The ruling Patriotic Front (PF) says it will now take Law Association of Zambia (LAZ) President Linda Kasonde as a political opponent.

PF Secretary General Davies Mwila told Journalists in Lusaka that because of Ms Kasonde’s interest in politics, the ruling party has no option but to treat her as a political enemy.

Mr. Mwila says it is very clear that the LAZ President has been supporting the opposition UPND and that is the more reason the party will now treat her as an opponent in politics.

He said the judiciary should also be criticized when it makes certain decisions just like the Presidency in Zambia is criticized.

He said the PF has on several occasions assured the nation that it will not interfere in the operations of the judiciary but that when it does something wrong the party and stakeholders are free to criticize.

Early this week the Law Association of Zambia strongly condemned State House Special Assistant for Press and Public Relations, Amos Chanda’s recent attacks on the judiciary.

LAZ president Linda Kasonde said the statements by Special assistant to the president Amos Chanda appeared to suggest that any judgement against a Member of Parliament from the ruling party was not in the interests of justice. The statements went further to suggest that there would be repercussions against any Judge that rules against a ruling party Member of Parliament.

Ms Kasonde said the threatening comments by Mr. Chanda such as that the Judiciary “must not be like politicians” and “must not push the Executive to push judicial reforms [in] the Kenya style” were unacceptable and contemptuous.

Last week the Lusaka High Court nullified the parliamentary election of Minister of Commerce, Trade and Industry, Margaret Mwanakatwe as PF’s Member of Parliament for Lusaka Central Constituency in Lusaka Province and Minister of Higher Education,Professor Nkandu Luo as Member of Parliament for Munali Constituency in Lusaka Province.This was not well received by the Patriotic Front prompting the comments by Mr.Chanda.

      I can’t agree with you more bwana PF SG. LAZ is just an association of lawyers with a possibility of swearing allegiance to some party or just getting compromised. The fact that LAZ is just but grouping of people called lawyers, they can err in ops and deeds. Since PF is a political club and LAZ is a club for lawyers, you can point fingers at each other.
      My heart shudders when you begin to entangle Government in this context Mama Mambilimas Judiciary and ECL’s executive or Matibini’s Parley in some kind of fight. Here we may have issues.

Anyway, it’s inconceivable to expect a semi-illiterate ape like Mwila still in the process of evolving to Homosapien to understand the concept of separation of powers and why the judiciary cannot be subject to malicious accusations. It’s for that reason that literally every judge can be in the executive or parliament but not all the chaps in the executive and parliament can be in the judiciary.   18. If PF expected LAZ to follow blindly, then PF is in for a rude shock. All national and international law societies issue statements that defend democratic values. This generally corresponds to expressing view that are critical of government civil excesses and criminal conduct. Criticizing judges as the judicature using TV by government officials can not be condoned by law societies. Or are we suggesting that the judges must be provided same space same time to respond? That is wrong. The rightful respondent is LAZ.

      I listened to Amos Chanda’s the Sunday Interview twice and also listened to HH’s tirade against the Concourt judges when he called them thugs and criminals. I found what Amos Chanda said about the judiciary much less threatening and intimidating than HH’s tirade against the judges. Imagine what was going to happen to these judges had HH won. What was he going to do to judges he considered to be thugs and criminals? Retain them on the bench or put them before a firing squad – Ghanaian style? Let us learn to be objective and just a trifle more analytical and less blinded by partisan emotions.

      HH spoke as an aggrieved party, Amos Chanda as a member of the Executive branch of government. That is the difference. Amos Chanda was speaking from a position of authority, as a member of the Executive, to threaten the Judiciary. Do you see the point? The relationship between the Executive, the Legislative and the Judiciary is clearly defined by law. It’s what provides the much touted, and yet, often least adhered to, checks and balances, within a government system. Amos Chanda spoke as though oblivious to this cardinal reality. Shame on him. He is too ignorant to be a government spokesperson.

Even if he was, however, the fact is that, Linda Kasonde, as President of LAZ is not obligated to comment on each and every court incidence. It seems Amos Chanda’s statement is a planned and ochastrated strategy at the highest political level and is meant to intimidate the whole judiciary by the PF. Some of us remember 1967 when the chief justice James Skinner had to resign for similar circumstances when Kaunda made similar statement that Amos made. UNIP vigilantes ( cadres ) were mobilised and destroyed one of the the lion statutes at supreme court. Justice since then has never been the same in Zambia excerpt for few occasional brave judges such Judge Musumali who had the courage to convict Kambarage Kaunda for shooting an innocent girl.   64. Linda Has clearly shown that she is supporting UPND and the simple reason is that she remained mute when HH was castigating the con-court judges. A wise councilor is not expected to take sides. Linda learn something from the recent post election state of affairs and align yourself.
