LAZ strongly condemns the attacks on Judicial officers in the media

The Law Association of Zambia has said that it strongly condemns the attacks on Judicial officers in the media.

In a statement issued to the media, LAZ President Linda Kasonde said her organization condemns the publications which seem to criticise decisions made by judges in cases which are before the courts of law.

Ms Kasonde who has faced criticism herself due to her organization’s stance on certain cases in recent times, said the criticism was undermining the independence of the Judiciary in the country.

She explained that going to the press was not the right channel through which Judicial officers can be criticised as it does not give them a chance to be heard and respond to the allegations.

“…. The said articles and reports seem to criticise decisions made by judges in cases which are before the courts of law. LAZ is saddened by these publications as they undermine the independence of the Judiciary and deprive the particular judges a right to be heard and respond to the allegations.”

She said Zambia is a democratic society which has embraced the separation of power and that the Judiciary was an important component of that society if it is to flourish.

“…The recent articles and editorials published by certain media organizations are an attack on the aforesaid principal of Independence of the Judiciary which is a besic tenet of a democratic society and may diminish the integrity of our Judicial system. LAZ strongly condemns the attacks on the Judiciary in the press especially as this is not the appropriate forum to deal with any alleged misconduct or shortcomings of Judicial officers without a fair hearing,” she said.

Ms Kasonde however, called on those with grievances to use the established channels in dealing with judges found wanting.

“Although the importance of the Judiciary cannot be over emphasized, it is equally true that no Judicial officer is immune from oversight or sanctions where they are found wanting. Article 144 and Article 236 of the our Constitution makes provisions for Complaints to be made to the Judicial Complaints Commission against Judicial officers,” she said.

      If the judiciary has any aorta, they MUST tell blind Lungu as per the constitution~give power to the speaker & the presidential petition MUST be heard. Without the Lungu giving power to the speaker & the presidential petition is not heard as the law & constitution stipulates, PF remains in power illegally.
      Those comical PFudges at the Con~Court & together with ECZEMA, or sorry ECZ bandits of Chulu & Isaacs are a DISGRACE to humanity. Chimbokaila is their next squatter with their Ugandan Chavula real soon.

      So Madam, why not just say Mmembe through his reincarnated The Post/Mast should stop this ridiculous habit of attacking Judges every time cases don’t go his way. The other biggest culprit is HH/UPND. Why beat about the bush every time these two get out of line? Yet don’t hesitate to attack and call out others by their exact name or affiliation!

We have no faith in Partisan (read Patrick) Mvunga’s JCC. The media (the fourth estate) is the only way we shall communicate with each other.

There is no separation of powers in our case. These guys are crazy and need to be castigated in strongest terms.

      Who ever still takes the Zambian PF judiciary serious must his head examined or be taken to chainama.

    • You have no Nzelu. No amount of insults on the judiciary will change the fact that PF and ECL beat UPND and HH. You will just die to depression with you disillusionment. Just accept that no matter what you do or say will change the fact that ECL is the legitimate Republican President and HH the professional loser.

      The Judiciary are just doing their job and doing it well. HH and UPND are the ones who wrongly wired and need re-engineering politically.

      I know you hurt so much that you lost, but in any game there losers and winners. Unfortunately, your team has turned into a professional loser with no hope of EVER ruling this country!!! 2021 will be based on learnt lesson of regional voting and HH and UPND will get a rude shock because they will that time have little votes in non UPND…

    • The so-called judges have themselves to blame for being such jackasses. How can judges fail to manage court proceedings and then claim later that they have no time to make a judgement? Are they mere spectators in court proceedings? These idyots should be impeached or whatever you do to incompetents.

    • Its okay, but she can not fold her hands and leave the horses running all over the place. She has got to find a way to tame the horses back to the barn, and hence take this as her first step in that direction.
      Give her the support she needs. Who else can do it, ECL? So what are you suggesting?

      My comment was neither PF nor UPND. I just said the horses should be tamed back to the barn.
      Our problem is that we are always criticising. But down your heart, you might be saying that she is right but since you suspect her to be UPND, then whatever she does, it’s all wrong. I am saying is, that should not be the case. Just read through comments above and below, almost everyone is saying its too late. NO, it is not too late, she has got to start somewhere. If it is too late it doesn’t mean she should not do start.
      So for the sake of us all, let us encourage good practices and I don’t care whether its UPND or PF.

      I am not aware of any time I celebrated when UPND MPs won election petitions.

  2. Shut your trap. Where were you when the petition was denied which saw a loser ascend to power. How many of your members have been reported to the concourt for gross incompetency, corruption and ineptitude? Corruption is the order of the day in this once respected profession. Mind you,if you can’t keep up with checks and balances in your organisation, we will do it for you because you seem to be compromised and only comment on matters were you have an interest. Why have’t you given your position on Lungu’s eligibility in 2021? Lest we remind you that this is a democracy where all opinions must and should be respected.

  3. Comment:OOnly to be reminded by well meaning citizens before LAZ can say something. Linda Kasonde if i were you i would have resigned a long time ago. Your failure and being partisan on certain issues has made people rushing to the media. This very issue you have just commented on is an example, it has taken you many weeks before you come up with your position,meanwhile those with bongo ya ngwena continued writing damaging issues about some Judges.

  4. Fellow Zambians let us mind what we say…… If you agree or not with LAZ president , do not bring other people in the discourse and use innuendoes to demean others.
    Surely , Do we fear GOD really?
    My simple advice is that let us have great restraint when you want to criticise our perceived enemy. Love is from GOD and he who love knows how to treat others well especially those whom he thinks do not share his values…..
    Let us not be engrossed in political blanket as there is more to life than politics.Worship God and seek HIs righteousness is our top priority….. Never should the things of the world cloud our minds…..

  5. Ba Linda awe shuwa such a let down…when you were condemning ‘rightfully so’ a certain PF cadre who made alarming remarks you mentioned them by name. When you were speaking about media freedom when your friends paper was closed you mentioned her by her pet name, ‘chichi’….so what has changed now? Ah please name and shame rather than speak ‘generically’. You know when you emerged victorious at your meetings we all held our breath because we thought ‘finally’, but alas….

  7. Buck teeth Lungu, kindly knnow that God allows certain things beyond our comprehension.He needs not to expalin himself why he allows it. Tell me if you or I die , will God expalin to everyone why we are dead.if GOd does not explain ,will others blame HIM.

  8. Professor Mvunga’s JCC held a Public Hearing on Concourt 14 Days Petition Hearing on the 10th February 2017. The complaint was reported by Mr Sinkamba to the JCC.What became of this Hearing and what was said of the Concourt corrupt Night Judges? These Concourt Judges are a disgrace not only to the Judiciary but to Zambia as a Constitutional Democracy. JCC did not issue a Statement so we are in the the dark. Justice Nkonde is alleged to have stolen K2.5m. JCC is a toothless bulldog and people have no trust and confidence in this PF State Dept.

    • This JCC chaired by Prof. Mvunga is a sham on concourt because Mvunga is an interested party. He was among the lawyers that represented ECL in the presidential petition case. If he is worth his salt he should recuse himself from hearing this petition by Sinkamba. Oh I forgot it is Zambia the Banana republic and so it wont happen!

  9. Mundia if everything is PF and corrupt including the JCC, then you just continue reading The Post re-incarnated (The Mast), believe everything you read and don’t bother with any legitimate institution of governance!
    There is need to avoid being led by emotions for one to discuss and debate intelligently, but this is too much to expect from certain quarters of our Zambian society. They are still blinded by political sentiments.

  10. Every high profile person in society whenever they get involved in a scandal it always comes out in the media. And this trend will continue, like it or not. That’s why these people in high profile positions should THINK CAREFULLLY BEFORE THEY ACT or else their names will continue to be ridiculed in the media like what is currently happening to Judge Nkonde

  11. The Petition should have been heard,determined and the winner declared by the Court b4 inauguration. Concourt did not do this but there was No comment from LAZ. Lungu blocked the Petition and proceeded to illegally and unconstitutionally inaugurate himself in power but there was silence from Laz. The Petition is being tossed around in the High Court but there is no word from LAZ. ECZ Officials have openly revealed that Elections were rigged in favour of Lungu and LAZ has remained silent.The Chavulas of this World were caught rigging the Elections in the ECZ Server Room but there was silince from LAZ. Lungu refused to resign to allow the Petion to be heard but LAZ said nothing. Laz should not have commented on this issue since they have not said anything about the corrupt Night Judges at…

  12. The solution is to be done with those lingering cases by throwing them out, chaps are abusing the legal system and the Judiciary is allowing this. Why is this still ongoing. Judges please judge like you mean it and rid your courts of these characters.

  13. Why is Kasonde failing to openly mention the names “HH or UPND” in her talk. We know the buack stops at HH and UPND, but Kasonde is failing to be categorical because sh know she i shooting her own foot. It is like she is being forced to make this statement. She still remain a UPND cadre even in this statement by failing to openly condemn HH.
