Opposition Movement for Multi-party Democracy (MMD) president Dr. Nevers Mumba has described today’s court appearance by republican president Michael Sata as shameful deplorable and retrogressive.

Speaking in an interview in Kabwe, Dr. Mumba added that the president has confused priorities as there is no way a president with the right priorities would have time to sue private citizens when the country is facing so many challenges such as high meal mealie prices.

He further encouraged the Daily Nation news paper not to be intimidated by the president saying Mr. Sata should realize that when one agrees to be president then they are suppose to be open to criticism.

“This is one president with confused priorities. Zambia people right now as we speak are complaining about the fact meal mealie is going at K80 instead of the K37 we left it at, people are complaining for lack of jobs, people complaining because the government has gone south and he lives state house goes to court and he calls cadres like an opposition leader.

He is the republican president, what he has done is deplorable, unfortunate and retrogressive and I think that we are shaming the very politics of our country.

I would like to encourage the Daily Nation that they should not be intimidated by the president. When you agree to be president you also agree to criticism,” said the opposition leader.

[pullquote]He is the republican president, what he has done is deplorable, unfortunate and retrogressive and I think that we are shaming the very politics of our country.[/pullquote]

He added, ” A president will be challenged on the policies, will be challenged on the tie you wear, will be challenged on the shoes you wear, you can’t sue every body. This a very sad day for Zambia and a dark day for Zambia and who so ever advises the president need prayers because he is the one really misleading the president because the he has no business going to court to sue private citizens we are all very ashamed of this move and we hope that this will be the last time.”

And Dr. Nevers Mumba has challenged republican President Michael Sata to have his immunity removed so as to make it a level playing field legally.

Dr. Mumba said if the president misses going to court so much he should have his immunity removed so that he can be taken to court every day like he has been doing to his friends in the opposition who are appearing in courts almost on a daily base.

“The problem we have is that we have Mr. Richard Sakala a private citizen standing in court against the president who has got immunity, what are we dealing? You are actually victimising your own people.

If he really loves courts that much let us remove his immunity so that he can be going to court every time he insults me which he does every time, so that he goes to court every time he interferes in all our cases in court. Let him have his immunity removed so that he can go to court as often as we do under his direction,” Dr Mumba challenged.

    • But Ba Sata is an embarassment!! was he trying to show HH and Pastór Mumba how to go to court??
now wonder i dont see Dr kaseba escorting sata to court in any of the pics,,, i feel for that poor woman,,, she has tried everything in her medical books (including physical medication) to make sata have normal behaviour,,, Sata is just immposible mwebantu!!!

    • Dr.Mumba, we should not ask him to remove his imunity. it is removed automatically by him taking part in these court proceedings against a private citizen. There is no need to even remove his imunity,it is done already. thats the supreme law of the land. Like you said, level playing field, and thats what our laws as zambians see us. equal!!!! so in this case, the de facto position is that the president loses him imunity the moment he parades himself in a court of law. How can you interrogate or cross examine a witness who is not obliged to answer any question? the doors of any court room in zambia are like a cleansing screen which strips everyone of the previledges and power to make all under that roof equal. Thats the supreme law of the land.

    • nga ba kateka bakana ukwasuka ama question during cross examination, ku bakaka for contempt of court. fyakuiletelela fye ifi fyena. we appreciate him trying to show that all are equal, but he should go it the whole way. if found guilty, ni immediate resignation. knowing sata though, he has calculated this move already, he is linking his actions to justify why the constitution as presented is not adequate because i doubt if such a case was considered. chenjeleni, uyu muntu ni master dribbler!!!

    • AND THE PERSON WHO HAS BEWITCHED SATA,WINTER KABIMBA,ACOMPANIED HIM.NOW WE KNOW THE REAL STATE OF SATA AND THAT HE IS NOT HIM RULLING THE NATION.OUR MPS DESPITY THEIR POLITICAL PARTY THEY BELONG,SHOULD SAVE US….WELL SAID MAN OF GOD AND LETS PRAY FOR ZAMBIA,A CHRISTIAN NATION……

    • @Ndobo, the only behavior I know which can not be fixed and is side-effect of something is when a child’s teeth start from the top. In Bemba we call “Ichinkula”, what do you call that in Lozi?
I also feel for Bamuka Yama Kaseba, can God help her have courage to leave that bedroom, it is scary.

    • @Nostra
kekekekekekek ati Ichinkula, i have forgotten what its called in lozi but my grandfather once mention that to me, he had traditional medicine of the same at the time.,,,,,,,,, and you are right Ichinkula cant be fixed but maybe minimised

Mama Kaseba needs a break, its rough living with Sata everyday kuti wa pena

  1. If the transcript I have read on an online website which Foreign Affairs Minster Hon Harry Kalaba yesterday told us not to believe turns as to be a true reflection of what happened during the court session today, then am afraid I will have to endorse the strong words used by my president.

Oh, and just to put the record straight before all you kaponyas who can’t read hijack this thread with all sorts of unprintables, our president has NOT said the president is ….., but rather his APPEARANCE AT THE COURT is … Keep that in mind as you comment.

MMD Chief Booklicker educating kaponyas and signing off.

    • Very sad and difficult to understand what’s going on. One would hope the on-line script is not true but i fear it may come out true.

    • Sata is surely ordinary man. Like Obama he wants to show everyone that no one in Zambia including himself is above the law.

This is what Nevers Maikalange and HH Malema cant see because they are far above being human.

    • In order to keep everyone in the loop, please include URLs for discussion point rather than referring to the generic: “online” or “in the press”.
Now I have to search the net for this generic transcript.

Thanks guys. Thank you very much.

  2. Keep quite Pastor Mumbwe.Presidents in most common wealth countries can sue.Its only in American and a few other countries were such a system is complicated.

    • Craping in public as usual saulosi?
Please tell us in which Commonwealth Country sitting president and head of the government has taken civil action against a fellow citizen?

    • STOP CHEATING THE SO CALLED CHEAP SAWA MILK OR SAUZANDE OR WHAT EVER THEY CALL YOU- SAULO- BLIND AND CHEAP SUPPORTER.

    • Doesn’t matter which president of the commonwealth has done it.It is there in the laws of most commonwealth countries.Do you research baiche instead of just yapping without knowing right from left.Use your internet wisely.

    • Still is a shame for a head of state to sue a citizen when he himself can not be sued. What a shame after 50 years of independance

    • Saulosi, you are becoming embarrassment to your own handlers. Blabbing without any knowledge. By any chance, are you related to any of laying failures of the class of 2011?

    • Saulosi, as you have become expert in Commonwealth law, please enlighten us which law applies to the legal procedure in the High Court of Zambia?

    • If Sata stood in the middle of Cairo Road, took off his pants and took a dump in full view of everyone, Saulosi would find a way to justify it.

    • saulosi a.k.a mulenga chola, would support anything so long as it is ba Sata. Got to admire your chldlike faith and trust!!!

  3. An ignorant Number. You think President Sata would have gone to court without seeking top-level legal advice”

    • @2201 whatever, after all his blunders, you have the audacity to say the president gets top level advice? If he does, then he never listens to them

  4. Nevers something seriously wrong is going on. Today he speaks this tomorrow that the other day this. Its actually him who does not set his priorities right. What a shame?

  5. If what is printed in the only line media as verbatim proceedings is anything to go by then we do not have a leader, the country is being run by people holding HEMCS hostage. It is time we remove our heads from the sand and faced reality. Our man (head of state) may not be in the right frame of mind.

  6. Where is chief PF bootlicker Mushota. We need her stupid comment on this clown we call our president. To be honest l feel very ashamed to be a Zambian today

  7. Something is seriously wrong when a bully like Sata goes to court.Sata’s presidential immunity intact, its like having two boxers in a ring – one with iron clad armor fighting against a butt naked opponent.

  8. Today Zambia’s constitution has been shred to pieces and thrown out of the window by the president appearing in court. How could he with his immunity still intact appear in court? This has NEVER happened in the history of our country and worse enough its happening in the jubilee year. Whats wrong with our President if at all we have one? I don’t know what other countries are saying about Zambia today. Sata has undressed our country!

  9. Ba Sata please you are the president of zambia please stop it you are not in opposition. Why are you rushing for courts, your time is coming.Calm down president and focus on the economy.

  10. Sata’s has foolishly opened Pandora’s box with this stance that will bring into question his powers…its just shameful that an individual such as Kabimba has the president’ s ear on legal matters.

  11. The level of ignorance being expressed here is out of this world! Worse still it’s coming from a party president, Nevers Mumba. MMD should ditch this chap now! Uku pupimina ba Nevers will come back to bite u in the bum and Kaingu, Chituwo and them will be vindicated

  12. MICHEAL CHILUFYA SATA PRESIDENT OF THE REPUBLIC OF ZAMBIA HAS STRIPPED HIMSELF THE IMMUNITY

PF GOVERNMENT WHY ARE YOU EMBARASSING US ZAMBIANS. SURELY WHERE ARE THE ADVISORS TO MICHEAL SATA.YOU CAN NOT ALLOW THE PRESIDENT WITH THE IMMUNITY TO GO ACHALLENGED AN ORDINARY CITIZEN IN COURT. SINCE THIS AHS TAKEN PLACE WE URGE THE MPS TO TAKE IT UP NEVER TO RESTORE HIS IMMUNITY BECAUSE HIS ACTION IS A SELF DISCHARGE OF THE IMMUNITY. KABIMBA STOP MISLEADING OUR STATE PRESIDENT. SHAME ON YOU KABIMBA.
SHAME ON YOU PF . VIVA SAKALA STAND FIRM ASK HIM ALL THE QUESTIONS THE CITIZENS HAVE BEEN WAITING TO ASK HIM. SINCE HE NEVER ADDRESSED THE NATION, THIS IS THE RIGHT TIME TO ASK HIM ON BEHALF OF ZAMBIANS.AS HE HAS STRIPPED HIMSELF OF HIS IMMUNITY WHEN HE IS STILL A SITTING PRESIDENT.

  13. Those saying that President Sata should not have sued Richard Sakala are just useless UPND cadres. Every Zambian are at liberty to sue some one in court for defamation of character and President Sata can not be excluded because he is also a human being and every human being has a heart so all those who are barking and making noise should just shut up.

    • Apapene pali nefwakuti ni ba useless UPND cadres??? what about you, useful cadre what is your opinion sir/madam?

    • We are not saying he should not sue but he should not have gone to the court and stand in the witness box. He has no immunity in this case.

  14. Hahaha, this ignorant showmanship is what you get when you have a grade seven villager as president.Sata ni rrais mujinga sana inafaa arudi nyumbani.

  15. LAZ, we need your position, Sata’s amenable to the courts in civil proceedings, however, the danger with his conduct today open’s him to contempt of court which is a criminal offence.Given that he enjoys imnunity from criminal jurisdiction of vthe courts upon vacating office. I believe in this case he went to court as a private citizen and if commits contempt will not be protected on vacating office, unless the matter will be statuted barred. Any way 2016 is just around the corner.

  16. Despite the issue at hand, the picture of our president has scared me. He is not looking ok. I am moved, i wish he could resign and take good care of himself.

  17. Chiluba sued the post. RB instructed Chansa and Mmembe’s arrests so whats so special about the president going to court. I think Sata is a revolutionary leader. he gets everyone talking. Nevers what was he doing before Sata went to court, he had to be the first one to comment without reseach.

    • He gets people talking??? How is that important?? What about him is revolutionary?? Coz the girl who appeared topless in the post got people talking also. If he get people talking about important issues then that will be good.

  18. Sata’s presidency is an insult to the Zambian collective intelligence. The country is being led by a mental retar d yet the Zambian intelligentsia, men and women of substance, have become spectators to this shameful comedy. Sata has become a sore and an embarrassment to the country. He is mentally unfit to continue presiding over the affairs of this great country. He should be forced to resign.

  19. Sata has opened a can of worms he won’t be able to close by appearing in court.

He now HAS to make himself available to the court and lawyers for cross examination. He cannot put back the “veil” that he unilaterally lifted.

Now the daily nation lawyers will rip him a new a$$ hole. They will ask him specific questions about the said libelous statement to prove the truth of all its parts and defend their client.

Sata is in deep doodoo now!

  20. Article 43(1-2) of the Constitution provides that: “Civil proceedings shall not be instituted or continued against the person holding the office of President or performing the functions of that office in respect of which relief is claimed against him in respect of anything done or omitted to be done in his private capacity. (2) A person holding the office of President or performing the functions of that office shall not be charged with any criminal offence or be amenable to the criminal jurisdiction of any court in respect of any act done or omitted to be done during his tenure of that office or, as the case may be, during his performance of the functions of that office.” The immunity the President joys is not a bar to him suing but to him being sued. There are two (or more) ways in…

  21. Hahahaha I like Sata’s comedy, he was literally being schooled on court ettigues
I hope he is not getting dementia forgetting his age.he is risks catching a case.
For just trying to get paid.

  22. Nevers is just a kolwe with no agenda but to comment on none issues. more than anything this president has shown that he’s not distant from the people.
cheap fake politician crappers like Nevers and cattle defiler (HH) have no place on our political scene in Zambia. this is a non-issue. now we just wait for ka (HH) to spill some cow dang boo sheet in the press over thi matter. it wont be any different.

    • Agony is trying to defend a president whom the Gods have decided to destroy. Baba, your insult on Nevers and HH wont help you in an way. The fact still remains that your president has AIDS. His body is wasting away fast than some of us wanted. Its the begining of the end of Sata and his PF.

    • Hope protection was used when he was doing you Kudos. Maybe thats why you defend him so much. To comfort yourself.

  23. If the Watchdog’s report of what happened in court is true, then I am afraid we have a real mad person in state house. The president swore at a lawyer and committed perjury by lying about his age on oath. This could be the chance Zambians have been waiting for to get rid of a mad man from state house and send him to jail (Chainama).

  24. The problem here is not his appearance in court but his state of mind and his healthy and mental condition. Most of us can clearly see that the man is not fit to lead Zambia and in six to nine months time he will completely be incapacitated.Lets face it this is not the Sata we know.More embarrassments are coming.Parliament must move a motion to check his mental condition.GOD BLESS ZAMBIA.

  25. It is common for seating presidents (globally) to appear before the court of law. But there are examples or exceptions. One great man called Nelson Mandela was summoned by a racist judge to appear in court. The difference here is ba Sata volunteered to defence himself in the court of law. And more disturbing is his (Sata) conduct in court is so unpresidential, undignified and unhonorable, unxxxxx….you name it. ba Sata niba bachumbu munshololwa.

  26. SATA is sick and anything can happen very soon this year will not end. Is NEVERS MUMBA ready for a Presidential by-election? The truth is that NEVERS is still very far that is why the Kaingus and Chituwos who sees what is coming are calling for his removal. moreover NEVERS is coming from MUCHINGA with SATA what change can he brings? BEMBAS voted for SATA deliberately when they knew that the man is mad and they were even saying it that CHIPUBA CHESU meaning he is our fool what can we do lets just VOTE for him. So we should not give them another chance coming back using NEVERS MUMBA let them remain with FIPUBA FWABO we need leadership which will prosper this country, NEVERS has already shown his weaknesses of being arrogant, greedy, pompus and dictator do u think he can change?

  27. Sata is just as ordinary as he has demonstrated by standing in the dock. There is nothing special about a president especially a zambian president. The president dragging Richard Sakalanyongo to court will help our news writers to write only what is true and not defaming innocent people.

  28. Very very shameful state of affairs. I cant wait to see this come to an end, this is shameful. Un head of , Winter Kabimba please resign on moral grounds to serve yourself too. You are the mouth piece of the President, yet you were in the for front to escort him to the courts of Zambia. You new this was a Pandora box, please am giving you 3 days in which to resign or else I will be the second Harrington to drug you to the courts. 3 days. you have miss lead our President. You PF thugs monitor what winter is doing he will make sure you are all doomed by 2016.

  29. I personally feel he has the right to sue considering what is going in this country. People just seek for attention by yapping anything un objectively. this is worrying especially on LT people seat back read in between lines and respond even when they are shooting themselves in the leg ” imagine someone blaming the PF government over the KCM revelations?
