Opposition MP’s dare President Sata to Dissolve Parliament

Two opposition members of parliament, UPND’s Cornelius Mweetwa and MMD’s Michael Kaingu, have challenged the Republican President Mr. Michael Sata to dissolve parliament if he so wishes because the constitution will be the only topic debated in the house.

Speaking on Zambia Blog Talk Radio, a Diaspora Forum, MP Cornelius Mweetwa stressed that the opposition is united in having the question of the constitution resolved before 2016. “And this means ordinary business in the house has to come to a stand still.”

Speaking on the same forum MP Michael Kaingu pointed out that it was not the intention of the opposition MPs to disrupt proceedings but, “these are extraordinary circumstances which require extraordinary actions.”

Last week Opposition Members of Parliament forced Speaker of the National Assembly Patrick Matibini to prematurely suspend proceedings of the house before subsequently adjourning the sitting of the house.

This followed the Speaker’s decision to dismiss Mazabuka Member of Parliament Garry Nkombo’s follow up debate on Justice Minister Wynter Kabimba’s ministerial statement on the update with regards constitution making process.

In his ministerial statement to parliament Justice Minister had said that one of the reasons leading to the delay in the handover of the report was the attempt at one point by the Constitution Technical Committee to hand him the report instead of the Republican President, who was the appointing authority.

But Mazabuka MP Garry Nkombo rose on a point of clarification from the Justice Minister Kabimba because the answer given was basically the same as before hence there was nothing new he was talking about.

Nkombo said the whole statement by Kabimba was just hollow and did not provide a clear answer.But Matibini ruled that Mr. Nkombo had not asked anything hence he proceeded to other matters on the floor of the house.

During the time for question and oral answers from opposition MPs to government, each time the Speaker called an opposition MP, they all shouted “constitution”.

The opposition MPs continued shouting “constitution” forcing Speaker Matibini to abruptly adjourning accusing the opposition of not being ready for business

The MPs constantly obstructed the deliberations the next day by insisting that it was inappropriate to continue proceedings without attending to issues of the Constitution process.

      Well, if at all you are indeed studying for a higher degree as I seem to have gathered from previous comments by you, then please consider my comment below as a very fair one. Your comment above is very feeble and nimble. The law of meeting demands that an agenda item is exhausted or deferred to the next meeting and not just abandoned or ignored. The members of the meeting, and where necessary assisted by the Secretar(y)(iat) can demand that the chairman (Speaker in this case) allows the agenda item to be exhausted or deferred collectively. This seems not to have happened in parliament. The speak wanted to run rough shod over the opposition MPs. Plse help the masses who paid 4 our education.

    • Hon. Kaingu is entitled to change his mind should he realise the previous path he was on was leading to no where. How many of our political leaders to day changed their minds and have continued to be “recycled” to date. I choose to use my head. Our own President of today, just like Hon. Kaingu, has changed his mind about the constitution. The very article above shows that. The current confusion comes about as a result of abrogation of the Tech Committee to Release the constitution to the public upon completion of finalizing the draft. As if that was not enough, the President is talking of an animal driven constitution!!! Think man, think with your brains. Don’t think with your heart. Its not too difficult for the President to state when he will release the constitution to the public.

People have said, written and cried enough for the release of the document and yet the likes of the Kabimbas think Zambia is their own home or village which they can manipulate in anyway they want.     All this uproar on the constitution is becoming monotonous. Even though it’s their right, I feel people ought to appreciate the fact that the country is and has always been peacifully governed under the current constitution.

    One thing they should know is that the coming into effect of a new constitution does not guarantee good governance. In Africa, we have a lot of countries where good constitutions are in bad hands. Egypt is one of them.

It beats me how a well meaning action like advocating for the people driven constitution could be regarded as nonsensical. Just who is being nonsensical here, the current leadership in government who are busy intimidating and belittling the Zambian Citizenry on the constitution making process for their selfish gains or the masses, the governed who are crying for what rightly belongs to them? Just who is nonsensical?

    Lets be more objective,serious and patriotic about this issue and leave behind a legacy, a foundation for the rule of law for our future generations to come and proudly write home about.

  23. Tribal based issues will not the country any where. The constitution will be ready before 2016 and not with the 50+1 costly and catalyst to tribalism and regionalism.
    Zambia does not have a luxury of resources to waste on election re-runs. There are other important issues to spend money on and not on such useless re-runs.

      Your arguments are not factual. They are not based on evidence. Who tells you that 50+1 leads to costly elections all the time. What about the many by-elections we have had? If you did not know, 50+1 gives comfort to the winning candidate, it ensures that the leader is elected into office by more than 50% of the people who voted. Tribalists on the other hand fear it because if their tribe is big and they overwhelmingly vote tribally, candidates from small tribes stand no chance. Please, see it this way. You may feel comfortable because you are from a big tribe but let us think beyond our narrow personal interests. We need a mechanism to break the tribal barrier between us. 50+1 is worth it.

  27. Unless releasing the draft constitution affects the national security of the country, there’s no need for the secrecy. The process should be open to the public from start to finish and the people should be the final arbiters (through a vote). Unfortunately the government is obfuscating the process by continuing to stall. Transparency should be the goal in such a process so the people can be confident that their government has their interests at heart. Mr. Sata, release the document and let the people decide.

  30. It’s so hard to come to terms with the level of incompetence of our elected leaders. Granted some ‘gridlock’ in the constitutional process of governance but to have such impasse, malignment and lackluster commitment to government officers (top brass, middle and lower level) is just a shame. And that’s putting it mildly. Unfortunately, government is in many ways a reflection of it’s citizens and one need only read some of the comments here to see the dysfunction is deep rooted and hence the decay we have in Zambia. Those of you who took English Lit. in high school (Libs ’99) may have read Orwell’s ‘Animal Farm’. Remember Muriel the Goat? We need to be more like him and less like Napoleon and his cohorts. Or we can degenerate into oblivious ineptitude, your choice.

  31. This is just too much we all know the need for the new constitution but thats not the only problem Zambia faces, our MPs have lots to do in the constituences.   37. The Constitution is a very distant document. On its own it cannot change much…what needs to be of priority is developmental issues and certain policies and laws which can be reviewed inside parliament.

    I was not happy seeing my own MP behaving like an obstinate Sunday school boy….even sitting down in defiance of our Speaker yelling ‘ Constitution’ as though the enacted Constitution will reverse the dollar-Kwacha rate and make KCM return the money they are looting.

    For our MPs own information..we constituents are also planning to Recall all you inactive MPs basing on the number of visits made to your areas and projects initiated and delivered. I will share the Score Card with you shortly.

Mr Sata should be reminded that not all Zambians are Bembas to be tossed about or dethrone their traditional leadership as he has done with Bemba’s Chitimukulu. How can you in all your exposure contend that the fact they said they would provide the constitution in 90 days inconsequential? This goes to the root of the integrity of a leader or the lack of it! Its obscene that one aspiring for the highest office of the land can say one thing and mean something else! My take in all this is that Mr Micheal Chilufya Sata owes the people of Zambia a serious apology! He needs to get off his high horse and face the people instead of hiding behind others!     We have given PF a chance; However we have to check what they are doing and provide criticism, checks and balances to keep them focused. This is essentially the reason I blog; its not to attack personalities or individuals; my values teach me to love even my enemies; and love is corrective.
    whilst am in diaspora, my heart is always with Zambia and Zambians. I contribute taxes and I have employed people back home. I visit Zambia at least once in a year. Am Zambian and I love Zambia; its my Home.
