Court warns Kambwili against further adjournments in his forgery case

The Lusaka Magistrate Court says it will take appropriate measures if National Democratic Congress (NDC) leader Chishimba Kambwili does not open his defence on March 20, in a case where he is accused of forgery and uttering false documents.

High Court Deputy Registrar David Simusamba, who sat as a Magistrate, says this is because Mr. Kambwili has been given enough time to defend himself.

Magistrate Simusamba says it has become a trend to adjourn the matter at the instance of the defence.

He said this after the defence asked for time to get more instructions from the suspect.

The defence also said the matter cannot go on because Mr. Kambwili’s new lawyer Musa Mwenye was attending to matters in the High Court.

The State expressed disappointment that progress has not been made despite the suspect having been placed on his defence last year.

Last week, Magistrate Simusamba threatened to issue a warrant of arrest for Mr Kambwili if he did not appear in court today.

This was after Mr. Kambwili failed to appear before Magistrate Simusamba on account that he was admitted to the University Teaching Hospital after being diagnosed with multiple comorbidities.

In this matter Mr. Kambwili was found with the case to answer and is supposed to open his defence

The suspect has not opened his defence due to adjournments.

    Talking about ECL, sir the ka Thursday holiday is seriously attracting a lone Friday of work. Kindly declare Friday a holiday so we can have a early 4DH in March.

  4. But this same Simusamba has been reported to ACC for extortion by Kambwili for asking for money. Lusaka Times you lagging behind. This was reported last week on Friday or Thursday in the Mast and you are reporting it today.

Looks like the courts are SO interested in Kambwili’s accusations but are very blind & deaf when it comes to the corruption relation to Overpriced road contracts, Mukula, 48 Ghost houses, gassing suspects, etc.. The Law needs to be applied the same on every Zambian as no one is above the law. While forgery must not be tolerated, the court needs to be careful how they are applying justice.

  6. Police need to URGENTLY find this criminal who committed the below crimes in the first instance…
    1: He attempted to kill Enoch Kavindele Jnr at Chrismar Hotel which is owned by Valden Findlay. He fired several shots at Enoch in the Chrismar carpark.
    2. He assaulted and verbally abused CAF officials live on TV and in full view of President Edgar Lungu at the Under 20 AFCON Final at Heroes Stadium in Lusaka.

    7: About 3 months He kidnapped, assaulted and falsely imprisoned several young men at Chita lodge in Kafue, he brandished his guns and through them in prison without cause.

  9. These are small cases!
    We should be looking for the biggest suspect who is making our Kwacha useless every day and causing a lot of suffering among Zambians! We have to shelf a lot of projects now because of cost over runs! Things are becoming expensive every day because of the depreciating Kwacha! This suspect can’t even find the root cause! It seems the solution is as elusive as the gassers! We may need a Commission of Enquiry to find out who is messing up with our Kwacha! It’s terrible! We know those who are getting easy money at the moment don’t feel it yet but it won’t be long!

    How is he going to defend a forgery case where there is overwhelming evidence of forgery . Wish him lots of luck.

    1. Convict the guy. Give him 5 days simple imprisonment and lock him up immediately.
    2 Make sure he is sentenced and locked up just before the upcoming long weekend on 9th April 2020.
    3. By the time the long weekend is over , He would have served his five days sentence and due for release.
    4. He will be an ex-convict.
    5. The appeal to the High Court will be academic.
    6. Then pay the corrupt magistrate his money for a job well done. ( What CK offered + 5 years salary + gratuity+ pension + commission = ZMW 1.5 million)
    7. Retire the magistrate in national interest.
