Defilement case of uncle allegedly defiling a minor niece commences in Namwala District

Trial has commenced in a defilement case involving a 32 year farmer Maurice Mweene of Shanambe village of Chief Mungaila chiefdom of Namwala District of Southern Province who is accused of having unlawful carnal knowledge of a minor.

Particulars of the offence are that Mweene on the 21st day of March 2017, at Namwala in the Namwala District of the Southern Province did have unlawful carnal knowledge of a minor aged below 16 years contrary to section 138(1) of the penal code chapter 87 of the laws of Zambia.

When the matter came up for continued trial before Namwala Magistrate Andrew Kasongo ,Prosecution Witness number four constable Chrispin Mubanga testified that in May 2017 he was assigned to investigate a case were Joseph Madyenkunku reported that her niece was allegedly defiled by Mweene .

Mubanga further testified that he started investigating the matter and interviewed the victim who confessed that her guardian Mweene had unlawful carnal knowledge of her.

Constable Mubanga added that in proving that the child was allegedly defiled medical reports from Namwala Hospital indicated that the victim had bruises in her vagina .

When asked by the Prosecutors how he managed to establish that the child was under 16 years ,Constable Mubanga replied that he obtained certified copies of a school register at Namusonde primary were the victim is a pupil which showed the age of the victim which indicated that she was born in 2002, and that her guardian was Mweene.

But when the accused under cross examination denied ever having unlawful carnal knowledge of his niece was who also his dependent.

Mweene testified that what he only did on that material day was to ask her niece to bring him bathing soap while he was having a bath.

Earlier when the matter came up for plea the accused pleaded not guilty to the charge.

The matter has since been adjourned to 31st October 2017, for continuation of trail to allow the school head at Namusonde to produce original copy of the school register since pw4 had produced a photocopy of the school register during trail, but the state applied that an original copy of the school register should be produced.

Namwala Magistrate Kasongo has extended for the bail.

In an another development of a case involving a 62 year old farmer of Mayaba village of chief Mungaila of Namwala District of Southern Province who is accused of having unlawful carnal knowledge of a girl under the age of 16 years failed to take place .

This is after Namwala Magistrate Andrew Kasongo requested for the father to the victim and the headmen, to came and testify before the court, because earlier the victim had already testified during a juvenile court that she was allegedly defiled by Mathews Muchanga was taking care of her .

The father to the victim and the headman of the village had earlier wanted to settle the matter out of court before the matter was reported to Namwala police by the mother to the victim.

This is in a case were Muchanga on the 18th day of march 2017, Namwala in the Namwala District of the southern Province of the Republic of Zambia,is accused of having unlawful carnal knowledge of a girl under the age of 16 years contrary to section 138(1) of the penal code chapter 87 of the laws of Zambia.

The matter has since been adjourned to 31st October 2017 by Namwala Magistrate Andrew Kasongo to allow for the father to the victim and the headman of the village to testify before the court.

  1. The poor will continue going to prison… what about the defilement cases that happened in woodlands were some were 13 years old? will that case die just like that because the house belongs to a roman catholic priest or father.
    for that matter we had the minister of Gender issue statements with regards to the house being forfeited to the state, please update us was the Government involved in this sex scandal? why the silence? where these kids from wealthy/connected families such that the case should be silenced.

    • A 25 year old girl is a child these days. I can’t be tempted by a naked 25 year old in hipster.
      But a 25 year old boy is too old to play in chipolopolo national team.

  2. when you have sex at 15 its defilement, at 16 its legal but you can only get married at 21 meaning from 16 to 20 its free sex infact the government and NGO’s support sex before marriage thats why they want to start supplying condoms and birth control to the same age group.

    Its funny Donald Trump just reduced the budget for contraceptives but in Zambia we have NGO’s championing the same. The agendas of certain NGO’s is questionable to say the least.

    Zambia let us not follow blindly. how many of our mothers got married at 15 years, did they turn out bad? NO… cause these girls of nowadays at 21 years there sex organs are like for 40 year olds. lets priotise morals not laws for sake of pleasing donors who dont care about our indigenous morals.
