Nevers Mumba’s account in Canada did not belong to the state -witness

A State witness in Dr. Nevers Mumba’s case of abuse of authority of office yesterday admitted that he over stepped his mandate by auditing a private account which was opened by Dr. Mumba in Canada for funds he sourced from Barrick Gold Corporation in his private capacity.

Mr Jolyzia Manyonga, an auditor in the office of the Auditor-General said that he received a report that Dr Mumba received a sum of 122.229 Canadian dollars which he allegedly misused by not following financial regulations.

But In cross examination Dr Mumba’s lawyer Mr Makebi Zulu challenged Mr. Manyonga to explain what made him think that the money allegedly used by the High Commission to sponsor the Amayenge Cultural ensemble belonged to the Zambian government when the group was funded by Barrick Gold Co-operation.

Mr Zulu further asked Mr. Manyonga if he knew that Dr. Mumba wrote a letter to the ministry of Community Development to sponsor the Amayenge Cultural Ensemble to travel to Canada and that the ministry replied that it did not have money for sponsorship.

Mr. Manyonga admitted that he was aware about the letter and the reply from the Ministry and he was also aware that it was Barrick Gold Co-operation which sponsored the group.

Mr Zulu further asked Mr.Manyonga to confirm whether he audited a public or a private account which had money from the sponsors to which he replied that he was given wrong information because he was only told that money was misused by the High Commissioner.

Mr Manyonga told court that according to an investigation, the former High Commissioner to Canada received 122,229 Canadian dollars in two instalments.The first instalment of 41,500 Canadian dollars was received in August 2011 and the second instalment of 80,759 Canadian dollars was received in September.The money sourced by Dr Mumba was meant to support the Canada-Zambia Exchange Show which invited the Amayenge Cultural Ensemble.

Mr. Manyonga said from the bank statement the auditors were able to establish that a sum of 30,000 Canadian dollars was not accounted for because it lacked supporting documents in the form of payment vouchers and receipts.
He added that the same bank statement showed that an account did not belong to the Zambian government and the Secretary to the Treasury had no authority over it.

Mr.Manyonga further stated that same account had four signatories who were the High Commissioner Dr.Mumba,Dr.Joseph Daka,Cecillia Mulenga and Mable Chipasha and the three were not employees of the Zambian government in Canada which was very irregular to have outsiders as signatories to an account opened by a government official(Dr.Mumba)

He also told the court that some payments were done without following financial regulations which he did not explain.
Mr Manyonga however said Dr Mumba did not seek authority to open an account and there lack of preparation and reconciliations of the bank statements.He said there was also a wasteful of expenditures and the worst of all was the former High Commissioner’s involvement of his wife in the project.

  1. Nevers is a failure period. He blew the only success he had as a preacher. Unfortunately, he had no insight into his own future.

    • So what was this Government Letterhead we hear was used to request for financial assistance, and the money come from the people to whom the purported Govt letter was sent?

    • @Nubian- The sewer mouth.I really don’t understand the personal hatred you have for Dr Mumba.With your Peoples’ Fault(PF) Party,surely out of more than 50 Diplomats,who were recalled,only Dr Mumba had a case to answer?.Infact I know that the Zambian High Commission in Canada was not among the Embassies which were found wanting by the AG’s Office when they audited almost 3 times in a role.Sata had wanted Dr Mumba to join PF,but because he refused,they had to play politics on him.No Weapon fashioned against Dr Mumba will prosper.

    • @Nubian,let it be known to you that,in most cases Doners don’t fund government initiated projects at these Zambian Foreign Embassies.So most of the Embassies open private A/Cs for such initiatives.The funder may even say that they did it privately to finance a private initiated project by the Embassy and not Government perse.

  2. This case is going nowhere, the money was not in a government account and was not donated to the government. When the ministry of Community Development could not sponsor Amayenge, mumba took initiative and fundraised in his individual capacity and opened a separate account for the money he received…. it was not the ministry of Community Development that asked for money from Barrick Gold Co-operation.

    There is no case here, actually government might end up paying Nevers Mumba for wrong accusations a and waste of time.

    • Ba Mwaba jr tamwaishiba law. Wait for the cross examination for Mumba before u start yapping.
      The fact that this money was sourced from a company based in Zambia, on a missions letter head, then money was put in a private account, then only Mumba was the signatory on it with some strangers is a doom for him. Plus wife having access to it is another fuss.

      According to financial regulations of Zambia, any money borrowed on government letter head must be deposited in a public account and is supposed to be audited.

    • @Kafupi,Barrick Gold is a Canadian Company.Negotiations started in Canada.Who knows,maybe the same Company shall be Dr Mumba’s witness.And they will clarify why they made such donation-politics of vegency don’t go anywhere.

    • Ba kapufi ,which law do you know yourself.The AG is only mandated to Audit Government money which goes into the government A/C.That’s why the Witness is saying he was misled in thinking that it was government money in the govt.account.

    • @kafupi,What does Private Account mean?It means any person can be included to be signatory depending on the arrangement made.That money may not even necessarily have come from Zambia because the Company in question has it’s H/Q in Canada,it’s a Canadian Company.hatred does not pay and is evil.

    • Ba Kafupi,does it mean that the money sourced from zambia automatically becomes Government money?Your reasoning is dangerously wicked.There ‘re so many private companies in zambia.When money is sent from here, it still remains private money.Dr Mumba wanted to make it public money by requesting Min.of Community.The Ministry declined,so he made a private arrangement.Ask those who have served in Missions,they’ll tell you that these private a/cs are very common.This is their initiative,because sometimes they even use these funds when the Govt delays funding them in good time.Otherwise they can starve.Especially under PF,you have to be creative otherwise you starve.

  3. @Mwaba Jr you are right man. Its just that the specialist in Nolle Prosqui doesnt want to admit. Even RB’s case is the same. This fits in the definition of madness. Mutembo just like Kamimba cant win a case without the assistance of through court

    • The letter Mumba wrote to Government requesting for sponsorship of Amayende yielded nothing.GRZ had no money for this purpose.Nevers constituted a fund raising committee to raise funds.As Head of the Zambian Community in Canada he had to issue a letter on behalf of the committee so as to give legitimacy to the fund raising venture.Once the money was raised,the only responsible thing to do was to give account to the donors as to how the money was used.It is only the donor who can complain in a case where this money was not used for the purpose.Dr.Mumba might call Barrick Gold Corporation as his witness should the court find him with a case to answer.If Barrick Gold will testify that they are perfectly happy with the manner the funds were used,what NEXT????

    • Simon, your points are good this case looks very Political
      Dr Mumbai will come out stronger from this case , hope his lawyer can argue out the case of the letterhead, his wife’s involvement if true and the unreconciled $30000. Can the lawyer compel the Govt to audit all embassies and the same court action to be taken to rule out any discrimination on this case. Can the lawyer also compel the Government to audit all Government departments and similar court action to be taken.

  4. Simple and straight forward: no case. Just wasting people’s time and energy. Nervus did the needful. He did not steal misappropriate anything. In fact he has the right to the money and he can use it in any way he wants. That is it! PF cadreism no bututo costing our country a lot of money through worst full witch hurt such as this.

Mr Mumba being an employee of the Zambian Govt, used the govt to source for funds, he used his position as high commissioner and the letter containing the Zambian govt details which must only be used for govt business. Therefore, the money was given to him because of the position he held and he simply gave the sponsors a wrong account instead of the govt account. Mumba erred in his actions.

  6. So wonder corruption will not end in Africa. In any developed country any gift to a government official, no matter how small must be declared. Did Mumba delare the gift? Recall just afew days ago Cabinet Office PS memo to all education institutions to surrender funds raised from extension classes as one way to encourage transparency. Mumba was hiding the dough and the wife had access to the account. Smells corruption even a mile away!

    • Political Parties need to be held accountable for the Funding they receive for elections, what interest do Funders have in the Zambian elections, that is corruption because when parties win the elections then they are paid back. Zambia needs strong code of ethics and a strong constitution.

  8. Nevers Mumba is a money laund ering machine.
    He abuses tax payers mo ney and fires anyone who gets in his way. He and Mr Nz oya (the deputy at the high commission here in Ottawa) have been ste aling mo ney to buy luxu ry cars for them selves in Ottawa;they travel around the glo be for personal reasons then finance them through the mission.
    They fired Mr Te mbo because he was against this and sent him back to Zambia. they also have an office sl ut ( car olina rodri guez ) working for them and she abuses the Za mbian mission’s money by offering her physical body to diplomats.
    this is such a sha me; abu sing hard ear ned tax payers money
