Police urged to explain Nevers Mumba, other MMD officials’ detention

The Human Rights Commission (HRC) says there is need for the police to explain the circumstances in which Movement for Multi Party Democracy (MMD) President DR Nervers Mumba and some Members of Parliament had their liberty curtailed allegedly for unlawful assembly.

In a statement made available to ZANIS, HRC Chairperson Pixie Yangailo said the Zambian people deserve a clear and unambiguous statement to reassure them that human rights standards are not being violated with impunity.

Ms Yangailo said the commission is unease with the recent unconstitutional applications of the Public Order Act.

She expressed regret that the country seems to be descending into a disregard for fundamental human rights and freedoms as guaranteed by the constitution and international standards on freedoms of assembly, opinion, and expression.

Ms Yangailo stated that human rights are the highest constitutional order of this country, adding that they are guaranteed to everyone through part 3 of the constitution.

She stated that the seriousness of this part of the constitution is indicated by the entrenchment clause in Article 79 by which not even Parliament can amend any of its content without recourse to a referendum.

Ms Yangailo said human rights must be the first consideration in any action by the state if Zambia is to remain a beacon of good democracy.

    So, the Mumba issue is HRC issue? Why were you quiet when the Lozis were being butchered by Police? Or that wasn’t HR issue? Human rights or tribal rights?

    • I agree with you. How come these HR activists only come out of the cacoon when it serves them best. The killing of our lozi countrymen, brothers and friends was the biggest violation. Now a pastor as president of a political party breaks the law, and we call it abuse. Why can’t these politicians just follow the law as ordinary Zambians do?

  2. There is no need for the police to be expalaning each and everytime over the detenntion of these chaps. The reason the police gave earlier was “UNLAWFUL GATHERING” wat else do you want you dull chaps? Whoever is found gathering without a police permit is likely to be jailed…this is wat Nevers did…

  4. The Sudanese Darfur crisis started from govt pushing people into a corner.Denying people their rights then violence becomes the only option thus ICC could easily find a new pariah in Sata.

    • Don’t start a war you can’t win. The majority of Zambians are on the side of the government. Probably you have never come across the rarely seen Zambian special forces.

No wonder Austin Liato buried over K2 billion underground. I want to see how the supporters of Hakainde react when he get caged for alarming the nation through his Sudan tantrums. And please, don’t you or anybody who has not been to a war torn country instigate what you have not physically seen. Go to luanda in Angola or bujumbura in burundi and then kigali, rwanda, and then come and tell us. I have friends that are so survivors of such wars so don’t kid yourself about war. You may be safe but you entire family won’t.

It is the selective application of the law much to suppress opposition while those in the ruling party do they same with impunity that will bring war to this country. Only a dull person would say the words you have used against HH and his supporters. HH merely read what the post newspaper had already written and was accused of alarming the nation. Only a dull person like you would not take what GBM said concerning people plotting to kill Sata as not alarming the nation, only a dull individual like you will not take the statement made by Bob Sichinga that MMD had printed fake money as not alarming.   7. We Zambians are very incompetent because we have incompetent govts. Our constitution has been undergoing review after review for yrs yet Kenya finished theirs after us. Zim finished theirs after us and Egypt has just finished theirs after us. We’re just allowing thieves to steal money for development for these endless reviews.

  10. We’re tired with cheap talk from the opposition parties. If opposition leaders break the law they should be arrested. I wonder why opposition break the law. Is it to been heard or seen by people that they are working? I believe opposition and the party in power should work together and find lasting solution to bring down poverty level from 65% to a level of 5% or less in the next 3 years. This is what we should be reading or hearing. Shame to the oppostion. Police officers if you’re arresting opposition leaders who have not broken the law you should stop doing that. Leader of PF if they break a law they should be arrested as well. We need non basied police officers. Ministers who have used their position to get contracts should resign because they are no interest for the poor people.

  11. Are rights absolute?? the answer is no. What does the Law say about permit?? If the Law is clear, I think Mumba and his friends misused the Law and also their rights, they deserve punishment and inflict pain on them because with we don’t do so we will deny them their rights of being punished. This is to say that they know that if we do this or that will punished but they went on and act, that is understanding and choice, the act was deliberate and voluntary. Hence, everybody has rights but these rights are not absolute but relative, they can be removed if they threaten to harm others.

  14. Zambia has never experienced any coups but i do not think dictator Sata and his minions will survive any coup that comes if he continues this dangerous path of taking Zambians backwards.

    Honestly he can not survive this. No matter his IDI AMIN style of governance.

  16. Human rights? Why is it that human rights are only been applied in politics in Zambia? A Somalian kills a Zambian in cold blood for asking for his pay, no problem!  We deport a few Somalians or  foreigners, you start shouting human rights. What happened to our laws? We are abusing this cry of human rights, the police should not be told how to do the job, they are doing the job, it is up to the people to start following the laws of the country. Politicians are not special, they should follow the laws of the country. 

    • The Zambian justice system is too cumbersome and out of date.
      It needs a chief justice, with guts, to upgrade the entire system.
      Proper training for lawyers and judges. And above all an independent
      police commission.
      In the photo above Mr. Mumba has to check his details in the book.
      These details should have been computerized. A decent computer wont
      break the police station’s budget.

  17. Zambia is a failed state slowly degerating into zimbabwe coz how do you explain the detention of someone driving on the road for unlawful assembly. the increases in meal meal, cement and several commodities prices. fuel shortages ,exchange rates the list is endless. The country on auto pilot.

  18. MMD is paying the price for maintaining stupid laws. They had chance to repeal this silly law but  chose to keep it for  their own interest. So PF MPs should learn that if they do not have a critical look at this law, it could be used against them once out of power.
