Kitwe Court convicts Chinese National who shot a woman, sparking riots in Chimwemwe Township

The Kitwe Magistrates Court has convicted a 43-year-old Chinese National who shot a woman, sparking riots in Chimwemwe Township in September this year.

Passing judgment , Magistrate Malota Phiri said the prosecution proved beyond reasonable doubt that Gaoen Ming indeed fired a gun and injured 19-year-old Roydah Mumba who is his employee.

Magistrate Phiri said from the seven prosecution witnesses and the convict’s own admission, Mr Ming was negligent in handling the gun and became a danger to society and himself.

She said he has found Mr Ming guilty of the offence of failure to take precaution against injury or damage contrary to section 40 of the Fire Arms Act which carries a fine or a two-year jail term.

Magistrate Phiri has however reserved sentence to Monday next week.

And on the earlier charge of unlawful wounding, Magistrate Phiri discharged the suspect because he was not convinced that the prosecution proved the case against the suspect.

He said from the evidence adduced, there was no malicious intent on the part of the accused to wound the woman.

  1. The judgement sounds crazy. If the woman was wounded why would someone who has admitted shooting her be acquitted of unlawful wounding? If you acquit him are you saying she wasn’t wounded or this wounding wasn’t unlawful? Learn your law properly you exam leaks products! And whats that I am seeing? A fine or two-year sentence for such a heinous crime? Atase people who injure others with guns deserve to be locked up a long time not two years

    • @Celebrity and @John: How can it be an accident and with no intent to injure if:

      He fired the gun. That is no accident. Why did he fire it at the poor woman? Why not in the air if he had no intent to injure?
      Unless you are a product of exam leaks use logic here

  2. It just shows he wanted to send a message to all his employees by intimidating them with his gun. This is not how a person with a gun licence must behave. A gun is issued for self defence not for threatening citizens who pose no threat. We all know from the records that a woman in Zambia is never that kind of threat to cause one to fire at her. It has never happened until the Chinese arrived. Ten years jail sentence should suffice

  3. What was the motive of this slave master to carelessly display his gun in public? Any charge for psychological traumatizing of workers? Anxiously waiting for Monday outcome.

  4. The Chinese are lungus paymaster generals , their money keeps him in power , nothing will be done, maybe a 3 to 6 month simple imprisonment…

    Ask any kaponya on the steet, the worst crime a Zambian can commit is to harm a Chinese…

  5. Section 40. Fire arms Act – Failure to take precautions against injury or damage (As amended by Act No. 13 of 1994
    Any person who, in his handling or care of any firearm or ammunition, fails to take reasonable or proper precautions against possible injury or damage to persons or failure to take precautions against property shall be guilty of an offence and liable on conviction to a fine not exceeding injury or damage fifteen thousand penalty units or to imprisonment for a period not exceeding two years, or to both.

    Both would be a better punishment, plus deportation.

    • Magistrate reseves rulling to monday in order to see if a brown envelop from china man can come over the weekend. Come monday the judgement will be suspended and a fake reason will be given in favour of a choncholi. That is Zambian court!

  7. I saw the CCTV footage, the Chinese man did not fire the gun, it accidentally fired itself while he was holding it, the footage shows he himself was in shock when the gun fired, not realising that the girl was also shot.
