Nchito Tribunal will be open to the public

The Tribunal set up to probe allegations of misconduct by suspended Director of Public Prosecutions Mutembo Nchito will be open to the public and will start sitting on Wednesday April 1st 2015.

Tribunal Secretary Mathew Zulu said this in Lusaka.

Mr. Zulu says the tribunal will start sitting after receiving preliminary applications from the two parties.

He told TV2 news that the proceedings will be held at the Mulungushi International Conference Centre in Lusaka.

President Edgar Lungu early this month appointed a 4 man tribunal to probe Mr. Nchito’s alleged misconduct.

It is being chaired by former Chief Justice Annel Silungwe, while former Chief Justices Mathew Ngulube and Ernest Sakala are members.

Meanwhile, Prominent Lawyer Sakwiba Sikota says the caliber of individuals appointed to investigate Mr. Nchito cannot be questioned.

Mr. Sikota says any lawyer would want to appear before a tribunal chaired by former Chief Justice Annel Silungwe because of its members’ vast legal experience.

He told TV2 News that there is no need for Mr. Nchito to worry because the tribunal members have experience.

The tribunal comprises former Chief Justices Annel Silungwe, Ernest Sakala, and Matthews Ngulube and Mathew Zulu as tribunal Secretary.

    • Finally, reason has prevailed. Now, please avail us with findings from all those tribunals under Sata ‘s (mis)rule.

    • SATA was a f00l. I come from N/Western, yo Sata did nothing there. I travel often to Chingola, yo Sata did nothing for the people of Chingola. Nowander God could not allow him to stay longer and ruin everything.

    • I simply have no idea why I don’t like Mutembo. In 2006 I heard a case of Chiluba in person, which Mutembo was prosecuting, from that day to date I never liked Zambia. How could they allow such a man a abuse 4 hours, just sipping a glass of water, and asking nonsense questions. What a scam of a man. Maybe the all Zambia is a gonga, a scam of a country.
      Even that tribunal will end as an income generation project.

    • Thank God Mwanawasa died, I could have sued him for employing Mutembo Nchito. All these “abuse” was brought up Mwanawasa, even Chiluba’s money and shoes are all lost, nothing came out of it. Mwanawasa died, and Zambia have no ways to discard top criminal Mutembo.

    • I have no facts before me but I cannot believe that there was any suggestion from Government and/or Judiciary that the tribunal was going to be held in “secrecy”.
      People please “hold back” in re-vomitting the fabrications published in the Post Newspaper and it’s now sister media at ZWD lest you find yourself supporting a criminal who defrauded the nation of K14bn (your money).

    • You are very wrong. If the tribunal is very wrong, why making as open as to the public. Nchito is not sacred that he shouldn’t be questioned. If the tribunal finds him innocent, then he will be justified… So, why fear the tribunal. We want to hear his side of the story. I know M’meembe wouldn’t like this coz he knows he has huge unpaid taxes and a public debt to clear. So, he would not report well on a politician championing his business partner who is DPP. For public interest, we don’t want cartels in this country.

  1. Tribunals which never yield any results. We are still waiting for the results from the Chikopa tribunal which gobbled up a good chunk of public money. Where is the accountability in this country kanshi?

    • Stop crying over chikopa tribunal.justice is very expensive.how much did levy spent on corruption fight? Be positive even when u don’t like the government.

    • Iwe Gaby, so because LPM spent alot of money trying to fight corruption we should keep quiet about making sure that whatever tribunals are constituted provide us with results? What’s wrong with some of you Zambians? Whatever the expense is, we should should demand the final findings and recommendations of these tribunals. Getting used to mediocrity is a disease in itself.     • Mutembo didn’t fight for it! Pipo demanded for it.The tribunal should not worry you,to me its a best opportunity for him to clear himself.lets wait & see.

      You obviously don’t know what the term “in camera” means! It means that the public & press are excluded. Should I explain the meaning of the word “excluded”?
      That is why PAZA & TIZ complained. They understand what “in camera” means. The Tribunal secretary issued a statement that it would be “in camera”.
      I think Mutembo knew what was meant, that is why he wrote to complain.

  6. Robbin you must be very dull. There is a letter from Mutembo Nchito to the Chairperson of the Tribunal demading that he be tried in public. The letter is on the web site of the ZWD and it is signed by Mutembo. So who is lying. We do not believe everything writtern either on this blog or others if it not properly supported.

    • Mutembo is lying because he was responding to rumours. Where is the letter from the tribunal chairperson which suggested that the hearing was going to be in camera? Unless this is produced Mutembo was chasing the wind but it was a good chase.

    Featuring on ZNBC’s Sunday Interview on September 7, 2014, Edgar, who was then PF secretary general, Minister of Justice and Minister of Defence, told the programme anchor Grevazio Zulu that he had no intentions of seeking the Republican presidency because of his poor health:

    Grevazio Zulu: If you are given an opportunity to run for [Republican] president in an event that H.E. Michael Sata steps down due to ill-health, would you go for the presidency?

    Lungu: Grevazio, I have acted now for many times on this position of President and I tell you this position isn’t an easy one, it’s a very demanding job. I have no interest and intentions of becoming President of this country.

    We are not owned by HH or Edgar therefore free to discuss on important national issues. If you are so dull that you cannot think about issues without belonging to this or that then you should shut up

  19. Those dancing on their tails that Mutembo has been cornered are missing the bigger picture. What is going to suffer here if Lungu and his masters succeed is the Office of the DPP and the Zambian people not Mutembo Nchito.

    Some of you were crying that the President in this country is too powerful and you needed to reduce his powers. The Office of DPP in our current constitution is just as powerful and this president is going against our constitution in trying to hound out Mutembo. And instead of defending the DPP Office, you are busy throwing rocks and are so blinded because your eyes are buried deep in your backsides!

    Sata with all his faults at least tried to respect the constitution when he wanted to get ride of the former DPP. Chalwe Nchenga in my view was the worst DPP!

    Let it be know that I was against this stupidity! Mathew Nguube was a judge who fled when Mutembo was prosecuting the others people. Ask Sonny Mulenga about Ernest Sakala over the Backlays Bank case, Silungwe on Kambarage.

    It does not mean that when a person is accused, his credibility falls. Save for Justice Silungwe, accusations relating to Justice Ngulube were all calculated and a manipulation of the PAST. We cannot be stopped to gain rare wisdom inherent in these justices of rare valor just because Mmembe wants to hide his anus.
    ASK yourself: WHY IS THE CHURCH AND MAY IMMINENT ZAMBIANS NOT TALKING ABOUT ISSUES YOU HAVE RAISED. It is because Corruption Fight has lost meaning. WHY because it was manipulated by the PAST to fatten its pockets through endless prolonged adjournments

Although am an Engineer i have followed Nchito’s antics, he goes into weaknesses in laws and use them against ignorant people. Lets call a spade,a spade and not a big spoon.     • Nolle prosequi meaning “be unwilling to pursue” and amounting to “do not prosecute” does not mean the end of the road.

      So listen close! The declaration may be made because the charges cannot be proved due to very weak evidence that could make it difficult to carry the burden of proof!

      What does this tell the police? It simply means they should investigate further and come up with enough evidence to carry the burden of proof. What did the police do when Mutembo entered a Nolle in his own case? They sat on there hands because they knew what this whole shenanigan was all about.
