This is a complex case and might take months or years, the constitution says that the case should be heard in 14 days after a petition is filed in but it does not say when judgement should be passed, this might take a long time.
And should judgement be passed in 4 years from now, and Lungu is declared to have been legitimately elected, he will have to vacate office 5 years after he was declared winner meaning that he will only rule for a year.

@Nubian, selective amnesia has taken the better of you: GBM was a founding member of PF. Sata is on record stating that GBM financially and materially supported the PF.
He became a member of the inner circle when he was given a Defense portfolio, a position he gave up on principle. That move made GBM the second cabinet minister in the history of Zambia to give up ministerial post solely on principle.

Good move by Cabinet. Even if legally there is nothing wrong with proceeding with the inauguration, it is better to show respect for the Constitutional Court rather than showing disrespect for it. Give the court chance to do its work although the country is being taken backward. Up to now there is no parliament, cabinet, etc.

The petition must not be perceived as UPND project. It is for betterment of Zambia and the future. We dont want a repeat of such shameful electoral malpractices. Where ECZ Chairperson corruptly is caught on camera announcing wrong results. This so shameful very shame for Justice Chuulu. Justice Mambilima refused to baggy to such shameful acts and acted with the interest of Zambia at heart.

I think this Zambian democracy has hope if this trend of respecting the constitution continues. This is not about HH or Lungu being president or who is not supposed to be president. Both will be dead in next 52 years but the constitution will still be there. What is important is to instill the culture of following laid down procedures and rules. We are setting an example to future generations. Bulldozing situations is never a solution, otherwise Bulldozing should be enshrined in our constitution – so that it can be accepted legitimately. The losing party must with satisfaction.

Guys this not about Ecl and hh but ecz. Did ecz deliver a credible and fair election? Let the court decide, this the only way we can correct the flaws as we prepare for the next election. We cannot continue with people crying foul over every election, mazoka,sata and now hh. If we took similar steps then we could have had cleaned out the grey areas in our electrol process. @Recruit stop being dull.HH did not contest as MP but presidential candidate and so what matters is the number of votes he acrued country wide compared to what Lungu got.Its posible for someone to have more Mps and lose an election.HH won in with a wide margin in four provinces and was geting half of the votes Lungu in 5 provinces because Muchinga is too small to be called a province its just an appendage of Northern.Whilungu won in 5 by half and lost terribly in 4 provinces.Also look at the voter turn out only 50% of people voted in ECL stronghood while more than 70% of the poeple in HH’s strong hold voted.Iam Bemba lets face it HH won clean.The recount will vindicate HH.

Today the upnd have petitioned the elections. If they don’t win, they will appeal. If they don’t succeed, they will insight people to revolt against the government. I don’t think they will end this silly circus. ECL will be squized so much that in the end he will decide to use his stick against them. At that moment, sanity would be established. Thereafter, I predict confusion in upnd. Mark my word, this would be the start of the end of upnd. New members would want take over party leadership, the situation that the founder members would not take. I think I have noticed with Zambian’s that as long as the support a person or party they will support and defend that person or party even if the person is wrong. This is really wrong. If we want to move out of proverty we need to look beyond political parties and individuals. You may support PF or UPND at the end of the day will those people do the right thing once in power? If we step back from partisan politics (and tribalism!), what do we see? A failed election; missing ballots, added ballots, computer hacking, flopped referendum, budget deficits … failed.

The Con Court throws out UPND petition case on the grounds that:
– the alleged irregularities during the campaigns should have been presented
to the ECZ at that they occurred;
– it was not enough to complain through the press as that only amounted to
gossip and hearsay; and
– there cannot be a recount of spoiled ballots since the UPND representatives
had equally consented to the conclusion of them being spoiled.
BREAKING NEWS:
Following loss of the petition case, UPND fails to settle legal fees in full, the part splits with some members saying the petition was not in favour of the Party but that of the presidential candidate and his running mate and that those should therefore be the ones to pay.
The two candidates are subsequently bankrupted, and the party loses its financiers, its public credibility and support.
Frustration and disappointment in the party’s stronghold leads to violence and civil unrest but is quickly crashed by the Zambia army.
ECL is finally sworn in and life gets back to normal.
