in futility.She said that the nation would be informed of the next course of action following the failure by Mr Banda to appear before the team of investigators.

      The problem with us Zambians is that we are too gullible and easily swayed by “headlines”. Chongwe has not said anything new or contrary to what Sakwiba or indeed the ZWD have said. RB has immunity that is a fact. The investigative wings can not persecute him without lifting that immunity – fact. The investigative wings can “ask” him to attend or assist with investigations just like they can with any citizen but the LAW does not compel anyone to attend and neither does it assume guilt in that refusal. The LAW is clear…Charge someone with an offence, “warn and caution” them, then interrogate them. To do this to RB they need to lift his immunity. LPM did so without trying to score media points by inviting FTJ to ACC…ACC should just put their case before Paliament – Period!

    I thought it was a ACC that Mr Banda was supposed to appear before?I’m confused please help.

    • Mr Banda was a president of Zambia. He may be of use when wanting him or others when dealing with crimes. As a former head of state there could be many people who cashed cheque he never authorised. being questioned does noy mean being charged. let not our stry thoughts just waste a country that has potential. a lot national interest in how the money donated has been used are being asked. read world bank audid book for africa.

    • Are you saying ACC resources should be diverted to other streams to address some of the concerns you have highlighted? Let’s give credit where it’s due an upload what ACC is trying to attain here. I believe RB alleged crimes were committed before Kabimba. For simple sequence and logic, you deal with projects at hand before moving to new ones. If PF officials are not prosecuted during their current term, it will just tilt the balance of where you vote will go.

  10. Chongwe’s advise sounds like that of a lay man in law. Does the constitution specify if the president can be interrogated for actions or decisions made while in office? NO then its a blank and you can say what you are saying. please use the law to advise not opinions and emotions. Besides no one will take your advise seriously considering your stance against RB in 2011.

    • Lawyers always differ depending on who they are representing. There is always two sides to a story and the Judge or jury have the role to decide whose right depending on the facts and evidence presented…

    • Mubukwanu there is no fundamental difference from the comments being made by the lawyers …Dr. Chongwe is in agreement with Saki on the fact that RB has the right to refuse being questioned , his opinion rather is that given the position , SAKI could still have allowed RB to be questioned that did not require the immunity to be lifted…furthermore he has indicated ways and means that the ACC can use to question RB in the evnt they put up a case in PARLIAMENT for Parliament to lift the immunity guess what its MCS who needs to take the case to Parliament like levy did on Chiluba ……does he have the ability to expound the case …well you are the right judge

  18. I am not a lawyer anyway but I am seeing some lawyers misdirecting and misrepresenting the people on this one! In the first place, why summon someone whom you know that no matter what the outcome of the interrogations/interview would be, you would not do anything to implement the outcome of such interrogations? It would make much sense to me if the interview was meant to get information from Mr. Banda in cases where he is required to testify as a witness but if it is on wrongs he (Mr. Banda) committed during his tenure of office as Republican President, I cannot see any logic in summoning him as he is still enjoying constitutional immunity from criminal and other charges. The best for me is to go by the way of parliament as others have advised.

    • My brother there is logic in interviewing RB because it is out of this interview that ACC will establish a prema facie case (if there is any) which will then be presented to the Public and Parliament for immunity to be lifted. Otherwise these caps will just go to parliament and read out unsubstantiated cases and RB immunity will be lifted like it happened with Chiluba. At that point RB will be treated anyhow.

However coming to your point against ZWD. They are more credible source of information than the Post and they have every right to “point out” the blatant lies printed in the Post just as any media house can point out lies by the ZWD. However, your point of “ZWD not telling when Sata left Zambia, the UK or India” is rather shallow and at most irrelevant. The ZWD exposes the incompetences of the PF Govt and the lies of all Pro-PF media and they do a good job at it. Rodger Chongwe is supposed to be a seasoned Lawyer and with that you would expect him to comment with integrity and due regard to the principles of law such as “presumed innocent until proven guilty”. But if you read the following extract from the article attributed to him, you wonder just how these guys think

    LPM had the basis to lift FTJ’s immunity and Paliament did. If this Govt has the same let them do it. It should not be “an expectation” that every new Govt should be prosecuting the head of the former, unless there is compelling evidence to do so.

  21. The plan is not prosecute RB… We will turn him into ‘the state witness or state property’ because he knew and still know everything MMD did. This way, he will for ever be quite ..and then we will put him into a witness protection programme. May be Mukobeko prision is ideal for our valuble state-witness.   22. This is where we have problems with Zambian lawyers. Dr Chongwe who would have thought is competent on such matters is parrting academic law that at this stage is inconsequential. If its true that RB can be questioned by ACC at this stage, but at the same time has the liberty to decline being questioned as has done, then its an academic exercise of law. The substative issue is his removal of immunity that will not easly happen. Chongwe also claim sitting president Sata can be question by ACC. Chongwe is in a dreamland. Sata has to issue permision for an investigation on himself. This is where we rate some Zambian lawyers to be one of the dullest in the world. This may explain why Sata fired Dr Chongwe.

    • The issue here is to destroy Rupiah’s credibility before he leaves for Kenya at the head of the US NDI election observer mission. The fact that a government can connive to compromise the credibility of its own citizen who they are supposed to protect and support is the highest form of treason against its own citizen. A self confident government of patriots would in fact help him with additional competent Zambian staff to ensure he has a successfull mission to Kenya. Even if they have a case against him they should have waited until he has returned from Kenya. The plot to discredit RB is a signal that this government does not deserve any loyalty from any Zambian. We have to stop this PULL HIM DOWN sysndrome.

    • Please Zambians, don’t ask for removal of immunity before you are convinced that RB has a case to answer in our Courts. Its not difficult to remove immunity in parliament because our MPs are highly compromised. How come we have Mutembo Nchito as DPP when parliament knew very well that the guy had issues around him.     REMEMBER CHILUBA HAD MOURNED THAT HE HAD NOT BEEN GIVEN A CHANCE TO EXCULPATE HIMSELF FROM ACC INVESTIGATIONS BEFORE THE FIMOFIMO WAS REMOVED. THERE WAS SOMEWHAT SOME RUSH IN CHILUBA’S CASE. As per Chongwes observation RB could have chosen to attend or to refuse …..so there no contradiction read the comment of Chongwe please…to add on Chongwe is infact saying even our current President can be questioned , he has a right to agree or refuse ….please learn to read and understand.

      The point you should understand is that there is no LAW that compels anyone to answer questions by the ACC or any investigative wing, if you are not arrested and cautioned especially if this can lead to self incrimination. But to answer your cunning question;
      Yes, they would. If the offences were against RB it will be in his interests to help the Police with their investigations. If he was a witness of any offence or, in his capacity as former head of state, he can OFFER his account of what he knows or saw. Immunity does not play a part in those matters. However, it is a totally different issue when it comes to allegations of crimes committed, by him, while he was head of state. there is a safe guard in the LAW and one can see why it was prudent to make such a safe guard.

  27. I ve said it before and will say it again that IT IS VERY DIFFICULT TO CONVICT A FOR A FORMER HEAD OF STATE. Less stop academic exercises meant to hoodwink people. This exercise is only meant to enrich one local cartel. We lost alot of money in Chilubaz case and most of the assets confiscated from him were later returned to him. ANY PERSON INNOCENT IN THIS PRESENT GOVT SHUD BE THE FIRST TO CAST A STONE ON RB! Winning a case requires evidence beyond reasonable doubt which Im sure Madam Wandi doesnt have and wants RB to supply

  28. Why was Dr Chongwe quiet when the president said Mr Kabimba cannot be questioned without permission from the head of state? In any case, what does the term prosecution mean? From what I have researched, prosecution can also be synonimous to what the ACC where trying to do. Further, I think he is contradicting himself when he says RB has the right to refuse to go to ACC. The question is, what gives RB this right not to go to ACC if Dr. chongwe is saying RB’s immunity doesnt matter? Isnt the Doctor contradicting himself?

They knew very well that he has the right to refuse to attend to their summons and at the time he cannot be prosecuted. What were they trying to achieve? If for you as Mr be interviewed, ACC has to ask for permission from the president for so called administrative reasons, even ACC has to ask permission from Zambians through parliament for them to interrogate MR RB or MR Sata.   35. There’s a danger of harassment of a former head of state. To me he looks like he’s gained some international credibility globe trotting on how he “gave up power willingly”. President Carter has appointed him delegation leader for Carter foundation observer mission in the soon to come Kenyan election. Obviously the suspicion here is; Is this an attempt by PF to smear the man to an extent that his reputation will remain in eternal tatters? So that no international body identifies with him? Secondly,Madam Wandi has no sufficient evidence against RB. If the people who ve accused RB gave enough ammunition to ACC to go at RB, why not start their trial? As for Dr Chongwe,Im sure he wants to realign himself after the Barotse fracus. On a better closing note u’ve kept yoself in the whole debate and I hop u ve not insulted in case of my oversight.   40. Who doesn’t know Roger Chongwe? Frustrated white bearded old man, who wanted RB to influence Goverment to pay him for that shooting in Kabwe. When that didn’t happen, he has hated RB ever since. RB, Dr Jacob Mwanza and Chongwe were together at School and the two used to beat him in class face down. He has a grudge from long time ago.
