With new Amendments, Deputy Ministers are in office illegally- Nawakwi.

FDD President Edith Nawakwi says the office of the Deputy Minister became null and void the moment President Lungu assented to the Constitution Bill.

Speaking when she featured on Hot FM radio on Thursday, Ms Nawakwi said Deputy Ministers should vacate their offices because all officers but Deputy Ministers are provided for in the amended constitution.

“The Deputy Minister is effectively not provided for in this constitution, they are seating in our offices illegally. All the the other offices are provided for except that of the Deputy Minister. By virtue of the President signing the new Constitution, their offices became null and void, so what are they doing flying our flags and walking around as Deputy Ministers? These are some of the lacunas and problems that are sitting in a corner as if you are doing a grade 12 exam and you don’t want your friend to copy. This is public office stopping hiding things from the people,” she said.

She accused the PF of not being open about the constitution making process saying President Lungu had refused to meet stakeholders to discuss some of the clauses which have since been left out.

She said the PF had started behaving as if they are the people who started the process when it is the people of Zambia who wanted some rights to be included in the supreme law of the land.

“This is the President who vehemently refused to have any meetings or interactions whether with the church or people like me who wanted to engage them on issues of mutual interest.

“My disappointment is that my President has completely paid a blind eye to the fact that the genesis of this work was about the rights of individuals and especially the youth and women so for him to stand up and say there is no money for them to be MPs I find that totally unacceptable and completely alien to his profession as a lawyer,” she said.

She said with open consultation and dialogue some of the issues being talked about after the constitution has already been signed would not have arisen.

And Ms. Nawakwi has reiterated that the country is economically in a mess because the people entrusted with managing the country are clueless.

She said the PF have no idea on how to run a country hence the economic quagmire the country is facing adding that a government with a clue on what is needed to be done to turn the country around would not continue spending money on things which would not help bring in income.

She further wondered how a normal government would be dormant when there are some signs of drought in number of places in the country.

She said instead of waiting for the disaster government should be making preparatory works to avoid any calamities in places which will be affected by the foreseen drought.

On the Public Order Act Ms Nawakwi said police should stop inconveniencing the opposition because the new Constitution provides for parties to have preliminarily elections before the general elections.

She added that the police should not be selective in the way the apply the law adding that the PF started campaigning the day Edgar Lungu was announced as President because there are cars branded PF and Edgar Lungu for President 2016 all over the country.

    • Spot on .but if one wants to challenge it s/he has to go to constitution court which currently its none existence as the judges have nt be appointed yet.my understanding is we ar stil using the unamended docu.am sure ecl will argue that the implementation will start after elections

  6. This is all due to a failed leadership as far as the constitution making process is concerned. I even wonder whether the constitution was translated or worse still whether the translators read it. mind you the whole program was driven by the PF. We told them to legalise is but they chose to do it under the table and passed it at night while they were half asleep in order to protect Edgar Lungu. now it is biting them too. God can never be mocked.

      The Constotion is simply silent on this issue. And I suppose this was on purpose because Ministers were supposed to appointed outside parliament. They should have been professional people who need less of people like deputy ministers. Now things are left hanging….

      I once visted Kafue Gorge. If my memory of its ingenuous design is correct, I think there is potential for more power generation at the gorge. A conservative estimate of about a third of current generation is highly probable. If interested in this informed speculation, contact me for details.

    • Ba 1PLUS1. Stick to politics and not technical issues. There is no quantity in kilometre per litre in the power equation. The power equation = Efficiency of the turbine and generator x gravity (9.81m/s2) x Discharge (cubic metre per sec) x Head (m). There is no kilometre per litre in this equation. Kafue Gorge has a head or drop of 600m and KK used only 400m. So there is still 200m that can be exploited. RB launched a project to utilise this head just before the 2011 elections. This project is still on the drawing board and is referred to as Kafue Lower.

  10. Thank God for new Constitution and for President Lungu’s willingness to assent to it. Over this Constitution process I’ve learnt to respect his wisdom & intelligence despite being humble @ the same time. Previously I used to think these opposition leaders were more intelligent but I’ve been shocked by amount of ignorance on governance issues that the constitution debate by opposition leaders has revealed. Opposition leaders stop rushing to the press & embarrassing yourselves like this. President Lungu assented 2 Bills. Go & read s7(2) of Act No 1 of 2016 on validity of position of D. Ministers.

Act No. 1 of 2016 is the Constitution of Zambia Act dealing mainly with transition issues following amendment of the Constitution. It provides as follows in s7(2): “A person holding the position of Vice President, Minister, Deputy Minister shall continue to hold that position under the Constitution until the appointment is terminated by the President in accordance with the Constitution.”

  15. Apo walya mayo. our next vice president. Article 113 does not provide for deputy ministers but only ministers and provincial ministers. Can the minister of justice clarify this? Was it an oversight by the draftsmen or its a measure to reduce cost of running govt announced by EL?

    • My brother/sister please understand that there are 2 laws that facilitate the new constitution. One contains the substantive provisions which you are citing namely Art 113 and the other deals with the transition from the old constitution to the new constitution. The 1 that deals with transition issues is Act No. 1 of 2016 to facilitate an orderly switch to new constitution and avoid the anarchy that Ms Nawakwi is attempting to advocate for. It is fantasy & irresponsible to think that a switch can happen like magic @ the snap of fingers! These are state institutions that we are talking about here.

  20. So let’s get this straight… the ‘amended constitution‘ implies updates or changes were made to the current constitution. That means clauses which were there before remain the same unless they were removed, updated or changed.

    When we write technical documents, if we amend the documents, we usually give some introductory pages specifying what was amended or revised document. If the deputy minister were in the constitution and weren’t removed, they should still exist in the amended document.

    But even if they were removed, it just means the office is a non constitutional office. It doesn’t necessarily meani t is now illegal. I doubt every govt position is a constitutional office, or is it?

  26. Going by what Edith has exposed her shallow brains on the law then it means that starting from chiluba regime to date all D/ministers have been holding office illegally. The current amendments did not touch on that clause. How can the signing of the document nullify even what was not ammended.

This reminds me of Chiluba who signed a wrong statutory instruments to invoke the powers of a state of emergency only for Prof. Mvunga SC, defence lawyer, to catch the intellectual dwarf pants down for arresting people illegally. Chiluba cried foul to Dr. Chongwe accusing him of not having advised him correctly. The good old Chongwe told Chiluba it was Grade 7 Civics that the Attorney General and not Minister of Legal Affairs, was his advisor, not the minister. I can foresee this masalamusi of a constitution going the same way.

    An amendment simply means a statement that is added to or revises or improves a proposal or document (a bill or constitution etc.) So whatever has not been provided for in the amendment act remains the same in the principal act which is the constitution.

    Anyway, the good thing is that it has exposed all those nincompoops who demanded that the constitution should go to referendum without further debate as it was what the people wrote down.
