Barotseland activists treason trial moved to Lusaka

THE Lusaka high court has transferred from Mongu to Lusaka hearings in a case in which former Barotse Royal Establishment (BRE) Ngambela Clement Sinyinda and 83 other barotseland activists are charged with treason.

Judge Evans Hamaundu said in his ruling yesterday that he was changing the venue of the case hearings to Lusaka because it was convenient for it to be heard in the capital city than in Mongu.

Mr Justice Hamaundu also transferred the detention of the accused persons from Mongu prison to Mwembeshi open prison in Mumbwa.

This is in a matter in which the State had requested for the transferring of the case hearings and detentions to Mumbwa court and prisons respectively citing security concerns.

But the activists led by Sinyinda had objected to the application saying there were no disturbances that had risen during their appearance in the Mongu magistrate court but all that their relatives and supporters did was to cheer outside the court after court sessions.

Mr Justice Hamaundu said in his ruling yesterday that he had inquired from the Mongu magistrate court on the allegations of disturbances during court sessions but he was informed that there had been no disturbances in court.

He however said that if the matter was moved to Mumbwa as was requested by the State, it would mean that the accused persons would be required to appear in Kabwe where there is only one court room and would in the process affect other matters.

Mr Justice Hamaundu further said that he was changing the venue to Lusaka because there were several courts with many judges who would handle two or more parallel court sessions.

He said that Mumbwa was good for accommodation of the suspects because of the Mwembeshi prison which had spacious space.

Mr Justice Hamaundu said “trial is convenient here in Lusaka so I have changed the venue from Mongu to Lusaka”.

Some of the charges are even laughable such as raising the Barotse flag! Remind your government that the Barotse flag is currently, like it has always done, flying at the muleneng ie the Litunga’s palace. And sinyinda has also been charged with organizing the Barotse National Conference in January 2012. A conference that government officials attended including representatives of the diplomatic missions and the UN!

      The British have nothing to do with this. Kenneth Kaunda as Prime Minister signed on behalf of Northern Rhodesia and Sir Mwanawina King of Barotseland signed on behalf of Barotseland to bring the two territories together as independent Zambia. Kaunda later renegaded on this Agreement. This is the issue here. It is a legal document which your Zambia is been requested to honour! Just stop the bullsheeting!

    • Foolish Agreement? Your government appended its signature to the said foolish Agreement! Western Province or Barotseland is only part of Zambia because of that Foolish Agreement. And without the Foolish Agreement there’s no Western Province but only Barotseland!

If you have evidence that Barotse is an Independent country why cant you present yourselves to the courts other than waiting for Kenneth Kaunda or Sata? Your brothers and uncles will die in prison for nothing. Better stop this nonsense.     • Yobe katali, please stop creating your own reality. For starters Nkoyas were never the first settlers in Barotseland. The first settlers were the Makwengo and the Mbukushu commonly referred to by morons like you as bushmen. They are concentrated in the South western corner of western province. The next to come were the Subiya and the Totela. Then it was the Luyi or Luyana i.e the Litungas tribe. These were followed by the Mbunda who asked for refugee status from Litunga Santulu in 1795. later we had Nkoyas, Luvales , etc And in the mid 1800s the Sothos invaded the territory and referred to everyone they found as Barotse i.e people who settle along water sources. The final arrivals were the Kalanga . Lozi/Rotse is not a tribe by the way!

  7. The design of the rail was changed due to sand and now the rail cuts Zambia almost half, the 1964 document says the demacation is the rail. Let them be clear on which parts of Zambia they want. Gorvement should not take these people to jail because there is an AGREEMENT.

This is the area which is and used to be called Barotseland until 1969 when called changed the name to Western Province in 1969 upon the abrogation of the Barotse Agreement. Please desist from manufacturing your own history. It is alright to oppose the Barotse issue but please let be on informed facts not some made up nonsense. Please look at the resolutions of the Barotse National Council of Jan2012. They make no such claims on land that belongs to your Zambia! ubufi muleke!

    • Mwenda Njangula, Barotseland is made up of Lusaka, Central, Copperbelt, North-Western, Southern and Western Provinces. The 84 remandees are our freedom fighters. Very soon the four poorest provinces will be the only ones to make up Zambia: no Central Bank, High & Supreme courts, No international airports, no nothing,

  8. Why do you people cling to Barotseland so much? If she’s useless, LEAVE her alone. When someone divorces one, the best you can do is go your separate ways. Why kupapatila someone who says “I DON’T LOVE or NEED YOU ANYMORE”? It’s because Zambia knows that once this is done, there will be no Zambia. Own up, guys. Honor the Agreement or let us be. Stop clinging to us. We’ve refused. Period! Release our heros or expand your prisons because many of us are right now preparing to join them. If you want, kill us all.

  9. This issue has failed in Namibia and others in that country went to USA for hinding but it has never helped them up to this day! Educated without common sense. Keep on singing loudly for more schools, hospitals, clinics…etc and that shall work for all in western province but not those stupid dreams.

    • Lol! Was there the issue of Barotseland Agreement in Namibia? Barotseland Agreement was between Northern Rhodesia and Barotseland. These are the two entities that signed a document to bring their two territories together under specific arrangements which Mr Kaunda later chose to ignore. We should be encouraging the two protagonists to sit around the table and iron out their disagreements. This issue is about governance and the distribution of resources. Is the current overcentralised system based suited to Zambia? How do we use the Barotse Agreement as a means to change the structures of democratic and devolved governance in Zambia? These are the pertinent questions we should be answering rather than drawing spurious parallels with other countries.

    • Even if HH was to become president today (which I doubt), he would not honour the baroste agreement. This you should all know. If any sitting president is to honour the baroste agreement, that would signify the end of his rule (or life).

    You are both S****. Make informed comments. The Post at one time published BA 1964. Honoring the Agreement actually safe guards the unitary state of Zambia. The Choongwe commission recommended to the govt to honor the Agreement. For your own information HH has actually promised to honor BA and use it as an example to devolve power to the rest of Zambia.

  19. The Barotseland issue calls for great minds. For nearly 100 years prior to Zambia’s independence, the white man had tried to rule and subjugate the region to no avail. At independence Kenneth Kaunda stepped in the shoes of the white man and thought he could fool the Barotse people by agreeing to sign the Barotseland Agreement and then later abrogate it, strip the Litunga of his powers and change the name of the region from Barotseland to Western Province! That too hasn’t worked. Prior to independence, Barotseland was an autonomous state even under the white rule. The infamous BA 64 is the only document that gives Zambia the mandate to rule the region. Outside of the BA 64, Barotseland is off the hook and can decide to determine its own destiny. The matter is litigable.
