Fr Bwalya put on defence for saying “Mumbu mushololwa, muwelewele”

The Kasama Magistrate court has found Alliance for Better Zambia (ABZ) leader, Frank Bwalya, with a case to answer for defaming President Michael Sata.

Principal Resident Magistrate, Vincent Siloka, has since put Fr Bwalya on his defence in the matter.

This is a case in which Fr Bwalya is charged with defamation of the President contrary to Section 69 of the Criminal Procedure Code Chapter 87 of the Laws of Zambia.

The State yesterday called seven witnesses who testified against Fr Bwalya.

Meanwhile, the other count which was slapped on him of proposing violence was dropped.

The witnesses testified that Fr Bwalya used insulting words when he appeared on Radio Mano when he addressed President Sata as “Mumbu mushololwa, muwelewele”, meaning he is like a sweet potato which cannot be bent and if you force it to, it can break and that he cannot reason.

However, Fr Bwalya earlier denied the charge and told the court that he will bring over 15 witnesses who will include those that are conversant to interpret Bemba idioms and proverbs.

Magistrate Siloka found Fr Bwalya with a case to answer and put him on his defence and the matter will come up on April, 1, 2014, on which day the audio cassette disk featuring his programme on air will be listened to.

Fr. Bwalya is on a K10, 000 cash bail.

  1. LEAVE THE MAN OF GOD ALONE , HE USED THE SAME WORDS AGAINST RB AND THE SAME WORDS WERE FOUND NOT TO BE INSULTS , WHAT HAS CHANGED NOW??

    • TRY USING THE WORD TO REFER TO YOU OWN FATHER AND SEE WHAT HE WILL DO, THEN YOU WILL KNOW WHETHER OR NOT THE WORDS ARE HARMLESS. SIMPLE!

    • @ Mopao Mokonzi Wa Zabanga, please lets be civil when using this blog. Its meant to critisize and shape each other constructively and not insult one another. You may think you are being clever now but be rest assured there is always a sticking point when God calls you out. That said, I don’t think Fr. Bwalya’s statement is in anyway defamatory. Just because the word ‘useless’ would be interpreted as muwelewele in bemba shouldn’t be a premise for the law enforcements to be used to pursecute opposition leaders. Its a real shame to see the level this once vibrant party has crumbled to. I voted for PF very proudly but i am fast regreting my actions. At this point, God gives me the opportunity to vote again, i am very sure it will not be on the PF’s ticket. At least not this crop of…

  6. From my own opinion Chumbu is becoming more of a dictator day by day, if it is encouraged we shall have ourselves to blame.

If I remember very well [Chumbu, Ukwa or this Chimbwi no plan] you called The late L.P.M, M.H.S.R.I.P “Cabbage”, the late F.T.J. “Kafupi”, the late George Kunda M.H.S.R.I.P. “red lips” and Former president of all Zambians, R.B. “Nyama soya” yet you never saw the inside of any court room in Zambia. Don’t arrest people taste your own medicine, after all these are the types of politics that you are comfortable with.

    • The one thing about this language is that it is so rich. I have never heard of what you have said but the saying is so truthful or relevant. And we Africans want to lose such languages for English?

A few years ago in Luanshya I think it must be 2010 or 2011 around Mpatamato mine area, Fr Frank Bwalya whilst addressing a political rally there he used words like ” Umuwelewele” when describing RB’s behaviour and reasoning.Sata and the Post were in the forefront support Fr Frank Bwalya that its a bemba saying that does not insulting or demeaning the Presidency but the reasoning.Either the state or RB withdrew the case against Fr Frank Bwalya.Now how come the same words used against RB were not insults /defamation that time and there are insults or defaming the president today?

  10. As far as my Bemba knowledge goes Mumbu munshololwa on its own is harmless but he added Muwelewele. Muwelewele is one with no brains or who cant think. That is an insult. If you told your dad that mulichiwelewele dont ever come back home.

  12. Ba Sata has too much time on his hands to be caught up in such trivial issues. Makes you miss the Chiluba days, granted they were questionable days, but Chiluba never bothered about people who insulted him and those insults were on a daily basis. The man would even go to the same people who would in turn welcome him like a rock star, case in point, UNZA Students. Ba Sata needs to reign himself in and understand that this is the nature of the job he has taken up, not everyone will be happy with him all the time. Just keep it moving…

    HOW IS THE CHARACTER OF THE PRESIDENT INTERFERING WITH THE FATHER’S PARTY? WHY NOT CONFINE YOURSELF TO DEFINING YOUR OWN PARTY POLICY?
