President Sata’s call to include Chiefs from Muchinga province in the House of Chiefs is unconstitutional-LAZ

The Law Association of Zambia (LAZ) has called for a corresponding amendment to the constitution if the three other chiefs from Muchinga province are to be allowed to be members of the House of Chiefs in the country.

This follows President Michael Sata’s call that Chiefs from Muchinga province who have not been gazetted to be part of the House of Chiefs’ sittings, be brought to the House.

LAZ president James Banda noted that as much as his association is in support of the inclusion of Chiefs from Muchinga province to be part of the House of Chiefs, it would be unconstitutional do so now if the there are no corresponding amendments to the constitution.

Mr. Banda has affirmed that under the provision of the constitution, only 27 Chiefs are listed to be members and that as the constitution currently stands the three Chief from Muchinga province cannot validly take part in the House of Chiefs’ sittings.

Mr. Banda was speaking to Qfm in an interview.

And The Southern African Center for the Constructive Resolution of Disputes (SACCORD) has called for a mutual and respectable relationship between President Michael Sata and Traditional leaders in the country.

This follows the recent threats that President Michael Sata made that Chief Jumbe of Mambwe District in Muchinga Province risks suffering the same fate as Henry Sosala who had his chieftaincy revoked as Chief Mwamba of the Bemba speaking people.

The threat came after Chief Jumbe criticized President Sata’s allowing Paramount Chief Mpezeni of the Ngoni people of Eastern Province, to make a statement at campaign rallying to drum up support for the PF candidate in the just ended Chipata Central by-election.

SACCORD Executive Director Boniface Chembe says there is need for a proper understanding of how the President and traditional leaders in the country work together as the traditional leaders in the country complement the work of the head of State.

Mr. Chembe has told Qfm in an interview that Chiefs also need to be mindful of how they take up partisan lines in public as such a trend does not appeal well to other Chiefs who are objective and who do not take up partisan lines in public.

Mr. Chembe has called on Chiefs in the country to also observe what is required of them when they are making public pronouncements.

    • LT, edit your headline. As for the story, I am at a loss to make out what makes chiefs from Muchinga an issue. Is it not that they are chiefs first and foremost?

      Any way, I have not read the story. Does the constitution say only Chiefs from the 9 old provinces?

  4. @ nondo why in the first place does the president spend time with village chiefs ? president need to address issues like health, education, energy, agriculture, unemployment, but Sata doesn’t know law, his constitutional limits. any country needs a highly educated and naturally smart presido. we voted and its our fault.

  5. The problem I have is that the President can violate the constitution at will, the same constitution he vowed to uphold, without any consequences. Does this man really know the contents of this document? I ask because the number of breaches since he became president are unprecedented. Anyway, we undertsand considering the calibre of his advisors.

  6. We warned Zambians about Sata’s inability of statesmanship, let alone traditional respect every Zambian has been born with. Sata is busy threatening and abusing our traditional rulers as if he will be president in 3 years to come. He found those chiefs and will leave them. At least RB never dethroned any of them, Sata thinks is wamu ya ya. Shame on PF govt on its way out.

  7. LT, you keep reporting that Chief Jumbe is from Muchinga province. This is not correct. Mambwe District is in Eastern Province. Following your first report and the correction from bloggers, I expected that you should checked your facts. Please check and present correct facts to the readers especially if an error has been pointed out before. Mambwe District is where Malambo Constituency is and you will be reporting more on it in the coming weeks as there will be a by-election.

You think this is a market where you just say whatever comes from your mind. You are head of state for crying out loud. You are embarassing us.

Actually chiefs won’t defect to your useless pocket file and no bye elections. Yo tribal tendecies are really overwhelming you and yo drunkness with power is really drowning u.   12. The man called the late Chief Mwango Chiti Mukulu of the Bemba people names when he was in opposition. He was summoned later on by the chief to go to the palace to go and exculpate himself. He never went there. He has no respect for any authority traditional, political or religious. Just vote him out. Bembas have respect. Infact him is Bisa.

I think u must be the right hand man to Sata. No wonder he is making such mistakes of breaking law day in day out with impunity. This may lead to his being impeached.

  14. WAKE UP CALL!!!
    Let us have a new constitution. Everyone, including the current Head of State who wants chiefs from muchinga in the house of chiefs, needs that constitution. PF and His Exc. Michael Sata are in power and are the ones everyone is looking to put things right. They are the ones to come up with progressive laws to facilitate implementation of progressive ideas.

  15. Nkumbabukata- you will one day regret some of your comments. Let me correct you. When a law becomes an obstacle to progressive policies IT IS AMENDED OR REPEALED. NOT BROKEN as you suggest. Zambians gave PF the mandate to make the changes needed to develop the country, NOT TO BREAK LAWS. If GRZ was allowed to break laws where would citizens go for protection when they are victims of such an act? With such kind of thinking, you cannot make it as a leader at any level. If are a PF supporter you are scaring away potential supporters.
