UPP RESPONSE TO THE PURPORTED US$10 BILLION (K100 BILLION) HALLUCINATING LAWSUIT BY THE ZAMBIA REVENUE AUTHORITY (ZRA)
The purported legal proceedings by the Zambia Revenue Authority (ZRA) against the United Progressive People (UPP), if indeed it is true, over our allegations of corruption in the award of the contract to the Chinese Righlux and Inspur by ZRA, is welcome because it accords us a rare opportunity to present before the courts of laws the overwhelming evidence in our possession.
We maintain our position and do hereby vehemently submit that ZRA lacks integrity not only over the fiscalisation project in question, but also over the Zambia-Malawi K345 million maize exportation scandal, among other cases before us. We have not even covered 1% of the cases that we have.
UPP seizes this occasion to ask ZRA to state its position over direct or indirect dealings with CilTax Consultants over the years. There is a heap of very serious issues that we shall present before the courts of laws to show how the nation is losing revenues because of corrupt senior officers at ZRA and the political elite who have taken taxpayers for granted for far too long.
It is common knowledge that every organisation, as a legal person, is personified by the people who are leading it. Likewise, ZRA is personified by the Commissioner General, Mr. Kingsley Chanda, and other senior officers. This is the reason why all public officers are required by law to declare the direct or indirect interests that they have in entities that have questionable dealings with public bodies under which they are called to serve.
UPP shall successfully and overwhelmingly prove that ZRA, in its current form, lacks the integrity that the people of Zambia expect it to uphold.
Our evidence shows that ZRA was represented in the sitting of an irresponsible committee that cleared Transglobe Limited of Malawi to export 50, 000 tonnes of the 100, 000 tonnes of maize under the K345 million letter of credit which was primarily issued in favour of the Zambia Cooperative Federation (ZCF).
ZRA must explain to the people of Zambia how it was part of the maize exportation scandal without showing how taxes were going to be collected since Transglobe is not registered for tax purposes in Zambia. This is why we shall continue to demand for a tribunal to probe Hon. Dora Siliya so that she can explain how she worked with President Edgar Chagwa Lungu to facilitate corruption.
ZRA too, owes Zambians an explanation. We shall not rest until the tribunal is appointed. We are thankful to God that the purported lawsuit is a golden opportunity to prosecute ZRA over its alleged role in the maizegate saga.
ZRA must now prepare to face UPP in court and explain how some questionable corporate entities are used to evade the taxes by way of dubious appeals that culminate in massive reductions of taxes for a select few.
ZRA must explain why it failed to perform its legal duty of care to Zambians by not undertaking due diligence before awarding the contract to Righlux and Inspur when all the details on corruption and technical bottlenecks under the Zimbabwe Revenue Authority associated with the same company are within the reach of ZRA.
If ZRA had integrity, it would have been enforcing the law fairly and impartially. How many corporations owe Zambians taxes? Why did ZRA selectively pounce on the Post Newspaper with force leaving out many others that have even more tax liabilities? Integrity demands that justice be rendered to all in a manner which is above board.
UPP sternly warns ZRA to concentrate on corruption-free measures that will help Zambia to generate tax revenues that will help the nation to settle the debts and advance economic development.
The K100 billion being claimed is an ill conceived and misguided lawsuit. It is about the same amount of the national debt that Zambia has – it is also almost double our national budget. This money will certainly not come from the UPP.
Nonetheless, UPP has initiated the #BringBackOurMoney! anti corruption crusade, which seeks to prevent corruption as well as recover all the stolen funds and we can guarantee that the public resources that have been plundered shall be paid back to Zambians. We have kept the evidence under lock and nut in a secure place that no one can enter except a few justice fighters.
The army, police and prison officers, intelligence officers, civil servants and workers in the private sector are being subjected to hostile high taxes because of corruption.
The PF-MMD regime has run out of ideas on how to grow the economy and create jobs for Zambians. Consequently, they have resorted to heavily taxing the citizens to sustain the costly and aimless international travels of President Edgar Chagwa Lungu and his ministers.
The people of Zambia are facing hardships, but the reckless and insensitive PF-MMD leaders are continuing to waste public resources on luxuries. Enough is Enough!
We, in the UPP, believe in the justice and power of the Almighty God who has called us to the kingdom at a time such as this. We are fully FORTIFIED and ready to defend the truth.

I listened to him trying to explain this morning; he seems not to have any evidence.
He is busy talking about how a corruption case occurred in Zimbabwe involving the same company. But he is not explaining anything regarding how ZRA was corrupt in this particular transaction in question.
If he had anything against the company’s reputation outside Zambia why not just raise those concerns than accuse those that are trying to do business with that company of having been corrupt in that particular business transaction.
Otherwise he has to prove that ZRA was corrupt in this tender process, than to say because the company they are dealing with was corrupt elsewhere and use that as evidence that ZRA was corrupt.

Tell us who filed in another petition and in which court and when that second petition was filed in. Also explain to us where our constitution talks about the filing in of another election dispute petition and which court should handle it. Tell the bloggers when the legal and valid election petition is supposed to be done how long it should last. If you can argue with us from the constitution we shall join you in challenging the concourt to hear your petition. Note that Pf or the executive has no powers over the judiciary to compel it to hear or not to hear your petition. Remember that during the first petition Ecl never commented anything. The UPND Petition was “dismissed” on a 14 day technicality which is illegal at Law. To make matters worse 14 days in terms of the law is 14 working days ending 8th Sept 2016. Concourt has no powers to dismiss the Petition without hearing and determining it. Court was supposed to declare a Winner but they failed to do so. Concourt also forgot that the old Bill of Rights still exist and the High Court administers it and that Petitioners have Rights to be heard in Court. Legally the Petitioners have a very strong case and would win at ICJ without a doubt. The fact that Lungu refused to handover the Presidency to the Speaker of Parliament during the Petition Hearing process disqualifies Lungu from the contest.
Back Nez, going by the current constitution the petition is stile. Ask the lawyers who walked out. They will tell you.

ZRA should not be defensive. ZRA is a public service vehicle. ZRA is an instrument for empowering the nation. ZRA is not above the law. ZRA must accept criticism, even if the criticism is based on perceptions. ZRA must accept criticism, even if the criticism is based on allegations. The burden of proof is on the public servant. ZRA is near the crime scene and must therefore prove its innocence for the public to see and believe. ZRA mandate is implementing existing tax laws and procedures. ZRA has a duty to tax payers to explain its actions, decisions, dealings and operations to the employers, i.e., tax payers. On the other hand, a political party is free to complain about anything. Political mandate is limitless, including enactment of new laws to replace old laws.

PF Dunderheads don’t just get it. Hearing a Petition means the Petitioners and the Respondents giving evidence in Court on the conduct of the 2016 Election. Concourt did not hold a Petition Trial on the basis that 14 days had expired. Concourt did not do what they are required to do by the Constitution. Concourt was supposed to hear the Petition,determine it and then either Nullify the Election or declare one of the Candidates the Winner of the Election. Concourt did neither of these 2 things but instead went outside their Constitutional mandate to “dismiss” the Petition. That is illegal and unconstitutional and therefore Null and Void. The Petition is very much alive. # Let the Petition be heard in Court. Period.
What evidence did your smart people give before concourt in 14days that the constitution allows. Just tell us one evidence and we will support you.

People like Chishimba should be supported massively by all in the fight against a thieving tyrannical govt of Lungu. You can also compute you import duty online; know your tax dues and do not let the clearing agent take advantage of your ignorance. In any case there is No clause which says Concourt can dismiss the Petition within 14 days. At law u cannot use time expiry technicalities to deny Justice. Justice is far more important than time expiry. This reminds me of a story where a PF Cadre called Mushota was sent by his Company to go and deposit money to the Bank .Mushota decided to play around until after the Banks were closed then converted the money to his own use. When Mushota was asked for a Bank Deposit Slip he said he found the Bank closed. When asked for the Money ,Mushota failed to produce it but claimed he had paid the water bill for the company…

If you are clean why cant you simply prove it or send in Auditors…if the ZRA top brass want to sue let them sue him in their personal capacity.

@Moyo. I like your Mushota story. We know that Mushota is Concourt becoz it did what it was not asked to do by the Constitution. Concourt failed to do a simple task. To hear and determine the Petition and after weighing the evidence in Court either Nullify the Election or declare the Winner. They dismissed the Petition in terms of which law? By dismissing the Petition Ilegally Concourt has set Zambia on fire. Until this Petition is properly heard in Court and a Winner is declared elected there will be no peace in Zambia.
What evidence was brought forward before the concourt apart from preliminaries. I challenge you to state even half of the evidence which your hyena presented.
Also reading through this so-called response from Saviour Chishimba reveals that the man has an unstable thought pattern.
What he calls response is a list if mere nightmares unrelated to the case at hand.
The man is a Dr, and as such I expected his thought flow to be coordinated rather than being utterly disjointed.
The question is: is this man able to defend himself in court.
If Jane accuses James of impregnating her she must give evidence that the pregnancy she has was caused by James.
She cannot starting saying:

Peace for Zambia: Exactly my confusion as well. Dr. Chishimba is so disjointed in his thought pattern. To go further with your Jane pregnancy. Jane cant say I know James has also his young brother who impregnated my sister and in-fact James also was caught with my mother in the bush. That is evidence that James is promiscuous and he is the owner of this pregnancy. There is no such a thing as referral evidence. Jane please prove to the court that James is the owner of the pregnancy. In this case, Dr. Chishimba you should prove that the Chinese contract was corruptly awarded. Not these other cases with no relevancy to the Chinese contract. That is how cases are won or lost. In fact the Chief Justice even warned in yesterdays newspaper about people not having substantial evidence but hoping…

Honestly I am confused. Chishimba is being sued for issuing a STATEMENT that ZRA corruptly awarded a contract to a Chinese firm for a certain contract to be performed on behalf of ZRA. Chishimba has not been sued for issuing wholesome statements BUT for a specific contract in question. Now, looking at how Chishimba has responded, it is totally nowhere near the Chinese contract. He is shooting everywhere. Is that the way to win a court case? ZRA want you Chishimba to respond to the Chinese contract and matters related to the lawsuit. That is the problem of being trigger happy and spraying stray bullets, you end up shooting yourself in the foot. I wish you all the best. BUT please stick to the Chinese contract. If you want, in future report them on those other cases you have mentioned now.

This is good news for the general public. We urge the court to allow the public to hear the proceedings of this case as much money is lost through corruption and incompetency in most government institutions.
PF government is allergic to court hearings. ZRA is a public institution and Zambians have the right to know how their institution is managed. If there any concerns being expressed by one Zambian on behalf of the lot the solution does not lie in dragging an individual to courts of law at the same time judge him and slap K100m as damages. Justice in this case falls short of normal standards. Allow court process to play its role. Why is PF government so afraid with court procedural processes and resort to unorthodox methods of justice.
