Former Solicitor General defends Judge Musonda over Siliya’s case

Former Solicitor General, Sunday Nkonde says there is nothing sinister about High Court Judge Philip Musonda’s judgment quashing the findings of the Dora Siliya tribunal.

Mr. Nkonde said persons criticising the ruling are merely bent on distorting facts of the matter.

He told ZNBC news in Lusaka that a precedent exists where findings of a Supreme Court judge led Tribunal have been quashed by a High Court Judge.

Mr. Nkonde cited the Tribunal findings of the David Lewanika Tribunal against former Ministers Katele Kalumba, Peter Machungwa and Golden Mandandi.[quote]

The former Solicitor general who was one of the lawyers under the David Lewanika Tribunal said a single high court judge overturned the findings in a similar fashion.

He urged lawyers to help in enlightening the public who risked being misled on legal matters.

Mr. Nkonde has observed that the advice of the Attorney General is not mandatory.

Mr. Nkonde said during his service as Solicitor General his advice to the government was sometimes openly rejected without any public out-cry.

The MMD Party has castigated Patriotic Front (PF) President Michael Sata for alleging that President Rupiah Banda has allowed his Ministers and the National Executive Committee (NEC) members to bring the name of the late President Levy Mwanawasa into disrepute.

MMD Information and Publicity Chairperson Benny Tetamashimba says the Party was not using the late Dr Mwanawasa’s name to win political mileage but that the Party was using late President Mwanawasa’s name to appreciate what he did to the incumbent President.

He said in a statement in Lusaka today, that the MMD Party will not keep aloof when the PF leader speaks things that he does not understand as President Banda had told his ministers and NEC members that his ascendancy to the presidency was because of late Dr. Mwanawasa who brought him from retirement.

Mr. Tetamashimba said he has no regrets to state that the people who worked under late President Mwanawasa’s regime were stealing and that they were involved in corrupt practices without Dr Mwanawasa’s knowledge adding that he saw nothing wrong to mention late President Mwanawasa’s name.[quote]

Mr. Tetamashimba was reacting to PF leader Michael Sata and Patrick Mwanawasa junior remarks that the MMD Party was using late Dr Mwanawasa’s name to bring him into disrepute.

He charged that Mr. Sata was not a right person to allege that President Banda has allowed his ministers and MMD NEC members to bring the name of the late President into disrepute as he, Mr. Sata, was only interested in using Dr Mwanawasa’s name to win a cheap political mileage.

Mr. Tetamashimba, who is also Local Government and Housing Minister, challenged the PF leader to state how many houses he got under the Avondale Housing Project if he was not corrupt.

He further advised Mr. Sata not to bring Patrick Mwanawasa junior into the firing range adding that people should not mislead Patrick Mwanawasa junior as President Banda has promised to do his level best to help the Mwanawasa’s family.

Mr. Tetamashimba has since advised Patrick Mwanawasa junior to go to the University so that he can be a shining example to future generations.

Govt. intensifies monitoring of projects to curb shoddy works

Government has prioritized the monitoring of developmental projects to guarantee Zambians true value for their money.

Works and Supply Deputy Minister Mundia Ndalamei said contractors should provide satisfactory services to the public once they were contracted to carry out certain projects.

Mr. Ndalamei, who was in Luwingu district to inspect ongoing road projects, said this yesterday when he paid a courtesy call on District Commissioner George Mwamba.

He said government was concerned about numerous public complaints that there was too much poor workmanship by contractors.
He said government will now focus its attention on consultants who are engaged to supervise the projects on its behalf before dealing with the contractors.

Mr. Ndalamei said any shoddy performance by a contractor will be blamed on the consultant who is paid to ensure that works were done according to specifications.

Meanwhile, government is happy with the quality of workmanship on the 145 kilometre Luwingu-Nsombo-Chaba roads project which was rehabilitated at the cost of K20.5 billion.

Mr. Ndalamei has since urged Sable Construction Company to continue with the good work so that government could get the true value for their tax payers’ money.

He said government was happy with both the pace and quality of the works on the road.
He has since implored the Road Development Agency (RDA), which is supervising the project, to speed up the designing of Luena bridge that was washed away in the last rain season.
Mr. Ndalamei said there was need to ensure that a new bridge is constructed before the next rain season.

And Luwingu District Commissioner George Mwamba said people in the district were happy with the commitment government has shown towards the road project.

Mr. Mwamba said the Luwingu-Nsombo-Chaba road was key to the economic life line of the district because it leads to productive areas.
He noted that the completion of the road project will reduce the suffering people endure when ferrying their produce to the market.

According to the contractor, works which were initially scheduled to be completed in August this year may be completed by next month.

Police nab man, 30, for raping 76-yr-old woman

Police in Itezhi Tezhi are holding a 30-year-old man of Bana Choongo Village in Chief Shimbizhi’s area for allegedly raping a 76-year-old woman of the same area.

Both Police sources and Chief Shimbizi have comfirmed the incident, which happened on Sunday around 21:00 hours, to ZANIS in Itezhi Tezhi.

Chief Shimbizhi said Kauba allegedly went to the victim’s home and had canal knowledge of the elderly woman, who later reported him to her traditional court early yesterday.

Chief Shimbizhi said Kauba is still in Police custody awaiting a charge.

The traditional leader said Kauba has appeared before the traditional Shimbizhi chiefdom court for six times on charges of rape involving other women in his chiefdom.

The chief appealed to the police to investigate the case thoroughly and ensure that justice prevails in the matter.

He also warned his subjects against committing what he termed as ‘heinous sins’ that taint his chiefdom’s image and threatened that he would physically discipline all would-be peddlers of sexual immorality in his chiefdom.

Former ZESCO boss,Robinson Mwansa, opposed to tariff hike

FORMER Zesco Limited managing director Robinson Mwansa has advised the power utility to come up with a business proposal to enable the company access loans from commercial banks to recapitalise it.

In a written submission to the Energy Regulation Board (ERB) on the proposed 66 per cent electricity tariff increase by Zesco, Mr Mwansa said that the utility firm needed capital, which could only be accessed from commercial banks.

Mr Mwansa said there was no argument that the power utility was in dire need of capital injection.

He said that Zesco should not increase its capital base by subjecting citizens to the proposed tariff increase, as the cost of living in the nation was already high.

“With the difficulties all Zambians and organisations, including Zesco are facing, this is not the time to incite the citizenry to disturb peace and rise against their own Government,” he said.

He said Zesco had a large old stock of customer debt amounting to about K500 billion, which could be sold at a discount of 80 per cent.

Mr Mwansa said that this would mean that the customers paid 20 per cent while the remainder was written off.

He said by doing that, he was optimistic that within six months, Zesco would be able to raise K100 billion.[quote]

With the customers taking advantage of the debt write- off, an additional K100 billion could be raised and used to pay back commercial banks loans.

Mr Mwansa, a chartered electrical engineer, said it was common practice in business to reduce prices on old stocks to unblock the money which was locked up and raise funds.

“It is in the best interest of Zambian commercial banks because they know it and I know it that if Zesco sinks, the mines will sink, the Zambian economy will sink and inevitably we shall all sink together.

He said Zambian power consumers were dissatisfied with the performance of the national power utility.

Zesco could use the bailout capital accessed from banks to improve service to acceptable levels within nine months.

He said even if the ERB granted Zesco the requested increase, the cash flow would not increase much for the first nine months due to consumer blacklash.

Mr Mwansa said the value of any commodity went down when the price increased if there was no proportionate increase in the quality of the commodity.

“I am making submissions to ERB to reject the Zesco application and defer it to March 2010 to give Zesco chance to raise money from its resources and improve the service levels,” Mr Mwansa said.

He said that the proposed tariff increase would to some extent lead to citizens not be able to use power thereby dropping the standards of their lives or businesses.

“Those who are making this application may not have done any social, economic and political strategic environmental scanning and analysis on the impact of the increase.

“On the other hand, they did and are ignoring the results of the due diligence study,” he said.

Mr Mwansa said that in the medium term, Zesco could stop the wastage of the little money that it had if its workers rededicated themselves to improving the power supply using the available resources and raising the service levels to acceptable standards.

the family and herself are happy with her appointment as MMD national trustee contrary to claims by the late president’s son Patrick that the family was not consulted.

Ms Mwanawasa said claims by Patrick that she was not aware of the appointment were not true and advised her nephew to avoid being used by people not happy that the Mwanawasa family was ready to work with President Rupiah Banda.

“The Mwanawasa family has always been ready to work with President Banda. We said this even at first prior to the October 2008 presidential by-election and I do not see the reason things can change now.

“This situation will not take us anywhere. I mean, Patrick has never been in touch with me to talk about this issue and if anything, Patrick is just a child and he is not the person we should be consulting over such issues,” she said.

Ms Mwanawasa said family members who included her uncles Green Chilabika and Philimon Mokola and her older sister Rona were all consulted and gave a ‘green light’ for her appointment to the NEC.

Reacting to claims published in yesterday’s Post edition that she and the family were not consulted, Ms Mwanawasa said she even had the opportunity of discussing the matter with her close friends who all advised her to accept the appointment.[quote]

She advised Patrick to go back to school and build his future than allowing himself to be used by the people that would not help him shape his destiny.

Ms Mwanawasa said her family was ready to work with President Banda’s administration and that was the reason she accepted the appointment.

“In fact, after my appointment, we even went to State House with my two uncles to meet and thank President Banda for recognising me as a person who can work with the party and this confirmed that we were actually consulted,” she said.

Rona Mwanawasa said separately in Chisamba that the family actually sat down and advised her sister to take up the position.

“We actually sat down as a family and advised Evelyn to accept the appointment. We are MMD and we see no reason we should abandon the party to join the opposition just because our brother has died,” she said.

She said that those trying to use Patrick should desist from doing so because they were just bent on destroying the young man.

“In fact, if Patrick says anything wrong in the whole thing, he should have contacted us than going to the newspaper. We have never been in touch with him and it is not true for him to say he had even contacted Evelyn over the appointment,” she said.

Patrick claimed in the Post Newspaper story that MMD wanted to use the Mwanawasa name only when it suited them and that the appointment of her aunt was not genuine and was just intended to benefit the MMD.

But Rona said Patrick was not a politician and had never been one and that those trying to use him were not helping him.

Operations at LCM to commence after development of concentrator

Operations at Luanshya Copper Mines, LCM, owned by new Chinese investors, NFCA, will begin once the mine is redeveloped.

NFCA General Manager, Luo Xingeng, says operations are expected to commence about Six months after the takeover of the mine.

Mr Luo, who spoke through an interpreter, disclosed this when he paid a courtesy call on Luanshya District Commissioner, George Kapu today.

Mr. Luo said the investor is focusing at developing the flotation system at the concentrator and the underground haulage system that are obsolete.

He said the new investor is reorganising the mine to ensure facilities are put in place for improved production and overall performance of the mine.

He said the mine owners will make effective use of facilities for reduced production costs to sustain operations even in the wake of the global economic crisis.

He also assured government that management at the mine will strictly adhere to labour laws and ensure that workers are well remunerated.

Mr. Luo said his company shares government concern over some investors, who are denting the image of genuine Chinese investors, by mistreating workers and failing to adhere to labour laws.

He said all the 1,700 former employees of LCM, who lost their jobs when the mine shutdown operations, will be recruited though the exercise will be conducted in phases beginning with critical areas.

District Commissioner Mr. Kapu said the coming of NFCA to Luanshya has brought relief to the residents, who were faced with high rate of unemployment.

He said government is happy that NFCA has come at a time when most of the companies closed operations due to negatives effects of the global economic recession.

Striking nurses and other health workers at the University Teaching  Hospital, UTH, have given government a two-week ultimatum in which to address their demands.

The workers have vowed to continue with the strike until government pays them improved risk, night duty, Uniform, and housing allowances among other demands.

They accused government of neglecting their plight of working up to 78 hours per week when ministers are getting huge salaries and allowances.

The workers issued the ultimatum when Labour Minister Austin Liato addressed them at UTH this afternoon.

The irate health workers, who displayed placards denouncing the effort by Labour Minister to address them, said they will not succumb to any form of intimidation by government.[quote]

Zambia Congress of Trade Union, ZCTU, President, Leonard Hikaumba, who sympathised with the nurses advised government to desist from evacuating ministers to South Africa for medical treatment because the measure was compounding the problem in the health sector.

“We demand equal treatment in the distribution of health care facilities with those in south Africa because nurses at UTH are working under difficulty situations. We see senior government officials being flown outside for medical treatment when that money can be used to purchase the needed equipment, where is the fairness?”, Mr. Hikaumba wondered.

Mr. Hikaumba advised the nurses to remain united as ZCTU is working with the Zambia Union of Nurses Organisation, ZUNO, to pressurize government to improve conditions of service for public health workers.

He said the 15 per cent salary increment awarded to the nurses was done in good faith and dismissed claims that government bribed the labour leaders to settle for a ‘meagre’ 15 per cent salary increment.

He urged the health workers to go back to work because if they continued with the strike action, government would take advantage and weaken the solidarity in speaking with one strong voice through their reputable union, ZUNO.

But in response, Labour and Social Services Minister, Mr Liato urged the nurses to go back to work as their plight has been heard.

Mr. Liato, a former labour movement leader of the Energy and Allied Workers’ Union said negotiations for bargaining cannot be done in a short period of time but government acts when communicated to through labour union leaders.

He added that President, Rupiah Banda, has been in office for only nine months and pleaded that government be given enough time to address the concerns of the workers.

“Go back to work then the negotiation will go smoothly because government cannot start bargaining when workers are away. Government has heard from your side and so hear our side also. Allow the bargaining process to start because no-one is interested in trivialising this matter be it government or union leaders. As government we are addressing the strike with the urgency it deserves,” assured Mr. Liato.

Continuous voter registration to commence this month

The Electoral Commission of Zambia (ECZ) has announced that it will soon kick-start the continuous voter registration exercise.

ECZ Public Relations Manager, Chris Akufuna told ZANIS in an interview in Lusaka today that the commission was currently putting in place the necessary logistical requirements.

Mr. Akufuna said ECZ would strive to stick to the earlier announcement by its Chairperson Justice Florence Mumba to commence the exercise this month.

“The Electoral Commission of Zambia will endeavor stick to the earlier statement by Justice Florence Mumba that the continuous voter registration will start by June this year and members of the public will be informed once the exercise begins,” he said.

Mr. Akufuna said the ECZ is working tirelessly to ensure that the exercise commences promptly.

The ECZ Public Relations Manager said the commission is alive to the fact that it needs to act with a sense of urgency over the matter.

He said the exercise would ensure that all eligible voters are capture so that they may exercise their right to vote.

Pressure is amounting on the ECZ to commence the continuous voter registration exercise.

Government this year allocated K5 billion in the national budget to the ECZ for the continuous voter registration.

President Rupiah Banda is this Wednesday expected to hold a press conference at State House to address various issues affecting the nation.

This is according to a statement released to ZANIS by his Special Assistant for Press and Public Relations, Dickson Jere in Lusaka today.

Mr. Jere said the media briefing is expected to begin at 10:30 hours, adding that members of the diplomatic corps and accredited journalists should be seated by 10:00 hours.

He also stated that journalists, who wish to cover the press conference, should contact the Zambia News and Information Services (ZANIS) for accreditation and clearance.

Since he came into office in November last year, President Banda has held only one press conference.

Confusion reigns in Shangombo over electricity generator

Confusion reigned in Shangombo district today when residents protested against Zesco’s attempt to move a power generator from there to Chavuma district in North-western province.

The residents foiled the move by Zesco management to transport one of the power generators to another province.
Sinjembela Member of Parliament (MP) Mubika Mubika confirmed the development to ZANIS in a telephone interview today.

Mr. Mubika said a Zesco vehicle which was carrying the equipment, has since been detained at Shangombo police station.

He expressed disappointment with Zesco management for attempting to take away one of the two generators from his district to another especially that the area has had no electricity for many decades now.

Mr. Mubika lamented that he was not informed about the move by Zesco to take away the generator from his area to Chavuma district.
He wondered how his area would develop without electricity, which he said was a driving force to attaining the Millennium Development Goals (MDGs).

Mr. Mubika said power was vital to Shangombo district because of the ongoing developmental projects in the health, education, agriculture, tourism and local government in the area.

He said it would be irrational for Zesco to take one generator away especially that the two pieces of electricity generating equipment were not yet operating well.

Mr. Mubika, who is also Communications and Transport Deputy Minister, castigated Zesco saying he would lose his political stability if electricity supply was interrupted.

“ZESCO should know that Shangombo district is growing at a faster rate because of the developmental projects embarked on by government in my area and it is for this reason that government is pumping in a lot of funds to Shangombo district to spearhead development,” he said.

Meanwhile, Zesco has since instructed its engineers to stop the decision to remove the generator from Shangombo.

Zesco Public Relations Manager Lucy Zimba told ZANIS in an interview that in the interim, the company would look for an alternative way to provide Chavuma district with a generator.

Ms. Zimba said even though one generator was removed from Shangombo to another district, it could have been on short term basis because the other generator in the district was capable of supplying the entire area with electricity.

“Shangombo has got two generators and getting one of the generators was done in the short term basis because we realise that Shangombo has got a few customers. We have rescinded the decision to remove one of the generators from there to Chavuma district,” she said.

Chavuma and Shangombo districts are among the districts in the country that are run by thermal power generator.

Government, realising the cost of fuel has embarked on the rural electrification programme to connect Chavuma and Shangombo districts to the national grid.

Government devises stringent measures to curb corruption

Government has put in place stringent mechanisms to curb corruption in the public service.

Secretary to Cabinet Joshua Kanganja said it has become necessary to put in such measures because government efforts to fight corruption were being frustrated by some unscrupulous public service workers who corruptly divert public resources for selfish personal gain.

Dr Kanganja was speaking in Lusaka today during a Zambia National Broadcasting Cooperation Television interview to mark the eve of the Africa Public Service Day, which falls tomorrow.

He said cabinet recently approved the Anti-Corruption Policy, which is aimed at enabling ministries and government departments to perform within the legal framework of government.

He said government was concerned with the way public resources were being mismanaged or misapplied, adding that it will soon put in place measures that scale up the formation of integrity committees in all parts of the country.

Dr. Kanganja disclosed that government was working out modalities that would establish a financial intelligence unit, with a view to addressing fraud and money laundering related activities.
He further disclosed that President Rupiah Banda would soon launch the Anti-Corruption Policy.

Meanwhile, Dr. Kanganja has urged civil servants in the country to be non-partisan in order for them to effectively implement government policies.

Dr. Kanganja said there is need for civil servants to be loyal to the government of the day as government can only propel development if it received maximum support from the workers.

He further called on the public service workers to exhibit the highest sense of discipline in order to ensure that the public service delivered to the people was enhanced.

Dr. Kanganja said there was need for public service workers to change their mindset and poor working attitudes if they are to deliver quality services to the public.

The Secretary to Cabinet has since urged public service employees to be selfless and remain focused in order for them to contribute meaningfully and effectively to the development of the country.

Court Registrar rejects Chiluba’s submissions

Ndola High Court Registrar Jones Chinyama has turned down Second Republican President Frederick Chiluba’s application for submissions, pending judgement of his case.

Dr. Chiluba had last month made an application to file his submission after failing to meet the deadline.

Mr. Chinyama told the court that he had never instructed the senior court’s clerk to admit Dr. Chiluba’s application to file submission after the deadline.

Dr. Chiluba applied to file his belated submissions on May 21.[quote]

He was earlier supposed to file the submission on April 30.

His spokesperson Emmanuel Mwamba said Dr. Chiluba will revert to his defence counsel to decide the next action.

Meanwhile Mr. Chinyama has extended Dr. Chiluba’s bail application.

This is in a case where he is accused of plunder of national resources.

gridThe China National Electric Equipment Corporation (CNEEC) has shown interest in developing the Kafue Lower Gorge Hydro Power Station at a cost of $1.5 billion.

Corporation President, Zhao Ruolin, says the Chinese power company will source for the money if the Zambian government agrees to contribute fifteen per cent of the total cost.

Znbc’s Luckson Nthani reports that Mr. Zhao made the pledge in Beijing on Monday.

This was when a delegation of Zambian parliamentarians and government officials visited the Headquarters of CNEEC which is solely-owned by the Chinese government.

He also said CNEEC is willing to help Zambia to develop alternative sources of energy from bio-mass, thermal, solar and wind.[quote]

At the same meeting, Chief parliamentary Whip, Vernon Mwaanga thanked the government of China for supporting Zambia’s efforts to meet its energy needs.

And Commerce Minister Felix Mutati has invited the President of CNEEC, Mr. Zhao to Zambia in July to attend a SADC pledging conference for the Kafue Lower Gorge Power Station Project.

Mr. Mutati said Zambia’s power deficit needs urgent attention.

CNEEC has already signed a Memorandum of Understanding with private investors in Zambia who are planning to develop a hydro-power station on the Kalungwishi River in the Luapula Province.

The Kalungwishi River Power Station is expected to cost $600 million.
