The Ruling Patriotic Front (PF) has said that it will respect the decision of the Constitutional Court Cabinet Ministers to vacate their position immediately.

In a statement made available to the media by the party’s media committee, the party said that today’s decision gives credence to a robust and independent judiciary that Zambia has where the courts can enter judgments against the state, contrary to assertions previously made by the Opposition.

Earlier today the Constitutional Court has ruled that Ministers and their Deputies are in office illegally following the dissolution of Parliament.

The Ministers and their Deputies have been ordered to pay back all the salaries and other allowances they illegally accrued.

WE RESPECT THE DECISION BY THE CONSTITUTIONAL COURT- SUNDAY CHANDA, ON BEHALF OF THE PF INFORMATION COMMITTEE

Lusaka, 8th August 2016 – His Excellency President Edgar Lungu had earlier guided that his administration would respect the decision of the Constitutional Court on this matter. In respecting the rule of law, the Patriotic Front (PF) wishes to state that it will respect the decision of the Constitutional Court. It is on record that the PF under President Lungu delivered a people-driven constitution which also establishes the constitutional court.

The constitutional court plays an important role in, among other functions, the interpretation of ambiguous clauses whenever these arise. Today’s decision therefore gives credence to a robust and independent judiciary that Zambia has where the courts can enter judgments against the state, contrary to assertions previously made by the Opposition.

This is yet another confirmation that PF trusts and respects the doctrine of separation of power as the basis of our thriving democracy and the backbone of our governance.

There may be those across the political divide who may wish to mislead the general public on many aspects not pronounced by the judgment of the Constitutional Court. Some of these vehemently opposed the enactment of the new constitution, but this is expected. In this regard, we wish to inform members of the public that the vehicles are still part of the Ministers’ benefits as such nothing changes, and that Ministers will continue to use their own facilities for campaigns.

Lastly, the Constitutional Court’s ruling confirms that President Lungu has presided over very strong independent institutions with his outstanding record in further strengthening our governance structure. He has exhibited this by delivering the first people driven constitution in 50 yrs. This constitution is the basis of the court that today has demonstrated its independence and delivered this judgement.

It’s a proud moment for any leader to see the maturity of a structure or system that has been one of the milestones of his first 18 months.

Like the constitutional court PF also has confidence in an independent electoral process and administration thereof. In this regard, we must emphasize that other political parties should commit to respecting decisions of these independent institutions such as accepting the results of 11 August 2016, when they lose.

Zambians across the divide can therefore walk with their heads high being fully persuaded that indeed we are a country of laws and not of men.

    • Opposition parliamentary candidates standing against these ministers have grounds to petition the courts if they losing in their respective constituencies.

    • (1)Let them pay every coin and petition them in the courts of law for those standing as MPs and eventually win. I see some serious issues here. It’s like getting money by pretence and after using it to accomplish your *campaign* goals you retain it back that it was just sitting idle all along. (2) Political players need to fully understand implications of the Constitutional court in a case of an electoral dispute.
      (3) This Chanda guy is behaving like a man caught committing adultery in a matrimonial bed by the wife and defending himself that it’s not really bad since he is the one who bought the bed after sleeping on the floor for many years (typical PF bully).
      Some serious issues to analyse here.

    • ECL is a lawyer and he knew that the outcome was going to be against him. If he allowed the ministers to vacate their offices, some, if not,most of them would have joined opposition. Remember the opposition boasted of the Armageddon. This I can call it a well played game by ecl.

    • Any decision, appointments these empty tins have made or put pen to paper can be challenged as its null and void…this gross incompetence of the highest order. If you are a Civil Servant and you saw your minister and his deputy making contentious decisions challenge these *****.

    • This means all those appointments, hiring, and firing, contracts, etc that these illegal Ministers appended their signatures during their illegal stay is annulled. Everything they did while in office illegally does not stand and can be contested. The implications of this are huge. The decisions made by the Defense Minister to use ZAF to ferry cadres, the decisions by Home Affairs Minister to abuse the police, The decisions and statements by the Information Minister, all these and many more should be contested and annulled and ask for PF and Edgar Lungu to pay for any costs accrued at government expense.

      Government has clarified that Cabinet will remain intact after the dissolution of parliament tomorrow until the new President is sworn. Chief Government Spokesperson Chishimba Kambwili said in an interview that the law is clear and Cabinet has to continue working.

      Dr Kambwili added that there is no contention on the matter that needs the interpretation of the Constitutional Court. He said taking the matter to the Constitutional Court will be tantamount to abuse of the court process. Dr Kambwili said Article 116(e) supports the continued stay of Ministers until a new President is elected.

      “There is no need for a debate here. The constitution in Article 116 is clear, Ministers continue until a new President is sworn in so even as Parliament dissolves, Ministers…

This HH made deals under valuing these assests and gettin heavy payback from the buyers Zambia Cold Storage Board animals were sold as cheap as K10 each Good mature haelthy animals,some surely are HH’s farm now. This HH openly admitted that those were tough days for Zambians who needed the money he was stealing, but he said he came out of that period rich and smiling. Asking this rich man called HH how he amassed his wealth, he will never explain. One journalist SABC recently asked him this question several times in one interview, but this HH never answered. Why is he failing to answer this simple question?

      If this not someone who is morally corrupt, then there is no other!!!! I would rather vote for ECL on…

This is looking more and more like a ploy by PF to establish fake legitimacy for the Constitutional Court, so that when there’s an electoral dispute, as there most likely will be,, it rules in their favour and they tell everyone that “You all saw how independent this court is when it ruled against us. We accepted the ruling, so UPND must also accept.”
    I’ve never seen such deviousness in so-called public servants.

If someone seriously investigates these illegal ministers’ bank accounts, you will find that all the money they have earned since May 12 has been safely deposited , untouched in their savings accounts just getting ready to be paid back. Zambians are waking up to a sad fact that their government for the last few money was illegal and stealing their hard earned tax payers money .This government is not different to a thief on the streets of katondo and should be treated as such .What makes more is that such illegality was promoted by Lungu a lawyer who should have been in the forefront stopping it .God help us ! Zambia has indeed gone to the dogs. Ka Chanda should be apologising to Linda Kasonde for calling her all sorts of names and using a foul language. Zambians should salute her for sticking up for what is right. As a matter of facts and principle the wages and allowances these thugs have been getting should be properly audited and taxed at the BOZ interest rates.

  40. They are planning for election petitions- accept this ruling so late – they want us to accept the ruling on the result petitions that will be delivered within a week of the results. Where is the bishops and prophets to speak the truth in love. God protected Zambia from selfish politicians.

  46. It is a good decision but too late! I just hope that our people realise the implications. What this decision means that ECL abused his powers as president and defrauded the state of resources. It’s not just the allowances and salaries, it’s also the vehicles, staff, facilities, government network and authority of office. These people campaigned using their offices and officers. God forbid what will happen if ECL wins, given this brief experience with him as president. He is a lawless president, very much unaware of the consequences of his actions. Zambia’s bigger than any of us. Long after he’s gone, there will be need to protect its peace and integrity of its systems of governance. What he’s done is undermine the systems creating a precedence which is shameful. Let’s vote wisely…

  49. I hope everybody, and I mean everybody including PF supporters and ordinary PF members and the police etc have read or heard about this decision so that they vote along with UPND members and majority Zambians for HH. The writing is on the wall – PF kuya bebele! Lungu kuya bebele!

    • Unfortunately, we have already mind up our minds to vote for PF. We will live this matter in hands of the legal institutions. When it comes to 11, we are very geared to vote for our ECL and PF. UPND has problems because its support base remain the same while ECL and PF has improved. PF unlike in the last bye elections, many voters who had voted will in the general election come out in numbers to vote for ECL.

      It is very tough indeed for HH and UPND.

  50. Edgar Lungu and the entire PF have been made to eat humble pie. This is what happens when you allow power to get to your head. The ruling has really hit the last nail on the PF’s coffin. You can see how this Chanda the Propagandist has struggled to make it appear as though the ruling has not dented the PF’s image. Mr Chanda just admit that you have been disgraced as a government; stealing from innocent Zambians in broad daylight. These ministers knew it was illegal for them to continue occupying office even after parliament was dissolved. This is greed of the worst kind; theft of public resources with impunity. All these idio.ts deserve to go to jail. PAY BACK THE MONEY

  53. It looks like Lungu has sacrificed his ministers just to convince people the courts are independent in preparation for disputed results

  55. That respect for the decision of the court will only be manifested and make sense when Government recovers all the monies paid to the illegal office bearers during their 3 month illegal stay in office. I cannot believe this is the level we have gotten to as a Country
