A man of Chipulukusu caused laughter in the Chipulukusu local court when he said that he could not desist having sex with another man’s wife because he enjoyed doing it with her.
This is a matter where Michael Tholosi 37, sued Peter Kalunga of the same area for compensation for adultery.
Tholosi narrated before the senior local court presiding magistrate Agness Mulenga, how his wife Helen Tholosi, at some point told him to stop being jealousy of her lover because he was the one who was providing food for the family.
He told the court that his wife, was in the habit of talking to Kalunga on phone at night and that he had on several occasions warned her to desist from talking to Kalunga but that she never heeded to his advice.
Tholosi told the court that Helen was in the habit of patronising beer drinking places in the company of Kalunga and that caused her to return home late at night every day.
The couple got married in 2008 and they have one child.
“I found them to together at the tavern and when I asked her what she was doing with Kalunga, she openly told me that she was having an affair with him and warned me not to feel jealous of their affair because Kalunga was the one who was buying food which we were eating at home and that he was the one who was feeding me,” Tholosi said.
And Kalunga admitted having had an affair with Tholosi’s wife and that they two had been having sex for a year.
He told the court that he did not know that Helen was married although he was quick to admit that he could not end their affair but continued even after learning that she was a married woman because he enjoyed having sex with her.
“I have been dating Helen for a year now. I usually have sex with her. At first I did not know that she was married, but even after learning that she was a married woman, I could not resist her because sex with her is sweet,” Kalunga said.
Helen too, admitted having been involved with Kalunga stating that they have been having sex.
The court observed that Helen was an adulterous woman who had destroyed her home with her one hands adding that she was also not trustworthy.
The court ordered Kalunga to compensate Tholosi with K6000 payable in monthly installments of K500 beginning May 27th, 2016.

why pay when sex was consensual between the two adults?
The woman was not sexually abused
Because she is married and no other man is allowed to touch her even if she is willing to be touched. I wonder why the man did not also seek divorce, with so much infections you better be with a trustworthy woman anyway!
You can see how devil is using people:
What Devil? dont blame any one for your own selfish deeds bane!
Lots of women in Ndola are on Viagra. Very crazy when it comes to sex – they like it so much!!
As usual a senseless comment from this dunderhead.
how do you know you supply them viagra olo you are hammering them?
This is very sad. Tholosi need to be careful with this so called HIV and other STIs. These two guys need to repent or else they will pay for their sin at Judgement day.
This has become very common amongst many married women especially in Lusaka…married women busy with other men who give them money and free bed nights and even days…regardless of profession age, color its all for one… one for all
meanwhile Lusaka married men like to “hizzit the skizzins” with young high school girls or college girls
See husbands are too busy caring for their families and come home too tired to last a round. So the free-from-responsibility single guys are fit enough to do the deed. It is a deeper problem than it appears. But then again I don’t believe courts should be concerned about such things anymore because it takes two to tango (and tangle). Entertain that if it is a divorce proceeding, otherwise the husband must also pay the man for services rendered where he couldn’t…
Tholosi, very sad development my brother.Just run away for your life dont even get the ZMW500.00 COMPENSATION. LEAVE THE WOMAN.
No, he shouldn’t run at all. He needs to stay. Marriage ni shipikisha club , thats what women are taught. He should stomach her adultery and continue loving her like nothing happened.
Ichalo chalufyengo until it’s on your doorstep.
Remember the story of Esau and Jocab…….you can’t sell you marital rights because of food or hunger . Food is maent for the stomach and the stomach for food, but God will distroy both one and the other. The body is not meant for immorality , but for the Lord , and the Lord for the body. 1 Cor 6:13
Marrage rights should be honoured by both partners. Unfaithfulness has grown exceeding the simple explanation. Learn from the fig tree!!!!!!!
