The Lusaka High Court has acquitted two suspects Collins Soma and Edward Siandima arrested in connection with the death of Ruth Mbandu, a NIPA Student.
High Court Judge Chalwe Mchenga said this is because the Zambia Police Service failed to produce enough evidence to link suspects with the offense.
He said the fact that one of the accused persons was found with the phone is not enough because he bought the phone way after the offense was committed.
The judge further said the medical report that examined the semen found on Ruth Mbandu’s body was never brought to the court.
The Judge noted with concern that even a photocopy of the report would have added value to the case.
And speaking after the judgment, NGOCC Head of communication Madube Siyauya has expressed sadness at the police’s failure to properly investigate the matter.
Very sad indeed! This is the incompetence that continues to existing in the Zambia police. Without proper investigations somehow they expect a conviction, how surely!! In fact, most of the cases these ZP prosecutors successfully prosecute are those where the suspect was intimidated/tortured and confess otherwise tough case where proper investigations are required end up in this particular. Really regrettable! The DPP must put her house in order and demand hard evidence before proceeding to trial or else they will continue being a laughing stock and causing unnecessary criticism of the honorable judges.

I even wonder how these same Judges convict defilers based on hear-say without any forensic evidence. Just depend on Doctor saying “Hymen was broken” or what the victim tells them without even going further to ascertain as to whether accused person’s DNA was found on the victim. A lot of innocent people are in prison due to the incompetence of both the prosecutor and the presiding judge.

Those suspects may be innocent for sure because that Judge Mchenga is the one who at one time prosecuted Paramount chief Mpezeni on defilment charges without fear when almost everyone declared instrest for fear of being fired.

Yes they are innocent. The real murderer is Miles Sampa. That is why when UPND lost elections he quickly tried to go back to PF. He was afraid of nothing but this same case. See how quiet he has become after being rejected by PF. He does not condemn anything wrong that PF does.
Provide the police with evidence. That’s what’s lacking. Since you seem to know something, please help the soul of Ruth to get justice.

But why? Was It not even reported at one time in the media that the murderers confessed to having done it and even led the police to the crime seen and further narreted how they did it….eish!

Even if there is no evidence from Zambia Police to the courts, there is evidence in heaven and pictures are there waiting for who ever did that: In Heaven no one is going to escape and nothing shall be hidden. The ‘incompetence’, is deliberate. Police show incompetence to shield the real killer provided he/she can pay.They are not that dull,just hopelessly and shamelessly corrupt. Ruth mother hired a private detective according to MUVI TV news clip,information gathered was turned over to prosecution but on ignored and deliberately played dull to acquit the two and let the killer go scot free.
