Professor Luo who is also Higher Education Minister has directed her lawyers to immediately appeal the decision of the Lusaka High Court that nullified her seat.
The Lusaka High Court Judge Edward Musona this morning overturned the election victory of Munali PF Member of Parliament Nkandu Luo.
Professor Luo has also directed that lawyers obtain a stay of execution to stay the decision of the Court.
Judge Musona cited electoral irregularities and rampant acts of violence as reason for nullification of the Munali seat.
Judge Musona nullified the election on grounds that the ECZ failed officials to properly handle the electoral process and did not provide the Gen 12 forms to 14 polling stations in the constituency.
Judge Musona ruled that Prof Luo had an undue advantage in the election because she was a serving Minister at the time of election and used public resources especially that the Constitutional Court had ruled Ministers pay back to the treasury the monies they had accrued during that period.
Professor Luo retained the seat after polling 38, 356 votes while UPND’s Doreen Mwamba came second with 24, 207 votes.
Professor Luo was declared winner by Munali Constituency Returning Officer, Emmanuel Makulila.

Dear Idyot, the Kangaroo Court did not have to rule on your question. The matter before the court was something else, whether it was legal for Ministers to continue after dissolution of Parliament.

By the way, for your own information, the term Professor is for a university teacher and is conferred upon a person by a university while a Ph.D…well under normal circumstances you study to contribute some knowledge to a specific sphere and you get it and die with it, but professor? This Judge Musona has set a precedent. Good or bad doesn’t matter. In his ruling he cites that Luo had an unfair advantage since she was a serving Minister at the time of elections. This means that all those Ministers who ‘won’ the elections and were serving Minister should also lose their seats. Wapya Munzi.
It also means ECL as serving president had unfair advantage. We all saw him flying left right ,centre of Zambia using Government resources. Meanwhile he was blocking UPND chopper to land. He even sent people to stone our chopper. He blocked us from accessing the press, especially ZNBC . Dr Chishimba Kambwili is our witness. All MPs who were “elected ” and abused state resources to their advantage should actually resign.

Judge Musona has stood out among the judges. He’s actually challenged the executive itself (whether his judgement is right is another matter). How I wish we had just 3 more zambians like him.

Lungu has destroyed this country called Zambia. He is controlling the Judiciary, ECZ, Police, Media, ACC Defence etc. Why can’t he let these organisations to run independently? While Madam Luo has a right to appeal what are her grounds of appeal to Concourt? Concourt made the judgment of Ministers staying in office illegally. So Madam Luo cannot dispute that she used state resources to campaign. In all Lusaka Urban constituencies Gen12 forms were not provided by ECZ . Just on these two accounts it will be difficult to reverse the verdict on appeal. Presidential election results are doubtful for the same reasons given by Justice Musona. All former Ministers in Lusaka Urban will suffer the same fate if our judges are professional and consistent. Prof Luo has made a bad precedence for all MPs and former Ministers who used state resources for their campaigns.
WHILE WE COMMEND JUDGE MUSONA’S PROFESSIONAL CONDUCT, ITS PERCEIVED THAT THE RULING WON’T BE UPHELD BY THE SUPREME COURT SIMPLY BECAUSE THE CORRUPT CHIEF JUSTICE MAMBILIMA IS NKANDU LUO’S AUNT.. PERIOD
