The Law Association of Zambia (LAZ) has appointed Lusaka lawyer Musa Mwenye to represent lawyer Nchima Nchito in his personification case.
Mr Nchito who is in court on a charge of personating a Post Newspapers in liquidation lawyer and has denied the charge.
A warrant of arrest had been invoked by the Lusaka Magistrate Court with Nchito successfully appealing for its quashing on account of it being unnecessary.
Lawyer Mr Mwenye took the stand in defence of Nchito on instruction from LAZ.
Mr Nchito is the lawyer for Fred M’membe’s Post Newspapers in liquidation but liquidator Lewis Mosho has been insisting that the lawyer’s services were terminated once the liquidator took over.
Magistrate Greenwell Malumani adjourned the matter to April 3, 2017 for hearing.
LAZ president Linda Kasonde was in attendance alongside former Director of Public Prosecution Mutembo Nchito.
Mr Nchito has been caught up in crossfire given the Post Newspapers in liquidation’s long standing battles with tax authorities that the defunct publication allege is politically motivated.
The defence team led by lawyer Rabson Malipenga opposed LAZ’s appointing of a lawyer to defend Mr Nchito saying it was outside their mandate but Magistrate Malumani passed it saying the law was not categorical.

This is proof that if you are poor and a nobody, you will never get justice. There are hundreds of people languishing in Zambian jails who have innocent but do not have LAZ on their side. Nchito has enough money and ability to engage a lawyer or even to defend himself. What has LAZ got to do with this? If LAZ fears that there may be an injustice, why THIS case?

My uncle died at the age of 90plus for having no representation for smoking cannabis!He went in for 3 damn years! Life!
So LAZ is also a law firm? When a lot of poor people are suffering to find money to pay lawyers to represent them why can’t LAZ help than helping people who are already rich lastly who is paying for those services? can it be HH and GBV?
Did Nchito give instructions to LAZ or what ? I am a bit bemused here I thought his young fat desk lawyer ex-dpp and his young sister current laz honorary secretary where partners in their family tree law firm can ably defend him or could be they are lawyers who are wanting at law…so laz will pay Musa legal fees? Musa will render bills or is this ‘pro bono’ for a lawyer who can afford the fees he charges ordinary citizens?

LAZ has a responsibility of taking care of its members (of LAZ) and especially with cooked up charges organised by our beloved President Lungu in the background and pretending not to be the one calling the shots. LAZ knows that the Post Agreed to pay TAX the way everyone else does in installments but under the instructions from President Lungu ZRA refused to accept TAX payments from the post to insure they closed the post. Receipts from their previous payment was there at the current time when they were being closed. Of course the DPP will successfully appeal the ruling to the High court on grounds that LAZ represents a diverse membership some of whom sympathise with Nchima Nchito and Mmembe and others do not. The High court will ask if LAZ polled its members or reached a consensus to take up this cost on behalf of its diverse membership? This is the ultimate embarrassment of the legal profession!
This LAZ seems to come up against the gov’t in nearly all matters. Who appointed Kasonde? Is she not biting the hand that feeds her?
It’s not enough for Linda Kasonde to use her “powers”, she has to show that a resolution was passed by LAZ Council or membership.

LAZ is okay. There has been so much harassment of those who seem to oppose the PF. The mosho guy is appointed to fix Mmembe to settle scores since the post disclosed his shoprite dealings. Honestly speaking, even a 10 year old can see that these happenings have their origin in politics. LAZ is merely trying to help it’s members who are being mistreated by the govt. This is 100% acceptable.

Bloggers forget political alliances, look at this as a legal matter that has be addressed. Is this case not a matter of principle. Is the POST liquidated, if not then maybe the directors are still legally directors and responsible until such time the company is liquidated,wound up.. Can anybody clarify for me please
Good move by LAZ. You could go further by freely representing all those POLITICAL prisoners in our jails. While you are at it, how about organising 20,000 signatories to petition the ConCourt and have it dissolved in national interest. This country needs LEGAL leadership if we are to survive these politicians.
