Sata’s medical board exhibits ready

Civil rights activist, Brebner Changala, is today expected to file in a writ of mandamus in the High Court in an effort to obtain an order to compel Cabinet to constitute a medical board to determine the health status of President Michael Sata.

Mr Changala confirmed to the Daily Nation yesterday that his lawyer Makebi Zulu had completed all the paper work and that today he would be filing in affidavits at court.

He said the process was delayed because he was collecting exhibits that needed to be submitted to court when suing the Attorney General.

The civil rights activist said he was suing the Attorney General because he was the one who was expected to advise cabinet to constitute a medical board.

“There is need for cabinet to constitute a medical board to ascertain the health status of President Michael Sata. It is over seven days since we wrote to the then acting President Wynter Kabimba asking him to exercise his powers to ask cabinet to consider the question of physical or mental capacity of President Sata.

“There are a lot of unprecedented things that have happened in our country such as handing over power. Mr Sata must be given enough time to rest,” Changala said.

He said some of the exhibits that would be submitted to court include the campaign videos for President Michael Sata, the 2011 September swearing in footage at the Lusaka High Court, the footage when he was addressing the army personnel in Livingstone, a footage when the President appeared in court in May 2014, and his appearance at the Freedom statue on May 25th 2014.

Mr Changala said there was a lot of exhibits that would go with his affidavit that he wanted both the court and cabinet to review as they would be determining the matter.

He said he was doing this for the good of the nation and that it was only fair that President Michael Sata’s health status was examined.

    • Mr. changala are rejoicing that sata is sick? chili pamu nzako mawa chili paliwe. if sata is really sick let nature take its course. there is no need of going to courts over someone’s illness. i don’t support Sata politically but he deserves respect as a human being. live long king cobra. 10 years of toiling and only 2.5 years of enjoying. am really sad. Sata deserves a full term in office he really fought for the presidence

    • There is a first time for everything. Sata shouted loudly about the need for a medical board to ascertain the late Mwanawasa’s health and fitness to discharge his duties as president,only to find himself under the same scrutiny.

      Its time Zambians and Africans in general considered this medical board strategy to check if the president is fit to rule or not. Important jobs that need urgent attention of the president can not go un attended to for such long periods of time without risking being compromised.

      The big question is ,what happens if the president is found unfit to carry on as president;which is the most likely out come? Is he impeached or retired on medical grounds? Does the Chief justice take over the presidency for 90 days until the presidential by election are held?

      Don’t daft because your job is politically sustained. Can you continue paying your employee on sick leave until she /he dies instead of retiring them on medical grounds?

      Knowing you, the moment your servant is absent from work for 7 days due to illness you would quickly replace them without paying them their dues.

      So don’t pretend. Being a president in Zambia is not until death takes you. When Zambians voted , they voted for a fit person not a sick person whose illness is a taboo and makes him sneak in and out of the country under the cover of darkness like a witch.

      If people knew that Sata is ill like he is now , do you think people would have voted for him?

      Go back to school or start a genuine business and stop depending on politics for survival.

  1. Infact if Sata if found to be incapacitated by the medical board, he should be arrsted and charged for pretending to be fit and mismanaging the country while incapaciated.

      In fact, where is he? Is he running away from the 90 days of Donchi Kubeba?
      Since he fit as acknowledged by the PF Post of Mmembe on the phone interview, as Katema, so is Kapeya and Scott that he was enjoying himself on a “working holiday” in with wooing investors, where is he?
      The presidency is a public office, citizens have the right to be informed.

    • @ Tese Zono, I agree with you 100%. And then he should be taken to Court to repay all his salary from when he was malingering or absent from work.

      His performance since taking Office gives new meaning to the term “Ghost Workers” and is one of the most common CORRUPT offenses in Africa.

      Billions of taxpayers money is stolen every year by salaries to people that never ever even show up for work!

  2. Another exhibit is Sata’s Facebook which has never been active for a month. Even on working holiday, his Facebook could have had full pictures, as before.

  3. Have you realised that PF loud mouths have all gone into hibernation? They are now re-learning to be humble. people don’t learn. RB was the perfect example for learning that ukasamwa things will always put you in a situation where you are exposed and humiliated. Wish you improved health away from power Mr President.

  4. this move is really very radical in my view. first and foremost, no one has said the president is sick and secondly we have not heard anyone debate in parliament that he is sick. so its really perplexing that the man i have so much respect for can hurry this issue the way he has done. why not just wait, if HEMCS is sick, it will show some day. the government can argue that he is on a slimming diet what would you say will be valid about the videos? i know the government may be hasnt been transparent to us about this issue but it could be they were doing it to arrest the free falling kwacha that has seen some improvement. i am speculating here and may be Mr Changala is right after all. personally i would employ a wait and see stance.

      The very fact that no one in government has come out to clear the air about Sata fitness to rule, is the reason why Changala wants the courts to decide on the matter based on the evidence he will present before them.

      Why are worried about the medical board carrying out their duty? They are the best to declare Sata fit in this current situation where there are conflicting statements from government PR machine.

  5. BEING OVERSEAS IS A BIG PROBLEM AS FAR AS HAVING KNOWLEDGE ON WHAT IS CURRENTLY HAPPENING IN ZAMBIA. ZWD AND OTHER ELECTRONIC PAPERS DON’T MAKE IT ANY EASIER. THEY ARE ALARMIST PAPERS. READING THIS ARTICLE ONE WOULD THINK IT HAS BECOME A FELONY TO FALL SICK/ILL WHILE EMPLOYED OR ON OFFICIAL DUTIES. DO WE REALLY HAVE TO GO TO COURT IF AN EMPLOYEE FALLS SICK ON DUTY IN ORDER TO KNOW WHETHER AN EMPLOYEE IS FIT FOR WORK OR NOT. SOME OF THE STANDARDS ZAMBIANS ARE SETTING FOR THEMSELVES WILL BE VERY HARD AND COSTLY TO ACHIEVE. LET’S CONCENTRATE OUR EFFORTS AND RESOURCES ON CONSTRUCTING THE NATION, PEOPLE. TAKING SOMEONE TO COURT BECAUSE HE/SHE’S ILL IS UTOPIA.

      Yes there is need to go court if the employee is lying about his fitness to work and yet he is drawing a huge salary out of borrowed money without being productive.

      What Sata is doing is committing fraud as he always done all his life.

    • Its not a “felony” to fall sick, but hiding the sickness of a public figure.
      If he’s fit as all PF cadres are yapping, show us the president to prove to many citizens asking about Sata’ health and his whereabouts. Why hide the fact’s?
      Be reminded that there is NO Donchi Kubeba in Heaven and time to tell the truth is now.
      Very soon it will be Zeds Agriculture and Commercial Show, wondering how long PF will hide and continuously live in the dwellings of denial?

    • What development of the country are you talking about? How do you develop with an absentee President? What we want to know is how fit he is to rule. Thats all. If he is not fit, he retires. if he is fit he continues. We cant spend 5 years just defending the health status of a President. It is ridiculous.

  6. We have no leaders hence the lack of leadership in this country. If our leaders truly desired that this country should prosper, decisions would be made for the benefit of all of us. Right now, the decisions being made are only for those who wish to hoodwink the crown of power to themselves for their own selfish reasons.

    Sata thought himself too fit and too clever. Now, its evident that the tables have turned and history is there to remind us of how our leaders ignore legitimate authority to save face.

    • He doesnt need an acquittal to file any other lawsuit. That is another case which he will handle independently.

      Where is Sata? Its been 45 days without any evidence whatsoever to provide guidance that indeed our president is enjoying life in the “Holly of Hollies”. 45 days without a word from the chatterbox of PF?

While Mr Changala is within legal limits to request Cabinet to constitute a medical board to ascertain the capacity of the President to continue holding office, his suit will go no where because the Office of the Attorney General is technically vacant. The incumbent has not been sworn in and cannot assume responsibilities in the absence of taking the oath of office. Non-starter ba Changala. Your lawyer, Makebi Zulu, is using your lack of legal knowledge to drain you of your little cash. Open your eyes mwana

  8. Mr Changala can not play God. He needs to respect other peoples privancy. Mr Sata might be president but he needs a rest as well. Mr Changala should also tell the nation about his HIV Status. When you live in glass houses you do not throw stones. Do not be bitter wait until its your time, everything has a time and place.

      Ulekwatako insoni. Changala is not a public figure paid by tax payer’s money. Sata is a public figure. When he wanted to be president , he was every where begging for votes. Why is he hiding from the people that gave him his job? People are suffering and want answers from him but he busy hiding ,why?. Why didn’t he ask for votes while hiding?

      Once you are public figure,and paid by the public through taxes, then you avail your self to public scrutiny.

Do you think that would be tenable in a civilised world? These things can only happen on the dark continent. I am glad Changala is in the forefront of giving Zambians a kick on their backsides to do what’s right. Nobody is born with right to rule in Zambia as we are not a monarchy but a republic – a banana republic at that! Zambia was once the epitome of democracy in Africa until PF came and undid all the good works of democratisation of our politics and way of life. We are now back to North Korean way of doing things.       Changala is self made millionaire by Zambian standard. He got his money out of hard work, not from political bootlicking like some of you. He runs a manufacturing company which manufactures school chalk in Zambia among other businesses. This activism is just his hobby as a good citizen.

      Sata used DEC to intimidate him and silence him, but they failed. He is a pain on PF ‘s back side. I like him for that.

      For you worry about what next, your job is on the chopping board.

  10. So, from Sata’s appearance at the Freedom Statue, Changala will be able to aver that the President is physically and mentally unfit for the presidency? There is no limit to Ubukopo pa Zed among our activist and political imbeciles! Go Changala, go! Probably Zambians will finally come to know how dull you are.

    • @ze doc, i was thinking along the same lines. The cour will not admit this application because it will be hear say. The appearance of the president maybe linked to old age. Nothing in science says that a 77 year old becomes mentally and physically incapacitated.

    • This is what happens when people like Changala who have no way of making a decent living beyond being used by Politicians. Is there a way of getting rid of chaps like him Lifwekelo, Tayali etc. As there is nothing of value that they bring to our nation.

    • I agree with that. Well done Mr Changala, thank you for taking upon yourself the work that our miserable Cabinet Ministers and Parliamentarians have failed to do, even though it is their responsibility and they are being PAID to do this job.

  12. The only SOLUTION TO THIS DILEMA we did put ourselves is:

    1 Let the Acting President Wynter Act and Set the Day of Elecions. If Zambian r not Happy with Wynter let;

    2. Guy Scott shud STAND UP and ACT as a PRESIDENT and in 90 days elections.

    During this OCCASION let him REPRESENT SATA and on his behalf let him ask for forgiveness from Chitimukulu & others Sata has wronged.

    3 As WE TALK THE CONSTITUTION is ALREADY BREACHED and its in tatters. Alot of things ve been Breached by these inuits

    FAILURE TO THS- There will b CONFUSION even WAR but I would NOT want ths to happen.

    IF we dont do this will “JUST BE YAPPING DAY in Day OUT” about our GRANDFATHER SATA who is about to go the Land where no one RETURNS.

  17. I will also instruct my lawyers to commence legal process to determine whether Brener Changala is mentally, morally and physically fit to call for a medical board to examine the sitting republican president.
    The desperation of Changala and HH to taste state power is driving them to extreme madness for which they must be medically examined themselves.
