Zambian Voice happy with discontinuation of DPP’s case

The Zambian Voice has welcomed the decision by the Lusaka Magistrate Court to discontinue the case where a private Lusaka resident Newton Ng’uni drugged the Director of Public Prosecution (DPP) Mutembo Nchito to court on allegations of abuse of public office .

Zambian Voice Executive Director Chilufya Tayali said the law was clear that a sitting Director of Public Prosecution (DPP) cannot be prosecuted according to the constitution.

This is according to the press statement issued by Mr. Tayali to ZANIS in Lusaka today.

Mr. Tayali however observed that the discontinuation of Mr. Nchito’s case does not mean that the DPP’s immunity is not like that of the President which is explicit in the constitution.

He said the matter has remained with President Edgar Lungu to set up a tribunal according to article 58 of the constitution of Zambia to probe the DPP.

Mr. Tayali said the DPP may not function properly because public confidence has been shaken by the allegations.

He said therefore the President has an obligation to protect the DPP’s office.

Mr. Tayali has also commended President Lungu for not interfering with proceedings in court since the case started.

PF challenges Zambia Sugar to employ local people

Some shareholders plucking sugar cane plants during the conducted tour of the Zambia sugar factory in Lusaka yesterday.
The Patriot Front in Mazabuka district has appealed to management at Zambia Sugar to consider employing local people as seasonal workers particularly cane cutters.

PF District Chairperson, Moses Ngosa, said it is high time Zambia Sugar started employing Mazabuka residents as cane cutters as opposed to restricting their employment to people from Western Province.

Mr Ngosa told ZANIS in an interview that he will soon write to the Sugar Company over the need to start employing local people as cane cutters as opposed to the current situation where only those from Western Province are considered.

Mr Ngosa observed that while it is a known traditional fact that Zambia Sugar has over the years employed people from Western Province with the perception that they are strong, the local people have since shown willingness to take up the job of cane cutting.

Mr Ngosa said it is time Zambia Sugar Company considers revising its policy on the employment of cane cutters with the view to allow Mazabuka residents to get jobs as well.

He said it is the view of the PF party in the area that while Zambia Sugar continues to employ colleagues from parts of Western Province, spaces should equally be reserved for the locally based, especially youth, who have no jobs at the moment.

Mr Ngosa explained that it does not make any economic sense to continue employing people from outside the district at the expense of local people who are trying hard to get jobs in order to put food on their tables.

He observed that application letters by the local people to the company for employment opportunities have in the recent past been turned down on assumptions that they are lazy and not capable working as cane cutters.

Mr Ngosa said times have now changed where Mazabuka residents shunned and despised the job of cane cutting, saying adequate employment opportunities have made them realize the need to work hard.
He charged that local people will only appreciate the existence of one of Africa’s largest sugar producers if there is direct economic benefit which could only come through the access to employment opportunities.

Mr Ngosa further challenged the company to create more permanent employment opportunities now that the company has embarked on the expansion of its product alignment and refinery project.

Efforts to get a comment from Zambia Sugar Management proved futile by press time.

Momentum is growing with just two months left before the grand draw in Zambeef’s popular Butchery of the Month competition, as customers flocked to the company’s Garden Compound outlet in Lusaka over the weekend to discover who had won February’s prize draw.

Excitement mounted as Saturday morning shoppers jostled to see the draw in which customers stand a chance of savouring K50,000 in cash in the 50Pin at 50Years Butchery Bonanza– all for the price of spending just K35 or more on any Zambeef products in one of its 92 outlets.

Every month winning customers at each butchery also walk away with a K200 cash voucher to spend in their local Zambeef outlet. The monthly winner at each shop will then be entered into the national raffle draw for the grand prize, which will be drawn in Lusaka on May 6, 2015.

Thousands of customers have already submitted their entry slips in order to take part in the contest.

“Our Garden customers have really entered into the excitement of the draw!” said Zambeef Group Marketing Head Lubinda Chamileke.

“Zambeef butcheries are at the heart of every community we serve, and now anyone has the chance to win K50,000 cash – just for shopping at one of our butcheries. That’s enough money to transform your family’s life.”

To enter, shoppers just need to make a purchase of at least K35 of any Zambeef product, complete the Customer Feedback slip, attach it to their Zambeef receipt slip and post in the entry box at the shop. Each Zambeef receipt is equal to one entry, so customers can enter as many times as they wish.
Zambeef members of staff and their families are not eligible to enter, but the 50Pin at 50Years Butchery Bonanza competition will also identify the best performing outlet to receive the “Butchery of the Month” accolade.

This month’s winning outlets were Zamchick Inn, Southgate, which received K2800; Shoprite Chipata: K4000; Matero Butchery: K3500 and Kapiri Mposhi Butchery: K4000.
The 50Pin at 50Years Butchery Bonzanza was officially launched in November at Zambeef’s butchery in Sunningdale Mall, Alick Nkhata Road, Lusaka, kicked off by renowned ZNBC sports commentator Leonard Chibasa, where he presented soccer boots and balls to local schools.December’s Butchery of the Month was in Mandevu and the January draw was held in Chawama.

Cabinet changes name of revenue appeals tribunal bill

Cabinet has re-named the revenue appeals tribunal bill as tax appeals tribunal bill. This follows a Cabinet meeting held at State House today and chaired by President Edgar Lungu.

Chief Government Spokesperson Chishimba Kambwili told journalists at State House today shortly after the Cabinet meeting that the tax appeals tribunal bill has since been approved.

Mr. Kambwili, who is also Information and Broadcasting Services Minister, said the decision to change the name of the bill was to ensure accurate description of the tribunal and to enhance its operational efficiency. He disclosed that the tax appeals tribunal bill will now be tabled in parliament for enactment.

Meanwhile, Mr. Kambwili further disclosed that cabinet has deferred the approval of new guidelines on the sale of livestock breeding to farmers to allow for extensive consultations with relevant ministries.

[pullquote]

The minister said the new administration of President Lungu will seal off all the leakages which were allegedly rampant during late President Michael Sata’s three-year regime.
[/pullquote]

He said the guidelines would lead to the establishment of a policy designated to improve livestock production in Zambia. He pointed out that Zambia’s livestock potential has remained underdeveloped due to lack of policy despite its huge potential.

Mr. Kambwili also said Cabinet discussed matters on security but he could not divulge the information because such cannot be communicated to neither the media nor the public.

“Cabinet discussed three issues namely the tax appeals tribunal bill, deferred the new guidelines on the sale of livestock breeding and security matters. As you might be aware, security matters can’t be communicated to the public,” he said.

On the Access to Information Bill, Mr. Kambwili, urged members of the general public to stop panicking because the bill in question has now been submitted to the Attorney General for clearance.

Mr. Kambwili said once the bill is enacted by parliament, journalists and the public will be free to access information but not state secrets bordering on insecurity of the nation.

And Mr. Kambwili has taken a swipe at some people leaking government information to opposition UPND leader, Hakainde Hichilema who claimed that he controls the security wings particularly the Zambia Intelligence Services.

He commended President Lungu for directing the Zambia Police Service to get to the bottom of the claim and thoroughly investigate Mr. Hichilema.

“For goodness’ sake, why should people leak information because government is determined to make sure the media operates freely,” he said.

He has warned the Zambia Police Service including civil servants against leaking classified information or documents to the public.

The minister said the new administration of President Lungu will seal off all the leakages which were allegedly rampant during late President Michael Sata’s three-year regime.

And speaking at the same occasion, President Lungu’s Special Assistant for Press and Public Relations Amos Chanda said it was a felony for anyone to issue unauthorized document or statements from State House or any other government ministry.

President Lungu orders police to question HH over his OP remarks

President Edgar Lungu
President Edgar Lungu

President Edgar Lungu has ordered police to immediately question opposition Hakainde Hichilema over his remarks that he controls the Zambian intelligence system.

During a news conference last week, Mr Hichilema claimed that he controls the state intelligence system in the country and has access to intelligence files before President Lungu.

President Lungu said the Police should investigate to ascertain whether Mr. Hichilema’s claims are true or are just aimed at bringing confusion in the country through mere policking.

He has also directed Police to investigate and identify the officers leaking information to the UPND leader.

President Lungu issued the directive this morning at State House when he swore in Justice Ireen Mambilima as Chief Justice.

‘I expect the police to move in and find out from him how he is doing so. Has unsurped the powers of the President. The past five days have worried me a lot and I want you to find out from him whether it is true he runs the OP in this country because as far as I know there is only one President and that President is me and through me we all have to be governed,’ he said.

He said, ‘the police must find out from HH how he is controlling the state intelligence system and if there are people leaking such information to him, we need to fish them out and charge them and if there is a criminal offence occasioned, the Director of Prosecutions will take it up.’

President Lungu also reiterated that he will not interfere in the operations of the Judiciary.

‘As for me, I want to assure you that I will not interference with the judiciary, I will not interfere with the court general and I will not interfere with Parliament,’ he said.

He said with the appointment of a new chief justice, Zambians expect speedy transformation in the delivery of justice to the public.

And Justice Mambilima pledged to expeditiously address the challenges affecting the speedy delivery of justice in country.

Justice Mambilima disclosed that she will be meeting stakeholders to discuss how this can be addressed.

‘We hit the ground running and address the issues affecting the delivery of justice but it needs the input of all stakeholders including the bar, the public, the government and ourselves, we are going to start now and meet all the stakeholders,’ Justice Mambilima said.

The Lusaka Magistrate has sustained the nolle prosequi entered by Director of Public Prosecution Mutembo Nchito on 20th February this year.

When the matter came up before Lusaka Magistrate Lameck Mwale Monday morning, Magistrate Mwale told the court that after considering the matter, he is of the view that the DPP has power to discontinue the case even when he is the accused.

Magistrate Mwale therefore allowed the case to be discontinued as the matter was not an exception due to the powers vested in the DPP by the Constitution.

And in interviews with Journalists outside court, Nchito reluctantly said the law had to be followed. He said there were some people in Zambia that that wanted to bend the law to suit their own interests.

Meanwhile, the complainant in the matter Newton Ng’uni told Journalists that he will apply to the High Court to reopen the matter.

‘Sale ‘ of MMD is a fabricated lie

22
MMD's Dr Nevers Mumba
MMD’s Dr Nevers Mumba

The alleged “sale” of the Movement for Multi-party Democracy (MMD) to the Patriotic Front (PF) by Party president Dr. Nevers Mumba in return for a diplomatic posting to some South American country is total and absolute rubbish and should be dismissed with the utmost contempt it deserves.

On 28th February 2015, The Zambian Watchdog published a story containing these wild unfounded allegations that are clearly authored by known enemies of the MMD who are hell bent on distracting the party leadership from the current good progress we are making in bringing order and sanity to MMD after recent challenges.

President Edgar Lungu and Dr. Mumba have not held any discussion related to any diplomatic appointment and this is a complete fabrication.

The talks on a possible working relationship between the PF and the MMD have not been hidden but the nation has been kept informed on what is going on and both the MMD National Secretary Hon. Mwansa Mbulakulima, the MMD Party Spokesperson Mr. Raphael Nakacinda and the PF Secretary General Mr. Davies Chama have all made reference to these discussions and have clarified that nothing concrete has been agreed so far.

However, the nation needs to be informed that when matters are concluded in whatever fashion, the MMD will give a comprehensive statement. As is the culture in the party, no decision will be made one way or the other without full consultation with all our structures and the grassroots to ensure that we all have a common and agreed position.

Dr Mumba’s main preoccupation right now is the ongoing reorganization of the party. The correct approach for any media house is to verify such stories with us and we are always ready to clear the air.

We urge all Zambians, particularly the MMD structures countrywide, to ignore and dismiss this malicious story because it is a complete fabrication only intended to prolong the destabilization of the party and in no way represents the truth.

What was Hakainde Hichilema’s role in the Grazier Matapa funeral fiasco

68

Outspoken human rights campaigner Laura Miti has questioned UPND leader Hakainde Hichilema’s leadership qualities after the events around the murder and funeral of UPND member Grazier Matapa.

In a statement, Ms Miti said the development confirms that Mr Hichilema urgently needs to rein in his party cadres.

She said the manner in which the UPND cadres conducted themselves on the day of the burial was unacceptable.

“The manner in which they conducted themselves on the day of the burial was way beyond the pale. In this regard, I have a few questions to the UPND leadership and especially the President Hakainde Hichilema.

  1. Was the carrying of the coffin through the streets of Lusaka authorized by the party leadership?
  2. If it was, does the leadership agree that that was a very uncultural and self-serving act whose appalling end was inevitable and therefore could have been predicted by anyone who cared to interrogate that “strategy”?
  3. If the carrying of the coffin was decided on in the lower echelons of the party, by unruly cadres, does the leadership agree that they are losing control of the party?
  4. Does the leadership understand that they need to rein in the very volatile and dangerous sense of being hard done by now pervading the party?
  5. Does the UPND and especially President Hichilema understand that no political unhappiness can ever justify violence or its threat nor will it be countenanced by the wider citizenry? If they do, what are they doing to ensure their cadres understand that cardinal point?

Ms. Miti reminded that no politician or any political interest is worth engaging in violence for.

[pullquote]Simply the point is Zambian politics is shallow and only about the interest of politicians. These guys, all of them, have shown how easily they will jump from one party to another at the offer of a simple DC or ambassadorial job. We as Zambians must be prepared to hold all of them to account for the way they act.[/pullquote]

She added that no political interest is worth sacrificing the peace that has ensured that Zambians are able to survive inept self-serving government after inept self-serving government.

After the events around the murder and funeral of UPND member Grazier Matapa, it is very clear that the UPND President urgently needs to rein in his party cadres.

“I will end by repeating something that I wish Zambians would understand.

No politician, not one, nor any political interest is worth engaging in violence for. No political interest is worth sacrificing the peace that has ensured that citizens are able to survive inept self-serving government after inept self-serving government. Because we have peace, single mothers, unemployed youth, out-of-work adults can wake up in the small of each morning to eke out a living one way or another,” she emphasised.

She added,

“Our peace is therefore not a sentimental attribute. It is vital in a country like this one in which public resources are never directed to improving lives of citizens. In short, government, politicians do nothing for the ordinary woman in the various compounds of this country. She lives without government. Her life is in her own in her hands. For that reason, her ability to survive must not be jeopardised because politicians want to get into or stay in State house.”

Ms. Miti said, “Zambians only need to look at the great lesson former President Rupiah Banda taught us in the last election to understand how dumb the enmity between cadres of different parties in Zambia is.

‘Not 3 years before 20 January MMD and PF cadres were at each other’s throats. They were willing, it seemed, to shed blood and they certainly were destroying each other’s property. Not 3 months before 20 January 2015 cadres hated each other, some for RB and the others for PF. Then an internal battle in MMD later and RB was best friends with PF flying around in the ruling party chopper. He did not consult the cadres that had engaged in battle for him nor could he argue he was doing this for anyone other than himself.”

Ms. Miti further added, “Simply the point is Zambian politics is shallow and only about the interest of politicians. These guys, all of them, have shown how easily they will jump from one party to another at the offer of a simple DC or ambassadorial job. We as Zambians must be prepared to hold all of them to account for the way they act.”

She said, “We need to insist that those in office improve our lives and those in opposition engage with those in power in such a way that ensures they govern in the interest of the nation. The unquestioning support of any politician is what leads to the tragic events saw at the burial of Mr Matapa. Even more worrying is that they have led to stupid conflicts in many countries on this continent and Zambia, believe me, is not immune.”

Zesco United and Power Dynamos now know their first round opponents after both successfully negotiated their way past the preliminary phase of their respective continental club outings.

Zesco advance to the first round when they beat Mbabane Swallows 1-0 to advance 2-1 on aggregate.

They will face AS Kaloum of Guinea who drew 1-1 with 2014 Confederation Cup runners-up Sewe Sport of Cote d’Ivoire on Sunday in Mali to advance 3-2 on aggregate.

Zesco will host AS Kaloum on March 14 at Levy Mwanawasa Stadium in Ndola.

In the Confederation Cup, Power overturned a 1-0 away loss to Al Khartoum to win 2-0 at home on Sunday at Arthur Davies Stadium in Kitwe and subsequently advance 2-1 on aggregate.

Power will travel to Libreville to play CF Mounana in a fortnights time.

Mounana advanced to the first round after they picked up emphatic back-to-back wins in their preliminary round tie over Polisi of Zanzibar.

The Gabonese beat Polisi 3-1 away in Zanzibar on Sunday to book their first round date with Power 8-1 on aggregate.

Power will face Mounana on the road on Match 15.

Lwandamina okays Zesco Utd’s mediocre display

Coach George Lwandamina is content with Zesco United’s narrow 1-0 win over Mbabane Swallows of Swaziland in Saturday’s return leg of the 2015 CAF Champions League that saw his team advance to the first round 2-1 on aggregate.

Lwandamina’s team wasted several clear cut chances and must thank midfielder Justin Zuku for scoring the solitary goal at Levy Mwanawasa that separated Zesco and Swallows at Levy Mwanawasa Stadium in Ndola.

The controversial trainer claimed he was not bothered by his team’s failure to convert uncountable opportunities.

“I don’t know how content you want us to be? What is important is to excel or to move to another stage,” Lwandamina told reporters during a post-match media briefing.

“I am not frustrated, football is a game where you expect chances to be created and you can’t put away everything,” he said.

But Swallows coach Siyabonga Bhembe said Zesco were luck to beat his side and warned them to improve ahead of their first round outing in the Champions League.

“We were unluck to concede a soft goal. They (Zesco) are a ordinary team, it is just that they scored a luck goal but they are not good,” Bhembe said.

The two teams drew 1-1 in the first leg match played in Manzini a fortnight ago.

And President Lungu has appealed to Paramount Chief Gawa Undi of the Chewa people and Paramount Chief Mpezeni of the Ngoni to share one platform to promote unity in the two chiefdoms.

Mr Lungu said Chipata will soon be a city once the Chipata General Hospital is upgraded and modern infrastructure put in place.

He said this during a special interview with journalists at Luangwa House before he graced the Nc’wala ceremony on the western outskirts of Chipata on Saturday.

“As a freeman of Chipata, I would love that the Chipata Municipal Council attains the city status before I leave office. I will also go to Kasama, Mongu, and Solwezi and consult the respective councils,” he said.

President Lungu also said Government will promote tourism through cultural activities like the Nc’wala ceremony, which attracts foreign and local tourists.
He said Zambia has many tourist attractions in Eastern Province and other parts of the country.

I can easily scoop seat on PF ticket – Simbao

Chairperson of the Parliamentary Committee on Communication, Transport, Works and Supply Kapembwa Simbao

FORMER member of Parliament for Senga Hills Kapembwa Simbao says he will easily win the seat if adopted by the Patriotic Front (PF).

Mr Simbao, who was MMD MP until last week when the Supreme Court nullified his election, has applied to contest the seat on the PF ticket.

“The people that campaigned for me have asked me to stand on the PF ticket. I have personal strength and I will certainly win if adopted,” he said in an interview yesterday.

Mr Simbao expressed hope that the ruling party will adopt him.

“I will deliver this seat on behalf of the PF if they adopt me.

I am strong on the ground and I have a huge following,” he said.

The Supreme Court overturned the High Court decision that Mr Simbao was duly-elected after finding that his election was marred with election malpractices.

PF losing candidate Giles Yambayamba appealed to the Supreme Court after the High Court found that Mr Simbao was duly-elected as MP for Senga Hills.

In his petition, Mr Yambayamba contended that Mr Simbao’s election was characterised by widespread undue influence, bribery, intimidation, voter treating and electoral malpractices contrary to the law.

Mr Yambayamba further alleged that Mr Simbao made false statements and displayed an awful picture depicting the late PF President Sata as a person unworthy to rule Zambia and that the PF and its candidates were satanists.

He also alleged that Mr Simbao accused Mr Sata and PF male candidates of being pro-homosexuality and further false statements were made that the PF government would do away with fertiliser subsidies.
