The Ruling Patriotic Front (PF) has said that it is launching a formal complaint to the Medical Council of Zambia over the remarks made by UPND Vice President Dr. Canisius Banda so that he is made a accountable for the statement he issued at a press conference yesterday.
In a media statement in which the party addressed a number of issues, PF said that Doctors are bound to keep the confidentiality and details of any patient and that they will appeal to the Medical Council of Zambia to debar Dr. Banda for breach of these highly sacred medical ethics.
PF described the purported document UPND claims to have as not only a total fabrication concocted by people that known to celebrate illness and death, but also designed to cause scare and panic among Zambians.

SUBJECT: UPND DEAD SCARED, MASEBO IS SUSPENDED, DESPERATE AND KNEW HER FATE
It is clear that it has dawned on the United Party for National Development (UPND) and its leader Hakainde Hichilema that PF President Edgar Chagwa Lungu will win the forthcoming Presidential Elections.
The case in point is the party’s press conference recently addressed by its Vice-President Dr. Canisius Banda, which made incredible and preposterous false allegations regarding the forth-coming elections. Some of false allegations stated that:
- That Defence Force Chiefs are advising soldiers to vote for Hon. Edgar Lungu
- That foreign nationals from Congo and Rwanda have been unleashed on Southern Province to cause violence
- That the UPND has a medical report of Hon. Edgar Lungu that purport that he has kidney problems.
- That an electoral rigging scheme is underway
We wish to caution that the level of desperation demonstrated in their statement is dangerous, inflammatory, irresponsible, and defamatory and puts national security at stake.
It is regrettable that the UPND is now involving our Service Chiefs in partisan politics.
We demand that Mr. Hichilema apologizes to the Defence Forces for this irresponsible and careless statement.
We also demand that Mr. Hichilema should apologise to the Republic of Congo and to the Republic of Rwanda for his false insinuations of its nationals that might sour the harmonious relations that Zambia enjoys with these sister Republics.
On the alleged medical report circulating on social media for sometime now, it is now a proven and established fact that the said medical report is a total fabrication concocted by people that known to celebrate illness and death.
The criminal fabrication of this medical report was designed to cause scare and panic among Zambians.
However since Dr. Canisius Banda is a medical doctor by profession but has chosen to play dirty politics by issuing careless remarks, our lawyers are launching a formal complaint to the Medical Council of Zambia to hold him accountable for this statement. Doctors are bound to keep the confidentiality and details of any patient. We will appeal to the Medical Council of Zambia to debar Dr. Banda for breach of these highly sacred medical ethics.
Because the said Report is fake, and because Dr. Banda is a medical doctor, some gullible people might believe him his utterances. It is for this reason that the medical fraternity must punish Dr. Banda for his criminal conduct.
Regarding Sylvia Masebo’s utterances and endorsements, we wish to state that Masebo remains a suspended official from the Patriotic Front for her earlier acts of gross indiscipline.
Her actions are designed to pre-empt the disciplinary measures she is facing. It is for this reason that Zambians should not pay attention to such an official attempting to clean her misconduct by such an action. The Central Committee will seat, deal and resolve with her matter of indiscipline.
We therefore appeal to our supporters to remain steadfast and unshaken by these desperate antics by the UPND and its affiliates. They will become more and more desperate as we count down to January 20th 2015.
We wish to state that we have over 100 Members of Parliament from the PF, MMD and UPND campaigning in their constituencies for Hon. Edgar Lungu. We also have our party officials across the country who are also campaigning for Hon. Lungu.
Hon. Edgar Lungu is enjoying massive support across the country and public rallies he has held in Kitwe, Lusaka, Kasama, Mongu, Mpulungu, Mbala and Mungwi are a testimony to his popularity and show a very popular leader pulling crowds only comparable to President Michael Sata’s public rallies in 2011.
We should remember that Patriotic Front by its stronghold in Lusaka, Copperbelt, Luapula, Northern and Muchinga provinces, and by the support its enjoying countrywide because of its infrastructural development in roads, bridges, Hospitals, clinics, schools, colleges and Universities, will definitely sweep the election with a landslide.

I do not support what Dr Banda has said on the Medical report. It is a mistake that should not be made by such a senior Doctor.
The question is however; Is it true that Edger is sick?
If you take him to court or the Medical council, he may just prove that Edger is sick but he will be debarred and you would have both lost. But who will lose more? because Banda can be reinstated if his President were to win just like Edger got his Law license back.

It’s wrong to publish someone’s medical report. But, that is one of the issues Zambia faces today. There’s no data protection whatsoever, it is shocking to see people walking about with their medical reports and carrying those reports to their homes. Any one can get hold of an individual’s medical record,even I as a mere soul. Bottom line- put proper systems in place then all this will be avoided. I’m not aware of any data protection laws regarding patient information or the sharing of that information,do they even exist?
On another note, we need healthy leaders who can adequately represent us at international levels,not someone who when the country sends you to the United Nations,instead of delivering a speech, you are busy collapsing and calling paramedics from New York.

Where as HH has continued to engage in positive campaigns and has not attacked any individual nor used scare messages, Canicious Banda has on the other hand used the Sata method of campaigns of scare and mudslinging. Firstly EL was reported to have collapsed at State House sometime early last year whilst attending a swearing in ceremony and to which he mentioned that he had a “health condition.” The records are in public domain. He further reiterated after taking over from Kabimba that he was not interested to being president as he was not well and that he was a disciple of MCS (MHSRIP).
Kalaba should note that disclosure comes in where there is Doctor-Client relationship (EL must prove that he is a client of Dr. Banda). Hope Kalaba is one those EL intends to dispose off if he wins. Kalaba is an empty tin, a lot of noise less thinking.

UPND has got a very good chance in these elections and my advice to them is to stop campaigning on negativity like this and campaign on positive strides and hope that you would want to bring to Zambia. Imagine how many votes HH would get if he only said ‘ I understand that EL is not well but wish him quick recovery’ ? Sobriety, with due respect I disagree with you and many others. For me campaigns should have Health as the first thing on each of the political party’s campaign agenda. Why do I say so?
1. The health of a president determines the direction the country moves. In developed nations the moment an incumbent is sickly the stock markets tumble. You would tell me that here we are not advanced, and that the more reason we need a healthy president as most of the powers are reposed in him and if he is infirm the country comes to a stand still (lessons already learnt during the illness of MCS, MHSRIP).
2. The position of president requires a healthy mind to make informed decisions. Its a healthy mind, in my case, that will a correct decision rather than one which is not.
If you say that HH cannot rule Zambia, who will? Edgar Lungu who is running around like a headless chicken?
Deal with the failed doctor Canisius Banda. He ran away from his career because he failed to make the grade. He has since become a master at peddling political falsehoods!
The HH-UPND are now desperate as they see a clear loss on 20 January so they have resorted to character assassination which has now back fired on them. Really its a party of under 5s. They called themselves educated but what we are seeing is that they have coped the campaign style of the Great leader they called uneducated Sata. Well done Dr. Banda for raising concerns, backed with proof, the questionable health of Mr. Edger Lungu, as well as his copy-and-paste promises. That is to say EL would have consulted Dr Banda, that is when Dr Banda becomes bound to keep EL health record confidential!!
Doctors are bound by ethics, info coming to them by way of being direct patients or as secondary pts by correspondence or by indeed other methods – they are still bound by confidentiality – Dr’s are not simple kaponya’s who can simply claim they heard it from the grapevine – they have serious responsibility handed down to them upon taking the oath & being granted their doctorates – their CONDUCT should be above board.

Dr C. Banda is informing Zambia that there is information suggesting E Lungu’s health is not up to one holding the office of president. It is up to E. Lungu and PF to come with a clean bill of health for Lungu. Zambia,s constitution does not allow a sick person to become president and preside over national affairs. That is the more reason a medical committee can be convened to decide the health of a serving president. Zambia has been cheated before and ended up with a sickly president whose rule was by remote.
We do not need to go through it again. Why is talking about the sickness of individuals seeking public office still a taboo in our political environment? come off it, lets be progressive in our meritocracy to purify our democracy.
You are wrong about the constitution!! It doesn’t bar anyone with ill health from taking up the presidency – it is particularly silent on this aspect. What it allows for, is, if there is enough serious medical concern about an incumbent, Cabinet is allowed to convene a medical board!
Information Governance is above politics and if Dr Banda had privy info regarding the service user, mayb to his clinic (EL) or even info of EL having access to other health facilities, he can be jailed under the confidentiality act 1974 if at all this applies to individuals in Zambia.
The fact that the sick report was in a public domain through the post you will be wasting your time better let the sleeping dog lie it is a non starter.

Confidentiality is practiced in an institution more especially in a health setting such as a hospital. The are multidisciplinary group system working towards the well being of a client. Almost every one in the institution may have a role to play,e.g laboratory may do some tests on the client, domestic workers clean the room for the client in short am trying to educate the other cadre who has been saying Banda can not be liable for he was not the direct doctor. The fact remains that he is part of the multidisciplinary group. Imagine if Banda was found in a consulting room, the way he has behaved and appear(very dirty) do you think this client can even stay? No aba pa campaign will talk about my problem. Mostly I still salute nurses,they see and hear a lot more than others you will not hear.

It’s interesting reading the comments of UPND, supporters. It’s clear they see nothing wrong with the matter of Dr Banda using another candidates health as a campaign issue. As a doctor it matters not whether he treated someone personally. The issue is that as a doctor he ought to know that is unethical. He clearly understands the psychological implications of confronting a patient to divulge his illness in such a manner.
I cannot think of any time it would be appropriate for a doctor to harass a person with their medical details, and not cause distress to the individual.
As for the comments that it is important to know whether Ed is ill as a campaign issue; that’s clearly not legally required and what’s more completely irrelevant under the universal Human Rights Laws.
Everyone has a Right to Life and to preserve, protect it from any threat to it, be it physical or psychological. Also everyone has a Right to sustain their life through work, to provide Shelterto preserve that Right.
How odd it would be if people could not work or achieve their ambitions because society created Laws to prevent them reaching their lawful ambitions.

The confusion has continued? Dr Banda’s credibility comes into question at the point where he begins to waffle about PF’s attempt to rig the elections using what he alleges as ‘fading ink’, which his own party is failing to prove even from S.A where they are witnessing the printing of ballots. So anything else he says thereafter can only make sense to his devoted (rather bigoted) disciples.
