Statehouse statement on the allocation of K1.5 billion to the office of the First Lady

STATE HOUSE is dismayed by some unfounded and unjustified concerns being raised over the allocation of the sum of one billion, five hundred million kwacha (1,500,000,000.00) to the office of the First Lady and therefore wishes to provide the following clarifications.

If the various stakeholders expressing concern had genuinely wished to understand the actions of the Government, they could have sought clarification from the Government and been accordingly advised that the reference to the office of the First Lady is merely for transparency and as a departure from the old culture of Government incurring illegal expenditure on this office.

The activities and items funded under the estimates of revenue and expenditure, commonly referred to as the yellow book are based on the offices and activities permitted by the constitution using revenues of the republic from the consolidated fund. The application of activity based budgeting in Zambia has existed for several years now.

In the budget estimates for 2013, the Government decided that it was necessary to provide further explanation for the activities falling under the Office of the President as they relate to the activities of the First Lady. Thus, there is nothing illegitimate with this process given that the Government and State House in particular has upheld the tenets and principles of good governance.

Note that through this method, the Patriotic Front Government is being accountable and transparent in accordance with the promises it made to the people through its manifesto. In addition, it is a legal requirement that at the end of the year the expenditure to the office of the First Lady will be subject to an audit by the office of the Auditor General. It is not our desire or intention to spend unbudgeted for funds. And on that basis, State House deserves commendation and not vilification and wanton condemnation as shown by certain stakeholders.

You may wish to note that these funds are used for the payment of security staff, transportation and other logistics that are necessary for the effective operation of the First Lady in undertaking assignments that are of a formal nature on behalf of His Excellency, Mr. Michael Chilufya Sata, President of the Republic of Zambia and the state in general.

Further, there is no specific reference in the estimates of revenue and expenditure to the office of the First Lady as there is no such office constitutionally established except by convention, which has evolved over time. In any case, if there had been anything illegal about this expenditure, parliament certainly reserved every right when considering the budget not to pass this particular vote.

  1. It is standard in civilized society the world over for the office of the first lady to have a budget and staff. State house does not need to explain itself on this.

    Even when we dont agree with ba Sata 100% we have to agree that Madam Kaseba is intelligent and representing the country well and doing her duties diligently.

    Now if Tandiwe Banda was allocated that kind of money, I would have been pissed.

    • Office of the first lady doesnt exist in our country. So the government is allocating money to something that doesnt exist my dear, wake up! they are stealing money from you and all you talk about is civilised world. In the civilized world, governments allocate money to offices and institutions that exist!
      Next Sata will tell you that they are allocating K2 billion to the office of the Prime Minister and you will start clapping again.

    • Nibian Princess, you’re right. Infact, what this means is that under Thandiwe there was no transparency that is why we knew nothing about how the state was funding her. We only knew about charity moneys. Now we can even talk about Dr. Kaseba’s moneys because it is being done in the open. Only die-hard haters will have an issue with this. 

    • Two wrongs never made a right. Make the office constitutional/legally so that who ever is in charge of the kwachas there is held accountable. There are a number of things that happen in the developed countries that should not just be copied for the sake thereof. Please. I am sure their legislators would have collapsed had such a thing been done without any legal backing.       You can not allocate public funds to an office that does not exist by way of the constitution. That is the issue here. Accountability can still take place in the office for which she is attached, I.e office of the president. If you want an office for the first lady, add it to the constitution so it’s recognised. Diverting from the constitution to satisfy Sata’s ego is a recipe for disorder and CNP type of Governance. Rules and Laws are there for a reason and so are processes for changing them.

    Kwacha is devalued and because she is Bemba like me and looking at the precedence of Bembas monopolizing and taking a stronghold on the state of affairs in Zambia she can have that for all I care
    I am on over £40000 a year Nick is in excess of £55000 a year I drive a Micra he drives a Renault Clio in summary we bring in excess of £100 000 a year between us so K1.5 billion is nothing really for people that are used to touching/spending this type of money without feeling it

  5. mr Chellah, y didn’t u tell your friends in state house to first constitutionally create the “office” of the first lady before rushing to allocate a slush fund to it? In a constitutional democracy, procedure justifies the end – you cant just ‘imagine’ there is an office of the first lady and start funding it. You talk about parliament passing the allocation of funds – this is a sleeping parliament! This is the same parliament that passed appointment of a compromised DPP

  10. My understanding from this statement is that the 1.5 billions were actually separated (with the resources cited) from the Office of the President? Then it is formality because those resources have already been seconded anyway. What is a bit perplexing, if this is so, is why go through parliament when you could have simply continued with the President’s vote? Or is the rationale that there has been over-expenditure in the past and therefore a curb is implicit? We still need some kind of clearer explanation… Yaba!

    • Finally someone who can read comments on this issue. Kalok what difference would it make if after auditing, the expenditure is accounted for by the office of the president or by “the office of the first lady”? At the end of the day, the money is still being accounted for albeit in a more transparent manner.

      Don’t over look the Law of the land. Common sense is not always common! So while the PF explain this to the “blind” and it makes “common sense” the Law of the land does not recognise “an office” run by unelected first lady. So as far as we Zambians should be concerned this is illegal and LAZ or any interested party should petition.

      I fully understand what you are saying and totally agree with you on the legal issue. I do however feel that it is commendable move that enhances transparency. We should actually lobby for it to be put into legislation instead of petitioning for the sake of making noise. I suppose one could say it is an illegal action with the best of intentions

PF comes with a budget, it becomes a hot issue. Which is ok; but would we rather return to the times when no budget was metioned and yet the money was being siphoned?   16. Soon we will have the office of the first son and the office of the first daughter! It seems in Africa politicians always have a way of justifing wasteful expenditure. This budget line is not necessary. The same first lady will also be drawing funds from State house vote. Last time she went to Namibia using Presidential challenger. The running costs for this jet are budgeted for under state house. Her support staff her budgeted for under state house. Chella’s justification for this budget line is unbelievable. If it was RB who had done this, Sata would have rushed to the POST issuing a statement that RB was not following the consitution. As for Mushota(No 5), the lady is out of touch with reality. She is full of herself. Her stay in UK has gotten into her head.

Budget or no budget the office of first lady always has been using public funds thus tax payers money, so just get over it and this time appreciate parliament and government to at least show some transparent on this matter by allocating a budget to the office of first lady, so that we the citizens of Zambia should be able to know how much money the first lady is using and how its used. Unlike in the past we were never told how much public funds were going to first lady’s office, though we knew it was tax payers money.

  21. #1 and all those in support, I think the opposition is not concerned about amount of money allocated. The issue being missed here is the NON-EXISTENCE of an office called “OFFICE OF THE FIRST LADY.” People can mention it by name but if it is not a formal office it does not exist period. In such a situation what can stop gov’t from allocating money to a another non-existent “Office of our friends and family?” The right thing to do is to first go to parliament and have the office established constitutionally and then allocate resources.

Ba Chisenga (#32/35), your point about transparency is appreciated but the bottomline is that there is no entity entitled “Office of the First Lady.” That’s why the predecessors set up “NGOs.” What your people need to do is to go to parliament and seek authority to set up the office. Thereafter, money can be allocated. To ignore this fact is like saying it is okay for a thief to announce that he is stealing (i.e. being transparent) even when it is blatantly clear that the act is wrong. It is better the thief asks the owner of the property if he/she can have it and then take it once authorised.

    History once again is repeating itself, but worse still, the money is being allocated to ‘an office’ that does not exist.
    Does the First Lady have an office?
    If she does, who are her employees and what are their salarieds and do they and herself pay tax?
    Who audits this office. Mr Sata used to say that the Task Force on Corruption, set up by a Lawyer was illegal. How much more illegal is theis office of the First Lady?

It is a fact that money can only be allocated to offices that exist and this particular office does not exist. Mr Chellah and his boss should stop insulting our intelligence.   37. Chella, in the world of management a ‘budget’ or estimates for financial overheads of national undertakings only provide a macro estimate commitment of financial outlay. The financial details of the expenditure is up to the internal systems mamagement- microdetails. As you correctly state, the office of the first lady falls under the office of the president. Its needless to belabour to the general public to justify the expense on the office of the first lady unless there is an attempt to conceal falsehood in pundering to the public. Dr Kaseba is not the only’1st’ first lady in Zambia. There has never been any palaver before. When people know thieves even in time of their innocence, take them as THIEVES.

    We should blame parliament for this! Parliament has been asleep on the switch. This proposal/budget was approved by the the same people (MPs) who should be the guardians or custodians of our laws. Is the entire Legislature really that stup!d not to catch this error!?

    I agree with you, this office needs to be legitimized through our Constitution. But to blame State house on this one is really directing our anger at the wrong people. This was never done behind closed doors or in secrete. The money was approved by Parliament like any other budgetary allocation, so blame lays there. If the Office of The President, in a bid to be accountable and transparent, made errors here, it was Parliament’s duty to remind the State house how things are done—-that’s how I see it!

  40. When FTJ was justifying allocation for slush fund, it was argued that the money was necessary as it was like a father giving sweats to children. Atleast it was to his office then. Now this is worse than FTJ slush fund allocation. Next it will be allocation to the first son, etc.

  41. I believe people think of K1.5 billion & think that it is a small amount not worth debating. This how it starts. Most of the time govt comes back with a supplementary budget which can see more money allocated to this unconstitutional office. What is even more certain is that 2014 budget will have far more than the amount allocated in next year’s budget. Let the government follow the constitution which the president swore to uphold and protect. Money in the budget is allocated to constitutional office which by law have controlling officers (mostly PS’s, but can be anyone appointed by Secretary to the Treasury). So for the office of the First Lady who is will be accountable for the money. Does the office have formal structures such as accountants, internal auditors, purchasing team, etc

Since when was the so called office of first lady established as a public funded institution? Zambians are much more intelligent than all the *****s in govt leadership.
    Community activities for first ladies have always been financed through donations from the business and coperate world not public funds.If the office of first lady is legalised then there will be need to make the first lady account for all the donations that she will receive to the state. Further, the first lady should not be allowed to run an NGO as this will be used to siphon public funds including donations to such NGOs.

  49. Christine Kaseba is not an employee of government. The president has his vice president and the ministers to undertake the functions that he can not at no extra cost to the national fiscus. Which constituency does Christine Kaseba represent and who voted for her to usurp official functions from established offices of government? It would be prudent for Christine to go back to work at UTH or just stay home and take care of the president. She is already causing confusion in the Ministry of Health by performing what are essentially ministry of Health functions. We are sick fed up of hijacking what are government functions!!
