BRANDING Constitutional Court Judges thugs and criminals by Hakainde Hichilema is the gravest assault on the Judiciary and the UPND leader should know that his conduct towards the Zambian courts is injudicious and not acceptable, Brebner Changala has charged.

And Mr Changala has said Zambian Judges should be protected from political hooligans whom he said were on the loose and on rampage of violating the sanctity of the country’s judicial system.

Mr Changala has demanded that sanctions should be taken against Mr Hichilema for his disrespect and insolence against the Judiciary which is one of the critical institutions of governance in the country.

Mr Changala, who is civil rights activist, said Mr Hichilema should be made to account for his insults against the Judges because such kind of conduct had the potential to destroy the Judiciary without which the governance of the country would be threatened.

He said Mr Hichilema was not the first neither was he the last to have lost elections and that his bitterness over the electoral defeat he suffered at the hands of President Edgar Lungu should not be extended to the Judges who presided over his failed petition to nullify the re-election of the Head of State.

Mr Changala stated that Mr Hichilema’s assault on the Judiciary which was a critical part of the governance system, and demeaning Judges to the level of reducing them to criminals should never be condoned and the UPND leader should, therefore, be condemned in the strongest terms for his unbecoming behaviour.

Mr Changala explained that Zambians had made the right decision to reject Mr Hichilema because the UPND leader was going to destroy the Judiciary had he taken over the leadership of the country.

“Destroying the Judiciary is killing the umpire of justice. Zambians must strongly condemn Mr Hichilema for insulting the Constitutional Court Judges. Zambia is bigger than individual political parties and Mr Hichilema. I am asking that there should be sanctions against the UPND leader so that we can preserve our three arms of government. Mr Hichilema must be reminded that as a man aspiring to take over the leadership of the country, he will not be able to govern if he is going to inherit a nation with a destroyed judicial system,” Mr Changala said.

Mr Changala said the phenomenon of wanting to win an election and get State power at all costs had completely blinded Mr Hichilema who he said had been of the belief that he had won the general elections and had powers to abuse institutions of governance.

He said the UPND leader had no proof whatsoever that the Constitutional Court Judges had been paid by President Lungu to lapse his petition neither did he have evidence that the Judges were nothing but a bunch of criminals.

“Ironically, Mr Hichilema is still going to the courts and will be appearing before the same Judges he has branded thugs and criminals. What sense is he making out of his attacks? How does he insist to continue appearing before the same Judges he is abusing with impunity?” Mr Changala wondered.

    • hichilema believes he is above the law. he is the criminal that swindled the zambian people and dubiously took over upnd and hang on to power without a convention. he is welcome to leave zambia because he doesn’t respect our institutions; the law enforcement, judicial and presidency all of which he has repeatedly insulted.

    • The judiciary has got itself to blame. There was an opportunity to come out clean and let justice prevail but this swept under the carpet. This will go down in history as a case that was never heard.

PF bandits like always with their vampirism of violence, even had the audacity to camped out at the High Court for a BBQ intolerable intoxication. Public nuisance is a felony!       This is utterly uncalled for and unacceotable. You cannot insult the judges merely on account of falsehood and lies, when you even avoid discussing your own petition due to lack of evidence, and in fact due to lack of a case.

    • He never used such language as criminals and thugs. Leave politicians insult anyway. The worst thing is that all zambians are politicians; including judges.

    • Judges have destroyed themselves. I have never seen such stoopidity from the courts. In future if you have an argument with somebody, just physically fight it out with guns, pangas, or stones. There’s no justice in Zambia. Lowyers and judges have ruined the Zambian justice system.

  2. UPND needs to be sober and do a self reflection. There must be a very very strong reason why ALL the major NGOs including the churches, who are certified critics of the PF have not entered or joined their fight.

    Surely, you can’t say they were all bought by PF. I don’t think the Grand-coalition of father Chiti or the so called council of Elders, with big Lungu critics like Simom Zukas and the churches, have all been paid huge money.

    And neither has the international community or donors joined UPND fight. You say that they also have been paid huge money.

    UPND needs a thorough and honest self assessment than just insult us all. There is a very clear silent message on the wall that UPND leaders need to read. Their stolen votes claim is just not resonating with anyone and…

    • The petition failed because the evidence is at heroes stadium and not in the head of upnd. They should learn to an assessment of their performance and improve rather insulting everyone who voted against them

    • The petition failed because upnd didn’t have evidence at all. If they did have evidence I repeat they could have presented it on day 10 of the petition instead of wasting our time and that of the court. HH is a crook and he has succeeded in conning all his supporters that he wasn’t given an opportunity to present his evidence. How pathetic and desperate he is for power.

After losing at the 8/11 election, he goes on to lose the prtition and all the preliminary issues, loses all the motions in the high court, and goes on to lose in the supreme court. And all cases he lost due to childishness, frivolity, lack of merit, misconceived at law. And this guy had top lawyers. I hope by now he has learnt the importance of assessing the merits of what you are fighting for before you engage lawyers, they are only humans to guide you someway but the fight is yours. Now just imagine with top lawyers on his side (Sangwa Simeza) he ends up with misconcieved suits in court!

    • HH should have stated at the beginning of the petition how many days he wanted to have the case heard seeing that the 14 days given in the Constitution was not enough to even call Maureen or Belinda or Martha to the stand. He should have said on the 20th of Aug that please judges amend the Constitution for me so that I close my case on 30th Sept.

    • You should have told your HH that he is an ordinary citizen of Zambia and he should have called witnesses to prove his case. He should have given the powers that be all the rope they needed to hang themselves. He failed to call a single witness in the time allocated now he is crying that the judges interpreted the Constitution to the letter.

    • Did you read or study the new constitution and understand the contents, don’t just say things you don’t know?? Kalusa told his impis not to take part in Constitution making process and this explains why today is in a conflict with what Zambians proposed.

  8. Fortunately for him he quicly withdrew the last one before the Concourt judge Mugeni Mulenga. I thought that was the ultimate in HH stuopidity. Surely thiscaspiring president aka Kalusa should have known that when the Concourt threw out his petition, the status quo.reverted, which is that it was as if mo petition had taken.place, and therefore the only thing remaining legally is that the president elect had been declared by ECZ. Does Kalusa need a lawyer to interpret that for him? I am left wondering what sort of businessman HH is, all the renowned successful businessmen that I know or read about are savvy in their understanding of both the law and politics. They are a disgrace to Zambian Judiciary & to all Zambians. 30 pieces of silver (K13Million) won’t last even 2 years, becoz IMF-induced inflation will come & eat it away. They can’t quickly build mansions, do serious shopping becoz pipo will point & say “thats dirty money”. Any change of Govt will end their careers.

  10. There is no rule of law in Zambia anymore. Hooliganism was started by ECL himself. He has no respect for rule of law. He has no respect for the will of people in an election. Today he is being inaugurated because he stole votes. If sanity has to materialise it has to start by resolving the theft of votes by PF. The problem is people talk as if they are talking to children. The chief law breaker is Lungu himself. Today as he is being inaugurated, the Zambia democracy is being buried. We are now going the Zimbabwe, Uganda way. Injustice at play, we are yet to see more rubbish from PF government.

  12. The Bamba tribe was historically a plunder tribe. They would wait for other surrounding tribes like Ushis, Mambwes etc. to farm & attack them shortly after harvest, targeting the Grain Storage huts.

    Fast forward 200 years, unfortunately this trait hasn’t changed. With bambas walking in the corridors of power, it’s all about self-enrichment in the form of Govt jobs & contracts. The worst part is that the population of bambas has grown 10-fold due to thriving on the Copperbelt. Democracy now favours them & this trend will be Zambia’s curse especially that millions of bambas moved from Copperbelt to Lusaka when FTJ ruled. Just go to cairo rd or intercity, unruly bambas has taken over.

    • Is President Lungu Bemba? is her honour the Veep Bemba? Your bitterness over Bembas is misplaced. Are you scared of the Ngonis or Nsengas as the case maybe and the Lozis? They are the ones holding the two top jobs in Zambia. If Bembas were tribal, they would have voted for HH/GBM since GBM is Bemba and an automatic successor of HH in case of anything.

I have also said it before and will repeat for you: imagine a presidential candidate lises an election and he even comes out number seven. He takes a petition and out goes the president of the country? Where on earth?       If the petition is contesting that the president elect did not actually obtain 50+1 of course he must step down even before a rerun.

Wait until GBM bails out of UPND then you can hear openly again their description of bembas.

As for Bemba language at bus stops most of these are not even Bemba but have just opted to use it as an easy way of communication. Just like prisoners at Katombora are mistaken as Bemba just because they speak the language by virtue of coming from copperbelt yet they could be Tongas.

  28. This so-called human rights activist!! You mean you can’t see the injustice done by the judges, or you pretend not to see? Whats wrong with some Zambians, or rather whats wrong with blacks? Isn’t it the conduct of the 3 judges which has undermined the integrity of the court? The upnd petition was an opportunity for the court to show its authority in a contest dogged by institutional collapse and growing executive impunity. Mr. Changala, you mean you cannot see the impunity of the executive, or the failure of ecz to conduct credible elections? Why should we be voting if those in power can manipulate our votes, or have we become a nation of fools? But take note of this fact: history teaches us that life has a way of sorting out crookedness. Somebody told me that Anne Sitali is actually Anne Mwewa Sitali an Ushi from Luapula Province; Mungeni Siwale Mulenga is a Namwanga from Muchinga or Northern province; Palan Mulonda is Swaka from Central Province. All these judges are Bemba speaking and HH is convinced that is why they ruled in the manner they did. Ba HH please change your mindset. These are very reasonable and rational Zambians whose judgements have nothing to do with their ethnicity.

  31. Sometimes when I read comments on social media I wonder whether Zambians read enough. Ironically the same people that we call thugs and criminals are called upon to adjudicate on our cases. The biggest letdown is the lawyers. As a layperson I see that both actions for HH failed not because of judges but because the lawyers did not know what to do. See yesterday case, the lawyers wanted a full bench 3 Supreme Court Judges but started the matter as a chamber matter which as per laws of the court meant a single judge hearing the matter. A motion would have been correct.

Its only those who benefit from the rotten system and are beneficiaries of proceeds of crime that are jubilating the unprecedented scandal orchestrated by Lungu and his minions. Zambia will not prosper and will never unite and will end up dividing when you have warped minds that believe that Tongas,Lozis, Luvales, Lundas and Kaondes can never rule, and post outrageous insults about these tribes.     • Mr Changala, I strongly urge you, as Human Rights Activist, to canvass for a preliminary inquiry into the aborted petition. Only after that should we start entertaining demands for people to be tried for contempt. If anything the Court was in contempt of itself!

  56. We need to ensure that we examine the actions of this party for the public to be sensitised on their tribal tendencies. This election was disturbing in that so many people were duped to vote for HH in growing numbers. Insulting Judges and The Office of a The Preside t should be treason and we need a legal finding against HH&Co so that thus is never repeated. Calling UPND a Political Party is like the UK calling the former IRA in Ireland a Political Party! Rightly they were Terrorists and had the integrity to call themselves that. UPND has no integrity to do so, and I believe the Zambian gov’t should not be frightened to treat UPND for what they are.     No doubt President Lungu’s legitimacy is in question no matter how one would gloss over the fact. The fact that the opposition were not given time to present their evidence will always cast a dark cloud on Lungu’s presidency.

    Having said that this constitution needs to be updated to remove inconsistencies and ambiguities. Even the Speaker handover isn’t a best solution. First a Speaker is usually a political cadre so this doesn’t eliminate bias. Then there’s a question of what happens if an president-elect is from the opposition and the petitioner is also from the opposition? Or in the last term of the incumbent in which he/she has no interest.

  58. When the CONCOURT ruled in favour of HH and LAX over the continuation of Cabinet Ministers after dissolution of Parliament there was jubilation in the opposition camp and LAZ. The CONCOURT judges were praised by HH. When HH failed to commence prosecution of the declaration of ECL as president-elect and IMW as vice-president elect while concentration was on filing and modifications on the filings forgetting that time was running out without presenting evidence for judges to act ending up with a thrown out case the same HH called the CONCOURT judges all sorts of names. Double standards??????
