The matter in which special Assistant to the President for Political Affairs Kaizer Zulu was arrested for allegedly threatening former vice President, Enock Kavindele’s son, Enock Junior has been withdrawn.
In a letter dated 29th September 2015 and addressed to the Criminal Investigations Office at Woodlands Police Station, Enock Kavindele Junior said he has voluntarily withdrawn the criminal complaint against Mr. Zulu and that the two have reconciled.
Mr. Zulu was on Friday last week arrested by police at Woodlands Police Station where he was summoned to answer to allegations that he had threatened violence against Enoch Kavindele Junior.
It is alleged that Mr. Zulu in the early hours of Saturday, September 19, 2015 violently threatened Enoch, 42 and fired gunshots in the air at Chrismar Hotel after an altercation.
Isn’t this a criminal offence that is different from a civil case? Isn’t this case a crime against the state rather than just an individual who reported it? Doesn’t this mean that despite the case being withdrawn the state should still go ahead and prosecute. Legal minds please advise!
I know for a fact that if you go out and fire your gun at a tree or thin air the state will arrest and prosecute you!
I too would take the money and run. In any case Kavindele Jr. wasnt injured in the fracas. It’s now upto the state to prosecute! I only hope Kavindele Jr. will do the right thing and testify for the state.
You are spot on. Its not up to Kavindele jr to withdraw. If there is evidence, the state must proceed. But, if the complainant who should be the witness in court, withdraws, then the state would have it tough to convince the court. However, if there is other pieces of evidence like people who witnessed the shooting and bullet catridges are retrieved, why should the state not have a case to prosecute. I hear you very clearly?

Does this mean even the stolen State House documents, and all firearms in storage at Kaizer’s residence will be returned to Kaizer???

This is indeed a criminal case. The complainant is the state and not an individual – Kavindele jr. is jus a witness among others who were present at the scene. Stupid Kavindele, has he been bought??
Firing gunshots in public is dangerous and should not be condoned. This is not about the coward Kavindele Jr. who cannot stand up for what is right. If people begin to fire gunshots in public, what kind of a society are you creating?

You cannot withdraw the complaint of a felony even under asection 8 of the CPC.So this Kavindele should just do don’t kubeba and chew the money he has been evidently given and leave the rest to Lungu and his Government since he now controls the DPP as well.
This shouldn’t change anything if it does then it will be a sad development! !

justice is for the rich, my husband beat a man that used to sleep with me before i got married. When they tried to settle out of court, the police refused and said its now a state case. Talk to boma, he is in jail rgt now serving 9 months,
so how come attempted murder can be withdrawn, this is the humble lungu who follows the law.

Enoch JR has done well to withdraw the case. In the first place, JR was wrong. Anyone can react the way Kaizer reacted- you’re chilling with your lady then someone disturbs your outing, off course one can react. Kaizer is no Angle.
No need to with draw the case before it goes before the courts of law. That only goes to show that the two a both thugs.
