Government followed right procedure when appointing Prof Chirwa and the board-Yaluma

Transport, Works, Supply and Communications Minister Christopher Yaluma has said that Government did follow the right procedure when appointing suspended Zambia Railways Limited (ZRL)
chief executive officer Clive Chirwa and the Board of Directors before handing them the responsibility to handle ZRL.

Speaking in an interview yesterday Mr Yaluma said that the layed down procedure was followed.

“When appointing a CEO, we look at proficient and experienced people, they are interviewed using the laid down procedure after a body they are affiliated to recommends that they possesses the qualities required. Appointing the board of Directors is also guarded by a statutory instrument,” he said.

And Mr Yaluma has said that the suspension of Zambia Railways Limited (ZRL) chief executive officer Clive Chirwa and dissolution of the Board of Directors will not in any way undermine strategic plans to revamp the national railway or in any way hinge on the Governments long-term planned strategies to improve the operations of ZRL.

“We have long-term plans and strategies put in place to enhance the operations of ZRL. These contingencies are there not to derail operations but to put in more efforts meant to sustain the national railway,” he said.

Mr Yaluma said Government’s decision to suspend Prof Chirwa and dissolve ZRL board is proof that the State is committed and would endeavor to see that Parastatal companies are run smoothly to benefit the people of Zambia.

“When we see that something has gone wrong in any Parastatal, such kind of investigations should be instituted to probe what’s going on. If things are not moving smoothly, we will endeavor to see anyone involved is probed, he said.

Mr Yaluma said employees at ZRL should remain calm and committed to the course of duty as law enforcers undertake the probe into the company’s operations.

Chirwa has said he was recalled to walk into a job.The interview if ever they happened was just a paper exercise.The so called minister should not waiste time telling lies because the whole Chirwa Saga has UKWA’s singer prints on it .He should bear some responsibility for it and say sorry to tax payers.People are fedup of accomodating scam ministers at the Villa at a cost K70 000 000 per month for warming office chairs

    • Both President Sata and Hon.Yaluma should be sincere on this matter. If indeed procedure was followed when recruiting Chirwa, who else was interviewded with him for the job? The government , as the prospective employer, was supposed to offer conditions of service and not the other way round. If the conditions did not meet Chirwa’s expectations, he was at liberty to either refuse or accept a compromise for mutual benefit’s sake. Unfortunately, we see a situation where somebody was offered a job without due consideration to pertinent factors relating to the poor state of the company and its impact on the economy.

    • Ngoshe, I would not be surprised if that happens in Zambia; however, some of us have been headhunted for specific positions where we are BUT we still go through a competency-based interview. If procedures are followed a recall does not necessarily mean laid down formality with rigorous scrutiny is not carried out. It just makes it that much easier for both parties, and also ensures some semblance of stability of tenure. I can also boast of having been “called” to my job – BUT I still competed for the specific competencies the job demanded…

    • Who else was interviewed ? Who was on the panel , UKWA -alone!? The crucial point Chirwa raised is , he is not the only one wasting our money on accommodation. UKWA is playing games with Zambians.

    • A lot of PHD’s in Zambia even among Professors-I am surprised at Sasa’s and team’s behavior. What can Sasa show to have done done in Zambia as a professor apart from manipulating Scholarships and crooking small businesses?

  2. What procedure dictates the free-issuing of share (25%, my foot!!) stake in a parastatal to individuals without the approval of parliament or any consensus? How many other parastatals are being freely given to other individuals? These questions will be asked a few years from now when u are no longer in power Mr. Minister. Please do not take us back to the FTJ days when a few greedy individuals wanted to secretly steal ZESCO & other parastatals.

    • Iwe Man-Abel, stop spreading ignorance here. Chirwa asked for 25%, it was turned down. The matter has never arisen again until the Board brought it up. It is a long dead issue. No one agreed to give Chirwa 25%, and he has never pursued it. So, why are your panties all bunched up in a knot over it?

    • Bakadansa, the 25% is what Chirwa’s lawyers drafted for purposes of negotiations. Muleumfwikisha. His contract doesnt contain that nonsense. Most of these issues just came up after the board was dissolved (ukufilila munsenga). We all make these demands when we go for interviews but it depends on the particular company salary structures. There is just too much PHD in this whole issue. Saasa is an Economist, so he may not really understand what is required to revamp ZRL from the technical perspective.

    • Vision or fantasy? Underground rail in Zambia??? And what exposure – to academics and aeronautis? Trains run on the gorund not in the sky and Zambia Railway has to run on commercial lines not like a university department.

    • Friends, I am sure we can leapfrog some of the “miracles” that we see in the so-called first world. Mistakes have already been made and what we need is to pick what has been primed. Do you know that it has taken Namibia a fairly short time to embrace 4G, Digital TV, etc.? Why? Because they have gone to the head of what is cutting edge and not to the beginnings of communications. The same is true in construction. All over the emerging economic world countries are seeking out smart ways of catching up and even surpassing their first-world counterparts. We CAN have underground railways; why not?

    • If you asked Kansanshi or Lumwana, how long it will take to excavate say (1.3Km * 50 deep), you will be surprised as that’s nothing. All it takes in a WILL AND ENOUGH MONEY TO DO THAT (Remember, there are a lot of financiers out there looking for bankable projects). YES WE CAN.

  6. The demeanor of Chirwa tells it all. He seemed to have had a problem in respecting authority. It was clear he seemed to think he had the blessing of heaven and earth to do what he very well liked including an attempt to single source his personal company to conduct training of senior mangers. Gravy train indeed. The question is, was he acting alone or on behalf of an invisible hand?

What does it say about the appointing authority when both the board and the CEO prove to be bad for the organisation as has happened in this instance?

To those of you busy complaining that the board was appointed after the CEO was already in place, take up the issue with the Constitution Review Commission, or whatever it is they are calling themselves these days. Our president has too many powers. He appoints parastatal CEOs, while the ministers appoint the Boards. How do you expect the CEOs to respect the Boards if their appointing authority has more powers? Our constitution gives unnecessary powers to the President. And people have totally lost the plot on what is wrong in the ZRL saga. It is not that Chirwa is getting KR128,000 per month and KR72,000 in housing allowance, or that he doesn’t respect the board. The issue is with who agreed to his contract, and lax corporate governance in parastatals

It appears the minister is trying to influence the ACC to “rubber stamp” that part, during their reporting into the ongoing investigation?

    • Fully agreed. Zambia is a talk shop for accountants and Lawyers. Funny that they are actually dictating developmental projects. When some Engineers try to change the status quo, they all rise and bring down any meaningful contribution intended. End result is lack of development, no innovation and the poor gets poorer.

      The same attitude is evident in Computer science grads. and Lecturers, complete waste of space.
      Maybe engineers should stop calculating mechanical problems and try real human ones.

  15. Why don’t these interviewers ask real questions. Here’s what I’d like to know from Mr. Yaluma:

    1) Where was the job advertised?
    2) Who else was interviewed?
    3) Was there any due diligence to check on Chirwa’s past performance?
    4) Why wasn’t the Board of Directors involved in appointing the CEO?
    5) Why was a technical engineer chosen instead of a business person?
    6) About GRZ’s “vision”, does this still include high-speed bullet trains, underground stations, and monorails in a country with a chronic shortage of electricity?
    7) How will users afford these services, why are these more important than basic freight trains?
    8) How much public money has been spent on this vision already?
    9) What exactly did Yaluma mean when he said “all is well at ZRL” one week ago on Apr 18?

      Perhaps if the ACC weren’t so busy defending its credibility, they might also like to look into this? In he meantime, let’s make this question No. 10 for Mr. Yaluma per the above.

  16. We all know that Prof. Chirwa was appointed by the president and this is the reason our Prof was trying to undermine the board.
    SOLUTION: CEOs for parastatals should be appointed by the board and not the president.
    How I wish the way the ZR board and CEO have been laid aside to pave way for investigations would have been the same procedure taken when clearing Winter & GBM. The fight against corruption should not be selective. Hon. Winter was not interviewed and was still the Boss of ACC.
    ACC should also work independently rather than waiting for instructions from HE MCS

  17. Interesting. Even if the board of directors appointed the CEO, in our ZR saga, the directors would be having lots of sittings and chew the Eurobond fund. There is just something wrong with the way we use public fund. Once the probe by ACC is completed, do not only end up dissolving the board and or dismissing the CEO. Punish them for having stolen public funds. Punish, even a jail term just to teach. It may be deterrant to many other similar parastatal and govt block heads.

Board of Directors should have been appointed first and then the board should have advertised and interviewed the prospecting CEO and the best person would have been selected – not the other way round especially that ZRL was starting anew.   21. Do not waste too much time and resources for nothing. Just get the Chinese. I China built TAZARA from nothing to what it became,how can they fail to rehabilitate ZR. Just get them. They will do a better service than the money spending before nothing of substance at all. Surely before a white man just like a Chinese steals he/she will have made profit. Its from the profit that they would pilfer. Not our case, they give you seed for planting, you first chew so much of that seed and still expect to have bumper harvest.   26. The problem we have found ourselves as a nation is that we are in a ‘Dont Kubeba’ republic. Every source of information from the PF government bears marks of Dont Kubeba syndrome that has become toxic to the nation. Only a few days ago Yaluma told the nation all is well at Zambia railways company in it, Dont Kubeba. Soon afterwards suspensions were leashed out first on the board members after Dont Kubeba them that Chirwa would be fired first that shocked them being dissolved first. Today we are told the appointment of Chirwa as ZRL CEO was done following laid down procedures. In agreement with other bloggers about lies of this government which is now its badge of dishonour. This culture of deceptiveness borne from one region of Zambia need not be a national trade mark of all Zambians.

  33. Chi Yaluma leka ubufi, who interviewed Chirwa and how many people were on the panel apart from UKWA himself appointing Chirwa through a telephone call? Secondly what experience are you talking about, when Chirwa him self admitted on Muvi-TV that he had NO experience running a parastatal company what so ever, Chirwa admitted that he is only an Academician at Bolton University teaching mechanical engeering without experience of managing a company. This PF government should stop taking Zambian people for a ride, we are tired of listening to lies all the time, incompetent Kaponya governement for real.

Just to refresh the mind of those who doubt Zambia building underground railway line in Lusaka.Remember STATE HOUSE TUNNELS WHICH Chiluba showed to the outside world?the technology is the same.ACTUALLY, the State house tunnels are more than 3 km from state house to some mountain in Lusaka.ask any body in lusaka if the show or heard the construction being done .nil. leave mr Chirwa alone.please give him phase one of his plan and prove him wrong.i believe within 7 months the BLIND WILL SEE.

    • I don’t know why I’m taking time to reason with you, but the technology is not the same at all. Being able to dig a 3km escape tunnel so KK could flee a coup or drag his opponents off for a bit of torture in the country and constructing significantly larger tunnels with proper ventilation, drainage, emergency exits, fire suppression, fail-safe power supply, etc. that are safe enough to handle electric trains with thousands of passengers on board, day in day out, are two completely different things! In truth, there is no secret to how to construct an underground train system or even how to maintain such a thing. That part is easy! The challenge is being able to afford such a project and justify the cost!

    • Thanks, but you don’t need to build something to see that it can be built or that it doesn’t make economic sense to begin with. If Clive is so “courageous” why did he refuse to run the numbers and do a feasibility analysis? Because he is in a hurry? Sorry, but where have I heard that line before and, believe me, when you are in a hurry you make mistakes! This is why many people are calling Clive an international conman! Yes, progress requires risk but would you rather mortgage your grandchildren’s future with debt to have a ego-fueled train project or spend more realistic amounts on schools, clinics, etc? Or, if you want to solve the problem of traffic congestion (which is real and serious) why not try and re-introduce full size city buses? This is what govt needs to answer.

Extend the discussion further by itemizing reaources and materials needed to get the job done. We need to discuss these matters.

What do you think is a reasonable time frame to rehabilitate the sector Luanshya-Ndola, Chingola-Ndola, Mufulira-Ndola, and Ndola-Kapiri Mposhi? To make the discussion interesting, itemize the needed resources as regards workers, machinery, materials, etc. I am sure this is the kind of stuff we should be discussing in addition to what you have already presented. Zambia has people such as you to make things happen if the leadership is willing to listen and adopt suggestions presented.

  46. @Reality train, et al, listening Professor Chirwa on Muvi and ZNBC tv a few days ago, he said his underground train plan is to cover a distance between the Lusaka flyovers (@ Kabwe and Kafue roundabouts). His initial logic is to free that piece of land ON earth for other business ventures. This is how the Metro train system is configured and operating, for instance, in the Washington, DC area (around The Mall and yonder) and beyond. Professor Chirwa needs to first come up with results/numbers derived from a feasibilibity study to support the ZR side of things.

  47. @DEVELOPER, starting on a lighter note, GRZ or ZR would need to pay good dollar or rebased Kwacha to get Reality Train to invest in that consultancy. It’s not a blog issue. Suffice to add, on a serious note, that there are Zambians out there, Reality train not excluded, who can draw up a business plan in collabotion with Professor Chirwa and his ZR team and GRZ wingers. Let’s not limit ourselves!
