Former Electoral Commission of Zambia Director Dan Kalale has raised concerns over the announcement by Home Affairs Minister Davies Chama that prisoners will be allowed to vote in the August elections.
Last week, Home Affairs Minister Davies Mwila directed the ECZ to allow inmates with voters cards to vote in the forthcoming elections.
Mr Kalale said the opposition should open their eyes because the development is a clear red flag.
He accused the PF of introducing methods that even the ECZ is not aware about.
Mr Kalale also described ECZ Chairman Justice Essau Chulu as the most spineless Judge he has ever come across saying the man has no mind of his own.
Writing on his Facebook page, Mr Kalale said Justice Chulu in all details his clueless about the electoral process.
“For those that have not seen cluelessness in its physical form, just look at Essau Chulu and you would have seen it all,” Mr Kalale said.
He said under normal circumstances, the ECZ was the entity that was supposed to make the announcement about inmate being allowed to vote.
Mr Kalale said there was need for more public awareness of the change coupled with more information on the modalities of the new dimension in terms of the voting procedures.
“In any case, could it be desperation on the part of the PF government? Will the prisoners be taken to their polling stations or ECZ will create new polling stations in prison precincts by also spelling out safeguard measures put in place to counter possible manipulation?”
He added, “In my view this is not an easy undertaking that should come as by the way sort of a thing or as on the spur of the moment after thought. In case this is in the amended constitution, it still doesn’t sit well because ECZ doesn’t seem to have taken that consideration in their preparations of August 11 event.”
Mr Kalale has since challenged the ECZ to avail to the stakeholders the promulgated subsequent legislation to back up the new provision in the Amended Constitution before they effect the ‘Ministerial directive’.
“By the way it’s not everything that has been touched in the Amended Constitution that should haphazardly take effect without due diligence consideration, i.e. has the dual citizenship clause been effected?”
“If not, then why should a Minister announce that Prisoners will vote without ECZ showing preparedness of the change in the statute?”
Meanwhile, Electoral Expert Macdonald Chipenzi has stated that it is erroneous for Mr Mwila who was quoted as having said that the law existed that allows prisoners and detainees to participate in this year’s general elections to make such a public electoral blunder.
Mr Chipenzi said the directives by Mr Mwila to prisoners or detainees with voters’ cards to participate in this year’s General Elections is illegal as it is against the provisions of the Electoral Process Act No. 35 of 2016.
“Under section 47 (c) states that “a person shall not be entitled to vote at an election if that person, at the date of the election is in lawful custody or the person’s freedom of movement is restricted under any written law”. Unless this section has been deleted in the Act, the encouragement by the Minister of persons in lawful custody and whose freedom of movement has been restricted to vote in the coming elections is source of electoral confusion, problems and ultimately illegal and challengeable,” Mr Chipenzi said.
“In as much as the law pronounces innocence to a detainee until proven guilty by the courts of law, leaders must learn to respect the laws they have created. In this regard, Therefore, those who are calling for the allowing of detainees and prisoners to participate in elections whilst in lawful custody and when their freedom of movement is restricted must first take recognizance of the existing laws and advocate for their amendments.”

The debate should be based on the new constitution than personal opinion period. If those class of Zambians are protected by the same cinstitution, who are we to outlaw the constitution clause? This is why the constitution court has been set up. Take the matter there for interpretation. We can learn from the State of Virginia how they have handled a similar issue following the state Governor’s announcement.

I think that the explanation by HH to say that he picked GBM because he needed some who could soil himself, someone who is a hard worker is a serious lack of diplomacy as a leader.

Well, on Prisoners, if the new constitution allows Prisoners to vote, then this Kalale better just keep his mouth shut. If it does not, then ECZ is breaking the law and need to be taken to court. It is as simple as that.

ECZ has not yet commented on the Minister’s comment or “directive” as he wants to put it – besides, I would have loved to see Kalale quote provisions of the Constitution before unleashing insults on Judge Chulu — am I missing something? Though I do agree to most of PF development agenda in their manifesto, on this one i wish to differ. Under no circumstances a convict serving a sentence should be allowed to vote. If this is what is taking place on the ground then the constitution is been abused and undermined. In any country if you are a convict and serving a sentence in prison custody then you have forfeited your fundamental rights such as voting among other rights. This is how constitutional law works, i just hope Dan Kalale is not telling the truth otherwise this will be serious violation of constitutional and electoral code of conduct.
Dan Kalale is spot on. Justice Essau Lungu is not showing good leadership as Chairman of ECZ. The problem is that Chulu is a first cousin to RB and was appointed by Lungu on RB’s advice and based on “Wako niwako” thinking. This was done with this election in mind. So u have a comprised ECZ Chairman being given illegal directives by an illegal Minister Mr Mwila. Its an integral part of their plan to rig the elections in Lungu’s favour. The only reason Judge Chulu and Priscilla Isaacs are behaving like this is because they know there is a clause in the amended constitution that protects ECZ officials from Prosecution for any wrong doing! Interesting to hear that prisoners should be allowed to vote. Let’s do some consultations with other countries. What’s obtaining there? Do their prisoners vote? If so,what’s the main reason or reasons? In my opinion prisoners can be the easiest to manipulate, because the incumbent President can simply go to them and say “if you vote for me I will pardon you” and the opposition can say the same thing to them. That’s why it is called “incarceration”. You miss out on all opportunities of life.
But lets think about this, any voter should be well informed for them to vote wisely. When it comes to inmates voting, how are the opposition going to market themselves? Article 47 (c) under Part VI of N.A.B 35 of 2016 bars detainees from voting. However, the law is ultra-vires & needs to be challenged. Apart from the rights which the sentence carries with, eg. life, hard labour, the rest of fundamental human rights remain intact for detained person apart from those executed. Voting can still be done under prison warders escort just like they are able to attend medication clinics including hospitalisation. If the state can afford to send them to their polling stations without stressing the public coffers, there is nothing wrong about it.
