UPP RESPONSE TO THE PURPORTED US$10 BILLION (K100 BILLION) HALLUCINATING LAWSUIT BY THE ZAMBIA REVENUE AUTHORITY (ZRA)

The purported legal proceedings by the Zambia Revenue Authority (ZRA) against the United Progressive People (UPP), if indeed it is true, over our allegations of corruption in the award of the contract to the Chinese Righlux and Inspur by ZRA, is welcome because it accords us a rare opportunity to present before the courts of laws the overwhelming evidence in our possession.

We maintain our position and do hereby vehemently submit that ZRA lacks integrity not only over the fiscalisation project in question, but also over the Zambia-Malawi K345 million maize exportation scandal, among other cases before us. We have not even covered 1% of the cases that we have.

UPP seizes this occasion to ask ZRA to state its position over direct or indirect dealings with CilTax Consultants over the years. There is a heap of very serious issues that we shall present before the courts of laws to show how the nation is losing revenues because of corrupt senior officers at ZRA and the political elite who have taken taxpayers for granted for far too long.

It is common knowledge that every organisation, as a legal person, is personified by the people who are leading it. Likewise, ZRA is personified by the Commissioner General, Mr. Kingsley Chanda, and other senior officers. This is the reason why all public officers are required by law to declare the direct or indirect interests that they have in entities that have questionable dealings with public bodies under which they are called to serve.

UPP shall successfully and overwhelmingly prove that ZRA, in its current form, lacks the integrity that the people of Zambia expect it to uphold.

Our evidence shows that ZRA was represented in the sitting of an irresponsible committee that cleared Transglobe Limited of Malawi to export 50, 000 tonnes of the 100, 000 tonnes of maize under the K345 million letter of credit which was primarily issued in favour of the Zambia Cooperative Federation (ZCF).

ZRA must explain to the people of Zambia how it was part of the maize exportation scandal without showing how taxes were going to be collected since Transglobe is not registered for tax purposes in Zambia. This is why we shall continue to demand for a tribunal to probe Hon. Dora Siliya so that she can explain how she worked with President Edgar Chagwa Lungu to facilitate corruption.

ZRA too, owes Zambians an explanation. We shall not rest until the tribunal is appointed. We are thankful to God that the purported lawsuit is a golden opportunity to prosecute ZRA over its alleged role in the maizegate saga.

ZRA must now prepare to face UPP in court and explain how some questionable corporate entities are used to evade the taxes by way of dubious appeals that culminate in massive reductions of taxes for a select few.

ZRA must explain why it failed to perform its legal duty of care to Zambians by not undertaking due diligence before awarding the contract to Righlux and Inspur when all the details on corruption and technical bottlenecks under the Zimbabwe Revenue Authority associated with the same company are within the reach of ZRA.

If ZRA had integrity, it would have been enforcing the law fairly and impartially. How many corporations owe Zambians taxes? Why did ZRA selectively pounce on the Post Newspaper with force leaving out many others that have even more tax liabilities? Integrity demands that justice be rendered to all in a manner which is above board.

UPP sternly warns ZRA to concentrate on corruption-free measures that will help Zambia to generate tax revenues that will help the nation to settle the debts and advance economic development.

The K100 billion being claimed is an ill conceived and misguided lawsuit. It is about the same amount of the national debt that Zambia has – it is also almost double our national budget. This money will certainly not come from the UPP.

Nonetheless, UPP has initiated the #BringBackOurMoney! anti corruption crusade, which seeks to prevent corruption as well as recover all the stolen funds and we can guarantee that the public resources that have been plundered shall be paid back to Zambians. We have kept the evidence under lock and nut in a secure place that no one can enter except a few justice fighters.

The army, police and prison officers, intelligence officers, civil servants and workers in the private sector are being subjected to hostile high taxes because of corruption.

The PF-MMD regime has run out of ideas on how to grow the economy and create jobs for Zambians. Consequently, they have resorted to heavily taxing the citizens to sustain the costly and aimless international travels of President Edgar Chagwa Lungu and his ministers.

The people of Zambia are facing hardships, but the reckless and insensitive PF-MMD leaders are continuing to waste public resources on luxuries. Enough is Enough!

We, in the UPP, believe in the justice and power of the Almighty God who has called us to the kingdom at a time such as this. We are fully FORTIFIED and ready to defend the truth.

I and all those that the LORD God of Heaven has given me shall not die, but live to declare the works of the LORD, signs and wonders in Zambia from the Holy One of Israel! These words of prophecy shall come to pass before the eyes of this nation!

God bless our nation!

Saviour Chishimba

Pathetic Zambian men. No credibility nothing.

    • Chishimba in paragraph 13 (bring back our money campaigns) sounds to be contradictory in the sense that he is blaming Pf of doing what he exactly intends to do. Bring back our money is a step that Pf has undertaken and that’s why zra was able to collect above target taxes owned by individuals and businesses and note that they haven’t collected anything from post mmembe yet. This guy is a true coward, instead of him commenting on what he had being sued for he goes ahead to talk about Dora.

“..Bring back our money is a step that Pf has undertaken and that’s why zra was able to collect above target taxes owned by individuals and businesses…”

They were able to raise that money because they are taxing Zambians mercilessly to cover up their incompetence to generate wealth for the country.

I listened to him trying to explain this morning; he seems not to have any evidence.

He is busy talking about how a corruption case occurred in Zimbabwe involving the same company. But he is not explaining anything regarding how ZRA was corrupt in this particular transaction in question.

If he had anything against the company’s reputation outside Zambia why not just raise those concerns than accuse those that are trying to do business with that company of having been corrupt in that particular business transaction.

    • I hope he will not resort to preliminaries as a way of escape like his oppositio-mate HH who ran away from his own petition due to lack of evidence.

He was busy saying I raised the issues because I have got stake in ZRA.

Now does that stake licence you to be malicious or you do so because you have got valid reason and cause to do so?

He further say the money ZRA has demanded is too much because that is almost zambia’s annual budgett

He is trying to negotiate for a discount before the court process even starts – what does that speak of.

Why negotiate for a price if something you are not intending to buy. If he has evidence and stands on firm ground the demand made by ZRA is not an issue.

I agree with you, except Chishimba is confusing himself in the process.

Let him bring evidence in the courts. Regardless of how strongly you feel about the matter if you don’t have evidence, you ae malicious.

The philosophy of saying Maureen Mwanawasa found my votes in a bin is a flawed philosophy in the absence of evidence.

“No, look here, a truck is carrying illegal votes from Luangwa”. You even hire Mushipe to start dancing at mulungushi and yet you are cooking the story.

The said truck is from within kabwata constituency getting to the totaling centre.

And you call lies freedom of speech?

  3. This is the way things should be. People given an audience in court to prove their points. We wonder why pf is scared to hear petition. It only leads to one conclusion that they stole election and know we have sufficient evidence

    • Tell us who filed in another petition and in which court and when that second petition was filed in. Also explain to us where our constitution talks about the filing in of another election dispute petition and which court should handle it. Tell the bloggers when the legal and valid election petition is supposed to be done how long it should last. If you can argue with us from the constitution we shall join you in challenging the concourt to hear your petition. Note that Pf or the executive has no powers over the judiciary to compel it to hear or not to hear your petition. Remember that during the first petition Ecl never commented anything. He waited until no evidence was heard and concourt closing the case as lacking merit. So if you have other reasons about the preliminaries not being…

    •  The UPND Petition was “dismissed” on a 14 day technicality which is illegal at Law. To make matters worse 14 days in terms of the law is 14 working days ending 8th Sept 2016. Concourt has no powers to dismiss the Petition without hearing and determining it. Court was supposed to declare a Winner but they failed to do so. Concourt also forgot that the old Bill of Rights still exist and the High Court administers it and that Petitioners have Rights to be heard in Court. Legally the Petitioners have a very strong case and would win at ICJ without a doubt. The fact that Lungu refused to handover the Presidency to the Speaker of Parliament during the Petition Hearing process disqualifies Lungu from the contest.

  7. ZRA should not be defensive. ZRA is a public service vehicle. ZRA is an instrument for empowering the nation. ZRA is not above the law. ZRA must accept criticism, even if the criticism is based on perceptions. ZRA must accept criticism, even if the criticism is based on allegations. The burden of proof is on the public servant. ZRA is near the crime scene and must therefore prove its innocence for the public to see and believe. ZRA mandate is implementing existing tax laws and procedures. ZRA has a duty to tax payers to explain its actions, decisions, dealings and operations to the employers, i.e., tax payers. On the other hand, a political party is free to complain about anything. Political mandate is limitless, including enactment of new laws to replace old laws.

    0

    0
    • That is why they have taken the matter to court, so that ZRA too can openly defend themselves before the courts.

And let us avoid reverse thinking. How can you choose to go before the courts to judge your matter by the law that you consider yourself to be above.

ZRA, by taking the issue to court, they are admitting that they’re subject to the law.

It is also a clear sign of publicly declaring that they are transparent about the issue. You don’t take to court someone who accuses you if you clearly know you are stained.

And if you accuse someone, why should you be running away from your own ‘case’ like HH who ran away from his own petition until he caused it to expire.

  8. ZRA is 100% owned by govt. Why is it as a Parastatal refusing to be held accountable by the Public? ZRA is playing PF Politics. Its mixing Tax issues with Politics. ZRA is being used by Lungu as a tool to fix all those opposed to Lungu’s Illegitimate Rule. To achieve his One Man Party Dictatorship Lungu is silencing the Media using ZRA as the Executioner. Mr Chishimba we are fully behind you against this illegitimate Lungu Dictatorship. ZRA is using scare mongering tactics to silence UPP, but will soon withdraw this case from the Courts becoz it will backfire. ZRA is now a dept in the PF Secretariat and is doing the PF Bidding. ZRA is now auctioning the Post Assets when the matter is still in Court. ZRA is now part of this illegality stemming from stolen and Petitioned Election. # Let…

Anyway away from mushota’s nonsense..what Saviour Chishimba has done is welcome and we shall patiently wait for the day in court, he is an intelligent man but he was in a very fast lane during Sata’s era that’s why he even resigned as kasama mp..he wanted to challenge ba Sata for the presidency but had he been patient maybe he could have been president by now because he was more vocal in PF than the Kabimbas and Kambwilis..that’s why in life you need to take one step at a time but he was rushing things and he should have remained in PF..we shall see how this goes

Dr Chishimba I applaud you, this is the way we need to check on Govt and their activities, somehow you are sending a message to those in Govt. The only thing is that you seem to be so quick to go to the press, otherwise you are far much better than UPND whose concentration is making their great leader go to plot 1 and chasing their own shadows.

  11. But ZRA know very well that they are very corrupt even if they are taking Saviour Chishimba to court. It is unfortunate that our courts in Zambia have lost their meaning and relevance because president Lungu has manipulated these courts. Don’t fear Chishimba! The nation is behind you!

  13. If indeed these corrupt transactions have taken place culprits will do everything together to hide their foot marks. So don’t bring out every evidence. Ofcourse this information is important for the public. The problem we have in Zambia is that journalists cover only current happenings but fail to keep track of these cases for many years that they take to be concluded.

  14. Mr Chishimba, why shoot from the hips? Surely you can do better than this bri-a-bra picking of targets. Yes, ZRA like any other public institution remains susceptible to corrupt practices. And the organisation admits as much hence the efforts made to lessen tax payer – tax collector interaction by implementing e-services in order to let tax-payers themselves handle tax processes. But you have picked ZRA on a wrong issue by starting off on that tender issue because the tender procedure was transparently followed to the letter and awarded to a modestly priced bidder – not to the astronomically priced bidder as alleged. Check your facts and come again with a genuine case.

  15. PF Dunderheads don’t just get it. Hearing a Petition means the Petitioners and the Respondents giving evidence in Court on the conduct of the 2016 Election. Concourt did not hold a Petition Trial on the basis that 14 days had expired. Concourt did not do what they are required to do by the Constitution. Concourt was supposed to hear the Petition, determine it and then either Nullify the Election or declare one of the Candidates the Winner of the Election. Concourt did neither of these 2 things but instead went outside their Constitutional mandate to “dismiss” the Petition. That is illegal and unconstitutional and therefore Null and Void. The Petition is very much alive. # Let the Petition be heard in Court. Period.

  17. People like Chishimba should be supported massively by all in the fight against a thieving tyrannical govt of Lungu. Zambia maybe a nation of mostly docile people, scared silly of fighting a blatantly evil govt but there will always be people like Chishimba as torch bearers to inspire a revolution. We all know Lungu’s govt is not only the most incompetent on earth but it’s turning out fast as the most evil. Let ZRA take him to court, it will be interesting to watch and hear how they will try to squirm out of this one.

  18. Saviour Chishimba is a very brave man. This fight is not his alone . Its out fight . Anyone who calls himself a Zambian should be applauding Savior in the first place and most importantly lets rally behind him so that the truth can be laid bare. All those people or institutions mentioned should be made to account for their acts. ZRA can not scare the Nation by threatening a huge claim against Savior . If ZRA or Kingsley Chanda had any thread of integrity in them, they owe it to Zambians to explain and respond to the allegations point by point. An attack on Chishimba is an attack on the Nation. The answer is simple Chishimba is speaking for us. Lets form a funding platform to fight the case in court with every Zambian contributing what he can afford eggs , chicken, charcoal bags…

    • Spot on..Zambians are likened to those villagers in that 1960s classic western movie Magnificent Seven. They dont know that when they stand up together with hoes and spades they can see off gun weilding thugs invading their village for food.

  19. There has been statements and counter statements from both Saviour and ZRA, those were preliminaries. Now the finals will be in court under a referee, both will prove their credibility. Let’s wait. There’s usually sensation at the beginning. Don’t you remember how HH screamed all the way to court when ka Eddy Chomba said he was a satanist? Ka Eddy said he will ask HH to take off his shirt for the court to see what he meant, from then on the case wnet quiet until HH gathered some men of god for lunch at his residence and said he had forgiven the mischievous chap Eddy Chomba

  20. ZRA is working hard to curtail corruption. Do you know you can apply for your TPIN online? Visit the organisation’s website and go to e-services. You can also compute you import duty online; know your tax dues and do not let the clearing agent take advantage of your ignorance. FACT: ZRA is well ahead of govt and quasi-organisations in bringing services to your door step. The onus is on the tax payer not to fear the PC keyboard like ebola.

  21. @ Moya.Your comment is spot on but PF Bloggers have no capacity to understand the Law. When the Concourt dismissal is Null and Void it means the 14 days argument falls away. In any case there is No clause which says Concourt can dismiss the Petition within 14 days. At law u cannot use time expiry technicalities to deny Justice. Justice is far more important than time expiry. This reminds me of a story where a PF Cadre called Mushota was sent by his Company to go and deposit money to the Bank .Mushota decided to play around until after the Banks were closed then converted the money to his own use. When Mushota was asked for a Bank Deposit Slip he said he found the Bank closed. When asked for the Money ,Mushota failed to produce it but claimed he had paid the water bill for the company…

    • It is really amazing that UPND buffoons like yourself keep calling a CONSTITUTIONAL REQUIREMENT/CLAUSE a TECHNICALITY! Are you people really that damn?

The best thing you can do as UPNDonkeys (to borrow some bloggers language) through your representation in Parliament is to initiate amendments to the Constitution if you don’t like the 14-DAY requirement for a Presidential Petition. Better still, they are Constitutional amendments/cleaning up going on right now, I hope you are making submissions to have this changed. Let us have a debate over the merits and demerits of why you want this clause changed. If you persuade enough people to see it your way, you may carry the day in the end. But to keep calling a STIPULATION OF A NATIONAL CONSTITUTION a technicality is really UNPRODUCTIVE…

Infact it’s a waste of time to take Savior to court otherwise those Directors will be shamed coz most people will take advantage and expose ZRA.So please Ba ZRA mwalasebana and most of you chaps would lose jobs and be convicted.I’m PF member but i don’t also support corruption in the country.ZRA & Zamtel are corrupt institutions.I’ll start now kuulula.Custom chaps in ZRA have billions through corrupt practices.Take Savior to court and you’ll be exposed bamambala. We are tired of stealing our money.go go Savior and go go PF.

  29. Where on earth do you see a Public Institution like a Tax Office taking taxpayers to court for questioning its integrity…really sad…whose money are you using to sue people? If you are clean why cant you simply prove it or send in Auditors…if the ZRA top brass want to sue let them sue him in their personal capacity.
Zambians need to wake up from the docility…and ask for checks and balances for these people in public office they work for you NOT the other way round.

And why should Jay Jay not apply his intellect on matters of public interest that affect all of us? You want him to look the other way while the rot continues? Don’t shoot the messenger but address the message. This docility is appalling.

  30. If the general public is so blameless and ZRA so corrupt, who is corrupting ZRA? For sure ZRA is not corrupting itself. Judging from Savior’s wild rants, he must have oiled a ZRA officer big time at some point. There’s no way he can merely drug ZRA into the alien matter involving Dora and Malawi.

  31. @Moyo. I like your Mushota story. We know that Mushota is Concourt becoz it did what it was not asked to do by the Constitution. Concourt failed to do a simple task. To hear and determine the Petition and after weighing the evidence in Court either Nullify the Election or declare the Winner. They dismissed the Petition in terms of which law? By dismissing the Petition Ilegally Concourt has set Zambia on fire. Until this Petition is properly heard in Court and a Winner is declared elected there will be no peace in Zambia.

    • What evidence was brought forward before the concourt apart from preliminaries. I challenge you to state even half of the evidence which your hyena presented.

  32. Also reading through this so-called response from Saviour Chishimba reveals that the man has an unstable thought pattern.

What he calls response is a list if mere nightmares unrelated to the case at hand.

The man is a Dr, and as such I expected his thought flow to be coordinated rather than being utterly disjointed.

The question is: is this man able to defend himself in court.

If Jane accuses James of impregnating her she must give evidence that the pregnancy she has was caused by James.

    She cannot starting saying:

“No, because even Mary was impregnated by him. In addition his wife also accused him of impregnating Linda. Even a married woman was caught in adultery with him. This is the pile of evidence I have my Lord.”

Iwe, iwe, iwe Jane please! – you mean James’…

    • Iwe, iwe, iwe Jane please! – you mean James’ adultery with a married woman got you pregnant?

“Ah no, let him deny that he has a child with Mary; let him tell the court that Linda is not pregnant for him; let him deny openly here that he was not caught in adultery with a married woman in the name of Mrs James.” Aah – you!

And like HH, when Jane loses her case she starts saying, “the judge is a thug, the judge is James’ puppet, the judge is criminal, all that pile of evidence I gave – including a married woman”.

Iwe Jane, don’t learn from HH, his ideas make sense only in his world.

This Jane am advising is actually Saviour Chishimba.

    • Peace for Zambia: Exactly my confusion as well. Dr. Chishimba is so disjointed in his thought pattern. To go further with your Jane pregnancy. Jane cant say I know James has also his young brother who impregnated my sister and in-fact James also was caught with my mother in the bush. That is evidence that James is promiscuous and he is the owner of this pregnancy. There is no such a thing as referral evidence. Jane please prove to the court that James is the owner of the pregnancy. In this case, Dr. Chishimba you should prove that the Chinese contract was corruptly awarded. Not these other cases with no relevancy to the Chinese contract. That is how cases are won or lost. In fact the Chief Justice even warned in yesterdays newspaper about people not having substantial evidence but hoping…

  34. @Peace for Zambia, your reasoning never fails to impress me , regardless of the fact that you keep hitting HH under the belt – but that’s a story for another day. You, BR Mumba Jnr (gone quiet recently), Dr Kasonde do strike me as ‘must read’ bloggers. Keep posting.

  35. Honestly I am confused. Chishimba is being sued for issuing a STATEMENT that ZRA corruptly awarded a contract to a Chinese firm for a certain contract to be performed on behalf of ZRA. Chishimba has not been sued for issuing wholesome statements BUT for a specific contract in question. Now, looking at how Chishimba has responded, it is totally nowhere near the Chinese contract. He is shooting everywhere. Is that the way to win a court case? ZRA want you Chishimba to respond to the Chinese contract and matters related to the lawsuit. That is the problem of being trigger happy and spraying stray bullets, you end up shooting yourself in the foot. I wish you all the best. BUT please stick to the Chinese contract. If you want, in future report them on those other cases you have mentioned now.

    • Yeah, so that he can prove his allegations and if found wanting ZRA can be held to account.

Would you like the matter to end at rumour level, and not verified with Chishimba’s evidence presented in court?

  37. He should be called President Saviour Chishimba. He is fighting for the under-dog, you and me. We are going through hell in life as a result of the runaway corruption in the presidency of Edgar Corruption Lungu.
He is a brave man, a rarity in Zambia where men walk about with shrunken balls, scared of their own shadows because they are afraid of their own need to get a better life! Go Mr. Chishimba, GO! Show us that you are the last man standing for the downtrodden eating garbage due to Lungu-made poverty and suffering!

  38. Zambians will remain poor because of blind support when a few are getting supper rich from your taxes. Surly how can you give a contract to a compny with questionable dealings. This shows how Zambians are dull while money is being stashed away in foreign accounts. You need a white man to rule us. Useless Zambian Bafika continue suppoting and live in paperture poverty

  39. This is good news for the general public. We urge the court to allow the public to hear the proceedings of this case as much money is lost through corruption and incompetency in most government institutions.
PF government is allergic to court hearings. ZRA is a public institution and Zambians have the right to know how their institution is managed. If there any concerns being expressed by one Zambian on behalf of the lot the solution does not lie in dragging an individual to courts of law at the same time judge him and slap K100m as damages. Justice in this case falls short of normal standards. Allow court process to play its role. Why is PF government so afraid with court procedural processes and resort to unorthodox methods of justice.

  40. Ba Chishimba mwe, Twatasha Mukwai. Ifyo mulechita fintu fwamano sana. What you are doing is the best a real leader should be doing. Most Zambian leaders put themselves far away from real issues. You have taken the bull by the horns. We need to know how we can support you, us as small, forgotten citizens. Lungu is out to rape our country, since he became self-sworn president. His agenda is despotic and his party, called PF is nothing but an organized group of gangsters, but being sanctioned by himself and hie ministers at Home Affairs, Defence, and Justice. I fear for my country because we seem to be bottled up ..stuck with evil where ever you look for solutions to our suffering and corruption. There are so many Judges now that we all know are simply disguised jail-birds and yet they are…

  42. Zambia is a rich country, if only leaders were selfless and worked for the good of our nation, the poverty and deprivation we are going through would have been history. Saviour has raised issues that calls for serious investigations. The only problem is that its the whole state machinery being implicated. This is corruption institutionalized and with such high levels of corruption, who can manage the economy efficiently? the consequesnces are visible to see. High uneployement levels, abandoned projects, high rise in criminality and a complete breakdown of rule of law. This is a sad reality that we are faced with. I thank Saviour and UPP for their courage in atleast bringing out such scams. One day, am sure somebody will bring somebody before somebody to answer chargers. Am hopeful that at…
