Government to continue upholding the doctrine of separation of powers-President Lungu

President Edgar Lungu has today sworn-in four judges at state House with a call for them to carry out their duties independently.

Speaking during the swearing in-ceremony, President Lungu said all members of the judiciary should reflect on exploring ways of enhancing their independence, transparency, accountability and efficiency to win public trust and confidence.

He said as the executive, they shall continue to uphold and respect the doctrine of the separation of powers so that the judiciary can work independently.

President Lungu said this can be seen from the fact that their appointments involved all the three arms of the government.

He said the recommendations were made by the Judicial Service Commission to the executive after which the National Assembly ratified them.

Those sworn-in include Justice Martine Musaluke as Constitutional Court Judge, Justice Florence Lengalenga as Court of appeal Judge, Kelvin Limbani as high Court Judge and Catherine Phiri as High Court Judge.

President Lungu appealed to Judge Musaluke to help contribute to public confidence by deciding on cases based on the rule of law and not follow public opinion.

The President further said he has no doubt that with vast experience in the High Court and Supreme Court Justice Florence Lengalenga will offer valuable experience to the court of appeal.

The Head of State stated he is confident that Justice Kelvin Limbani having spent most of his career in the Judiciary, he will use his vast experience to help tackle the huge volume of work in the high court.

President Lungu also reminded Justice Catherine Phiri that she is joining an institution that is very different from the one she worked for, which involved handling criminal matters.

  1. Advising Concourt not to do what the High Court in Kenya did does not sound like upholding the doctrine of Separation of Powers.

    • @Mushota I see you woke up with a hangover and you didn’t wake up in time to be the first to post! I think that you have settled for being second best! Why does it have to be political all the time? Give us a break we are all Zambians and in God’s eyes, there is no PF this or UPND that. Grow up (you sure don’t need a PhD for that).

    • Mushota didn’t know that she was pregnant and doesn’t know exactly who put the super glue for the same pregnancy due to multiple unprotected sex relationships she has, now these are the results, one may wonder how she comments due to the same unwanted pregnancy.

    • Ba Vodiga Rungu, as long as you are the one appointing them (and not the people’s representatives), the poor chaps will continue to be beholden unto you in order to keep their jobs.

    • There can never be separation of powers as long as the president is the appointing figure of high court judges, constitutional judges & nomination of who stands as MP.

      Their allegiance will always be the president NOT the people they are meant to serve.

    • See who is talking, do you Lungu understand what separation of power is if you can make statements that border on threatening the Judiciary? Do you respect the Constitution? Give examples of when you last respected the constitution. We also know that you are appointing these Judges indiscriminately, so that when you leave office and appear before them they will sympathize or side with you. How come you have appointed more Judges in less than two years than all the other legitimate Presidents before you?

    • Good doctrine does not necessarily translate into good practice. It requires a lot of efforts to practice the preached doctrine. So, Lungu should not be a mere appreciator of the doctrine but a doer of it.

  2. Mr President I support you but what’s happening on the he ground is disheartening and going against what you are purporting.

    A point in question. The judges ruled for the ministers to reimburse the state for monies they were illegally paid.

    Government has received directive of the ruling from the judges.

    Why is the justice minister seating on it and advising that he is yet to make a decision?

    A decision has already been made by the judges. So what you are saying about independent judges is not what is obtaining in the ground. The judges are being undermined.

    History will judge us harshly on this one Mr President and once out of power, we shall pray for the independence of judges we are bashing and undermining now. A chance we are squandering to make them fully independent…

    • Presidents come and go, you won’t be the first nor the last and in as much as we would like you to do the right things, you will certainly be visited by the same law once out of power and without the independence. The same quasi independent judges you leave behind is the same that will preside over you.

      Mr president, do the right thing, empower institutions. You will be remembered for that.

      For these morons, no other color exists, it’s either white or black. meaning if it’s not PF, then its UPND.
      And that is the reason they cant see things differently, but I understand, that is the only way they can argue. if you say something sensible, they attack you on tribal grounds.

  3. This is a president who will go down in the annals of history as a real joker! He is already telling the judges to be partial!! Where did we get this one? There a definite difference between his spoken word and his conduct. Judges ought to be impartial and be led by the law not what the president says.

  4. This Koswe Mumpoto is a hypocrite. He is talking of Rule of Law and separation of Powers between the Executive, Parliament and the Judiciary and yet he doesn’t respect Court Orders. He refused to resign and handover Power to the Speaker during the Petition Hearing. He also refused to follow Court Orders involving the illegal Ministers. This man is all froth and no beer.Koswe Mumpoto expects the New Concourt Judge to Rule favourable on his Third Term wish. That explains the timing of the appointment of this PF Concourt Judge.

  5. Yeah yeah president Edgar Lungu above seems to be telling Concourt judge Martin Musaluke to do the right thing about his eligibility to stand in 2021.the constitution is very clear,one is considered to have served a term after ruling for 3 years or more!!so ECL is free to stand in 2021!!

  6. @ Gigs, as long as UPND continue talking of rigging whenever they lose elections they will not improve and win any election. Analyse and see how you can increase your votes in the 6.5 provinces. You will never win with votes from 3.5 provinces only.

  7. BUT IT IS PLAIN TRUTH PF RIGGED. MINUTE DIFFERENCE WITH SOMEONE COMMANDING 6.5 IS SOMEHOW ILLOGICAL. ONE WRITES 6.5 SUBJECTS AND THE OTHER 3.5 AND OBTAIN ALMOST SAME RESULTS,MEANS POOR PERFORMANCE WITH THE 6.5

      that is too hard for these PF cadres to grasp. I keep reminding them, the difference between 6.5 and 3.5 is just 103000 votes, that is not so significant.
      If they keep assuming that the 3.5 is just for UPND, then they are in trouble because NDC is grabbing parts of 6.5.
      Come 2021, we can assume there will be firm 3.5(UPND), 6.0(PF) and 0.5(NDC)….,

    • What you fail to understand, is that in Kenya, judges showed there independence. Meaning they are trustworthy as opposed to Zambia. It’s not about Ondinga losing, we commend Kenyan judiciary for being independent without succumbing to political and outside interference. They are men and women with “something between their legs” which you cant say among Zambian counterparts. The judgment here is based on where the wind blows. The Kenya outcome is clean, no one talks about it now because of that sound decision by the judges, now look at Zambia, it’s still talk of the day. That is the difference Mwana, that is what we want to see in our judiciary changed, and not ECL giving them instruction on what decision to take

  9. HH won the 2016 presidential elections with overwhelming evidence afraid to be submitted in Con court prevented by Edgar Chagwa Lungu. Judiciary in Zambia has to prove its name with justice in law.
