Chiluba’s Kabulonga house ‘saved’

LONDON High Court Judge, Peter Smith, has reserved a ruling on an application by the State to seize second Republican president, Frederick Chiluba’s Kabulonga house, which is alleged to have been purchased using public funds.
Judge Smith set the ruling for Monday because the Zambian Government was not ready with the evaluation of the house in question.
The house could not be seized because there was an affidavit filled in opposition. This was in the ongoing video link between Lusaka and London where Judge Smith was hearing submissions on the quantum payments for the 20 defendants found liable to have defrauded the country of public funds through the ZAMTROP account.
Judge Smith in the earlier proceedings increased Dr Chiluba’s liabilities to over US$58 million from the earlier $41 million and another $1,815,000, money owed to a boutique called Basile.
Former Zambia Security Intelligence Services (ZSIS) director general, Xavier Chungu, was liable to pay more than $58 million, former ministry of Finance permanent secretary, Stella Chibanda, also the same amount.
Access Financial Services (AFS) directors, Aaron Chungu’s liabilities were over $27 million while Faustine Kabwe owes the country more than $53 million.
Congolese, Raphael Soriano, known as ‘Katebe Katoto’s liabilities are more than $29 million from the previous $20 million.

    In my analysis and concern of the Judge Smith involvement, I never hid the threat of a precedent that our judicial system had been subjected to. This is what happens when the influential people play around with the law and do not concern themselves with future impact and consequences of such decisions. Anyway, we still do not trust lawyers and maybe now judges? N.B. Note that this decision was quickly rescinded by the judge.
    I am aware that this topic is now closed but I feel if it is a conspiracy because FTJ never bowed down to the sale of Kafue Consortium led by GB letting them have the show once again in Zambian mines then it is sad.

  9. People thought the judgement will not be effected. now that the details are being decided,they are agitated, however there is no need to get excited yet, there is still a long way to go.
    when the the affidavit is put aside, the house should be grabbed, especially if the other assets do not add up to $58M.
    Lets bear in mind that the judgement was passed in london an thats how all the implementation phase has to do with london, its only normal, nothing unusual.

  10. Next time a case will arise in Zambia, GB will urge GRZ to take a leader to the British High Court or else Zambia will not get aid (knowing how much Zambia would part with in costs anyway). Should GRZ refuse for any reason, they will be referred back to this case taken out of Zambia to “Roy Welensky” to arbitrate (by the way, not in 1959, but in 2007), 43 years post independence.

  23. I find it surprising that in all these corruption debates that are going on no one has yet even mentioned the Mines that have been sold by the current gov’t. I mean almost everyone seems to be making a lot of noise about the alleged $48 or $58 million that Bashi Tito and co are allegedly stolen yet no one is saying anything about the multi billion $US dollar mines that have been given to foreigners!! While I don’t support corruption in anyway, I think that as Zambians we should focus on getting maximum returns on the mines, agriculture, tourism and other areas. Right now the value of Zambia’s mines is estimated to be at least $US60 billion before adding value to the minerals. After value is added we are looking at $US 500 billion that Zambia can potentially get from mining alone!!

I would agree with KUKU #60 that we need an all encompassing constitution that would stand the test of time and prevent this circus thats going on from ever happening again.It`s just unfortunate that I`m not currently in Zambia but I would urge fellow concerned citizens that are on the ground to fight and get what rightly belongs to us and that`s a new Constitution.LPM is on cruise control morgaging our Justice system and the country at large without anyone stopping him or his cohorts.KUKU see you in parliament 2011.

Chapi #65 i have read most of your comments on the blog, you do come up with good ideas and the like.Chapi some of the things you bring up though are imaterial at this time,Lpm will have his time to face the law if he has screwd up any where, and best believe he will, For now our focus is on this shameless thief called chiluba, we all have sympathy that he is sick, but remember this is the same man who had his own son almost dying in ndola central hospital , couldnt get a catscan costing a million kwacha while he chiluba was sitting on millions of dollars, it shows you how hard headed he is and he will do anything to stay in his conor safely.There is no need for sympathy now,Lpm like i said has his own time and it will come worry not about him but about shi tito , who has been proven guilty,as for levy he has a few more years.We need to do the right thing now or histroy will judge as badly.

  61. Titus #71, officially the current happenings are the brainchild of the task force on corr. Realistically, of course LPM has a say, I for one think their decision to sue in London and NOT z was superb. You can easily freeze accounts based on a london court order than ours, these are facts though they are not so pleasant. mind you there are 18 other defendants apart from FTJ, some of whom are international.
    LPM, has forever been an impressive lawyer in the Z fraternity, thats how FTJ also had confidence in him, except he did NOT know he can NOT corrupt him.

  62. The Dark days of FJT’s rule are truley over. During his 2nd term Zambia was indeed a desolute place with hordes of street kids and the culture of corruption the norm. As a sociologist one would notice kids not playing street football as you see thses days. Those were indeed sad, sad days.

  65. What LPM is doing to Ciluba is sheer persecution and not fight against corruption period. Ask why he should it? the answer is simple – self-preservation and political survival. This is a president who rules based on editorials and does not follow plans. If an editor says this and that thats when acts. He runs a reactive government and not a proactive one. He hasnt initiated anything, not even the fight against Chiluba, which led to setting up the task force against Chiluba. He has a “free rider mentality”. Economically most of what is driving this economy is Chiluba’s initiation; starting with HIPC attainment, privatisation of the mines inluding signing for setting up of new ones like Lumwana and Kansanshi, Road Infrastructure improvement, general economic re-orientation starting at policy level etc. Of course undeniably, mistakes where made along the way some of which are still there and need to be streamlined. But the current leadership is at the moment just focussed on pleasing Tony

  66. Guys Chiluba indeed may have misused some public money. But we need to be objective in the way we look at this issue. If say Chiluba today is stripped of all he has and sent to jail as demanded by LPM and the Post, what development will accrue to the common man/person in this country? Of course Mwanawasa would be happy because he will for once something that he would have in his reign. (Of course he hasnt done any other thing, then also the Post would be happy for an obvious reason – fulfill their egoistic tendancies like it or not. Then what “win” for Zambia?   68. No. 77 and 78, this is how a real world operates. It is not Chiluba was more corrupt that Tony, KK, or even LPM himself. It is just that the current opportunity available was investigate this person to pin him down. Of course if you fault find, you will definately find were something went wrong in any leader. Now I agree with you but the arguement is not whether or not privatisation benefited everybody including my children no, it is not just practical at least in the short term. Even in the long term the benefits wont evenly acrue to everyone. Am not discussing communism. It is not how economics works. There is usually a time lag. And when you ‘completely allow privatisation of strategic industries’ which ones are you refering to? is it mines? ZESCO? ZAMTEL? I agree with you that not all should be privatised (which FTJ did), but in your view which ones should have been retained as parastatals up to this day? LPM talking abt investment, that’s what we want and we’ve always. But investment takes various forms, which invest r u talikng about.
