Post Newspaper’s Invasion of Privacy Shows True Statesmanship in Chikwanda

Thanks to the Post Newspaper’s invasion of privacy and ‘deep-digging’, we now know indeed that Alexander Bwalya Chikwanda (ABC) is a noble man, a true statesman with a genuine concern for Zambia and its people.

While no one would support private media tapping of private conversations, the conversation between ABC and the Post’s ‘Other Person’ has clearly enlightened many of us that even in Mr. Chikwanda private home, while sipping on ka red wine, he is still concerned about the affairs of the nation.

I can imagine that the publication of this transcript was aimed at painting a negative image of ABC, but I think most would now agree that the effect is otherwise—-his ratings have gone up! The conversation has shown us that he is indeed an honourable man with respect and his character and stature if of a high standing. He is not petty in his dealings, and has larger concerns than petty fights.

Reading through the recorded conversation, many have asked the question: So What? Reading further, any sane Zambian would agree that the conversation reveals ABC as a principled man that is not excited about being in a position of authority. He comes out as a loyal believer of Mr. Sata who is willing to work hard to compensate for his Mr. Sata’s shortcomings.

He is concerned about so many things: From the Millennium Challenge Account to Rajan Mathani’s troubled Finance Bank where he is not willing to compromise the violation of the Banking and Financial Services Regulations of the Zambia. He clearly laments about the injustice Finance Bank faced when it was sold off for K5billion (unrebased) when it was worth over $100millio. He ponders on competition in the Cement industry and expresses his admiration for Aliko Dangote.

Clearly, if the post was hoping to discredit his standing in society, their invasion of privacy has not achieved its intended purpose. A further detailed read shows that ABC is indeed deeply concerned about the state of affairs but is however, willing to go if asked to, but cannot do so given the current state of the president. On his making reference to the Post newspaper, he is clearly not the kind of a politician who would need the Post to lobby for him.

With regards to details of the conversation, who would argue against ABC’s concerns such as:

1. Unnecessary and expensive government travel?
2. Non-Marketability of Wynter due to his arrogance when compared to Edgar Lungu?
3. The need to create a conducive environment for business to flourish?
4. That due to Mr. Sata’s health, someone has to double up their work effort to keep the country going?
5. That ZRA should approach any business entity and make it meet its tax obligations regardless of its real or perceived connections with state-house? That ZRA should be more proactive and focus on real concerns rather than following up small-scale traders and engaging in corrupt activities?

Clearly there is nothing malicious in ABC’s private discussions, and noting that it was over a bottle of red wine, one can only imagine that the man is indeed even more upright when sober!

Such media practice of tapping private conversations however shows us the other side of the paper—it’s a business that has failed to meet its tax obligations and would like to blame it on the Minister of Finance. It also shows how far the Post is willing to stoop, very low, perhaps even get deeper in the ground to survive. Many may be aware of Rupert Murdoch’s case of tapping telephone conversations. Clearly this led him in trouble, and had to pay a huge price. One would have hoped that the Post ‘snooping team’ is aware of the dangers of invasion of privacy and learn, or at least at the bare minimum practice the media ethics they are expected to be trained in.

If this is the ‘bad’ that the post has on ABC, then we can only imagine the ‘good’ side that they deliberately ignored. Clearly they have failed to get this man bow down to them. They triumphed with MMD’s Magande when he proposed some form of taxes to the media houses which the vehemently opposed, but they clearly have now met an enlightened and non-compromising noble statesman without qualification who does not need their sympathy nor support to execute his duties diligently. Let the show down continue.

    • I too did not see anything wrong with what Mr Chikwanda said. I have always known and said it on this blog that he was the only bright spot in the PF Government and what the Post put out just confirmed what I have always thought about Mr Chikwanda-An honorable man.

      I think the Post needs to be told that if you are stuck in a hole, the first thing to do is stop digging. Looks like they have just dug in further by illegally invading somebody’s privacy and I doubt this would stand in any court of law if it was their intention.

      Button line is if the post are moral police men in this country, they should have known better about the consequencies of breaking the law

    • Just the other day, someone commented on this blog that he expected Mumembe and the Post not to write about their own troubles in their own paper. Alas, they have done exactly that! This is very unethical. This is not the Mmembe of 1991, the guy has thrown all journalist values out the window – i guess the guy had been pretending all along, now the true evil Mmembe is coming out !!

      Even if there is no law on phone hacking in Zambia, there are laws which prevents an individual without state authorisation to evade some one ‘s privacy. What Mmembe did is similar to searching some one ‘s house without a warrant. So what ever laws Zambia has will be tweaked to make sure Mmembe dances ndendeule.

      Uk also has no specific laws on phone hacking, but the country managed to nail the culprits within the remits of the existing legal frame work.

      So Mmembe is in deep sh1t because he did not only spy on Chikwanda as an individual but on a government top official. What makes Mmembe ‘s situation worse is the fact that PF managed to turn the people against him.

      Just imagine if it was HH who spied on Chikwanda,what would PF and Mmembe have done to…

    • I don’t like politicians. They are all liars. To me a political gaffe is when a politician tells the truth! I couldn’t care less if Mr Chikwanda was planning on robbing the bank or killing someone. The fact that his conversation was taped in his home as a private citizen not as a minister of finance is astoundingly criminal. I hope with all my being that The Post newspaper is brought to book on this one.

    • Ba Chikwanda’s integrity as a real UNIPist has never been on trial … when MCS appointed him Minister Of Finance, I was the first to comment here and said the smart people of the Zambian Enterprise were in for a real treat with UNIP 2.0 accelerated rate of development.

      What half-men like M’membe don’t understand is that to UNIPists like Ba Chikwanda, Zambia is greater than any single one of us. These kind are already well accomplished individuals who are in government for economic purposes.

      Ba Chikwanda’s legacy can never be shaped by the POST neither can his character be defined by minion propaganda. At over 70 years, ABC has been there done that, he and Ba Kasonde were the youngest individuals at Finance before M’membe even cut his teeth.

  1. But, it is illegal or at least utra vires too for the Minister to give instructions to ZRA, an independent statutory board!

    Mr Chikwanda is herteby challenged to instruct all the Ministers in his cabinet to publicly declare their tax returns. Let him do that and we shall see how many are tax compliant.

    • My understanding is that ZRA falls under the ministry of Finance so basically ZRA is under Chikwanda. Anything to do with revenue is under the ministry of Finance

    • Nowhere in the article does it show ABC instructing the ZRA. If anything ABC told Berlin Msiska to act professionally. This article has actually raised ABC’s credibility.
      On the other hand, I feel the Post has committed a criminal offence by bugging ABC’s house without a court order and should be prosecuted for this crime. I hope the Police will not sleep on this matter and do what they are supposed to do.
      But before that, I would advise ABC to file a formal complaint to enable the Police to move in.

    • I think if Chikwanda can be vice president to Lungu , some semblance of sanity would be restored in the PF.

      By Mmembe’s own revelations, Chikwanda is level headed person though not perfect. He is another better devil than most PF minions.

    • If some one offers you a smart phone for free pass it on other wise they can monitor your calls and your movements by installing spy apps on it.

      I suspect this is what happened to Chikwanda. I now fear that Sata’s phones including Kaseba’s are all bugged and Mmembe is listening in to their conversations with the help of kachella.

      I also think Chella was planted at state house to spy for Mmembe. I now think he is being held at ransom by Mmembe to pass on as much information to Mmembe as possible.

    • That’s a dumb comment. ABC is the Minister of Finance. He is the boss of ZRA. Even if he instructs them, he would only be discharging his duty to the nation! But if you follow his words, he is actually doing the opposite – asking them to act not because he says so but because of their own conscience – their own commitment to duty. That’s honourable!

    • Wanzelu, I agree! If we had to be subjected to another term of PF and after reading that transcript, I would rather Lungu as president and Chikwanda his vice. I particularly liked where he explained his treatment of Mahtani. He would have to chill on the borrowing though otherwise my perception of Chikwanda has changed. I was a bit touched when he stated that people thought Sata was a hard man but that he was actually too soft and people took advantage of him. To me that says Sata has never been fit to hold the presidency.

In the US or some other country where laws are applied to every person regardless of status, Mmembe would have already been visited by some cops and taken in. This is a tax evader who decides to invade a cabinet minister’s private conversation and even has the temerity to threaten to sponsor a radio replay of the same.
    How we have lost it as a country. I hope PF supporters can now see for themselves the kind of strange bedfellows they are with the Pest…sorry the POORST on.. no the Post

That said however, my concern or surprise is that this was not a telephone tapping (which is illegal as well) but a recording in someone’s home. We do not know how the recording was done but we can speculate with certainty that maybe, probably or possibly, recording gadgets have been installed in important people’s homes to record whatever they say, and if so then every important person must be concerned about all this and they are entitled to that. I hope the Editor or Editors at the Post Newspaper know the consequences of this unacceptable action. VERY UNACCEPTABLE INDEED.     • It is very easy to obtain such a recording, you don’t have to bug anyone’s home, just set your smart phone to record voice memos, hence you can move from room to room recording whatever conversation!! This use of a blantant invasion of privacy/phone hacking by a tabloid to manipulate politicians and seek favours such as Tax oligations and relief from debt from DBZ are the worst form of hypocrisy and gutter journalism. I have just lost all the little benefit of doubt I had about Mmembe and Nchito. Its actually dangerouus to have a DPP who is is in business with a manipulator like Mmembe (the same boat). It’s unfortunate,this is why even the courts of law there is no justice.police will beat you without an offence.RSTA will take you to court just because of commissions .If u deny the charge they will impound your car until the case is disposed off.What happens,u’ll be stressed and give in for a simple charge which u did not commit just because RTSA reported you and yo car will be at RTSA over 4 months.Really,there is too much malice in this country especially when it comes to law and order.Please PF help us fight injustice.This can make PF unpopular if some people start abusing the rights of people especially RTSA.Viva PF n Sata

    First it is illegal and criminal to record someone without their consent (even if you were having a legal, consensual conversation with them… It is even more criminal to obtain that information illegally via wire-tap or otherwise. So clearly M’membe and The Post have broken the law and must be prosecuted. And I can’t even believe some high court judge even allowed them play the recording in front of him.

    As for Chikwanda, yes this private conversation actually makes me like and respect this guy. I have never warmed up to this guy but after this conversation, I can only have so much respect and admiration for him. What he says on the allegedly ’incriminating’ recording is in fact what I expected this govt to be doing.

      I wonder if the people who set out to make him look bad even listened to the recording or they were just excited about the fact that they obtained the recording illegally. The only thing incriminating here is the illegal recording of a private conversation.

      I never thought I would start viewing anyone within the PF in high regard (what with all the stuff ups), but I reckon Chikwanda has changed my position.

  13. Chikwanda did actually impress some of us, with regards to his personal stance on a number of issues of national importance. He is truly state’s man. However, for Mumembe he is a lost cause.

  16. Yes, the greatest promoter of tribalism in Zambia is Fred Mmembe himself through his opinion column. Unfortunately, it has reached a situation where gullible Zambians believe the tribal trash and Mmembe is unable to reverse the ‘invasive’ seed that he sowed. In his weird ways, Mmembe thinks he can pass the tribal tag from one area to another at will – first it was the southerners, now it is the northerners – to suit his myopic business interests.

      Each time there is a change of government we do advice our leaders to invest money in innovation, invention , product design and manufacturing of high tech equipment and products,.But unfortunately it does not register in their brains because most of them still think its impossible for Zambians to design and manufacture products.

      Once in power they instead choose to spend a lot of money giving embassy jobs to their relatives at the expense of crucial developmental initiatives.

      My blood boils when hear that even simple roads and bridges which a good number of Zambians in the diaspora are busy designing and managing their constructions are still being given to foreigners to design and construct. This is corruption.

      Hjoe Moono has given a readable analysis about the violation of invading ABC’s privacy and the attempt to seek sympathy by The Post news paper that they are being victimised concerning their tax obligations. It is imperative to realise that the Post intended to injur ABC through their verbatim publication of ABC’s conversation with their spy. Now that this has backfired, ABC has come out as incorruptable vis-a-vis Mahtanis flaunting of financial regulations, a honourable man concerned about the affairs of the country, hard working and a man who respect everyone including younger people like Edgar Lungu & HH (refered to as his nephews).

    The fact that ZRA has not pursued the Posts taxes due for THREE YEARS is proof of that.

    The man is incompetent as a Minister of Finance, he has bankrupted Zambia once before, and is going to do it again with excessive borrowing.

  26. This article is exactly my thoughts including on the case of Rupert Murdoch…Mr.Chikwanda has been shown as a man with a heart for Zambians. He is truly a statesman. This has had an opposite reaction from what the post intended.In a way the post has campaigned for A.B.C without realising it.Keep up the Good work Mr.Chikwanda. You are not a pretender. I also like what he said about the S.G Edgar Lunga ati even when he is drunk he speaks sense nomba what more sober. Another good campaign for Edgar Lungu. Its now time that the Post should pay their taxes as well as DBZ for that money can help our country develop further if paid back.

  27. M’membe’s period of mourning over Kabimba isn’t over yet. It has really affected him badly. He is now acting irrationally and doing things haphazardly. Try to relax and come to terms with the reality that those grand designs to prop Kabimba as president have horribly been shattered. It’s time to move on to plan B if there is any, but it’s no use throwing tantrums and acting irresponsibly. Your actions may pave way to one of Zambia’s nice prisons.

  28. What flips my pancake about Mmembe’s lack of judgement is that his desperation has made him lose the cutting edge analysis he once appeared to have. ABC has been suing and winning. Someone will be in a deeper hole than when we started. But then again one needs to be cautious Fred is not stupid he might now just started to sing the ABC song ( Not the Jackson 5 song, I mean Alexander B. Chikwanda) sensing where the tide is going. He might have already been on the phone to ABC to start a more marketable Chikwanda project.

  29. What is more disappointing though about all this is the reaction (or lack of) from Zambians. In other countries with an enlightened citizenry, by now we could have seen massive demonstrations against The Post newspaper demanding that they pay tax and the DBZ debt. Their offices would have been picketed en masse by protesters demanding what is due to them.

    Alas, not in this country… it’s business as usual like nothing has happened. This is the money that is meant to buy medicine in hospitals. And where are those vocal NGOs who were supposed to fight for the poor? If at they were relevant they need to demand this money from The Post.

    • I beg to differ with you on this one. Mmembe managed to escape the state ‘s wrath in past all because he was the love of the people. Now the dynamics have changed indeed.

      The master dribbler Sata lured Mmembe in so that he turn him against the public. Now that most of the public have turned their back on him, the cobra and his people have started to strike him because he has no public sympathy.

      Right now he is sweating and begging Sata through Chella to plead with Chikwanda to let him of the hook. But I think the damage has been done, there is no going. Remember there is no honour amongst thieves.

    • Why Pamela alone? Don’t you think it about time each individual Zambian realized what was good for them or their country? We don’t need organizations to do the work for us. It’s our civil responsibility as citizens. If for once as Zambians we focused on what was good for our country then we will demonstrate when we see injustice. Unfortunately, we focus so much on what we lose and not what we gain even when that gain may not be seen in our lifetime. This is a Zambian responsibility not a Pamela one.

The Right to privacy is the foundation of freedom and that is why even the Executive of Government with its security responsibilities can not violate it without oversight from the Judicature in the form of a warrant. This invasion of privacy by the Post is a serious attack on the rights of all because no one can tell who else is being recorded thus introducing fear in all citizens. I would appeal to ABC to do perform an important and liberating service in the wake of the tapping of his home, namely, file a complaint at the police for criminal trespass and for breach of privacy. He should also file a civil suite against the Post and its Managing Editor. However, the best treatment for a rogue newspaper is for it to go to new management. I hope ZRA can ultimately appoint receivers.

  40. Generally Zambians have short memories resulting from partly the absence of a reading culture therefore they can only comment on the present. They have forgotten how Chiluba closed Meridien bank to fix KK and Sardanis and how RB closed Zambian Airways to fix Mmembe and Nchito. In both, innocent Zambians lost jobs and tax payer’s money. Unfortunately Sata is making the same mistake trying to close the Post to settle political scores with Mmembe. If the post closes like in the past, it’s the man on the streets who loses a job and tax payers money while politicians and share holders, move on into another comfortable life. Hjoe, I admire your attempt to analyse national issues but you need to do more research to find parallel accounts in history in order to be more critical and evaluative.

    • if I can pay my taxes, why then shouldn’t the Post??? The employees should just accept that their company is at fault & they have been caught in the crossfire – no one is immune from paying taxes or paying debts that they owe banks!!!!!

    • @kamwendo. This is exactly what @ Judy is saying “lack of a reading culture”. If you had read the original story, you would have known that the Post had offered a payment schedule which was rejected by ZRA. The post has not refused to pay the debt but are asking for more time which is normal in any business. As to why they are being asked now has made it look like political victimisation.

  41. The Post is lying. They have not been paying taxes but have been using govt revenue.
    PAYE is paid by employees. Every month I pay for K30 000. This is my money that I earned which the company deducts and remits to the ZRA. It is to my credit not th company.
    VAT is a tax on consumption paid by the end users. Businesses do NOT pay VAT. VAT is collected by businesse and paid over to the ZRA. It is to the credit of consumers.
    Dutie are equally a licence of getting goods into the country.
    The only taxes that a company pays are corporate taxes! The Post HAS NOT been paying corporate taxes for sometime now.

    Let me say that not remitting and using PAYE, NAPSA, VAT is theft!! ZRA must impose the maximum penalties.

Hon Chikwanda did not instruct but advise commissioner general ZRA to act with a conscience and professionalism by dealing with Past newspaper with a bigger tax violation than Zambeef.   45. Judy you have missed the point. Sata-n is not trying to close the post. The post newspaper has always labelled others as corrupt and immoral, the same crime they find themselves in today. To save face they are trying to fight all good and innocent people including Chikwanda. Past newspaper should not be allowed to commit crime because they employ people unless you want people on the street to survive from the proceeds of crime.
