Northern Province rejects Dual Citizenship Clause as Father Bwalya and Government officials differ

THE clause which allows for dual citizenship in the First Draft Constitution has been rejected by delegates to the Northern Province Constitution Convention in Kasama.

Dual citizens can carry two passports and essentially live, work, and travel freely within their native and naturalised countries.

Opposing the clause, Mporokoso district medical officer Tresphord Mulenga said a person with dual citizenship had divided loyalties and Zambians needed to identified with prosperity or woes of their country.

Dr Mulenga said a genuinely patriotic person needed to be identified with only one republic and when issues of national importance arose, it would make it difficult for a dual citizenship holder to offer allegiance to one country and reject the other.

However, Catholic cleric Lombe Bwalya from Kaputa parish said dual citizenship was becoming more common in an increasingly interconnected global economy.

Many countries are now seeing the advantages of dual citizenship and were liberalizing their citizenship laws.

Some dual citizens also enjoy the privilege of voting in both countries, owning property in both countries, and having government health care in both countries.

However, when it came to a vote, it was recommended the clause on dual citizenship be removed.

In the Luapula Province convention the dual citizenship clause was retained amid arguments from some delegates including Chief Government spokesperson Kennedy Sakeni that the clause should be rejected on patriotic and nationalist grounds.

Debating on the motion, Mr Sakeni urged Zambians to critically look at the issue of dual citizenship and ensure that it was not allowed in Zambia.

“AS Zambians, let us critically look at the issue of dual citizenship and take the interest of the nation at heart. Why do people want to be citizens of other countries in the first place,” Mr Sakeni said.

Labour Deputy Minister Ronald Chitotela said dual citizenship would make it difficult to extradite Zambians who committed crimes if they moved to other countries where they had citizenship.

“Let us denounce dual citizenship because even countries like United Kingdom are having difficulties to extradite criminals,” Labour Deputy Minister Ronald Chitotela said.

Other delegates including former Minister in the MMD, Mwansa Mbulakulima argued that it was important for Zambia to give citizenship to Zambians living in the diaspora to enable them work in other countries.

“Most of the Zambians living in other countries cannot work because of the issue of citizenship hence the need for us to assist them,” he said.

Some delegates, especially from the medical field supported the dual citizenship clause saying it would go a long way in contributing to national development.

The issue of the dress code also raised concern with Pastor Maxwell Luchile saying indecent dressing had even affected the church.

The convention refused to amend the provisions of Article 9(a) to read “morality, descent dressing, Christian values and Ethics”.

The convention however agreed to amend the definition of words minority and marginalised groups in the draft Constitution, under Article 311, to ensure the words did not apply to groups like lesbians, homosexuals, bisexuals, gay and prostitutes, which did not reflect on Christian values.

In Muchinga delegates upheld the Article on death penalty as contained in the first draft constitution.
The delegates reached a tie before going into a secret ballot with 71 votes cast to retain the death penalty and 21 voted against the penalty while 7 people did not vote.

The delegates retained Article 28 sub-section 3 which states that a person may be deprived of life if that person has been convicted of a capital offence and sentenced to death.

A delegate, Victor Mapande said the Article should be carefully examined while Frank Bowa seconded the proposal.
Another delegate Lewis Shikapwasha said the death penalty should be upheld even in a Christian nation as the Bible allows death penalty hence should be retained as a deterrent.

The delegates retained Article 33 (1) which states that a person shall not be held in slavery as contained in the first draft constitution while others suggested that Slavery, Servitude and Forced Labour be redefined.

The delegates amended Article 60 of the draft constitution to state the State shall place affirmation action programmes designed to ensure that socially acceptable minority and marginalized groups, participate and are represented in governance and other spheres of life, are provided with equal opportunity in cultural, political, public service, economic and social activities.

The Article further states that minority and marginalized groups shall be provided special opportunities for access to employment and develop socially acceptable cultural values, languages and practices.

Delegates failed to retain the Article before settling for the secret ballot with a total of 99 votes cast and 33 opting for the Article to be retained in its original form in the first draft constitution while 63 wanted it to be amended.

A Human Rights Commission representative, Kebby Malila informed the delegates that issues related to human rights were not negotiable.

Mr Malila said the rights women should not be subjected to negotiation with their spouses as this compromised the essence of human rights.

“Human rights are not negotiable. Consulting the spouse on rights of the woman would be eroding the foundation of human rights”, he said.

Delegates retained Article 52 under the Bill of Rights which allows women to have rights to reproductive health and change nationality of their children, access to family planning and related information.

Other Articles in the first draft constitution that were overwhelmingly retained include Freedom of Persons, Protection from inhuman Treatment, Security of Persons, Protection of Privacy of Persons, Home and Property and Communication and Freedom of religion and Conscience.

In Mongu, UPND Senanga MP Likando Mufalali blamed the Technical Committee for the poor turnout of lawmakers at the ongoing Western Province Constitution Convention.

Mr Mufalali said in an interview in Mongu that the Technical Committee had not informed the MPs on time, resulting in a poor turn out.

“The low turn out of MPs is due to the fact that the timing by the Technical Committee, I think, was not communicated to them on time. They (MPs) are attending to Committees right now. Parliamentary  Committees have started,” he said.

    • This belief that people with dual citizenship or those working abroad do trashy jobs is misguided. With all due respect, to cite an example, Prof Clive Chirwa had dual citizenship and had an academic tenure at Loughbrough University. There are many well qualified people out here whose minds are challenged in a way that the Zambian environment wouldnt do. Like every where people work in different positions and please respect people for what they do in society. Just argue over the point at hand than bringing in what people do.

    • There seems to be absolutely NO VALUE added by these sittings. Why do we have to seek opinion of people who don’t even understand half the known implications of the subject matter at hand? Are they initially given lectures on globally known pros and cons of each subject for them to make informed conclusions? To me, all this is wasted oppotunities & If we don’t change this approach, I am sure we shall be working on our constitution forever.

  7. Article 59 must be revisted and changed accordingly. It’s not being male chauvenistic if one argues that, a woman who is married can not just decide at anytime that she will have her tubes tied without consulting the husband. A woman allowed to change the citizenship of her children, this is bizarre. A woman is from the man’s rib and so shall it be forever. If this clause is aimed at promoting homosexuality and breakdown in marriages then embrace it. Just as all body parts(one side of the heart smaller than the other, one testicle smaller than the other and the same with the female genitalia etc) are not equal but work in partnership, so was God’s intention that we should not be equal but work as partners complementing each others efforts. Such clauses are a danger to family unity…

  9. The smart people of Luapula Province (Liverpool) got it right when they recommended the need to adopt dual citizenship as the wave of the future. The economic benefits to the needful surpass all kinds of xenophobia.

    I applaud Father Bwalya for having such a great insight on the economic benefits of dual citizenship. It looks like most PF ministers just like the President have already decided to fight the clause but what they don’t understand is that Zambia Is Actually Greater Than Any Single One Of Us!!

    This issue might end up being their greatest downfall. Dual citizenship will one day reign within our fantastic Zambian Enterprise despite current opposition.

  11. Most of these individuals that are against dual citizenship are jealous that others can be given passports by other countries. Only an individual that profits a foreign country is given a passport. It is not just every Jim & Jack!!

    So these individuals need to be valued by their country of origin, Zambia. What does it say when the country that you came from treats you like a criminal, but others welcome you? To make matters worse for Zambia, Kaunda paid for the education of all these people and the current leadership does not realise that it is throwing resources away. Personally, I do not see how this country can develop if it does not treasure its people. Getting a foreign passport is not a crime, but simply a way for someone to move forward with their careers and livelihood.

  13. If the Chief government spokesman is giving the governments position on the matter this is scary that the government can not articulate their case against dual citizenship. On patriotic grounds, which patriotic grounds? Give us a list of patriotic grounds at least, so that we may understand you and have something to reason debate with. Secondly, why do other people want to be citizens of other countries in the first place… That is a question, not a reason why dual citizanship is not good. Answer that question honestly and you will find that it does not conflict with “putting the affairs of the country at heart” to have dual citizenship. The people advocating dual citizenship are gicing their reasons. Even Fr. Bwalya says he thinks dual citizenship because of trade advantage.

We don’t have dual citizenship and you’re still failing to get Henry Banda. Anyway, this to me sounds like people who are responding with negative emotional rather than with rational thinking. They are so hell-bent against dual citizenship that they wont see reason. They have not done their research, and they do not even have any reasons to justify their opposition to dual citizenship, and it is with this attitude they are approaching the constitution making process? God save us.

  19. I wouldn’t be surprised to learn that Dr. Tresphord Mulenga has only a first Medical degree. Doctor of Philosophy (Ph.D) is pursuit of wisdom in the field of specialization and from what is obtaining, he seems to have no wisdom at all.

Like someone said above those people have never even travelled out of zambia.     The arguements some people raise against dual citizenship make you wonder whether GRZ thinks they are smarter than governments of Canada,USA,India,France,Belgium,South Africa(with permission),Australia,Germany,..etc.. The question of loyalty that Dr Mulenga raises is the most ignorant that one can have later on a doctor. He dares question the loyalty of a person that would hold dual citizenship, implying the countries that allow dual citizenship are less concerned about nationality security,right? Divorce the pre-independence or Kaunda regime mentality of suspecting citizens of being enemies of the state. Abasungu baliya mune.
    The loyalty worth questioning is that of politicians that line their pockets with the tax payers funds,practise trabalism and nepotism.

  24. There are Zambians here in the United States who left Zambia when their education could earn then more here than in Zambia. Now that they have succeeded ( or maybe their children have succeeded) some might want to come back and give back to Zambia. But it took so long to gain American citizenship they would be unlikely to give that up so quickly. Granting them dual citizenship would let Zambia have more doctors, teachers, and other needed professionals who already speak the local languages. Use the gifts your children provide you, regardless of how long they were away from home.

Zambia’s pronouncement as a Christian Nation is a pure joke, i for one don’t see any Christianity take for example our President pledged to rule by the ten commandments which i believe come from the Bible but look at what his doing persecuting the opposition leaders for his entertainment. No one even a President has the right to force Christianity on an individual it is purely a personal decision. They refuse to address the issue of immoral dressing but refuse to accept that prostitutes and lesbians exist. Christians stop this double standards no wonder God has turned a blind eye on our Country because of fake Christianity.

  28. The politicians advocating for the rejection of dual citizenship know once they give a voice to the Zambians in diaspora they can no longer line their pockets with tax payers money. They will be questioned on every bad decision they make and as they say power corrupts. Let us wake up and realise the people on government work for the people and can be removed if not performing.

    What has been the impact on crime in countries after they introduced dual citizenship?
    What impact did dual citizenship have on the economy in countries like Nigeria?

  33. Im a tenant to an individual with dual citizenship. He comes back twice a year and I have seen the development and contribution he brings to his motherland. Needless to say, Im even jealous of the economic boom going on here because alot of morden infrastructure and business such as hotels and resorts, housing complexes, tech companies are owned by diasporians from this country (by Flag). It doesnt matter what they do in their second countries. Its what they bring back to their homeland…….oppotunities.

  35. Advice to GRZ:
    1. If your worry is on suspects being extradited, then fear not ; allow the dual citizenship and then use the wheels of GRZ to profile citizens and send data to second countries requesting cooperation in matters of your interest. At the moment the basis of argument is not tested, therefore can not stand.
    2. A look around the neighborhood would help to see the benefits. For instance, SA, Kenya, Naija, Ethiopia, Senegal and Rwanda are economically sound and have the reputation of mordenised societies. I believe the basis of your fears stems from the vices that come with mordenisation vis a vie escalation in crime and senseless deaths due to RTAs.

  38. Can someone please give our an indication of the main fears of Dual Citizenship (DC) please. I have heard so much good things about DC but what are the odds or negatives so we know and many others who dont even have a passport

If one objectively considers the comments of those in favour, it doesn’t take real analysis to see that it is simply selfish individuals who want to portray a view that somewhat you will be given huge sums of money by acquiring an additional nationality which everyone will pledge to mother Zambia so that we see economic prosperity in our mother land.     It appears people speaking their minds is a thing you are having a rough time to come to terms with. You are disparaging us for saying what any casual unbiased obsever will tell you about our GRZ,which is your govt. too. Namazai where does that come? You mean if I am a sanitation worker in USA or Zambia I have no right to express my views about my government? Expression of views or freedom of speech is a fact and reality in a democracy. May be Zambia is not a democracy,I thought it was. Naba namazai are gonna be dual citizens its just a matter of time,even gays gonna have thier rights in Africa one day regardless of how long it takes. Those against dual citizenship is a a confirmation that they have never been exposed abroad and think that Zambia is the best thing to have happened in their lives.

  43. Lucy Kutina, I do not appreciate your insult. Be reminded that, I was only expressing my opinion that you may agree or disagree with without necessarily resorting to name calling. This is a forum for discussion and not confrontation. We all have ideologies that we hold dear, but we can not force anyone with a different view to agree with ours. I will certainly welcome any dialogue based on substance and mutual respect.
