PF to treat Linda Kasonde as a political enemy

PF Secretary General Davies Mwila

The ruling Patriotic Front (PF) says it will now take Law Association of Zambia (LAZ) President Linda Kasonde as a political opponent.

PF Secretary General Davies Mwila told Journalists in Lusaka that because of Ms Kasonde’s interest in politics, the ruling party has no option but to treat her as a political enemy.

Mr. Mwila says it is very clear that the LAZ President has been supporting the opposition UPND and that is the more reason the party will now treat her as an opponent in politics.

He said the judiciary should also be criticized when it makes certain decisions just like the Presidency in Zambia is criticized.

He said the PF has on several occasions assured the nation that it will not interfere in the operations of the judiciary but that when it does something wrong the party and stakeholders are free to criticize.

Early this week the Law Association of Zambia strongly condemned State House Special Assistant for Press and Public Relations, Amos Chanda’s recent attacks on the judiciary.

LAZ president Linda Kasonde said the statements by Special assistant to the president Amos Chanda appeared to suggest that any judgement against a Member of Parliament from the ruling party was not in the interests of justice. The statements went further to suggest that there would be repercussions against any Judge that rules against a ruling party Member of Parliament.

Ms Kasonde said the threatening comments by Mr. Chanda such as that the Judiciary “must not be like politicians” and “must not push the Executive to push judicial reforms [in] the Kenya style” were unacceptable and contemptuous.

Last week the Lusaka High Court nullified the parliamentary election of Minister of Commerce, Trade and Industry, Margaret Mwanakatwe as PF’s Member of Parliament for Lusaka Central Constituency in Lusaka Province and Minister of Higher Education,Professor Nkandu Luo as Member of Parliament for Munali Constituency in Lusaka Province. This was not well received by the Patriotic Front prompting the comments by Mr.Chanda.

    • Shallow thinking from both Linda and PF sec G. This is not good guidance to followers of the party. Why not ignore her for the few months remaining before her term expires? 2021 is not far for pf to start engaging into fights with young politicians.

    • WELL SAID SG BUT POINT OF CORRECTION: LETS BE CLEAR HERE – NOW TREAT LAZ AS JUST A SOCIAL GROUPING, LAZ IS NOT THE JUDICIARY
      =====================================
I can’t agree with you more bwana PF SG. LAZ is just an association of lawyers with a possibility of swearing allegiance to some party or just getting compromised. The fact that LAZ is just but grouping of people called lawyers, they can err in ops and deeds. Since PF is a political club and LAZ is a club for lawyers, you can point fingers at each other.
My heart shudders when you begin to entangle Government in this context Mama Mambilimas Judiciary and ECL’s executive or Matibini’s Parley in some kind of fight. Here we may have issues.

    • Repercussions for the judges for following their constitutional role? Seems Mwila, Chanda and their fellow fascist goons are working hard at trying to turn this country into a full blown dictatorship. The Judicially is supposed to be independent of the Executive. That’s how you maintain balance of power and proper checks and balances. But these clowns are busy trying to turn our country into a one party totalitarian state. What the heck is wrong with these people? And you don’t refer to political opponents as ‘enemies.” Just because someone holds a different political view from yours doesn’t mean he or she is your “enemy.” It’s this kind of thinking and inflammatory language that leads to endless wars and bloodshed in Africa. Shame on you.

      Linda has double standards.

During the failed and expired presidential petition she wanted to influence the direction of the case by wanting to join the case by calling herself and some LAZ friends of hers as friends of the court. Who told her she is a friend of the court?

When she was denied her request HH and UPND openly and unashamedly complained bitterly citing the court as being biased – no psychology ba UPND. The never complained; So Linda is friend of who, court or UPND?

  2. Ala, is Davies Mwila not the former defence minister who lost his job because he does not have a grade 12/Form 5 certificate so got barred by the new constitution for little education! Anyway, it’s inconceivable to expect a semi-illiterate ape like Mwila still in the process of evolving to Homosapien to understand the concept of separation of powers and why the judiciary cannot be subject to malicious accusations. It’s for that reason that literally every judge can be in the executive or parliament but not all the chaps in the executive and parliament can be in the judiciary. It’s like Mwila himself, he is a notorious chikopo number 1, even imagining him as a judge gives one the creeps.

  4. The PF thugs should learn to pick their fights. That Ka Edgar has claimed to be a lawyer knows better that LAZ is not a political party. That Edgar needs to tame this Mwila- Monkey.

Better stick to fighting HH & GBM

  5. Munshebwa aile namashinshya kuli babuko. Under PF, there shall never be a thing like constructive criticism otherwise, its all hostility from opposition. The problem with you guys is that you are TOO DEFENSIVE more because you consider yourselves as Mr hollier than thou and know it all. You are supper humans next to God who never make mistakes. This makes many of us conclude there are a lot wrong with you. Every time your defending yourselves from someone, blame others for your failures, threatening civil servants with dismissals, suspending and or even closing some news media over opposing views. We leaved in peace under the MMD and the core reason we voted for change was to improve on MMDs good performance and not to live under your vipers poison.

  6. If PF expected LAZ to follow blindly, then PF is in for a rude shock. All national and international law societies issue statements that defend democratic values. This generally corresponds to expressing view that are critical of government civil excesses and criminal conduct. Criticizing judges as the judicature using TV by government officials can not be condoned by law societies. Or are we suggesting that the judges must be provided same space same time to respond? That is wrong. The rightful respondent is LAZ.

    • Meimatungu and other like-minded bloggers,

I listened to Amos Chanda’s the Sunday Interview twice and also listened to HH’s tirade against the Concourt judges when he called them thugs and criminals. I found what Amos Chanda said about the judiciary much less threatening and intimidating than HH’s tirade against the judges. Imagine what was going to happen to these judges had HH won. What was he going to do to judges he considered to be thugs and criminals? Retain them on the bench or put them before a firing squad – Ghanaian style? Let us learn to be objective and just a trifle more analytical and less blinded by partisan emotions.

    • @22.1 Stringer

HH spoke as an aggrieved party, Amos Chanda as a member of the Executive branch of government. That is the difference. Amos Chanda was speaking from a position of authority, as a member of the Executive, to threaten the Judiciary. Do you see the point? The relationship between the Executive, the Legislative and the Judiciary is clearly defined by law. It’s what provides the much touted, and yet, often least adhered to, checks and balances, within a government system. Amos Chanda spoke as though oblivious to this cardinal reality. Shame on him. He is too ignorant to be a government spokesperson.

    • And was it in order for Linda Kasonde and LAZ not to censure HH when he was clearly contemptuous of the bench?

    • 22.3 Stringer

To your question: “What do you think he was going to do to a judiciary populated by thugs and criminals?” here is my response – what HH was going to do, can, as of now, be only presumed. We don’t know. What you are doing is to use a barren method of wit to fill-in the blanks. Do you see how utterly unequivocal that is? If you see someone fall from a tree, do you immediately jump to the conclusion that he is going to sustain a broken spinal cord? Don’t you wait for the X-ray results instead?

      0

      0
    • @22.4 Stringer

I am not sure you have any proof that HH was “clearly contemptuous of the bench”? Even if he was, however, the fact is that, Linda Kasonde, as President of LAZ is not obligated to comment on each and every court incidence. It was the gravity of this particular issue involving your beloved “Amos Chanda” that compelled her to intervene; and that, justifiably so.

  9. WHY IS IT THAT THE PF DOESN’T UNDERSTAND THAT JUST BECAUSE ONE DISAGREES WITH THEM DOESN’T NOT AUTOMATICALLY MAKE THEM AN ENEMY? SECONDLY NO ONE SUGGESTED THE PF DOESN’T HAVE THE RIGHT TO CRITICIZE THE JUDICIARY OR THE JUDGEMENTS AGAINST THEM. THEY HAVE THE RIGHT TO DO THAT ALL DAY EVERY DAY AND TWICE ON SUNDAY. ITS THE THREATENING OF THE JUDICIARY WITH ACTION THAT CAN BE INTERPRETED AS PUNITIVE THAT WE ARE CONDEMNING. ONCE AGAIN TO CHANDA, CHANDA AND MWILA PLEASE LEAVE KASONDE TO DO HER JOB SHE WAS RIGHT!!! THESE GUYS ARE JUST IRKED BECAUSE A STRONG AND EDUCATED WOMAN IS STANDING UP TO THEM. THATS THE REAL ISSUE HERE. THEY CAN’T STAND THE FACT THAT KASONDE A WOMAN CAN PUT THEM IN THEIR PLACE!!!!!!!

I still do not understand this woman. Please where was she when HH set an on slaught on the judges,in a manner that was very demeaning and accusing? Her inconsistencies in issuance of statements had exposed herself.Judges were directly accused of receiving money;that they were not worth the gowns they wear, etc.Where was she? Compare HH’s statements to Amos’,who spoke very demeaning and nauseating statements over the judiciary? This woman has handsomely been paid.Thats why there are calls another Law association because this woman has sold off her integrity, foolishly!!!

She’s expressing the views of the Law Association of Zambia.LAZ is simply condemning what is wrong. Amos Chanda was wrong to attack the Judiciary in that way.The opposition should also start treating Amos as a politician and PF member.

Please we know that you wanted your HH but it was not Mwila’s fault that he did not win. The way you behave I don’t think your HH will ever win due to your behavior and full of hate, you are the ones contributing to his down fall. Behave so that voters can feel remorse for you. This is free advice UPND take it or leave it, since nimwe ba chumbu mushololwa.

THIS IS ABOUT THE ATTEMPT TO THREATEN THE JUDICIARY AND THE UNWARRANTED VILIFICATION OF KASONDE BY SOME SENIOR PF OFFICIALS. THAT IS NOT RIGHT REGARDLESS OF WHAT PARTY ONE SYMPATHIZES WITH. It seems Amos Chanda’s statement is a planned and ochastrated strategy at the highest political level and is meant to intimidate the whole judiciary by the PF. Some of us remember 1967 when the chief justice James Skinner had to resign for similar circumstances when Kaunda made similar statement that Amos made. UNIP vigilantes ( cadres ) were mobilised and destroyed one of the the lion statutes at supreme court. Justice since then has never been the same in Zambia excerpt for few occasional brave judges such Judge Musumali who had the courage to convict Kambarage Kaunda for shooting an innocent girl. This rubbish started a long time ago – this is now crowning time! We failed to escape it in 1991. It is happening!!! Just like that! Let me start by saying that the latest attacks on the judiciary and the Law Association of Zambia by the PF is the most eccentric way in the recent past. Mr. Davies Mwila who is also Chipili Constituency losing candidate in the last elections has exhibited bitterness and lack of leadership in the manner he has threatened a harmless woman who is simply doing her job. 37. Comment when HH & GBM Criticised the concourt judges and called them names where was Linda Kasonde? She was quiet why? If she has some political ambitions, let her resign as Laz President and join Politics, rather than play hide & seek

The Judiciary can, should and must be criticised. AMOS CHANDA did not critise the Judiciary he THREATHEND the IT, how unwise of him. People study read the ‘Kenya Judicial Reforms’ AC reffered to.
WHY IS THE PF DEFENDING A CIVIL SERVANT? by so doing you adding more credence to LAZ Pres LK’s observations!
Am sure PF misses of the days they had a PF Cadre in Musa as LAZ president, well, not this time.

  41. Linda Has clearly shown that she is supporting UPND and the simple reason is that she remained mute when HH was castigating the con-court judges. A wise councilor is not expected to take sides. Linda learn something from the recent post election state of affairs and align yourself.
