Ndola City Council warns Shopping Malls Charging Members of the Public to use Toilets

Ndola City Council (NCC) has warned of stern action against mall managers in the city who are charging members of the public to use toilets at shopping centres.

NCC Public Relations Officer, Tiyengi Mwanza told ZANIS yesterday that the local authority is dismayed to learn that ZEMART Mall is charging a fee of K2 per person to use the public facility.

She explained that the application by ZEMART management to the council to continue charging members of the public for using toilets at the mall was rejected as it is not in accordance with the laws.

Ms Mwanza said according to the law, Public health drainage and latrine regulation 80 Cap 1 bond cap 81 states that the owner or occupier of any workplace, public hall or other place by ticket or otherwise shall provide such a premises with proper and sufficient latrine accommodation for each sex and that such owner and occupier shall cause every latrine to be kept in a clean state and adequately lite during the day and night.

She said it is disturbing to learn that other malls have also started charging a fee to members of the public wanting to use toilets because of what they had seen at ZEMART mall.

Ms Mwanza has however, stated that the local authority has since written to all the malls managers to stop charging members of the public for using toilets with immediate effect.

  1. Too much criminal initiative going on in the country. Bank of Zambia doesn’t even seem to have control over Bureau’s paying different rates for different $100 bills based on when they were issued in the United States. Does age of a currency really depreciate it’s value even when it is legal tender? Copperbelt is particularly notorious for innovative criminality.

    • These malls should not be allowed to do that. Fine them heavily to discourage what they’re doing. If you slap a huge fine on them, you’ll see how quickly they stop the stup1d practice. If they don’t want shoppers to use their toilets for free, then they should close their malls.

  2. There will be always a difference between third word countries and developed countries. Third world countries(developing) will try to imitate like cheap Thursday, cheap Tuesday, boxing day, discounts etc but will not be a match.Fee paying toilets in shopping mall. Just accept that you will always remain behind despite artificial intelligence in 21 st century until you change your mind set.

    • Day 1, you step out of the country after winning YMCA ticket. Day 2, you post calling your country not a match! Day 3, they expel you on immigration issues you go back to your YMCA boasting “I’m Back”.

  3. It depends on where the shopping mall is located. If it is near a shanty compound, you know what to expect. Every Jim and Jack from the compound will be using the toilets

  4. Is it only me or others are just ignoring the beauty of this Ms Mwanza? Coming to toilets, Malls located near Shanty compounds if let unchecked the whole compound will shift their activities of answering the call of nature to the malls for free water, toilet paper making it very difficult to maintain these facilities clean.

  5. The toilets at ZERMART are very dirty and I should have expected the manager to talk about the dirt toilets also. The bad smile coming from these toilets are so bad that you wonder if this is a mall or something else.

  7. Indeed traveling opens up one’s eyes. Payments to use Toilets and/or paying for parking is NORMAL! Unless councils venture into such undertakings to raise even more money to keep those Toilets clean, no one will maintain cleanilines including; constant supply of Toiletries, soaps, tissues etc., etc .

    • Dont you know that you as a customer are paying twice for those services they are there to use for your convenience …that’s why its called indoor shopping mall

  8. It is absolutely wrong to charge people money to use public toilets in shopping malls ,restraunts , bars, bus stations ,schools ,offices etc.
    The owners of those business premises have a legal obligation to provide sanitary facilities to their customers otherwise they would not have been allowed to operate.it is their duty to keep those toilets clean .
    This has to stop even here in Lusaka.
    .60% of the people who walk in town daily do not have the 2 kwacha to pay for the toilet ,then what do they do?

    • No its not wrong at all..you find that some chaps ale lambwaza fye pa shoping mall elyo ngaumfwa umusana wafina abutukila na ku toi toi pa shopping mall mukuchaya open defecation..elyo ngachaya akapata kamo fye na shopping mall yonse yanunka…..very very bad indeed. Please make them pay!!!

  9. Malls near or within shanty compounds just have to charge otherwise you will have all those dirty and filthy chaps coming to sh.itt at the mall and who cleans for them. I also know of one guy who just helps himself at the mall says its more comfortable there than his own home.
    Tilyenji just change the rules mwana because even you as council you have leased out the toilets to others at bus stations so you raise money for what you know better. Just get a life and charge at a minimal fee say K2 its fine. The malls are now being visited by even people with no business but just to go and sh.itt there.
    Disaster!!!!

  10. The toilets should be free to members of the public who are also customers. Therefore the owners of the toilets should have the right to control that the public ate also customers, just like any restaurant anywhere in the world.

  11. Those malls near the so called shunty areas are benefiting from the dwellers of the areas, I would think that is the reason why these malls were built it is because they were attracted by the huge number of customers they would have and they have them.
    Those malls in return should reciprocate to the advantage they have so many customers, If they don’t like those dwellers then they better close and relocate where they will not be bothered.

    A failed project this country, never seem to amaze me. As I was reading this, I recalled that councils charge for using toilet facilities at council public places like at Lusaka City market… so why the double standard here?

    But I do agree that public places like shopping malls should never be charging customers for using their toilets. Problem we have in this sh*th0le country is anything for ‘free’ we abuse and ransack with no consideration for other users of the same facilities.

    But again the IQ of the mall owners is suspect. If they really wanted the public to pay for using the toilets, they could have just teamed privately with shop owners to hike prices by K2 so they can collect the fee on their behalf and pass it on to board corporate management without fanfare and…

      … and attracting the wrath of the council, problem solved. Think outside the box! I’m sure this what happens everywhere where there are ‘freebies’ for there is no such thing as free lunch. You know those cleaners need to be paid too!

      But anyway coming to the topic at hand..I also support the idea of charging people because ilyashi lya kunya lyalishupa sana..some people ngabaingila mu toi toi ..tu pata na ma bom yeka yeka.Elyo nga apwisha ukupanduka ashindila na ku chibumba elyo auma na depa…very stupid indeed.
