It is immoral for UPND to comment on President Lungu’s eligibility -Ndoyi

Prince Ndoyi the young politician from MMD known for his criticism of the opposition UPND and their leader Hakainde Hichilema says it is immoral for the opposition party to comment on the eligibility of President Edgar Lungu because they have more skeletons in their closet that they need to deal with themselves.

The Constitutional Court is set to make a landmark judgement on Friday as Constitutional Court judges will rule on the eligibility of the Republican President in the 2021 election which the UPND has said they don’t expect the ruling to be against President Lungu.

But Ndoyi has described UPND’s statement as careless, reckless and irresponsible adding that the opposition party has no ‘Loci Standi’ to comment on the matter because their leader should not have been a contestant in 2015 to start with because he had already participated in 3 elections.

“How does a National Chairperson of a party make such an irresponsible statement on behalf of the whole political party? Let’s be civil. Infact it’s immoral for UPND to comment in whatever form, on the eligibility of President Lungu.

The young politician said it is an open secret that the UPND are praying that the Concourt’s ruling can disqualify President Lungu because they are certain that with him in the race in 2021 the election is a foregone conclusion.

He scoffed at the notion that the opposition party leaders are showering praise and calling Hakainde Hichilema the incoming president describing their praise as the highest order of hypocrisy.

“It’s bogus to hear, them showering praise on HH as an incoming President. Aren’t they ashamed, learned lawyers and MPs calling HH their candidate for 2021. Let’s be real and serious, it’s hypocrisy of the highest order.

“They have failed to mobilize their moral conscience to recalibrate their position on this perpetual contestant of HH on the presidency,” he said.

He further mocked the opposition that they should use the same energy they have injected in the eligibility of President Lungu in dealing with the illegality of maintaining their leader as a candidate in perpetuity.

“They should use the same energy in dealing with this illegality of maintaining HH as a candidate in perpetuity. They should instead identify another candidate other than insisting on the same candidate who has lost 5 elections.”

He further laughed at UPND supporters for giving lame excuses against the reason for Hakainde’s unchallenged stay at the helm of thier party.

“How can a whole lot of a party give such a lame excuse that we allow him to stand because we love him? Love alone cannot be the basis to be used for an illegality or the obstruction of other fresh minds taking over the party.

“That is why I started a proposal of a law, to bar perpetual aspirants at presidential level. The onus lies on the Zambian people to define this issue by rising above who is heading PF or UPND today. Who should under normal circumstances be disqualified, between HH and President Lungu. And Zambians ask them to answer these questions objectively.

“Lungu has stood two times while HH on the other hand has stood five times. Who instead should not stand on moral grounds? President should not be bothered, we implore him to focus on the mandate given to him,” he said.

He added “Friday’s ruling has nothing to do with disqualifying anyone, and it cannot be reduced as such. All the Concourt will do is interpret a constitutional provision in view of 2021, that’s all.”

Green Eagles continue to shine as all four Zambian clubs advance

Green Eagles advanced to the first round of the 2018/2019 CAF Confederation Cup after beating Young Buffaloes of eSwatini 3-2 away on Wednesday to go through 5-2 on aggregate.

Debutants Eagles thumped Buffaloes 2-0 in the first leg tie of the preliminary round played in Choma last week.

In the return match, Eagles had scored through two-goal hero Anos Tembo and Spencer Sautu before the home side attempted to come back into the game with second half goals.
Tembo registered his goals in the 10th and 28th minutes with Sautu scoring after 14 minutes.

Dlamini Phiwa grabbed a second half brace with goals in the 76th and 84th minutes.

However, Coach Aggrey Chiyangi held on to the 3-2 lead to advance.

In the same competition, Green Buffaloes on Wednesday forced a goalless draw at Al Merrick Juba in South Sudan to advance to the first round with a 2-0 aggregate score-line.

Meanwhile, Zesco United and Nkana have all advanced in the CAF Champions League.

Three more District Hospitals earmarked for Lusaka

Government says three more district hospitals have been earmarked for construction in Lusaka, in order to provide access to improved health care services.

Minister of Health Chitalu Chilufya said the three district hospitals which will be located in Chawama, Kanyama and Chipata compounds are expected to be ready by 2020.

The construction of the three hospitals will bring the number to five district hospitals in Lusaka district, following the earlier construction and commissioning of Chilenje and Matero first level hospitals.

Dr Chilufya was speaking at a function at the residence of Japanese Ambassador Hidenobu Sobashima, to celebrate the birthday of Japanese Emperor Akishino.

The Japanese Emperor turns 85 years on December 23rd this year, and will abdicate the throne on April 30, 2019. His Imperial Highness Crown Prince Naruhito is expected to accede the imperial throne on May 1, 2019.

Meanwhile, Dr Chilufya said Zambia values the long standing relation it shares with Japan since the establishment of diplomatic ties in 1964, which are premised on the promotion of democracy, good governance and economic development.

The Minister further praised the Japanese government for the continued support to strengthen health systems in the country.

Dr Chilufya noted that a similar health project will soon be rolled out to the Copperbelt Province where two district hospitals are expected to be constructed in Kitwe.

And speaking earlier, Japanese Ambassador to Zambia Hidenobu Sobashima said Japan will continue to support Zambia’s agenda to become a middle income nation by 2030.

He said Japan has to-date given Zambia over 2 billion United States dollars for infrastructure and human resource development.

He also noted that over 4,000 Zambians continue to receive training under the Japanese International Cooperation Agency (JICA) and over 1, 500 Japanese volunteers are in the country offering various technical assistance under JICA.

The Japanese envoy said he will strive to ensure that Zambia and Japan deepen their trade and bilateral relations to benefit both countries from their long standing friendly and cooperative relations.

Ambassador Sobashima also commended Zambia for maintaining peace and stability since independence and for its role played in promoting peace and security in the region.

The Japanese envoy further praised Zambia for opening its borders and offering over 73,000 refugees a safe heaven and integrating over 23,000 Angolan and Rwandese immigrants.

President Edgar Lungu is later this month expected to undertake a state visit to Japan at the invitation of that country’s authority.

Farmers Union accuse Authorities of trying to legitimise the importation of GMOs food into Zambia

The Zambia National Farmers’ Union says it is aware of manoeuvres by certain quasi-government Authorities that are trying to propagate the importation of Genetically Engineered Foods into the country.

These authorities are trying to scheme ways of legitimising Genetically Modified Foods in the country at the expense of what Zambia has safeguarded for years.

ZNFU President Jervis Zimba said Zambia is a non-GMO country, and any manoeuvres towards legitimising GMOs will have far reaching implications than it can comprehend.

Mr. Zimba said the ZNFU will not subscribe to GMOs and shall reject processes that seek to sneak into the country or dump GM foods on our market.

He said the sector that will be hurt most if GMOs are allowed is the agriculture sector and farmers will be the worst affected.

Mr. Zimba lamented that the mushrooming Authorities are causing headache to the farming community and government should be wary of the intentions of some of the quasi-government Authorities.

“Most of them do not mean well to the country’s growth agenda. We are aware of some of the people propagating this. ZNFU will fight and thwart all efforts bent on legitimising GMOs. This country has made huge sacrifices to reach this far and the Union will not sit idly by while wrong things are being done”, He said

President Lungu calls on the Zambia Correctional Service to continue with its Agro Production

President Edgar Lungu has called on the Zambia Correctional Service to continue with its agro production which is making the service self-sustaining.

Speaking when he swore in Chisela Chileshe as Correctional Service Commissioner General, President Lungu noted that the service has made significant progress in agro production and diversification which needs to be sustained.

The President has also tasked Dr. Chileshe to also focus on improving the welfare of inmates through upgrading infrastructure in the service.

He said incarceration does not mean loss of human dignity.

President Lungu added that while Zambia’s correctional facilities have improved since 2011, more still needs to be done.

Dr. Chileshe was Deputy Commissioner General of Administration and Finance prior to his appointment on November 9th, 2018 to replace Percy Chato.

And Dr. Chileshe has told ZNBC News in an interview that he will work hard with his team to build on what his predecessor started.

He said it is possible for the 21-thousand 6-hundred inmates to have well balanced meals from their hard work in the various farms belonging to the correctional service.

Dr. Chileshe added that the service has already been given 4 point 6 million dollars by the World Bank to improve its irrigation system.

He said the service is also now venturing into livestock and making its farms independent to enhance production levels.

EU signs 20 million Euros agreement to improve public financial management in Zambia

The European Union and the German Technical Cooperation -GIZ- have signed 20 million Euros agreement to improve public financial management in Zambia and to establish irrigation systems for smallholder farmers in lower Kafue area.

European Union Ambassador to Zambia and COMESA Alessandro Mariani says Zambia has made tremendous progress in the promotion of irrigation farming, hence the need for stakeholders corroboration to grow the sector.

Speaking during the signing ceremony, Mr. Mariani said the program on effectiveness and transparency in the management of public resources will contribute to the improvement of the planning, budgeting and budget implementation processes.

And German Ambassador to Zambia Achim Burkart said accountability and transparency in public financial management as well as prudent natural resource management are essential in delivering social services for all Zambians.

Government launches the SADC seed certification and harmonized seed regulation system

Government has launched the Southern African Development Community (SADC) seed certification and harmonized seed regulation system.

Minister of Agriculture Michael Katambo says the launch signifies that Zambia has capacity to produce seed that can be traded across the SADC region.

Mr. Katambo says the launch is in line with the national agriculture policy whose overall agenda is to increase access to quality seed that assures increased production and productivity.

Mr. Katambo said this in a speech read on his behalf by Ministry of Agriculture Permanent Secretary Julius Shawa at Seed Co Zambia Business Park in Lusaka West.

And speaking at the same function United States Agency for International Development (USAID) representative for the Seed Trade Project Takele Tassew says SeedCo Zambia will for the first-time plant and harvest three seed varieties under the SADC harmonized seed regulation system.

Meanwhile SADC Food, Agriculture and Nutrition Resources senior crops officer Esaiah Tjelele said Zambia is leading the region in terms of domesticating the harmonized seed regulation system.

Mr. Tjelele said SADC member states will depend on Zambia to learn how they can upscale their activities in variety registration, certification and quarantine and phytosanitary issues.

The Health Professions Council of Zambia has reinstated two programmes that were withdrawn at the Copperbelt University’s Michael Chilufya Sata School of Medicine in Ndola early last month due to a number of irregularities.

The Health Professions Council of Zambia had withdrawn recognition and approval of Bachelor of Medicine and Bachelor of Surgery and the Bachelor of Dental Surgery after a compliance monitoring inspection revealed a number of irregularities.

These included gross over-enrollment of students, an inadequate number of lecturers, engaging unregistered and unlicensed lecturers and failure to index students.

HPCZ Senior Public Relations Manager Chinyota Msimuko said at a media briefing that the reinstatement of the two programmes comes after CBU met the minimum prerequisites.

Mr. Msimuko said the Copperbelt University met the minimum prerequisites and committed to an agreed rectification road map to continue addressing all remining recommendations.

Government withdraws motor vehicle replacement allowance for Cabinet Ministers

Government has withdrawn the motor vehicle replacement allowance for Cabinet ministers effective January 1, 2019 in adherence to the austerity measures government has put in place.

Secretary to Cabinet Roland Msiska said government has made the decision because it is fiscally untenable to continue providing the allowance at the fixed monthly rate of K32, 715.20 for each Cabinet and Provincial Minister which was being effected through the payroll.

Dr Msiska announced the development in a press statement issued to ZANIS in Lusaka yesterday.

He stated that the introduction of a motor vehicle replacement allowance was seen to be more cost effective as government would not have to spend more on maintenance and insurance of motor vehicles for ministers.

Dr Msiska explained that since independence, ministers and parliamentary presiding officers have been entitled to personal to holder and utility vehicles and fully furnished houses.

He said this was however revised by Government through circular 12 of 2018 issued on June 15, 2018 which abolished the provision of personal to holder motor vehicle and free furniture and introduced the motor vehicle replacement allowance.

Dr Msiska said the abolishment was in line with government’s pay policy of 2009 and recommendations of the Salaries Review Report of 2011 to rationalize and harmonise salaries and conditions of service in the public service.

He further added that the abolishment was in line with government’s implementation of austerity measures in view of the country’s current fiscal challenges.

Dr Msiska said all affected and eligible offices shall revert back to their previous conditions of service which require that they are provided with personal to holder vehicles and furnished houses.

The Secretary to Cabinet explained that requests by Members of Parliament to have the motor vehicle replacement allowance extended to them was unjustified as they were not entitled to in their conditions of service.

Dr Msiska explained that emoluments presently payable to Ministers and Parliamentary Presiding officers are provided under the ministerial and parliamentary offices Emoluments Act Cap 262 of the Laws of Zambia.

He said Statutory no. 63 of 2018 as amended is the emolument that is in force providing for special allowance, utility and constituency allowance and that personal to holder entitlements for Members of Parliament are not statutory but effected through circulars issued from time to time by the Secretary to Cabinet.

HH, Kambwili to lead streets protests over “illegal” salary hikes for Ministers

The opposition UPND and the National Democratic Congress have agreed to jointly hold peaceful demonstrations over the decision by government to award Cabinet Ministers and the President 100 percent salary and allowances increments backdated to January 2018.

The two opposition parties contend that the decision is illegal as it was down without parliamentary approval.

UPND leader Hakainde Hichilema and NDC Consultant Chishimba Kambwili have since appealed to all public sector unions to join the protest.

The two leaders disclosed their plans during a joint news briefing held at Dr Kambwili’s residence in Lusaka.

They were flanked by UPND Deputy President Geoffrey Bwalya Mwamba and NDC Vice President, Joseph Akafumba.

Mr. Hichilema said the two political parties have decided to come together and speak on behalf of Zambians whose welfare is at risk in the hands of the PF.

He said the PF has continued to recklessly spend public resources on expenditures that have nothing to do with the majority Zambians.

Mf Hichilema revealed that the two political parties will on Thursday lodge in a notice of protest to the Zambia Police Service in order for Zambians to stage a peaceful protest demanding for the revocation of the statutory instrument on the increase of the allowances and salaries.

“After a consultative meeting with our colleagues from the NDC, it has been resolved that we take any available and legal means to recover the illegal allowances that the PF has paid its President and Ministers. You have heard what my brother CK has said about those allowances. K41,000 each for a few individuals per month as salary increment is very inhumane when the majority of our people are getting very meagre salaries,” said Mr Hichilema.

“And then as if that is not enough, that hefty allowance has been backdated to January 2018. Why are people this selfish. We shall do this for Zambians and not for Kambwili or Hakainde, “he said.

“We shall also demand that the Concourt ruling on the Ministers that drew salaries after the dissolution of the 2016 parliament is enforced and that money is refunded in full to allow our hospitals get stocked with medicines as well as educate our students whose allowances have not been paid over time,” Mr Hichilema said.

The UPND leader said Zambians are in serious trouble and that this calls for all Zambians to join hands and demand for accountability from the PF government

“And it is our prayer that the police not be found wanting by standing against the people,” Mr. Hichilema said.

Mr Hichilema questioned the level of decision making in the PF government where people can spend $ 68 million to buy a Gulf Stream Jet for the use of five people when that money could have been used to address the several ills in the country such as the lack of medicines, the lack of adequate farming inputs as well as educate more than 30,000 university and college students.

“I just can’t seem to understand the thinking of some people especially when it comes to service delivery. $68 million Gulf stream jet for five people when national poverty is skyrocketing.”

“It is inhuman for the PF to spend over 60 million dollars to buy a jet that will be used by four or five people when the majority of Zambians are suffering. That money can take 30, 000 children to school and help procure medicines for our hospitals”, Mr. Hichilema lamented.

And Dr. Kambwili has called on all public sector unions including the police and the Military to join the planned peaceful protest as they are the ones that have been denied a normal and sustainable salary increase on assumption that there is no money in the treasury to warrant a huge increase.

Dr Kambwili said the increase which is outside the Ministerial and Parliamentary emoluments is illegal as it was effected without approval from parliament which is mandated to approve such increments.

He called on Zambians to stand up and ensure that the PF is not allowed to have a free thieving spree when the country is bleeding from poverty and hunger.

He further said the opposition is ready to use any available avenue to ensure that the money is returned to the treasury which will include the courts as the increase is not only illegal but also unconstitutional hence the need for it to be challenged vigorously.

Dr Kambwili explained that his legal team in September wrote to Secretary to Cabinet for advice on how much he owes the treasury for the salaries and allowances drawn during the period that parliament had been dissolved in 2016 as he was ready to pay back the money he allegedly owes Zambians and that he was awaiting Secretary to Cabinet response.

“For your own information, I have written to the Secretary to the Cabinet asking him where I should pay the money, the Concourt ruled and I will pay back that money having received it when I illegally stayed in Office”, Mr. Kambwili added.

But PF Media Director Sunday Chanda accused the two Leaders and their Vice Presidents of lacking the capacity to provide credible checks and balances to the government.

Nkana beat Songo to advance in the CAF Champions League

Nkana are through to the pre-group stage of the 2018/2019 CAF Champions League after eliminating UD Songo of Mozambique 3-1 on aggregate.

Kalampa on Wednesday edged Songo 1-0 at home in Kitwe in the return leg of the preliminary round match played at Nkana Stadium.

Midfielder Kelvin Mubanga converted a 43rd minute penalty after South African referee Thando Ndzandzeka pointed to the spot when Walter Bwalya appeared to have been fouled in the visitors box.

The decision didn’t go down well with Songo whose players and coaches protested for close to five minutes.

Ronald Kampamba missed a chance to put Nkana in the lead after 13 minutes when he fluffed in the box after being set up by Harrison Chisala.

There was another miss by Walter Bwalya whose header was saved by keeper Charles Swini in the 39th minute just after Songo’s Manuel Kambala had shot wide.

It was a match in which Nkana dominated possession but failed to create the needed clear chances on the day.

Nkana will now face Simba of Tanzania in the first round of the competition in two weeks time.

The Young African Leaders Initiative is concerned with the incessant attacks being showered at the Constitutional Court a few days preceding a crucial judgement regarding the 2021 eligibility case of President Edgar Lungu on 7th December, 2018.

YALI President Andrew Ntewewe said his Organisation has noted with great disappointment sentiments attributed to supposedly imminent people who have even reached the point of demanding the abolishment of the Constitutional Court.

“YALI wishes to be very clear and put on record that we find such utterances very shameful and unacceptable. We once again want to recapitulate, that as a democracy institution, we strongly believe in our institutions of governance”, Mr. Ntewewe has said.

He reminded citizens that all Zambians have a responsibility to protect the integrity and sanctity of the judiciary.

“Judicial independence is a very important pillar in a democratic society. This is because as a foundation for democracy, it is the source of perennial vitality and the beacon of hope for the nourishment and growth of democracy”, He added.

He has since called on all parties in the eligibility case, to exercise maximum restraint, maturity and sobriety further reminding them that they went to court because they believed in the first place in no uncertain terms that the court is a fountain of justice.

Mr. Ntewewe said whatever, the outcome, the Court must be respected, knowing that only one party can be a victor.

He has warned that if the incessant attacks continue even after the judgement, YALI will not hesitate to be the ones that complain to the Director of Public Prosecutions with a view to institute contempt proceedings.

Global Crude Oil Price Plunges, Government Should Reduce Fuel Prices Immediately

On October 2nd, 2018, Zambian Energy Regulation Board (ERB) Chairman, Mr. Raymond Mpundu announced nationwide upward fuel price adjustment stating that the “[crude]oil prices have increased on the international market”.

Whilst that could be a valid reason for any government to adjust the fuel prices, The Movement for Economic Emancipation (MEE) and other responsible entities, were at variance with the reason stated for the increase and issued a statement challenging the rationale behind the upward adjustment of the commodity at the pump.

Zambias fuel price increases are a farce and sham

MEE’s stated reason for challenging the government for this price upward adjustment, at the time, was that “it was not the first time the Zambian government had given this questionable explanation to justify the increase on fuel prices”.

MEE further stated and explained that according to the Energy Information Administration (EIA), there is still an abundance of Crude Oil Commodity inventory around the world, despite the upward adjustment in Crude Oil Commodity we have seen (in Zambia) lately.The successes of improved crude oil extraction technologies in horizontal drilling and fracturing is the reason we have an abundance of the commodity in inventory.

Though we continue to experience rapid fluctuations in the pricing and an occasional upward spike resulting from geopolitical imbalances, these fluctuations are widely believed to be non-sustaining and are easily countered by the supply abundance.MEE also believes that the government should be justified to make needed price adjustment in those circumstances.However, what the Zambian government has not been known to do was making those similar downward price adjustments when the Crude Oil Commodity price on the global market adjusts in the downward direction.

According to Bloomberg News – Commodity Markets (Energy), in the months of October and November alone, the Crude Oil Commodity on the global market has plunged from the high of $86.29 per barrel on October 3rd, 2018 to a low of $58.71 as of November 30th, 2018 on the Brent Benchmark (there are 42 gallons in a barrel).This drop alone represents a remarkable $27.58 per barrel or 32% plunge in the Crude Oil Commodity.

MEE conducted a representative survey, around the world, on fuel pump prices and the indication is that there is a corresponding downward price adjustment from around the world due to this declining Crude Oil Commodity on the global market.MEE would like to appeal to ERB and its Chairman, Mr. Mpundu, and the Zambian PF government to give a fuel price break to the citizens of Zambia as we go through economic challenges.

We believe and are ready to challenge the ERB argument that the current crude oil feed was purchased previously.Unless the ERB is willing to reduce the price of fuel in the next few days, that argument is of no consequence.

We believe that the Zambian government sources its Crude Oil Commodity from the same place where the majority of countries source its feed.It is therefore disingenuous on the part of ERB to not reduce the fuel prices accordingly.We would also urge the ERB to consider hedging strategies at these low prices to ensure the stability of fuel prices in the country.

As a citizen led movement, MEE echoes the voices of millions of all of us ordinary Zambian citizens appealing to the PF government to extend the benefits of these sustained reduction in world crude oil prices to us.

We desperately need an expenditure break in these very economically challenging times.

Zambian experts in climate change urged to educate the public

Lands and Natural Resources Minister Jean Kapata has urged Zambian experts at the ongoing climate change meeting in the Polish city of Katowice to get a share of the resources needed to implement climate change programs and projects in Zambia.

Ms. Kapata, who is also Member of Parliament for Mandevu constituency said the experts needed to ensure that they did not leave the meeting empty handed.

“You heard the Secretary General of the United Nations’ message to this conference that we are in deep trouble as an international community owing to our failure to quickly address climate change”, the Minister said as she encouraged the 13-member delegation to embrace their responsibilities seriously.

And Permanent Secretary in the Ministry of Lands and Natural Resources Mr. Trevor Kaunda urged the experts to help create an understanding among lawmakers and ordinary people what they were doing in climate change.

He noted that while there were projects addressing climate change in various constituencies, experts needed to devise ways of educating the public to understand them as such.

“When you visit constituencies, MPs may be asking what you are doing there in climate change because your work as experts is also to show both lawmakers and ordinary people the linkages”, Mr. Kaunda said.

On his part, Zambia’s Ambassador to Germany and Poland Anthony Mukwita told the Zambian delegation that his mission is expected to make follow ups beyond COP 24.

“There are decisions to be made at this conference and it is our duty as an embassy to play our part in ensuring the implementation of promises made”, said Mr. Mukwita.

The Zambian team of experts has divided itself into the five major thematic areas of the conference that include resource mobilization, technology, capacity building, and issues related to the operationalization of the 2015 Paris Agreement.

The two-week-long conference that ends on the 14th of December is expected to come up with a framework of implementing the Paris Agreement on Climate Change.

Zambia experienced devastating effects of climate change between 2015 and 2016 when rainfall levels dropped drastically forcing mining companies to slow down copper production due to shortages in energies as load shedding kicked in while the crop yield reduced drastically due to power harvests resulting into house hold poverty.

Zambia depends largely on hydro generated power therefore making it an easy victim of adverse climate change effects such as droughts and floods.

Cognisant of the harsh reality of climate change bad effects President Edgar Lungu on receiving the invitation passed the relay stick over to Minister Kapata and her delegation that includes PS Trevor Kaunda as a show of commitment to the global cause.

Some 28,000 diplomat’s government officials, activists and scientists including some 40 heads of states and governments are attending the conference that must shape the way the globe can keep global warming at below the dangerous spot of 1.5 degrees Celsius.

Execution of Judgment in Former Ministers Case : LAZ and UPND are key culprits

As the Green Party, we troubled by the silence from the Law Association of Zambia (LAZ) and UPND on the execution of the famous judgment against former ministers. Non-execution of this judgment is wrongly projecting a negative narrative of the Constitutional Court. We blame LAZ and UPND as key culprits of the negative public perceptions for reasons outlined below.

It is now more than two years since judgment was delivered and there no execution. We are troubled because execution or enforcement of a judgment, which follows the logical pronunciation of the same by the judge or magistrate, must be taken seriously as it is one of the most important aspects of the administration of justice in any society where the rule of law thrives. By execution, we mean quite simply the process for enforcing or giving effect to the judgment of the court. It is the last stage of a judicial process after the legal right, claim or interest has been determined on the merit in a judgment or order by the court.

Every judgment must be obeyed and is effective from the date of its delivery or from such a date stated in the judgment itself. The judgment is meant to be obeyed without demand and if there is default in obedience, after a period of grace, which can be between three to fourteen days, as the rules may prescribe, the judgment creditor is entitled to commence enforcement proceedings. A judgment is valid until set aside on appeal, and as such, must be obeyed.

To the best of our knowledge, there is not on appeal on that judgment. And it has not been set aside. Even if it was on appeal, we are not aware of a court order to stay its execution. So, LAZ and UPND are rightly entitled to fruits of that judgment by way of execution. If the judgment is unenforceable, for one reason or the other, LAZ and UPND are duty bound to come out in the open and tell the nation about the development so to clear negative public perceptions.

LAZ, especially, has a constitutional duty to ensure that the public generally hold the view that judges and court staff treat people who have business before the courts with respect and dignity. The positive image of the court system centers on three key aspects: perceptions that the courts meet constitutional obligations to protect rights; that litigants have adequate legal representation; and that judges are well-trained and are honest and fair in individual case decisions. Perceptions that courts are too slow; unfair in the treatment of the opposition and nonentities in society; are out of touch with the public; or are negatively influenced by political considerations, are inimical to the justice system on any nation.

The public should not believe that the courts handle cases in a poor manner. On balance, the public should approve of, and trust the state courts. Overall, public perception should be that courts handle cases in an excellent manner. We urge LAZ to promote this narrative starting with execution of the judgment against former ministers.
