RB is corrupt, insists Tayali

Outspoken Zambian Voice Executive Director Chilufya Tayali has insisted that former President Rupiah Banda who was this week acquitted of corruption is corrupt and abused in office in the Nigerian oil deal.

During a news briefing in Lusaka, Mr Tayali said the fact remains that as President, Mr Banda did secure a Government to Government oil deal from Nigeria.

He said this fact is proven by the letters which Mr. Banda wrote to Nigeria including his counterpart at the time late President Umaru Yar’Adua.

Mr Tayali said the State also established that oil deal was not in the interest of people of Zambia because Mr. Banda did not use the relevant government departments including the line Ministry of Energy but used his selected confidants mostly Major Richard Kachingwe and his son Mr. Henry Banda.

‘The State brought Former Energy Minister Kenneth Konga to testify in the case and he disclosed that he did accompany Mr. Banda, in his then capacity as Energy Minister, on an official visit to Nigeria when the Oil deal was being initiated. He said that while in Nigeria Mr. Banda and the then President of Nigeria Umaru Yar’Adua did hold a meeting where Mr. Banda requested that Nigeria supplies Zambia with Oil. However Mr. Konga was blacked out of the deal and replaced with Maj. Kachingwe who acted as Mr. Banda’s personal envoy in the deal,’ Mr Tayali stated.

He continued, ‘Maj. Kachingwe also testified that the deal did not benefit the Zambian people including himself because his share was not given to him rather the proceeds went into an account created by Henry Banda in Singapore. Henry Banda has since been a fugitive and refused to come back to Zambia because he was the receipt of the money which was allegedly used to fund his father’s political campaigns.’

Mr Tayali added that a Nigerian agent in the name of Akpan Ekpene came and testified how he personally dealt with Mr. Banda and his son Henry Banda.

‘With this evidence, it is clear beyond reasonable doubt that Mr. Rupiah Banda did engage in this Nigerian Oil deal and benefitted from it personally through his son who received the money which is why Mr. Banda does not want his son to come to Zambia to explain the role he played.’

He said, ‘It is also very clear that the deal was not done in the interest of the Zambian people because experts have actually told us that Indeni cannot process Nigerian oil. Indeni is not capable of processing oil from Nigeria or Angola among others because what Indeni does is separation of mixed products such as kerosene, petrol, diesel, etc. In fact, the oil never even came to Zambia it was sold by the agent Mr. Akpan Ekpene as testified in court.’

Mr Tayali said it is therefore proved beyond reasonable doubt that this deal was not done in the interest of Zambia though Mr. Banda contracted it on Government to Government basis using his office as President of the Republic.

‘With this analysis of facts presented in court we find the tears of Mr. Rupiah Banda justified as tears of disbelief in his luck to be acquitted because the balance of probability clearly shows that Mr. Banda did abuse his office and should have been found guilty by the courts and sent to jail like many of our poor people who get jailed for stealing food because they are hungry.’

He said the Zambian Voice justice in this Country is proving to be more for the rich and not the poor.

‘To make matters worse, even those who are jailed the power that be, abuse the prerogative of mercy to cleanse them of their evil deeds. Today people like Steven Masumba, George Mpombo and Moses Muteteka among others are as white as snow due to their political connections in spite of betraying public trust,’ Mr Tayali said.

‘On the other hand we are seeing those who are not in good terms with the PF being dragged in court for nothing or expressing themselves, for example my brother Pilato. We are also seeing cases which were closed being brought back to settle scores on behalf of Rupiah Banda like the cases of Dr. Rajan Mahtani. Mutembo Nchito was also arrested and now he is before the tribunal for prosecuting the very case we have discussed here.’

    • Ni oilo yadziko. That doesnt mean Rupiah should steal it. LUNGU and Rupiah are ligned meaning both are thieves. Wewill deal with them come 2016

  2. Why make noise instead of providing evidence to the state or sue him privately?? We are busy wasting monies proving cases when tayali has evidence.This Chap is just a noise maker

    • If with all that evidence, he has been acquitted what can an individual do about it. But we want RB and sons as well as Lungu to know that we know that he is corrupt infact the most corrupt president this Country has ever seen and that one day the law will visit him

  3. I have never seen any document as useless as the zambian constituition and an Instituition as rotten as the zambian judiciary. The two damn things are never specific on anything always living room for nonsense. Ma rubbish!!!!

  5. This thing of removal of immunity & court cases has never worked. Perhaps suspending the constitution, court marshaling and bullets to the head by sniper fire amid a cheering crowd at independence stadium shall bring an end to this wanton abuse of public trust /resources and miscarriage of justice. Jerry Rawlings did not spare corrupt judges. They were dealt with same as the politicians.

  9. This muppet has no credibility at all. He claims he’s innocent because the same court acquitted him and yet refuses to accept the same verdict when it comes to other people. This muppet was acquitted not because he didn’t commit the offence but because it couldn’t be proven. If has evidence of RB’s corruption he should have been testifying in court so as to ensure he is found guilty.

The judicial systems does not stand to accuse people, it is the complainant who uses the fact to prove the accused. so when the courts say someone is acquitted, it does not mean he is innocent .it is that the accuser have failed to prove there case. Tayali was acquitted, did it mean he was innocent no brother ,the fact is that the woman failed to prove that she did not consent to the act. that is why , it his unfair to say the court his biased. if it was then Tayali and RB should be sent back to court.i repeat the court does not stand has an accuser leave the court out of this Tayali with your foolishness. arm twisting is not for the court your sponsors have miserably failed brother.Only the righteous God will give us a fair judgment stop cheating yourselves.

  18. this case does not make sense…if Zambia was buying oil, it is Zambia who is supposed to be “paying” meaning money..funds are moving from Zambia to Nigeria. how come we are saying RB received money from Nigeria. And for what? who does that? unless you say oil was not supplied.
