Harrington fights Siliya tribunal findings

FORMER Communications and Transport minister, William Harrington has applied for an order to quash the Dennis Chirwa tribunal findings clearing Dora Siliya of any wrongdoing in the RP Capital Partners deal.

In a counter claim filed in the Lusaka High Court, Mr Harrington said the decision of the tribunal to clear Ms Siliya of allegations under the Parliamentary and Ministerial Code of Conduct Act was illegal and unreasonable.

Mr Harrington has been joined as intervenor to an application for judicial review where Ms Siliya (also former minister of Communication) is challenging a tribunal finding that she breached the Constitution.

The tribunal investigating allegations raised by Mr Harrington and a consortium of non-governmental organisations (NGOs) cleared Ms Siliya but found that she had breached the Constitution for ignoring the Attorney General’s advice when awarding a contract to RP Capital Partners of Cayman Island to valuate Zambia Telecommunications Company assets.

In seeking an order of certiorari, Mr Harrington said the decision of the tribunal was contrary to the proper interpretation of Section 4 (a) of the Parliamentary and Ministerial Code of Conduct.

Mr Harrington argued that the decision was against the weight of the evidence and the tribunal’s finding of fact that RP Capital Partners went to the ministry through Ms Siliya.

He further states that Ms Siliya helped RP Capital Partners in securing the contract and that through her conduct, the firm would now directly earn a base fee of $2 million.

Mr Harrington is represented by Ellis and Company, Permanent Chambers and Kabimba and Company.
Lusaka High Court Judge Justice Phillip Musonda gave the parties up to June 8, this year to file their submissions.

  2. Sometimes i wonder if there is any fair justice. There has been a trend to clear serious cases and find some one with small cases to answer and leave big ones. One good Example. Kopoko now is charged with 1.9 billion but what about the difference? Harrington continue your Work. We miss you in Government.

We will never ever develop with this kind of crap going on in our country. in as much as the contract was awarded to RP and a fee of $2 million equivalent to what Kapoko plundered at MoH and the case being under investigation the RP guys went ahead with their work to evaluate Zamtel. We where all supriesd to see Siliya get away with her wrong doing and she is busy walking free anywhere and still enjoying ministerial powers looking at the way she was accomodated in livingstone by the just ended bussiness forum, i don’t know why mmd cadres supports these thieves bcause they are not given anything from whatever these thieves steal from Govt. we have seen a lot of ministers who are rich now than they were before, but cadres are ever poor like me, for sure how do you sopport someone to continue stealing while yoself are wallowing in poverty, when will these cadre realise their shallow minded, Go Go wilie, great move.

What interests do they have that they should push their weight around for the benefit of select companies? Harrington’s fighting the good fight.

  7. This is a dark side of the judicial system in Zambia. If Dora breached the constitution then what next if it was in developed countries? That could have been Dora facing criminal charge/s. There is law for the rich, Politicians and for ordinary people. Law has never been legalised to many ordinary people who have been denied their legal rights to be heard.
    Harrington we love you and May God bless you. RB has even failed to comment on Dora instead inviting her to attend govt meetings and still lives in govt house and using GRZ vehicles. Is this not corruption? If the govt is fight corruption, Shikapwasha, Dr Chitulo, Mabenga, Katele Kalumba, Teta and many ministers should face corruption charges.

What Dora did was very wrong and adsurd indeed, She shouId have followed the proper channel. know that it is beyond any resonable doubt that the tribunal tried very hard to alleviate Dora’s misdeed and mess by finding her guilty of defiling the law of the land and free from messing with the parley’s code of conduct. It is extremely obnoxious for Dora and Bwesani to think that zambians are dull. Iam dissapointed to note that only Harrington should be fighting the unbecoming behaviour and misdeed brought about by Dora. Wait a minute! Dora almost got away with it as she somewhat managed to convince Parley with all MPs buying it. It had to take the courageous Willie to call for a tribunal. Photos of RB and Dora tells us that she is in charge still. Zedians are fooled.

  14. HOW KAPOKO ‘MESSED’ UP EVERYONE
    Thanks to a jilted lover, the lid has been blown that exposes the worst corruption cases in Zambia.
    Rudo Tukuza Chitengu, a planner at the Ministry of Health and has a child with Henry Kapoko vowed to bring Kapoko down after a ‘marital’ dispute in February 2009.
    When Kapoko broke her arm in an ensuing fight, she reported him to the Police for assault and occasioning serious bodily harm.

  16. The Judicial system is supposed to be the branch to check the EC and consequently the whole of GRZ: In the check and balance model of the state. The problem is that the Judiciary seems to act under the wings of EC instead of being an independent entity.This is why everybody whats to be president or a minister so they can have some kind of immunity from the law. Worse off, those newly appointed ministers have a tendency to exercises there powers by pointing fingers at others. In actual fact they are the same. Its the system people, not individuals alone.

    She promised to bring his arrogant ‘ass’ down and bring his financial empire and that of his ‘bosses’ to the drain.
    She took matters in her own hands and made frequent visits to Kulima House (where the Anti-Corruption Commission (ACC) is housed).
    This resulted in a sensational case where Kapoko has been exposed. ACC picked Kapoko and restricted and seized his newly acquired assets. Among the assets seized is an executive lodge, Best Home Lodge built in Roma.

  18. Other vehicles impounded were two 4X4s, a BMW X5, and a GM Hammer. The ACC also seized two Mercedes Benz cars, two Lexus cars, a 30 tonne Nissan Truck, two pick-ups, a Mazda and Ford Ranger.

    o seek ‘protection’ Kapoko quickly offered his new but ill-gotten wealth to political parties and attempted to ingratiate himself to its leaders. Patriotic Front (PF) leader, Michael Sata was among the beneficiary. He was given undisclosed amount of money and he held several meeting at the lodge.
    Also, Rupiah Banda’s consultants during elections, from Bell Portinger a UK, PR and publicist specialist also stayed at Best Home lodge.

  19. Although acting as a whistle blower, Rudo Tukuza Chitengu has not been spared! She used her own ill gotten wealth received from Kapoko, to illustrate how Kapoko, Miti and others stole public monies.
    The ACC has however acted prudently seeing through Rudo’s anger and intention. The ACC has consequently seized or restricted Rudo’s flat no 27 ZNBS Complex in Musonda Ngosa Road in Villa Elizabetha.
    Her account at Intermarket Banking Corporation with a K200million deposit has been frozen. Her mother’s (Ann Ngoma) assets have also been frozen. Rudo’s assets in shares at ZANACO and ZAIN have also been restricted.

  21. Dr. Bulaya after many years away from the ministry and currently in prison still receives a monthly stipend from First Alliance Bank! One wonders what benefits Dr. Simon Miti receives after ‘enhancing’ the financial relation of Ministry of Health with the Bank.
    Investigators are also looking at Gupta’s other banking transactions. The bank is said to keep record and transaction of its valued and personal customers in the strictest of confidentiality.
    A separate ledger is kept and managed by Gupta himself away from the prying eyes of the bank staff and regulators.
    It is this ledger that has attracted attention from investigators.
    Dr. Simon Miti and others are said to appear on this ledger.
    So is Mrs. (Dr.) Maureen Mwanawasa who is said to have USD10million (K47bln) in her account!

  23. The extent of the theft of public monies for the period currently under review 2008 and partly 2009 is over K27billion. But the theft is said to be as high as K64billion since 2006.
    In these recent revelations, most of the monies have been paid to a newly established nursing school housed at a private house in Chudleigh, Lusaka.
    The school, ESU Nursing School has received over K7billion (USD1.2m) just in 2008, on the pretext that it is training government nurses, mid-wives and clinical officers and the continuous training of health workers through workshops.

  24. This is more money given to a single and private institution than government and legitimate nursing training institutions ever receive from the Ministry. These government nursing schools are lying in a state of disrepair and are run under deplorable conditions. Yet ESU Nursing School was paid over K7billion in one year!
    One of the Directors to ESU Nursing School is Joshua Ushibantu Simpaya, a Ministry of Health employee! However it is known that such persons as Simpaya and Henry Kapoko are mere fronts holding such assets in trust for the big fishes in loftier positions.
    The now infamous civil servant Henry Kapoko received over K10 billion for his lodge Best Home Lodge based in Roma, and for his other companies Hesaka Enterprise, Kahekam ltd.

  25. Other notable recipient was Royal College of Business and Management (Royal Secretarial and Management College) received K4.3billion in 2008.

    hile many are genuinely shocked at the extent and blatant acts of corruption at the Ministry of Health, it is however, not surprising to the critics who opposed the major policy shift that President Levy Mwanawasa undertook at the Ministry.
    The rot at the Ministry of Health is rooted in one single decision made by the government of Mwanawasa.
    On 25th July 2004, President Mwanawasa announced that he would abolish the Central Board of Health (CBoH) arguing that it employed the bulk of health professionals leaving hospitals and clinics unmanned. He also accused CBoH of carrying similar functions as that of the Ministry of Health.
    This position was supported by his Minister of Health, Dr. Brain Chituwo and his Permanent Secretary, Dr. Simon Miti.

  30. Chituwo informed the nation that to carry out the dissolution, government needed K400 billion to cover the cost of the structural changes and also required statutory amendments to the National Health Services act of 1992.
    He said that since cooperating partners had pledged to meet some costs of this transformation, he hoped that they supported the dissolution idea.
    When Dr. Simon Miti pushed hard for the abolition of Central Board of Health (CBoH), many didn’t see the sense or fathom the logic behind it.
    This is because CBoH was a successful and efficient health delivery system that had ensured that healthcare country wide was delivered while the Ministry of Health remained preoccupied with policy issues and only played supervisory and regulatory roles.

  71. I have read the full text of the data on corruption being quoted here. I have seen similar data posted on the internet before, many a time without even the author’s name being mentioned. The present posting is titled, ‘CORRUPTION? WHOSE CORRUPTION?’ The earlier posting which was released at the height of the Zambian Airways saga is titled, ‘ WILL RUPIAH BANDA GET HOLD OF HIS GOVERNMENT?, again no author mentioned. Reading through the texts, one can clearly identify the intended propaganda in the postings. The texts are typed from the same computer, with the same font size and without missing the main theme of the texts – PROPAGANDA. I have never fallen prey to the propagandist.

  74. Fontini’s never cease to maze me. How can you over rule the findings of an independent body that has overwhelming evidence against Don inshiba. I think this is not about shelding Dona Inshiba, there is some Minister of Banda himself dating with her. Why has she received so much protection?

  96. After analysing the recent happenings in terms of MOH and relating it to the Dora saga, I think that Dora deserves a benefit of doubt. WHY? It appears the civil service hirechy is endemic with corruption, they know that as long as ‘PROCEDURE’ as outlined in govt docs is followed regardless of whether its abused or not, is not a problem. E.g get friendly businesses to supply with huge kickbacks to civil/s. Politicians, PSs, procurement officers + other senior civil servants can easily collude to benefit themselves while following tender procedures. My suspicion is that Dora had a hint and stopped it, unfortunately breaking procedure in the process. Obviously those deprived in the process had to fight the decision. so it could be a chicken and egg thing.

  99. CM …I think you are missing something. Dora was 100% involved in the scandal at Ministry of transpor. She was doing things alone so she could benefit alone. The guys were not happy that they had no share in it and leaked data. Dora is quilty thats why she is trying by all means rebuild her image. But why cant she use the image builders of Nyama Soya????

  101. Thanks Kambongolo. I am not sure about “100%” involvement in the “scandal”. You could be right, all possibilities are there. But the point is those civil servants and other pipo of influence could also have had links with competitor companies, and may not have been happy that after all the “procedure” that could have been abused to win them the contract was thrown to the wind. We heard about night visits in a bid to secure a contract for a friendly company. At the same time Dora may have also seen some benefits coming to her, though so far no one has given evidence of gratification to her. So anything is possible.

  106. it is right that Dora applealed that descsion. the constitution provides for her to seek ‘legal advice’ from the Attorney General, it does not compel her to accept the advice, though to do so would be desirable, lets analyse issues properly, further, much as i admire Harrington, i hope he has a lot of money to pay legal fees. President Mwanawasa (late) stated when he swore in Mumba Malila, that your job is to give me legal advice, i do not have to take that advice.

  108. May be Dora is not an angel, as her tribunal proved to us after all. However, I suspect Harrington’s mission is not about Dora. It is about 2011, and I’m sure this is not all we are about to hear from him!!!! The problem is that he is now appearing to be over-milking an issue that people are begining to put behind them. All eyes are now on K27billion. To belabour an issue that has been sat over and some judgements already made and the culprit no longer in govt, is a waste of time. Harrington needs political strategy advisors!

  110. #173 yes manty i agree with you. no less than our very own state counsel defined the role of the attorney general in precise terms. and note that our mr harrington and others were satisfied with the tribunal’s findings until dora decided to launch a challenge. as to whether mr harrington has a lot of money, i do not think that is an issue. if you carefully read the post stories and editorials these days you will realise that there is a 2011 syndicate, and harrington must be part of it whether he is aware of this or not.
