New constitution won’t solve Zambia’s problems-Kabimba

Justice Minister Wynter Kabimba has stated that the enactment of a new constitution will not wipe out Zambia’s problems.

Mr Kabimba said it is illogical to assume that a new constitution is the magical wand for Zambia’s development.

He said it is a fallacy perpetuated by the civil society and the church that a new constitution will deliver clean water and free education for all citizens.

The Justice Minister who is also PF Secretary General was speaking in Lusaka when he met leaders of the Oasis Forum at his office.

Mr Kabimba also told off the Oasis Forum officials when they protested about the presence of Journalists in the meeting.

“You called for this meeting and a Ministry we thought it is proper for Journalists to be present here so that the true spirit of the meeting is captured in the right context. We don’t have a problem with the presence of the media here, let us allow them to attend even if you didn’t request in your letter that you wanted the meeting in camera,” Mr Kabimba said.

At this stage, Oasis Forum Chairperson Reverend Suzanne Matale expressed surprise that the meeting had invited Journalists to the meeting.

The meeting later proceeded with Mr Kabimba stating that Government will not be a bystander in the constitution making process.

He said Government will not pass over the responsibility of supervising the constitution making process to NGOs and the church.

Mr Kabimba also admitted that the PF Government has observed that there are some contentious issues in the draft constitution.

He said the draft constitution will be subjected to cabinet in order to see whether the Technical Committee performed it’s functions in line with the terms of references as issued by President Sata.

But Reverend Matale insisted that the draft constitution be released as a jubilee present to Zambians.

She said the draft constitution will guarantee people’s freedoms and rights unlike the current situation where people are not even free to assemble.

And Zambia Episcopal Conference Spokesperson Fr Cleopas Lungu challenged Mr Kabimba to release the draft constitution to show that Government is not hiding anything.

The meeting ended without any key recommendations or outcomes on the way forward on the constitution making process.

    • No one is saying this is the magic wand to solving Zambia’s problems, but it is a step in the right direction…….and it is the reason you the PF spent billions of kwacha on this exercise. If you thought it was not that critical, why didn’t you use all that money for some developmental project??

    • Kabimba is right. Zambia’s problems are deep rooted and a sheath of paper is not going to solve any of them!

    • To claim that a new constitution will solve all the problems of Zambia is being simplicitic and distorting the argument for a new constitution. No one has even suggested that. However, a good new constitution is an enabling document that creates a conducive environment the rights and freedoms that allows for free expression, association and where citizens can attain their potention where the rule of law is adhered to.

    • The Minister of Justice should not be told to shut up. He is telling you that as long as his party is in power you will not have a new constitution. That is his campaign message. Make your own choices. If you want a new constitution vote for a party that is willing to give it to you. Why worry when we have so many parties to choose from. Si ba funa New Constitution ba PF. The message is clear to all of us.

  1. Surely that can not be the solution , we must first deal with roads hosspitals schools then turn to those casuals , now zambia seems to be quaete no more talk about the president

    • @Nshilimubemba; no one is talking about the president because we all have concluded that he is a cabbage. We all have accepted Fr Bwalya’s prognosis that Sata died just after becoming president. It is a pointless exercise talking about the dead.

  2. Well said Wynter !!! The new constitution won`t put food on their table or give them jobs.Zambia has more imprtant things to worry about than this piece of overhyped document. I know most will condemn you and i here just for the sake it. I have observed that most here are serial condemners, nothing a person whose political views they don`t agree with will ever say anything right.In their world objectivity has been replaced by prejudiced,predetermined,apologetic and stereotyped opinions.Shame !

      I dont believe there are people who think having a constitution will physically end their problems? If anything those that think the constitution is a ticket to an easy life are damn! I feel this is a cheap excuse to explain the delay of releasing the draft. Why not just be honest and explain once and for all the reasons it’s taking so long? Such unnecessary statements bring about more useless noise as everyone will start making statements based on this explaination dragging it for weeks on the blogs, TV stations, news papers, Fb etc! Why why do these politicians opt to drag issues? You know how impatient Zambians are and how they yap without facts, can you then incease the flame with more nonsensical utterances for an explaination?

    • Well said Cindy, but the problem is that the opposition have made it sound like all life depends on it. It is not like we don`t have a working constitution in place. I would rather wait longer and have a better and well thought out constitution than have one enacted in short time with so many flaws in it. Patience is a virtue.Let is bide our time,Rome wasn’t build in a single day.

      Yes i voted.Hope you won`t lose sleep over it. Make sure you vote in the next presidential elections instead of continuing being a key board warrior. I`m sick of tired of bloggers like you showing knowledge or lack thereof who don`t even vote come elections time.You Zambian`s must be proactive in changing the course of how the nation must be ruled, otherwise if you don`t do that illiterate people like me and Kabimba will continue ruling you.Make your vote count.

    • @Saulosi, you are entitled to your opinions. But to see nothing wrong with spending so much money on an exercise and leave it incomplete says volumes about your attitude towards public funds. That you can not see anything wrong with the way the Public Order Act is applied and the unchecked powers of the executive is baffling. For an educated person of your standing to want to live under a document that stiffles the participation of all freely is shocking. Unless you are deriving some benefits from this dispensation, ordinarily one would want a better and just deal.

    • Saulosi which part of zambia do you come from? i doubt if you are zambian. We need to correct things in our country and the constitution is the starting point. We are not saying it will sort out all our problems but some will be and then we can go to the next items

  4. What exactly are you trying to say? That Zambia should be Lawless? How do you govern a country without legistrative guidelines?
    Isn’t any organisation upheld and supported by a backbone of rules and regulations? In short you are saying Zambians are so st****p they dont know their rights? What about the time, energy and costs put into drafting the so called constitution? are you indicating that those who penned down the draft and those that who believe in it are all brainless for putting down a useless draft!
    So how long does it take to come up with a well stipulated meaningful draft? By the way, why not educate the masses the meaning and importance of a constitution just so to be clear?!

At primary, long before the birth of multiparty, democracy, the hour, privatisation, liberalusation etc, taught me a constitution is a set of rules or laws by which people have agreed ti be ruled by. Now I know that it us an enabler if freedoms, good governance and development with a multiplier effect. And, then, today some unlearned pseudo lawyer …

  7. Enough Already! If the constitution is not so important why not just issue it. Of course it is important to have it, how can you consider yourself a democratic nation when the mechanics of how are not written down. The constitution ought to be delivered before this years 50 years anniversary. It is more than just symbolic, it underpins all things. The document is not a voucher for food on tables, or jobs etc; the fact that psychopath in chief, Kabimba has made that connection is proof positive he has no clue of the intrinsic value of the document.

  12. When you were promising the new constitution was it because it would put food on the table? The new constitution is for governance issues. Good governance in the long will provide create a firm foundation for future generations to build on. Those road and hospitals won’t put food on the table in the short term but in the long yes, when agriculture is managed well and will need healthy citizens too.

  13. A constitution is the supreme (highest ) law of the land. Its importtant in the development of the country as it defines and provides checks on the powerful. Tinker can tinket with other issues not this one. Zambians let us say it loud “release the draft constitution” and we move forward. Ati jubille year with a discriminative constitution that also allows a president to win even by one vote. Shame on Tinker Kabimnba .

  14. Considering that Zambia’s biggest problem is poor leadership, the new constitution will force the leadership to be accountable – it also makes it possible for people to removes non-performing leaders.

    So, yes. The new constitution WILL solves Zambia’s problems.

    We will not see Zambia develop with this kind of attitude from the leadership.

  15. The truth is that a good constitution that guarantees transparency and effective checks and balances is a prerequisite for economic development. There’ll be lessened resource wastage and plunder!

  17. How unfortunate! If what WK said represents the PF govt’s views, then we are in trouble! I thought he would appreciate these issues better than an average Zedian, since he is a lawyer! Nobody ever said the new constitution was a panacea of Zambia’s problems! It is, however, imperative that we have a constitution in place that reflects the peoples’ aspirations! Clearly that is not the case presently! We could not have spent colossal sums of money for nothing! We need a new constitution now!!

To say he thinks like uneducated villager would be insulting those villagers. Like I said before no word in the dictionary comes close to describing this ***** of a minister. For the sake of mother Zambia these people must be gotten rid of as a matter of urgency. Pheeeeeeew I cant bring my head to understanding what Zambians see in these *****s.   21. Yaaaba! Surely, who says that the new constitution will solve all Zambia’s problems? Mr. Kabimba that is not what we as Zambians that are demanding for a new constitution are saying. What we are demanding is to take our country forward by evolving our supreme law so we can expand our freedoms and opportunities. Look if you have a problem with the current draft constitution , state what the problem is and propose solutions so that we can move forward. Don’t hold the country behind because you cant think beyond your nose!!!

  22. The current Constitution is ‘good’ for party in Power because it makes rigging easy. Under the current Constitution one does not need to win a Presidential election to be sworn in as President. All it takes is the system to declare one winner and he/she is sworn in within 48 hours. Under the current Constitution there is NO provision for verification of Presidential results – that’s only done after ‘winner’ has been sworn and he is President. This is PF’s confort.

  24. Does Kabimba know how many times Zambia has tried to enact a new constitution? There was a Mwanakatwe Commission, Mvunga Commission, Silungwe Commission. Surely isn’t this too many commissions too many? And Kabimba wants this cycle to continue unabated surely? How much money has been spent on all these commissions? If PF managed to sort out this constitution issue, the government will go down in history as the one that enacted the consitution after so many failed attempts? Why does the PF want to leave a legacy of failure in all departments, really?
