Man sentenced for three years for biting wife’s private part

The Mansa Magistrates Court has sentenced a 27 year old peasant farmer of Kale Village in Chief Mibenge’s Chiefdom to three years imprisonment with hard labour for assaulting his wife.

Before Mansa Principal Resident Magistrate Prince Mwiinga was Derrick Chiluba who stood charged with assault occasioning bodily harm contrary to section 248 of the Penal Code Cap 87 of the Laws of Zambia.

Particulars of the offence are that Chiluba, on September 24 in Mansa district did assault Annie Chalwe 23 thereby, occasioning her bodily harm.

Facts before the Court are that on that fateful day, Chiluba returned home from the bush and requested for food from his wife who denied to give him and that was only given food around 22 hours when he returned from a drinking spree.

Principal Resident Magistrate Mwiinga then heard how while, Chalwe who is also five months pregnant was sleeping, her husband bite her on her private parts and threatened to kill her using a scissors.

In mitigation, Chiluba pleaded with the court to be lenient stating that he is a first offender and that there will be no one to care for the child when he is sent to prison.

In sentencing him, Principal Resident Magistrate Mwiinga said he put into consideration his mitigation and that he readily pleaded guilty to the charge.

Magistrate Mwiinga however, noted that the circumstances under which Chiluba committed the offence were aggravating as he had to hurt his wife over food which was even provided to him.

He said Chiluba further went on to bite his own wife on her private parts and as if not enough got a scissors and threatened to kill her.

Principal Resident Magistrate Mwiinga said to deter others from committing the offence, sentenced him to three years imprisonment with hard labour with effect from September 26, 2018.
