Police in Chilubi have arrested former Member of Parliament, Obvious Chisala for allegedly breaching the Electoral Code of Conduct.

Both police sources and District Electoral Officer, John Mwanza, have confirmed the arrest of Mr Chisala.

Mr Chisala, who is also former Community Development Deputy Minister, has been charged with conduct likely to cause a breach of the peace together with five of his supporters.The accused have since been transferred to Samfya district where they are expected to appear in court today.

The former MP, who is re-contesting the Chilubi seat as an independent candidate, is together with his supporters alleged to have attempted to disrupt a PF rally held at Chifwenge area on Wednesday that was being addressed by the PF candidate, Rosaria Fundanga.

District Electoral Officer, John Mwanza, has appealed to all the six candidates contesting the Chilubi Parliamentary seat to conduct peaceful campaigns.

Prof Lumina post-election Thank You flier

United Nations (UN) member states have elected Zambian law Professor Cephas Lumina as member of the Committee of the Rights of the Child (CRC) from 2017 to 2020 at the elections held on Thursday at UN Headquarters in New York.

Prof Lumina was one of the nine that were elected out of 17 candidates.Other newly elected members are: Renate Winter (Austria), Amal Salman Aldoseri (Bahrain), Velina Todorova (Bulgaria), Olga A. Khazova (Russian Federation), BenyamDawitMezmur (Ethiopia),Mikiko Otani
(Japan), Ann Marie Skelton (South Africa) and Luis Ernesto Pedernera Reyna (Uruguay).

Zambia’s Permanent Representative to the UN ambassador Dr Mwaba Kasese-Bota conveyed its gratitude to the Members of State Parties to the Convention on the Rights of the Child for support the Zambian candidate, and congratulated all the newly elected members of the CRC.

Dr Kasese-Bota commended the Government for fielding a candidate in the election and supporting his candidature.She expressed gratitude to the diplomatic staff for their tireless efforts to campaign and ensure that Prof Lumina was in one-round ballot.

The Ambassador said Zambia’s good standing in the eyes of the international community, make it highly favoured for consideration to take up international assignments for the good of humanity as was the case in election of Prof Lumina.

Lumina is a Professor of Law at University of Fort Hare in South Africa and previously served as Independent Expert on foreign debt and human rights at United Nations Human Rights.

Lumina holds Bachelor of Laws degree from the University of Zambia,Law with Merit Zambia, Master of Laws in International Human Rights Law from University of Essex in United Kingdom and PhD in International Human Rights Law from Griffith University, Australia among other academic and professional credentials.

According to First Secretary for Press and Public Relations Permanent Mission of the Republic of Zambia to the UN Chibaula Silwamba, Prof Lumina has over 25 years’ legal practice, research and teaching experience in several countries including Australia, South Africa,Swaziland, Sweden, Uganda and Zambia.

The CRC is the body of 18 Independent experts that monitors implementation of the Convention on the Rights of the Child by its State parties.

The CRC also monitors the implementation of two Optional Protocols to the Convention, on involvement of children in armed conflict and on sale of children, child prostitution and child pornography as well as an Optional Protocol on communications procedure which will allow
individual children to submit complaints regarding specific violations of their rights under the Convention.

President Edgar Lungu has announced that government has repossessed Kawambwa Tea Company from Zimbabwean investors who have abandoned it.

Speaking in Kawambwa central during a public rally, President Lungu said he has already signed an acquisition order stating the repossession of the tea company.

President Lungu announced that ZAFFIC will take over the running of the company after the June salaries are cleared to ensure viability.

Last year, President Lungu announced plans to revive the moribund Kawambwa Tea Estate after Zimbabwean investors abandoned it and went away with the equipment.

In 2013 the PF government announced that it had chosen the Zambia Forestry and Forestry Industries Corporation (ZAFFICO) to take over operations at the defunct Kawamabwa Tea Company as a Management Consultant.

The previous owners of Kawambwa tea- KHUMO Holdings of Zimbabwe stripped the company of vital assets.All the irrigation equipment was taken out of the plant by the investor. The ‘investor’ also mismanaged the tea fields.

Workers have suffered over ten years since the company has been in the private hands following its privatisation by the former government. Last year,Chief Munkanta complained that workers at the tea company have been working without pay for the last ten years now.Representative of the workers, Wellington Mwewa appealed to government to consider repossessing the firm and further recapitalise it so that it once again could start producing tea.

The Miss All Weather beauty pageant organised under the Treat Her Like A Lady campaign, which is pioneered by Heathen to Brethren (HB2), has attracted nine contestants who will battle it out for the K5,000 prize money at the grand finale next week.
H2B founder Lee Mulapani told the Weekend Mail in Lusaka that Diana Lungu, Edna Kalumba, Jannette Jasmine Tatalias, Josephine Mutale, Mary Stephen, Ndanji Nakamba, Precious Mubanga, Sellah Chiminsa and Thoko Emma Changufu will be contesting for the Miss All Weather crown at Bongwe’s Big Bush in Lusaka’s Roma on 9th July.
“The ‘Treat Her Like A Lady’ campaign has been on the road in search of beautiful young ladies to be ambassadors and the voice for teenage girls and women across the length and breadth of our beautiful country Zambia and beyond. Each one of these ladies is beautiful in their own way and represents a particular type of girls/women. Supporting them will help create a better world for teenage girls and women,” Lee said.
The Treat Her Like A Lady campaign is aimed at creating a better world for women believing that every woman has the right to be happy.

Lee amplifies more on the Miss All Weather pageant.
“[The] Miss All Weather is a beauty pageant aimed at promoting beauty of all shapes and sizes, under the ‘Treat Her Like A Lady’ campaign. This year’s pageant has nine ladies of different shapes and sizes competing for the K5,000 grand prize and the Miss All Weather 2016 crown,” he said.
“Our main objective is to help women and girls know their worth, know themselves and know their valuable place in the world as leaders and world changers. That way, cases of gender abuse will reduce. Each finalist will showcase how a lady ought to dress and still look beautiful despite the weather type [winter, autumn, summer and spring].”

The guest judge will be the current Miss Zambia Michelo Malambo. There will be great musical entertainment by some of Zambia’s best mix DJs and performers.

We will not shut down phone services during vote counting-ZICTA

The Zambia Information and Communications Technology Authority (ZICTA) has refuted allegations by the UPND that it will shut down mobile phones services during the counting of votes for the August 11th elections.

ZICTA Spokesperson Ngabo Nankonde said ZICTA has no access to communication networks and has no plans of jamming phone services during the counting of votes.

“It is not possible. We don’t have any access to any communication network as ZICTA so we can’t even do that,” Ms Nankonde said.

UPND Spokesman Charles Kakoma revealed that the opposition party will deploy a vigorous Parallel Voter Tabulation System (PVT) aimed at protecting the votes because it allegedly has information that the PF government

Police say it is a blue lie that Post editor Fred M’membe, his wife Mutinta Mazoka and deputy managing editor Joseph Mwenda were roughed up by the police on Monday night.

As new evidence of The Post newspaper’s financial misdemeanors emerged, an eye-witnesss has challenged Mr M’membe to state categorically if the police or anybody else beat them up on the night the trio defied police orders not to enter The Post premises on Bwinjimfumu road which had been sealed by security personnel.

A police source at the scene described as a ‘‘complete lie’’ allegations that the three were harassed, saying that they voluntarily came forward to be arrested.

“I was at the scene all the time and at no time did the police respond to the verbal insults and provocation by Mr M’membe. The officers behaved professionally and all the allegations of harassment and brutality were a lie,” the witness said.
The Post newspaper reported yesterday that Mr M’membe, Mutinta and Mr Mwenda were roughed up and beaten by law enforcement officers when the trio tried to enforce a document purported to originate from the Revenue Appeals Tribunal for the police to vacate the premises and allow Mr M’membe to operate.

The eye-witness explained that neither M’membe, his wife Mutinta nor Mr Mwenda were beaten as they voluntarily surrendered themselves to be arrested.

The witness said in fact Mr M’membe and his wife ‘‘joined in the arrest’’ after Mr Mwenda was apprehended following his unlawful entry into the building where he was seen switching on a computer at a desk he was sitting before police switched off power supply to the building.
The witness said Mr Mwenda had secretly entered the premises and locked himself in the offices where he was seen switching on computers which forced officers to respond by cutting power to the building. Mr Mwenda’s move was seen by the police to be an attempt to utter electronic information, against a warrant of distress issued to the Zambia Revenue Authority (ZRA) for the recovery of unpaid taxes by the newspaper company.

Earlier, Mr M’membe tried to force a ZRA official to sign a forged document purported to have been issued by the Revenue Appeals Tribunal to restrain ZRA from continued occupation and locking up of the Post newspaper premises in an effort to recover their money.
This was almost one week after ZRA effected a Supreme Court judgment to enforce a warrant of distress against the newspaper in an attempt to recover over K53 million owed to the institution.

“They (the trio) roughed up the (ZRA) director at his home, trying to have him sign the order; and this startled the director who later informed his friends about the impromptu visit at his residence by Mr M’membe, and he was a little taken aback over his safety and security.
“He felt that there was a risk on his life and he made a few phone calls to his friends over his security that M’membe and Mr Nchima had actually gone to his private residence, over the ZRA action,” he said.

President Edgar Lungu has re-named Luapula University whose procurement process has commenced after the late second republican president Fredrick Titus Jacob Chiluba.

Addressing multitudes of people at Musangu village during his ongoing tour of Luapula Province the Head of State said the memory of Dr Chiluba needed to be honoured because he made great contributions to reintroduce plural politics in Zambia.

This is according to a statement released by State House Press Aide Amos Chanda.

Mwinilunga District Business Association Chairperson, Jackson Kapepa, says connecting the district to the national electricity grid will open up the area for more investment in various sectors of the economy.

Mr Kapepa said the development will help the business community in the district not only to expand their businesses in terms of production but also diversify into other sectors such as manufacturing and add value to the local products.

Mr Kapepa said the idea of having hydro power supply in the district has been long overdue, adding that it will facilitate massive economic activities as it will have a great spill-over effect on all the sectors and improve service delivery.

He said the thermal-generated power supply has not been user-friendly to the business community due to power deficits, adding that the coming of the national electricity grid will improve the way of doing business in the district.

Mr Kapepa said the development will also encourage the local people across the country to come and set up businesses in the district and improve people’s lives.

The US $163 million Dollars project of connecting Mwinilunga district to the national electricity grid is gaining momentum and has reached an advanced stage.

“UK departure is an attack on the Globalisation Project”

The departure of the UK from the European Union (EU) has dealt a debilitating blow to the EU and left major global markets in a state of shock. Global markets have become so interlinked with complex correlations; some of which are beyond immediate perception.

The EU is China’s second biggest trading bock and is the U.S.A largest trading block. The EU is one of the largest markets for South Africa. Therefore, any chaos in the EU has the potential to affect these major trading blocks which in turn can affect other economies with remote direct connectedness with the EU.

The departure of the UK leaves behind a fragmented common market. There is a valid fear that this departure can ignite emotions in other EU member states to re-evaluate their position in the EU and vote to depart as well; ultimately leading to a spiral of events that can weaken demand for goods and services and thus affect other economies in a global economy that is still weak. Should this happen, China, the USA, South Africa and other markets with direct correlations with the EU can get negatively affected. The Chinese economy is still struggling and can get knock off effects which in turn can affect Africa.

According to research, China, the EU and the USA are the top three destinations for exports from Africa. The implication for this relationship is that economic growth in these economic giants has a bearing on Africa’s prospects.

Conversely, challenges in any of these economic giants can spur headwinds for African economies thereby slowing economic growth.

It is for these reasons that Energy Forum Zambia wishes to express its deep concerns at the departure of the UK from the EU. The UK is a very big player and as such, its decision to depart from a common market cannot be taken lightly.

Fragmentation is not better than the power of integration. The vote to leave a well-integrated market has come at a wrong time and is an attack on the globalisation project. Furthermore, it has left many wondering whether the voters who voted to leave fully understand how the world is changing and how hard it is for any nation with global ambitions to go it alone.

The Zambia National Students Union has called on all students in the country to avoid exposing themselves to political violence by wearing political party regalia.

Commenting on the murder of a UNZA student who just graduated, Prince Ndoyi the ZANASU Vice President said the political violence in country has escalated to levels unseen before hence students should play what he termed as smart politics which will not expose them to the violence.

Mr Ndoyi said the levels of desperation by political parties is worrying hence students should realise that cadres will do anything to try and win the elections.

He said what is happening in the country is un-Zambian and that the police and other law enforcement agencies should ensure that the people behind the murder are brought to book.

He said the student body in the county is saddened at the loss of a vibrant young person who could have contributed to the country’s development and his family’s well being.

“These type of politics should have been long gone,and we call upon all intelligence wings to access the security situation in the country as we go to the polls and if it threatens the lives of the Zambians let us postpone the elections or else there will be no peace. We will not rest until the people are brought to book,” he said.

MMD Deputy National Secretary and MMD Mongu Central aspiring candidate Mr. Kamwendo Kamuti has charged that former MMD Vice-President Michael Kaingu should not mislead the nation that he ditched the MMD and defected to PF, but that he was invited by President Lungu to be a minister while still a member of the MMD.

Responding to an article carried in the Daily Nation of Thursday 30 June, 2016, headed ‘WHY I DITCHED MMD’ in which Dr. Kaingu claimed to have defected to the PF because Dr. Nevers Mumba was power-hungry, Mr. Kamuti expressed shock and embarrassment at the remarks by Dr. Kaingu. Mr Kamuti said Dr.Kaingu was exhibiting a ‘short memory’ when the correct position was that he had initially been removed as Vice-President by NEC due to gross indiscipline and reverted to being an ordinary member of the party.

He explained that when Dr. Kaingu and Mr. Vincent Mwale were invited to be ministers in Mr. Edgar Lungu’s administration, they were members of the MMD and the first thing they both did was contact Dr. Mumba for his approval and thanked him for allowing them to be appointed as Ministers.

He said this matter was widely publicised because Mr. Lungu had publicly explained that he had first contacted Dr. Mumba on the matter before making the announcement. He said that some members of the public may also recall that later Dr. Kaingu was one of the people filmed on ZNBC joyfully embracing Dr. Mumba at the Day of Fasting and Prayers at the Showgrounds in Lusaka, showing that there was peace between the two.

Mr Kamuti wished the nation to know that Dr. Kaingu had exhibited a lot of indiscipline during his tenure as Vice-President, warranting his demotion to ordinary member and had even refused to campaign in the Mangango by-election in Western Province, demanding to be given K50 million (un-rebased) before he could consider being part of the campaign team.

Mr. Kamuti said it was therefore most unfortunate that Dr. Kaingu could now turn around and claim that he had ditched the MMD because Dr. Mumba was power-hungry, which is very regrettable. He said these are the types of immoral politicians who are denting the image of politicians.

The Oasis Forum apalled and sad about Post closure

The Oasis Forum says it is not only appalled but also greatly saddened by events surrounding the recent closure of the Post Newspaper offices.

The Forum said the events at the Post surely borders on infringement of the freedom of the press and that of expression.

In a statement, the Forum said it strongly believe that the closure of The Post does not augur well with Zambia’s democratic dispensation given that Zambia will soon be holding its general elections on 11th August 2016 and the fact that the electorate need to make some informed decisions based on a wide array of information.

The Oasis Forum further observes that this incident and the questionable conduct of both the Zambia Revenue Authority (ZRA) as well as the Zambia Police is yet another manifestation of a serious breakdown of the Rule of Law and widespread lawlessness in the country.

“Indeed, if a public authority can have the audacity of ignoring a validly issued and legally binding court order, then we cannot but wonder as to where this country is heading. Again, if the law enforcement agencies cannot be seen to fairly, equally, consistently, reasonably and professionally execute their mandate in view of protecting citizens, we wonder as to whom those who feel threatened should run to,” it said.

“Furthermore, if it is true that the ZRA were not collecting the huge and much publicized taxes from the Post Newspaper since 2009, then heads must roll in their rank and file due to their appalling incompetence and neglect.”

“In addition, the Oasis Forum also wishes to register its deep concern and disgust over the brutal conduct of the officers in uniform as well as suspected cadres who arrested the editor of The Post Newspaper (Mr. Fred M’membe), his wife (Mutinta) and Mr. Joseph Mwenda. The Oasis Forum is fully aware of the implications of avoiding or evading tax and that no legal excuse can be given for individuals and institutions who refuse to pay tax. However, the physical violence unleashed upon them was totally uncalled for and is condemned in the strongest terms,” it said.

The Oasis Forum comprises the Council of Churches in Zambia (CCZ), the Law Association of Zambia (LAZ), the Non-Governmental Coordinating Council (NGOCC) and the Zambia Episcopal Conference (ZEC).

Women’s movement petition Police IG over video of woman sexually assaulted by a group of men

Police have confirmed that the women’s movement led by NGOCC Ms Engwase Mwale this morning presented a petition at Police Headquarters against women’s rights violation in a video circulating on social media.

The video shows a middle aged woman who has since been identified as a resident of Kafue being abused by a gang of men in the night.

The petition was handed over to the Inspector General of Police, Mr Kakoma Kanganja by Ms Mwale who called on the police to bring the culprits to book.

The Zambia National Women’s Lobby has said it is appalled by the behavior of the young men who sexually assaulted a young woman in a video clip that is circulating on social media.This is according to a press statement released to the media by Zambia National Womens Lobby chairperson,Beauty Katebe.

We cannot find the rights words to describe the actions of the young men captured in the video save to say that their actions constitute a gross violation of human rights which should not be tolerated in Zambia, the statement read.

Such acts of barbarism should not be allowed to go unchecked in Zambia and all citizens have a duty to act against such behaviors from the young people in our communities.

We further urge the police to intensify their efforts in investigating the matter and bring to book all the people that were involved in dehumanizing the lady in question.

Meanwhile Police deputy spokesperson Rae Hamoonga says that police have been able to locate and interview the woman who was sexually assaulted by seemingly drunk men.

Deputy police spokesperson Rae Hamoonga said in a statement that, “police have made head ways in the investigations and we were able to locate the victim and interviewed her. Furthermore our police officers are on the ground looking for the perpetrators. Investigations are ongoing,”

I never shot my wife, it’s the gun that went off accidentally, Banda tells court in defence

“I LOVED my wife such that I could not have shot her dead as alleged,” Lusaka lawyer Paul Pandala Banda yesterday told the Lusaka High Court when he opened his defence.

Banda, a former Zambia Air Force (ZAF) pilot and colonel by rank, told Judge Chalwe Mchenga that he did not shoot his wife, Vivian Ilukena, but the gun went off on its own either after she touched it or after it fell down.

He said Vivian had left the matrimonial bed to pass urine and on her way back, she could have touched the gun, which went off and shot her resulting in her death.

Banda is charged with one count of murdering his wife on October 27, 2015 during her 60th birthday.
But Banda denied ?shooting his wife and told Mr Justice Mchenga that the couple loved each very much and he could not have shot her no matter what.

He said as a result of the death of his wife, he was now lonely and depended on his children ?for comfort.

Banda, who was led in his examination-in-chief by lawyer, Valentine Kabungo said the death of his wife was an accident and the mere fact that he was with her in the bedroom did not point to him having shot her.

He explained that on the material day, after he had dinner with his wife, whom he related to well, the couple went to bed, but after some time, she left the bed to go and use the shower room.

Banda, who at some point during his defence broke down, said that he had put his gun next to the bed, against the wall, in readiness to fire in case the family was attacked by thieves.

He said that since he was asleep, his wife could have touched the gun or it fell down, went off and hit her.

“My wife left the bed to go and pass urine while I remained on the bed. Unfortunately, my wife could have touched the gun or it fell and hit her,” Banda said.

Banda added: “That has caused me a lot of grief. Although I have children I am lonely, I am grieving because having a wife is another issue.”

Banda further testified that after his children broke the bedroom door, one of them beat him terribly, but he could not defend himself as he was in a state of shock after losing a loved one.

He told the court that he fainted as a result of the beatings he was subjected to and that today, he was grieving as he had continued to miss his loved wife.

“I refuse having shot my wife. What would be the purpose? I am a lawyer, I protect people. Why would I shoot her?” Banda further asked.

Banda’s lone witness, retired Zambia Army Brigadier-General Haggai Chiluba, told the court that a gun like the one Banda was alleged to have used, could go off without anyone firing it, as long as it had been subjected to an impact.

After Banda closed his defence, Mr Justice Mchenga set July 29, 2016 as the day of judgment.
