Fred M’membe Speaks out, accuse President Lungu and Government of trying to Liquidate the Post Newspaper

Post Newspaper Limited Managing Director and Editor in Chief Fred M’membe has accused President Edgar Lungu his Government of being on crusade to shut down all independent media houses by their attempt to liquidate Post Newspapers Limited using their surrogates.

In a hard hitting statement, Mr M’membe said the the former employees of Post Newspapers are now being used to try and achieve the government’s goal of annihilating the company because the Post Newspaper has a strong stance to educate the masses on government corruption and abuse.

Mr M’membe said that the former employees have been used to file a petition for liquidation on the basis that they are owed money by the company.

“All the claimants resigned from Post Newspapers on their own. None of them has lodged any claims with the company. It is therefore strange that people who resigned and never demanded anything on their resignation can now be used to try and liquidate the company. Where is their claim so that the company can respond to it?”

STATEMENT ON ATTEMPTS TO LIQUIDATE THE POST ISSUED BY FRED M’MEMBE, MANAGING DIRECTOR AND EDITOR-IN-CHIEF

President Lungu and his government have continued their crusade to shut down all independent media houses by their attempt to liquidate Post Newspapers Limited using their surrogates.

This does not surprise us, although it saddens us, because of its impact on our democracy and on the thousands of people whose livelihood has been taken away by this crusade to shut down the newspaper.

The Zambia Revenue Authority was first used in this crusade. It appears that President Lungu is now attempting to use the courts in this crusade. We are hoping that he has not found willing facilitators in this very important institution.

Our concerns are borne by the fact that the courts have issued an order to liquidate the newspaper without those who are claiming money from the institution proving that they are indeed owed money. In fact, at no time have any former employees ever claimed any money from Post Newspapers nor has any court decided that Post owes employees money.

We fully sympathize with the employees who are simply being used by the same government that has occasioned them misery by taking away their means of livelihood.

The impunity being exercised by government is shocking. ZRA have gone to the extent of disregarding court orders to keep the company’s premises closed. The Tax Appeals Tribunal has ordered ZRA to open the company’s premises but they have simply ignored the Tribunal. Why is ZRA behaving in this way?

It is because they are acting on the instructions and protection of the government.

In relation to the latest developments, the government has employed a few former Post employees.

As intimated above, these former employees of Post Newspapers are now being used to try and achieve the government’s goal of annihilating the company because of its stance to educate the masses on government corruption and abuse.

The former employees have been used to file a petition for liquidation on the basis that they are owed money by the company. All the claimants resigned from Post Newspapers on their own. None of them has lodged any claims with the company. It is therefore strange that people who resigned and never demanded anything on their resignation can now be used to try and liquidate the company.

Where is their claim so that the company can respond to it?

Why are they avoiding giving the company simple demand?

This whole process is flawed. Mr Lewis Mosho, the person appointed as provisional liquidator, is being used by the government and he is unlikely to follow the law.
Mosho’s corruption, in collusion with those in government, was exposed by The Post.

The corrupt in government have now regrouped to annihilate the only means that had been available to expose their corruption. With The Post gone, Lewis Mosho, Edgar Lungu and those determined to loot government coffers, can now loot with impunity.

We remain hopeful that the Judiciary can still rise to the occasion and save this country from the state capture that has been waged by a few determined corrupt individuals. But our optimism is tempered by caution because of what we know about some of these judges and the information we continue to collect about their collusion.

At an opportune time, all will be laid bare.

For now, President Lungu and his government, through Mosho and other corrupt facilitators, are creating the conditions for corruption on a scale unseen without question. With corruption comes dictatorship and vice versa. After The Post, who will be next?

The moment Edgar Chapona Lungu stepped the corridors of statehouse, Zambia kissed goodbye to her democracy no wonder Mu7 and Mugabe have been the most respected leaders in Edgars regime when they’re the most useless heads of state Africa has ever produced after Idi Amin

    • Don’t like lungu at all, but if I pay Tax and an institution somewhat wants to find a way of avoiding paying tax, you have never leg to stand on.

      Even here in Europe companies find a way of paying tax by actually paying it albeit in a way they see fit by migrating to certain tax haven areas. They do pay tax the whole lot but find a way of not paying quiet enough tax. The post pretty much don’t.

      Post have an insurmountable tax bill for years, if they ahent been able to pay then, they won’t pay ever.

      Also, they are not quite as relevant now as they would have been prior to online news sites.

      Unfortunately, they have to go under and they get my blessing. Fred I know you read this as we talked ( 2009 was it?)a few years ago and sorry I am no on your side anymore…

      I love freedom of the press but responsible reporting is important. It is the intricate mix of hatred and manipulation for personal gain that l disagree with and with the post the latter that was the case . little wonder very few people are sad even fewer will be happy when you succeed. The moral lesson? Never be personal when you can be professional!

He vuvuzelad Sata and even refused to ‘dig shallow’ to tell the country that Sata was ill. Up to the last minute, the paper that ‘digs deeper’ kept burying the news while it was working in dark corners to set up another surrogate President. All the scheming failed and now we are back to Lungu this, Lungu that. What legitimacy has the Post to talk against corruption when it was protected by corrupt politicians and is now hiding behind its own hand picked judges not to pay its dues?

We are all human beings so is Fred,we are all bound to make mistakes and Fred has never claimed to be perfect, he has on many occasions admitted his flaws without justifying any of them.He has certainly contributed positively to the well being of mother Zambia a million times more than what most of you critics will ever dream of contributing even in your wildest dreams.

I don’t agree with most of the comments – the whole post saga is masterminded by Lungu to completely annihilate the free press – by the way, how about all the institutions including ZNBC, Zambia Railways Daily Nation etc, etc who owe ZRA money – are they exempt from paying taxes? Anyway, for me, I have never & will never defend despots like Lungu – that’s the more reason, this nation is heading nowhere with Edward at the helm no matter what u can say or think- that’s why I have a strong feeling that Zambia will end up the Zimbabwe way with all these revelations about the true state of the economy from the mouth of Mutati & off course of recent the IMF-& talking about the IMF & other donors, I doubt if they will fund this govt.     • Most people know that Lungu has fixed Mmembe and his PFost using ZRA. That’s not in contention. What people are saying is that this is only possible because PF is in power and that Mmembe supported PF in 2011. Lungu is doing what he is doing for his own survival. But if Sata had not become President in 2011, and Sata in his dying days had not left Lungu as Acting President, Lungu would not have become President who subsequently shut down the PFost. Lungu will be Lungu but Mmembe made a huge mistake with Sata and PF in 2011.

To begin with, tax evasion is a crime and all tax evaders must be jailed. You contribute to hunger when you evade tax, you deprive the country of the much needed resources for development.   39. Fred MMembe HH and GBM are not clever individuals. ECL is the same as he used to but he is insulated by the office of the President. Just like you Fred you have been insulated by the Incorporation of the POST except that the rules governing Incorporation and rules governing Presidency are different.   47. I disagree with all those assertions that Mmembe got what he deserved. How can laws be applied selectively and be considered right? He is a victim of political thuggery and abuse of power. Sadly many Zambia only try to see the surface of an issue. Press supporting preferred candidates is not an offence under Zambian law. The here is whether the country gains out of shutting down an important means for leverage by those discontented with government. Will they get back the millions owed by shutting the post? The answer’s no. Why kill the goose then? This issue will haunt ICL forever. It’ll be a terrible precedent for our country.
