The Minister of Finance is Occupying his office Illegally-Edith Nawakwi

Forum for Democracy and Development (FDD) President Edith Nawakwi has alleged that the newly appointed Minister of Finance is illegally occupying the office.

Reacting to the appointment and swearing-in of the new Finance Minister, Ms. Nawakwi said that Dr Situmbeko Musokotwane has not yet been sworn in as Member of Parliament hence rendering his appointment null and void.

Ms. Nawakwi said that it is unfortunate that President Hakainde Hichilema wants to govern the country by not following the law.

The former finance minister has also questioned why President Hichilema alarmed the nation that the country’s coffers were empty when in fact they were not.

“The country has 4 to 5 months import cover besides that, the country is cashing in every minute at every border plus money from toll gates, where is that money”, she questioned.

Ms. Nawakwi has also advised President Hichilema to appoint a Minister of Agriculture who will execute the promises the UPND made during campaigns of reducing the cost of farming inputs.

“Am asking our President Hakainde Hichilema to ensure that the person he will appoint as Minister of Agriculture must reduce the cost of fertilizer to K250 as promised in the campaigns especially that the 2021-2022 farming is around the corner”, she said.

Meanwhile, opposition Patriots for Economic Progress (PeP) President Sean Tembo has charged that Zambia currently does not need an International Monetary Fund (IMF) bailout package.

Speaking when he featured on Tuesday’s edition of let the people talk program this morning, Mr. Tembo said that at his inauguration on 24th August 2021, President Hakainde Hichilema found $ 1.7 billion in foreign reserves and IMF had given Zambia Special Drawing Rights of $1.3 billion, bringing the total foreign reserves that Zambia has to over $ 3 billion.

Mr. Tembo argued that there is no reason as of now to put the country on an IMF package unless government fails to run the economy which he says is not the case currently because Zambia has a new government that has not yet started performing to say it has failed and warrant an IMF bailout.

Mr. Tembo said that as of now the country can go on the open market and get another bond at a better rate with conditions not as restrictive as IMF, since the country has a new government.

Mr. Tembo is also said that Zambia does not need an IMF bailout package now because the conditions attached to the IMF program are retrogressive.

However, the PEP president also said that he has faith in the UPND government because of its credibility in as far as managing the economy is concerned and has advised the government to only consider a bailout package from the IMF when they fail to run the economy.

  2. This is an interesting comment by this former minister of finance. I am not a constitutional lawyer but the last time I consulted the constitution section 116 talks about appointment of a minister, there’s no mention of the minister being sworn in as a member of parliament. Common sense tells me that as soon as the returning officer declares a candidate as duly elected as a member of parliament he/she qualifies to be appointed a cabinet minister. Ms Nawakwi shows her awful ignorance of the constitution. Previous presidents made appointments of ministers before they took the oath of office as members of parliament. I would love to know Ms Nawakwi Hambulo’s explanation of why it was acceptable for previous presidents to appoint ministers before being sworn in parliament?

  13. We have LAZ in this country, what are they saying? This matter is a legal matter since someone had mentioned illegality. Can we safely assume that these bodies such as LAZ, ECZ and others are just for academic interests?
    It appears to me that only the EAZ does play some role in so far as being relevant is concerned.

    Debt is an efficient tool for IMF and World Bank sharks. It ensures access to other peoples’ raw materials and infrastructure on the cheapest possible terms. Through their ideology of neoliberalism, they immediately start to impose economic restructuring and Structural Adjustment Policies (SAPs) that forces countries to spend less on things like health, education and development to ensure DEBT REPAYMENT. In effect, other development priorities will be shelved and poverty start to creep into the nations.
    Doesn’t this ring a bell? Yes, you guessed right. Don’t pretend that you don’t know this. Bad things are happening again.

  27. Mr Situmbeko Musokotwane was the finance minister during RB and there was rampart corruption. RB chodren were incharge of tenders and one of even ran away to S.A. So what corruption will he fight which he didn’t fight then? Anyone who says PF is corrupt and you were not there during RB’s time just know it was the same man who was in charge of running the economy. What did he do then with the corruption in the procurement in government? Why didn’t he resign on principle if he didn’t agree with what was going on then? My point is UPND should stop calling their friends thieves, corrupt, mismanage because of the person they have put as Finance Minister he is part of the problems we have now as a country.

    You can also go interview successful economists and academics to offer solutions on what the government could do with the massive debt. Legal issues, ask Constitutional experts and scholars for opinions.

  38. @2 Melvin Hamalambo, what has changed things is the ConCourt judgement about the Ministers that were said to have remained in office illegally. So Cabinet can’t exist in the absence of Parliament and Parliament is formed when members take oath of office. So Nawakwi is right. Bally isn’t still shivering, he’s waiting for a signal from Parley for him to appoint his Cabinet, however, he’s been caught up in a crisis where the 2022 budget to be presented by 30 September has to prepared and aligned to the UPND manifesto within such a short period of time

  39. Please help us by quoting the exact provisions of the Constitution that prohibits the President from appointing an MP before they are sworn in by Parliament. And they should read inter alia : President cannot appoint ( note that the wording : “may not ” still gives the President some discretion to go ahead ) .

    Let us not confuse traditions and Practices to Law.
